PURPOSE: Consideration of the Preliminary Plat for Oak Pointe. BACKGROUND: The property is located in the extreme northwestern corner of Bingham Township on the south side of Yarborough Road (SR 1138 ) between Mebane-Oaks and Buckhorn Roads. The size of the tract is 12 .72 acres, and the average lot size is 45,236 square feet. The property is zoned AR Agricultural Residential. The County Land Use Plan designation is Agricultural Residential. No watershed designation has been assigned to the general area. The property is wooded. Land uses generally to the east and west are residential and wooded. The north side of the tract is bounded by Yarborough Road, and the south side runs along a "Low Swamp Area" paralleling a creek. The swampy area is primarily on the neighboring Larry Little property. A 600-foot contour line running through the southern portions of lots 4, 5, 6, and 7, however, indicates that there is a possibility of low lying wet area intrusion into the proposed subdivision. This could require the inclusion of a drainage easement and related buffers on the plat. Erosion Control Staff inspection prior to submission of the Final Plat will assist in determining this. 2 There are 9 lots of 40,000 square feet and one lot of 87 , 120 square feet (two acres) proposed, with 915 lineal feet of roads. To accommodate septic system and repair needs, the number of lots was reduced from 11 in the Concept Plan to 10 for the Preliminary Plat. All streets are proposed to be public and constructed to NCDOT standards. At all street rights-of-way intersections, 5 ' X 100 ' taper-triangles and 10 ' X 70 ' sight-distance-triangles shall be indicated in accordance with NCDOT design standards. The Planning Board reviewed the Concept Plan at its meeting of January 25, 1993 . The plan was approved at that time with the following conditions: 1. That access to all lots be limited to interior residential streets; 2 . That appropriate drainage easements and buffer be provided for the "Low Swamp Area" on the tract as determined by staff; and 3. That payment in lieu of donating land for park and recreation purposes be made by the developer. At its regular meeting of May 17, 1993, the Planning Board considered the Preliminary Plat and recommended approval subject to the conditions contained in the Resolution of Approval. All roads shall be irrevocably dedicated to the general public and constructed to standards of the North Carolina Department of Transportation (NCDOT) . The approval of this resolution authorizes and directs the County Manager to accept for Orange County, and on behalf of the public generally, the offer of dedication to the general public of the streets to be named Oak Pointe Lane and Oak Pointe Court. This acceptance of the dedication shall be without maintenance responsibility. These streets shall be maintained by the owner/applicant until such time as they are accepted for maintenance by NCDOT or another governmental body. Before the Final Major Subdivision Plat of Oak Pointe may be recorded with the Orange County Register of Deeds, the following requirements must be completed: A. Sewage Disposal 1. Each lot shall contain adequate areas for septic disposal and repair approved by the Orange County Division of Environmental Health. 2 . Disclosure that the septic system location may restrict the size and location of improvements shall be included in the Development Restrictions and Requirements Document to be recorded with the Register of Deeds concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Division of Environmental Health. B. Roads and Access 1 . Oak Pointe Lane and Oak Pointe Court shall be: a. Constructed to standards of the North Carolina Department of Transportation, within a 50-foot 6 right-of-way, and construction shall be inspected and approved by NCDOT; or b. Guaranteed financially through a letter of credit, escrow agreement, or bond submitted to secure construction to the standards of NCDOT. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The guarantee must reflect 110 percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The Development Restrictions and Requirements Document to be recorded with the Final Plat shall state that the financial guarantee will not be released until road construction has been approved by NCDOT. 2 . An erosion control plan for construction of the streets must be submitted. 3. All lots shall have access to interior streets, namely: Oak Pointe Lane or Oak Pointe Court. No lots shall have frontage on Yarborough Road (SR 1138 ) . This restriction shall be stated on the Final Plat and in the Development Restrictions and Requirements Document. 4 . At street rights-of-way intersections, 5 ' X 100 ' taper- triangles and 10 ' X 70" sight-triangles shall be indicated in accordance with NCDOT design standards. 5 . Approved street name signs shall be erected at intersections as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that signs are in place or a copy of the receipt for purchase of the signs shall be submitted to the Planning Department. C. Land Use Buffers and Landscaping 1. Landscaping in Oak Pointe Subdivision shall be: a. Installed or preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department; or b. Guaranteed financially through a letter of credit, escrow agreement, or bond submitted to secure required landscape installation and preservation. An estimate of the cost for required preservation, plantings and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. 7 2 . Provisions for protection of existing trees as shown on the approved landscape plan shall be included in the Development Restrictions and Requirements Document to be recorded with the Final Plat. D. Drainage 1 . Any stormwater detention/retention sites/undisturbed areas for infiltration shown on the approved Erosion Control Plan shall be labeled on the Final Plat. Use restrictions or other conditions shall be specified in the Development Restrictions and Requirements Document. 2 . The existing cross drain located along Yarborough Road (SR 1138 ) must be shown. When the final construction plans are submitted for review, they should show the cross line and address any drainage problems associated with the new development. E. Parkland 1. Cash in the amount of $899.00 ($3, 148. 17/acre x 10 lots/35 ) shall be remitted to Orange County as payment in lieu of parkland dedication. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Subdivision Regulations. 2 . The following natural and man-made site feature shall be shown on the plat: the low swamp area on the south side of the tract. 3. Front setbacks of 40 feet shall be maintained as measured from the edge of rights-of-way of Oak Pointe Lane and Oak Pointe Court. Side yards shall be a minimum of 20 feet, and rear yards a minimum of 20 feet. These setback requirements shall be stated on the plat, and in the Development Restrictions and Requirements Document to be recorded with the Final Plat. G. Certifications 1 . A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2 . A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Subdivision Regulations signed by the landowner and developer shall be on the face, of the plat and included in the Development Restrictions and Requirements Document. 3 . The Division of Environmental Health shall certify that each lot contains a suitable area for septic disposal. 8 5 . NCDOT shall certify that the streets have been constructed to State standards or that construction plans have been approved. 6 . A Certificate of Approval shall be signed by the Orange County Planning and Inspections Department. A stub-out shall be provided either between lots 5 and 6 or between lots 6 and 7 depending on topography. Burklin asked how Staff decided on a good location for the stubout. Kirk responded that the adjacent property has a lot of road frontage to the north and the property to the west is a 27-acre tract and is near a road in Alamance County. Lot lA is a long distance from a road and has no other access. Access may have to be obtained through Lot 14A; it appears on the plat that there is no access for this subdivision. Kirk continued that the amount of access must be clearly shown on the preliminary plat. Waddell asked why the choice was between lots 5 & 6 or lots 6 & 7 . Kirk responded that would be approximately the half-way point of the cul-de- sac and Staff was attempting to address concerns expressed by Mr. Tapp regarding provision of emergency services. Waddell continued asking about a stubout between lots 1 & 2. The engineer, Mr. Dan Paxton responded that there are some curves in the road in the area of lots 1 & 2 so it would be better to have the turn away from the curve. Cantrell asked if the adjoining property was in the same ownership. Mr. Paxton, engineer for the project, responded that property was an estated divided into four twenty-seven acre tracts. Jobsis asked if the stubout was to assure that the adjoining tract was not landlocked. Kirk responded yes. MOTION: Waddell moved approval as recommended by the Planning Staff. Seconded by Scott. Roads are proposed to be public. The Planning Board reviewed the Concept Plan at its meeting January 25, 1993. The plan was approved with three conditions: 1. That access to all lots be limited to interior residential streets; 2. That appropriate drainage easements and buffer be provided for the "Low Swamp Area" on the tract as determined by staff; and 3. That payment-in-lieu of donating land for park and recreation purposes be made by the developer. Agency comments have been received from SCS, NCDOT, Erosion Control and Fire Marshall. Applicable comments have been incorporated into the Resolution of Approval. The Planning Staff recommends approval of the Preliminary plan for Oak Point subject to the conditions contained in the Resolution of Approval (a copy an attachment to these minutes on pages ) . Reid asked if the low lying area is in a 100-year floodplain. Hinkley responded that it was not according to the floodplain maps provided by the 12 Federal Emergency Management Association (FEMA) . Also, it is not in a watershed . MOTION: Reid moved approval as recommended by the Planning Staff. Seconded by Jobsis. VOTE: Unanimous . (2 ) White Cross - Revision (Bingham Township) Presentation by Mary Willis. The property is located in Bingham Township on the north side of NC 54, across from the intersection of White Cross Road (SR 1952) . The total acreage of the tract is 8.44 acres. On September 8, 1992, a Preliminary Plan was approved by the Board of Commissioners. The subdivision contained five lots. Seven residences currently exist on the property. The purpose of the subdivision was to create individual lots for four of the residences so that they could be sold. No additional residences can be built on the property. Access is provided by an existing gravel road (Everett Lane) which currently approximates Class B standards. Due to the location, lot sizes, and other characteristics of the subdivision, Everett Lane was required to be upgraded to public road standards. Maintaining Everett Lane as a private road was not approved because it did not comply with the private road justification criteria in effect at the time of the Preliminary Plat approval. On May 3, 1993, the Board of Commissioners approved an amendment to the Subdivision Regulations which expanded the private road justification criteria. A criterion was added which allows approval of a private road in cases where the property being subdivided is already built out to 100% of its capacity. The White Cross subdivision satisfies this requirement because all of the lots being created already • contain at least one residence. The applicant has requested that the subdivision be amended to allow Everett Drive to remain a private road. There are no other changes proposed to the approved preliminary plan. When the final construction plans are submitted for review, they should show the cross line .,and address any drainage problems associated with the new development. E. Parkland 1. Cash in the amount of $899.00 ($3,148 . 17/acre x 10 lots/35) shall be remitted to Orange County as payment in lieu of parkland dedication. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Subdivision Regulations. 2. The following natural and man-made site feature shall be shown on the plat: the low swamp area on the south side of the tract. 3. Front setbacks of 40 feet shall be maintained as measured from the edge of rights-of-way of Oak Pointe Lane and Oak Pointe Court. Side yards shall be a minimum of 20 feet, and rear yards a minimum of 20 feet. These setback requirements shall be stated on the plat, and in the Development Restrictions and Requirements Document to be recorded with the Final Plat. G. Certifications 1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in the Development Restrictions and Requirements Document. 3. The Division of Environmental Health shall certify that each lot contains a suitable area for septic disposal. 5 . NCDOT shall certify that the streets have been constructed to State standards or that construction plans have been approved. 6.
