PURPOSE: To authorize publication of a Notice of Intent to Request
Release of Funds and execution of the Request for Release of Funds.
BACKGROUND: The Orange County HOME Consortium recently received an
award of $803,600 in HOME Investment Partnership Program funds to be used
for acquisition, housing rehabilitation and new construction activities in
Orange County. Of this amount, $453,600 is available for housing
rehabilitation activities. It is estimated that a total of 30 housing
units in the County, including the towns, can be rehabilitated under this
program.
The N.C. Housing Finance Agency (NCHFA) requires that an environmental
assessment be conducted prior to the expenditure of funds. County staff
has reviewed the regulations and determined that the proposed activities
are exempt from the environmental review process. Therefore, the County
can request the release of funds for this activity utilizing the attached
Request for Release of Funds form. The County is also required to publish
a Notice of Intent to Request a Release of Funds in a newspaper of general
circulation. The notice attached, in a format prescribed by NCHFA will
accomplish this task. Upon approval, this notice will be published on or
about August 4, 1993 in the Durham Morning Herald. The public will have a
seven (7 ) day comment period.
RECOMMENDATION(S) :
The Manager recommends authorizing the publication of a Notice of Intent
to Request a Release of Funds in the Durham Morning Herald on or about
August 4, 1993 and authorize the Chair to sign the Request for Release of
Funds on behalf of the Board.

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about August 12, 1993, Orange County on behalf of the State of North Carolina will
request the North Carolina Housing Finance Agency to release Federal funds under Title
II of the HOME Investments Partnership Act (PL 101-625) for the following project:
PROJECT TITLE
Orange County Housing Rehabilitation Program
PURPOSE/NATURE OF PROJECT
Housing Rehabilitation of thirty (30) substandard houses in Orange County
occupied and/or owned by persons at or below 60% of median income.
Total Project Cost = $453,600; Total HOME Cost = $453,600 HOME/Total Cost%=100%
LOCATION OF THE PROJECT
Orange County, North Carolina

An Environmental Review Record respecting the within project has been made by Orange
County which documents the environmental review of the project This Environmental
Review Record is on file at the above address and is available for public examination and
copying upon request.
Orange County will undertake the project described above with HOME funds from the
North Carolina Housing Finance Agency under Title II of the HOME Investment
Partnership Act. Orange County is certifying to NCHFA that Moses Carey, Jr., in his

official capacity as Chair of the Orange County Board of Commissioners consent to
accept the jurisdiction of the Federal courts if an action is brought to enforce
responsibilities in relation to environmental reviews, decision-making and action; and that
these responsibilities have been satisfied. The legal effect of the certification is that upon
its approval Orange County may use the HOME funds and NCHFA will have satisfied its
responsibilities under the National Environmental Policy Act of 1969.
NCHFA will accept an objection to its approval only if it is on one of the following bases:
(a) that the certification was not in fact executed by the certifying official or other officer
of applicant approved by NCHFA; or (b) that applicant's environmental review record for
the project indicates omission of a required decision, finding or step applicable to the
project in the environmental review process. Objections must be prepared and submitted
in accordance with the required procedure (24 CFR Part 58) and may be addressed to
NCHFA at 3300 Drake Circle, Suite 200; P.O. Box 28066, Raleigh, North Carolina 27607-
3300.
Objections to the release of funds on bases other than those stated above will not be
considered by DCA. No objection received after August 30,1993 will be considered by
NCHFA. Comments must specify whether they concern the finding of no significant
impact or the intent to request release of funds.
