Fikes Environmental Review Record Request for Release of Funds Combined Notice TELEPHONE NUMBER- Hillsborough - 732-8181 Chapel Hill - 968-4501 Mebane - 227-2031 Durham - 688-7331 PURPOSE: To authorize execution of the Environmental Review Record for the Abbotts Colony HOME Project and the Request for Release of Funds form and authorize the publication of a Combined Notice to the Public of No Significant Impact on the Environment and Request for Release of Funds. BACKGROUND: The Orange County HOME Consortium recently received an award of $803,600 in HOME Investment Partnerships Program funds to be used for acquisition, housing rehabilitation and new construction activities in Orange County. Of this amount, $50,000 is available for acquisition activities. This funding will assist in the development of four lots in the Abbotts Colony subdivision off Legion Road in Chapel Hill. These vacant lots in an existing housing subdivision will be developed by the Orange Community Housing Corporation. The N.C. Department of Commerce requires that an environmental review be conducted for each HOME activity prior to the expenditure of funds. This review is done to determine whether proposed activities will have a significant adverse impact on the community. County staff has conducted this assessment and determined that the proposed acquisition would have no significant environmental impact on the community. The findings of this assessment is recorded in the attached Environmental Review Record (ERR) . This document must be approved by the Board and executed by the Chief Elected Official before submission to the State. Additionally, the County is required to advertise at least once in a newspaper of general circulation a Notice to the Public of No Significant Impact on the Environment and Request for Release of Funds. The notice attached, in a format prescribed by Commerce will accomplish this task. Upon approval, this notice will be published on or about May 7, 1993 in the Durham Morning Herald. The public will have a 15 day comment period to review the ERR. RECOMMENDATION(S) : The Manager recommends: 1. Approve the ERR and the Request for Release of Funds and authorize the Chair to sign the document on behalf of the Board. 2. FINDING OF NO SIGNIFICANT IMPACT It has been determined that such request for release of funds will not constitute an action significantly affecting the quality of the human environment and accordingly Orange County has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190). The reasons for such decision not to prepare such Statements are as follows: 1. The findings of the Environmental Review indicate that the adverse impacts to human and natural environment are not significant and can be minimized by appropriate safeguards. 2. The proposed HOME project will improve the community conditions and provide much needed additional homeownership opportunities. 3. No negative comments were received from the statutory and related agencies. An Environmental Review Record respecting the within project has been made by Orange County which documents the environmental review of the project and more fully sets forth the reasons why such Statement is not required. This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at Room A-25 between the hours of 8:00 am and 5:00 pm. No further environmental review of such project is proposed to be conducted prior to the request for release of Federal funds. PUBLIC COMMENTS ON FINDINGS All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by Orange County to the Orange County Housing and Community Development Department, 300 West Tryon Street, P.O. Box 8181, Hillsborough, NC 27278. Such written comments should be received at the address specified on or before May 24, 1993. All such comments so received will be considered and Orange County will not request the release of Federal funds or take any administrative action on the within project prior to the date specified-in the preceding sentence. RELEASE OF FUNDS Orange County will undertake the project described above with HOME funds from the North Carolina Division of Community Assistance under Title II of the HOME Investment Partnership Act. Orange County is certifying to DCA that Moses Carey, Jr., in his official capacity as Chair of the Orange County Board of Commissioners consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in 35 relation to environmental reviews, decision-making and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval Orange County may use the HOME fu'nds and DCA will have satisfied its responsibilities under the National Environmental Policy Act of 1969. OBJECTIONS TO STATE RELEASE OF FUNDS DCA will accept an objection to its approval only if it is on one of the following bases: (a) that the certification was not in fact executed by the certifying official or other officer of applicant approved by DCA; or (b) that applicant's environmental review record for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to DCA at Suite 250, 1307 Glenwood Avenue, Raleigh, North Carolina 27605. Objections to the release of funds on bases other than those stated above will not be considered by DCA. No objection received after June 8, 1993 will be considered by DCA.
