BACKGROUND: In accordance with 153a-42 of the General Statutes, the
governing Board has the legal duty to approve all minutes that are entered
into the official journal of the Board's proceedings.

II. ITEM FOR DECISION - Property Transfer to Pines Community Center, Inc.
Purpose: To adopt a resolution authorizing the donation transfer of property by
the Orange County Housing Authority to the Pines Community Center, Inc. for the
purpose of developing affordable homeownership opportunities and authorize the Chair
Housing Authority to enter into a Performance Agreement with this entity
for this purpose and authorize the Chair to execute the Agreement on behalf of the
Housing Authority.
Background: On May 4, 1992, the Orange County Housing Authority Board
accepted the property transfer of three lots from the Orange County Board of
Commissioners. These lots are identified by Tax Map Reference 7.100.C.10, 7.100.C.1 OA
and 7.91.H.7 and are located on Wentworth Street and Edwards Street in the Pine Knolls
neighborhood of the Town of Chapel Hill. The Housing Authority agreed that these lots
would be conveyed to Habitat for Humanity of Orange County (HHOC) for the
development of affordable housing in collaboration with the Knolls Neighborhood
Development Association (KNDA). Since that time, KNDA on behalf of the Pines
Community Center, Inc. has requested that the Housing Authority convey these
properties directly to the Pines Community Center, Inc. (this is the incorporated
representative of KNDA) instead of HHOC. KNDA and Pines Community Center now
wishes to develop and sell the proposed homes without collaborating with HHOC as
originally proposed.
KNDA and Pines Community Center proposes the creation of twenty (20)
affordable homeownership opportunities in the Pine Knolls Community targeted for
families at or below 60% of median income. The proposed plan includes a combination
of techniques to achieve this goal. They include: moving houses onto vacant lots in the
neighborhood, rehabilitating existing houses in the neighborhood, and constructing new
dwellings (possibly using modular technologies). The proposed houses would be
scattered throughout the Knolls neighborhood in an effort to revitalize the community and
preserve the neighborhood's character.
The Association has recently received a revolving loan from the Town of Chapel
Hill in the amount of$90,000 to finance their first two housing ventures. (The houses have
been moved to an area off Merritt Mill Road and rehabilitation is in process utilizing a
creative sweat equity method.) These funds will be used to move and rehabilitate two
houses. Upon completion, the houses will be sold to a low-income homebuyer and the
$90,000 would be available to use again for two additional houses. This process will be
repeated until the twenty (20) units are completed.
The donation transfer of these three lots would provide KNDA and the Pines

Community Center, Inc. the land needed for the next phase of house
construction/rehabilitation. Please note that two of the three lots will may need to be
combined to meet the zoning requirements of the Town of Chapel Hill. Thus, these three
lots will provide land for the construction of two houses.
RECOMMENDATION:
Adopt a resolution authorizing the donation transfer of property by the Orange
County Housing Authority to the Pines Community Center, Inc. for the purpose of
developing affordable homeownership opportunities and authorize the
Housing Authority to enter into a Performance Agreement with this entity for this purpose
and authorize the Chair to execute the Agreement on behalf of the Housing
Authority.
The resolution stipulates the following conditions which must be completed prior
to actual deed transfer.
1. The Orange County Housing Authority will consult with the Chapel Hill
Planning Department to ensure that these lots are buildable under present
land use requirements.

Center, Inc. must provide a detailed outline of development plans
including timetable and financing methods for the County
Manager's review and approval.

County Attorney.

RESOLUTION
OF THE
ORANGE COUNTY HOUSING AUTHORITY
WHEREAS, on the day of , 1992, the Orange County
Housing Authority accepted non-warranty deeds from the Orange County Board of
Commissioners for the following parcels of property (hereinafter referred to as the
parcels of property"):
Parcel I: Tax Parcel 7.100.C.10
Parcel I I: Tax Parcel 7.100.C.10A
Parcel III: Tax Parcel 7.91.H.7 _
WHEREAS, the Orange County Housing Authority has determined that the parcels
of property should be developed to provide dwelling accommodations for persons of low
income;
WHEREAS, the Pines Community Center, Inc., a non-profit entity, has expressed
an interest in developing these properties;
NOW,THEREFORE, BE IT RESOLVED, pursuant to North Carolina General Statues
157-1 et seq., the Orange County Housing Authority authorizes conveyance of the
aforementioned Parcels I, II, and III by non-warranty deeds subject to satisfaction of the
following conditions.
1. The Orange County Housing Authority will consult with the Chapel Hill
Planning Department to ensure that these lots are buildable under present
land use requirements.
2. The Pines Community Center, Inc. will present to the Orange County
Housing Authority a development plan for these parcels of property which
will include a development timetable and financing mechanisms for providing
dwelling accommodations for persons of low income for the County

Manager's review and approval; and
3. The Pines Community Center, Inc. and the Orange County Housing
Authority will enter into a Performance Agreement which will provide for the
development and construction of housing for persons of low income (60%
and below median) to be located on the parcels of property. This document
must be approved by the County Attorney prior to execution.
