Petition & SR Addition Investigation Reports for Edburton Court and Berwick Place INFORMATION CONTACT: Karen Lincoln; 245-2594 PURPOSE: To consider a recommendation regarding a request for addition to the State Maintained Secondary Road System for Edburton Court and Berwick Place. BACKGROUND: The property owners on Edburton Court (14 homes) have petitioned the North Carolina Department of Transportation (NCDOT) to accept maintenance responsibilities for Edburton Court and a 0.05-mile portion of Berwick Place. Edburton Court and the 0.05-mile section of Berwick Place are located in Hardscrabble Phase III Section I in Eno Township. Berwick Place crosses the Orange/Durham County line, extending from Hardscrabble Drive in Durham County to provide access to Edburton Court. Hardscrabble Phases I and II are located in Durham County off the north side of St. Mary's Road (SR 1002). The Board of County Commissioners,approved the preliminary plat for Hardscrabble Phase III Section I in November 1994 directing that "Berwick Place and Edburton Court shall be irrevocably dedicated to the general public and be constructed to the standards of the North Carolina Department of Transportation." The approved resolution directed the County Manager to accept "for Orange County and on behalf of the public generally" Berwick Place and Edburton Court without maintenance responsibility, and specified that the "roads shall be maintained by the owner/applicant until such time as they are accepted for maintenance by the NCDOT or some other governmental body." NCDOT has investigated these requests (please refer to attached Secondary Road Addition Reports), and has submitted the petitions to the Board of Commissioners for its review and recommendation. In accordance with North Carolina General Statute §136-62~ the Board must take an administrative action to make a recommendation regarding the petitions to the North Carolina Board of Transportation before the NC Board of Transportation (NCBOT) can consider the petitions.. FINANCIAL IMPACT: There is no direct financial impact associated with this item. RECOMMENDATION(S): The Manager recommends that the Board recommend to NCDOT that it accept the request to add Edburton Court (0.21 mile segment) and Berwick Place (0.05 mile segment) to the State Maintained System. ~ North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present petitions to the board of county commissioners, and through the board to the Department of Transportation, concerning additions to the system and improvement of roads.
