BACKGROUND: On March 23 , 1993 , the Orange County Board of Commissioners approved the Notice of Public Hearing for the Joint Planning Area public hearing to be held on April 15. The only item proposed at that time was the Lake Hogan Farm rezoning. 1 Also on March 23 , the Carrboro Board of Aldermen received a request to add a second rezoning to the agenda for April 15 rather than wait until the October hearing. The request involved the Pollitzer property, consisting of two tracts totalling sixteen acres, located on the south side of Homestead Road. The Notice of Public Hearing was amended by the Planning Staff to include the Pollitzer property. The notice was mailed to adjacent property owners and sent to local newspapers on March 26, as required by State Statute. It has been the policy of Orange County that the Board of Commissioners approve Notices of Public Hearing prior to their distribution. In this case, the change was proposed after the Board action on the notice, but prior its publication. In keeping with current policy, the revision to the notice should be 2 ratified by the Board of Commissioners if the Board wishes for the item to be included on the hearing agenda. If the Board chooses not to ratify the change, then the public hearing will not occur on April 15 and all interested parties known to the Planning Department will be notified of this fact by mail. RECOMMENDATION: The Administration recommends that the changes to the Notice of Public Hearing approved on March 23, 1993 be ratified. The only item proposed at that time was the Lake Hogan Farm rezoning. Also on March 23, the Carrboro Board of AldeLmen received a request to add a second rezoning (Pollitzer property) to the agenda for April 15 . The Planning staff received notice of this request via the March 24, 1993 Robert Morgan Board of Aldermen "implementation" memorandum. The Pollitzer property is located on the south side of Homestead Road and is not part of Lake Hogan Farm. Sixteen acres are proposed for rezoning. Project review and preparation of agenda materials can be accomplished by the Planning staffs of Orange County and Carrboro , for both rezonings . However, legal notice must be sent to the newspapers and mailed to neighboring property owners today, March 26, 1993 . The advertisement approved by you on March 23 must be revised if the Pollitzer rezoning is to be considered at the April 15, 1993 public hearing. Since the advertisement must be published before you meet again, the following plan was devised by Planning, John Link and I . The Planning staff will have published the Notice of Public Hearing which is enclosed. The Notice will also be mailed to neighboring property owners . If you approve of the addition of the , [ Pollitzer property zoning change to the April 15, 1993 public hearing, you should vote in favor of ratifying the public hearing , 1 d Board of Commissioners Page 2 March 26 , 1993 notice. If you do not approve of the addition, you should vote against ratifying the public hearing notice. If those opposed to ratification prevail, the public hearing on this zoning change request will not occur and all interested parties known to Planning, including neighboring property owners, will be notified of this fact by mail. The proposal would rezone all or part of 10 parcels located in the Carrboro Joint Development Area as identified on the Orange County-Chapel Hill-Carrboro Joint Planning Land Use Plan. The specific parcels to be rezoned are identified as: all of lots 1, 2 , 3 , 24 , and the portion of lot 4 west of Lake Hogan Road and south of the Buckhorn Branch of Bolin Creek, of Tax Map 109 in Chapel Hill Township; and the portion of lots 31 and 31F south of the Buckhorn Branch of Bolin Creek, of Tax Map 23 in Chapel Hill Township. The total area is approximately 282 acres in size and is located on the east side of Old Chapel Hill- Hillsborough Highway north of Homestead Road. The property is currently zoned R-R Rural Residential by Carrboro, which allows a maximum density of 1 dwelling unit per acre. The proposed zoning is R-20 which allows a maximum density of 2 . 1 dwelling units per acre. ] Z-3-93 VIRGINIA POLLITZER An amendment to the Orange County Zoning Atlas is requested that would incorporate a proposed change to the Town of Carrboro Zoning Map. The proposal would rezone two parcels located in the f Carrboro Joint Development Area as identified on the Orange County-Chapel Hill-Carrboro Joint Planning Land Use Plan. 6 The specific parcels to be rezoned are identified as: all of lots 7a and 7b of Tax Map 108 in Chapel Hill Township. The total area is approximately 16 acres in size and is located about 1600 feet south of Homestead Road and about 1/2 mile east of Old Chapel Hill-Hillsborough Highway. The property is currently zoned R-20 by Carrboro, which allows a maximum density of 2 . 1 dwelling units per acre. The proposed zoning is R-15 which allows a maximum density of 2 . 9 dwelling units per acre. All interested citizens are invited to attend this hearing and be heard. Public comment will be received during the public hearing. Following the close of the public hearing, evidence and comments presented will be examined by the Orange County and Carrboro Planning Boards for recommendation, and Orange County Board of Commissioners and Carrboro Board of Aldermen for decision. Changes may be made in the advertised proposals which reflect debate, objections and discussion at the hearing.
