PURPOSE: To consider a request from the Town of Hillsborough for the
County to perform State-mandated fire inspections within the Town' s
jurisdiction.
BACKGROUND: The Hillsborough Board of Commissioners has adopted a
resolution requesting that County staff perform the periodic fire
inspections required within the Town' s corporate limits and
extraterritorial jurisdiction. These inspections are required of local
governments under Section 107 of the North Carolina State Fire
Prevention Code.
During a recent meeting between Chairman Carey, Mayor Johnson, and the
County and Town Managers, the town officials indicated their
willingness to enter into a contract that would fully reimburse the
County for costs incurred in undertaking fire safety inspections within
Hillsborough' s jurisdiction. The County would not be involved in
establishing or collecting fees for Hillsborough inspections. Should
the Board of Commissioners agree to have County staff perform fire
inspections for the Town of Hillsborough, the next step would be for
County and Town staff and attorneys to draw up a contract that would
be brought back to both elected boards for approval. The contract can
be designed to be reviewed on a year-to-year basis.
RECOMMENDATION: The Manager recommends that the Board approve the
request from the Town of Hillsborough, with the details to be resolved
in a contract to be considered by the Board at a future meeting.

A RESOLUTION REQUESTING THE ORANGE COUNTY BOARD OF COMMISSIONERS
TO DIRECT THAT THE PERIODIC INSPECTIONS REQUIRED BY SECTION 107
OF THE NORTH CAROLINA STATE FIRE PREVENTION CODE BE
PERFORMED WITHIN THE TOWN OF HILLSBOROUGH BY COUNTY EMPLOYEES
WHEREAS, Section 107 of the North Carolina State Fire Prevention
Code (Volume V of the State Building Code) requires that periodic
inspections be made of various buildings within each political
subdivision of the state according to a minimum schedule set forth
in that section; and
WHEREAS, Orange County is authorized under N.C.G.S . § 160A-411 and
160A-413 , pursuant to a request of the Hillsborough Board of
Commissioners , to exercise enforcement authority under the North
Carolina State Building Code, including Volume V, within the Town
of Hillsborough; and
WHEREAS, Orange County presently enforces within the Town of
Hillsborough other provisions of the North Carolina State Building
Code;
NOW THEREFORE, the Board of Commissioners of the Town of
Hillsborough resolves :
Section 1 . The Board hereby requests the Orange County Board of
Commissioners to direct that county employees conduct within the
Town of Hillsborough the inspections required under Section 107 of
the North Carolina State Fire Prevention Code, and that such
inspections be conducted under the same circumstances and subject
to the same requirements as are generally applicable throughout
Orange County.
Section 2 . This resolution shall become effective upon adoption.

above resolution was adopted by the Hillsborough To Board in official
session on Monday, December 14, 1992, and is a part of the minutes of that
meeting recorded in Docket Minute Book three.
