PURPOSE: To authorize execution of the Environmental Review Record
Cover Page and the Finding of Exemption for the HOME
Housing Rehabilitation Program.
BACKGROUND: The Orange County HOME Consortium recently received an
award of $803,600 in HOME Investment Partnerships Program
funds to be used for acquisition, housing rehabilitation
and new construction activities in Orange County. Of this
amount, $453,600 is available for housing rehabilitation
activities. It is estimated that a total of 30 housing
units in the County, including the towns, can be
rehabilitated under this program.
The N.C. Department of Commerce (formerly, the Department
Economic and Community Development requires that an
environmental assessment be conducted for each HOME
activity prior to the expenditure of funds. This assessment
is done to determine whether proposed activities will have
a significant adverse impact on the community.
County staff has reviewed the regulations regarding the
environmental review requirements for housing
rehabilitation activities and have found that the proposed
activities are exempt from the environmental review
process. Based on this determination, the County is
required to submit a Finding of Exemption form along with
the Environmental Review Record Cover Page to the N.C.
Department of Commerce. No advertisement of this finding is
required.
RECOMMENDATION(S) :
The Manager recommends authorizing execution of the
Environmental Review Record Cover Page and the Finding of
Exemption for the HOME Housing Rehabilitation Program and
authorizing the Chair to sign the documents on behalf of
the Board.

Briefly Describe Project:
The proposed Orange County HOME Consortium Housing Rehabilitation Program will
provide direct financial assistance to owners of deteriorating housing in the Towns
of Carrboro, Chapel Hill, Hillsborough and unincorporated Orange County. Assistance
will be targeted to owner-occupants at 60% and below of area median and rental
property owners at 50% and below of area median income. All deteriorating structures
will be rehabilitated to HUD Section 8 Housing Quality Standards.

Project Description: Single Family, Scattered Site Housing Rehabilitation
Program
Statement: This project has been determined to be Exempt under 24 CFR
58.34(a) as follows (check one of the following) :
(1) Environmental studies excepted by Section 104(f)(2) of
Title I.
(2) Activities authorized by section 105(a)(12) of Title I and
list in 24 CFR 570.205 and 571 .205.
(3) Administrative costs for Title I activities as provided by
24 CFR 570.206 and 571 .206 and administrative costs related to a Section
17 project that do not have a physical impact.
(4) The payment of principal and interest on outstanding urban
renewal project loans under Subpart N of 24 CFR Part 570 as long as the
payment is not covered by section 58. 15 of this part and the payment is
not associated with a change in the related urban renewal project.
(5) The payment pursuant to Section 108(c) of Title I and 24 CFR
570.701(c) and 570.703(c) of principal and interest due on notes or
other obligations guaranteed under Section 108 of Title I; and the
application of grants pledged by the recipient pursuant to Section
108(d)(2) to any repayments due the Federal government under Section
108(e) of Title I as a result of such guarantees.
(6) The payment or reimbursement authorized under 24 CFR Part
570 of reasonable project engineering and design costs incurred for a
proposed activity eligible under 24 CFR 570.201 through 570.204 and of
similar project costs authorized by 24 CFR Part 511 or 850.
(7) Activities under technical assistance awards authorized by
(i) Section 107(b)(4) of Title I to prospective grant recipients under 24 CFR
570.402 or (ii) Section 17(a)(3)(A) of the United States Housing Act of 1937
under 24 CFR 511 .3.

(8) Interim assistance activities eligible under 24 CFR
570.201(f)(1), and activities eligible under 24 CFR 570.201(f)(2) ,
570.432, and 571 .308 for imminent threats to health and safety, if the
assisted activities do not alter environmental conditions and are for
temporary or permanent improvements limited to protection, repair, or
restoration actions necessary only to control or arrest the effects of
imminent threats or physical deterioration.
(9) Public service grants authorized under Section 105(a)(8) of
Title I and eligible under 24 CFR 570.201(e) but only under the
following circumstances:
(i) The grant is for the continuation of previous Title I
assistance to supplement eligible public services being maintained by
the recipient with only minimal change by the recipient as to the level
and type of services provided.
(ii) The services affect only the social or economic
environment.
(iii) The services would not result in development of service -
facilities or physical improvements regardless of source of funds.
xx (10) Any of the categorical exclusions listed in Section 58.35(a)
provided that there are no circumstances which require compliance with
any other Federal laws and authorities cited in Section 58.5 as shown on
the attached Finding of Categorical Exclusion.

Finding of Categorical Exclusion
Project Name: Orange County HOME Consortium/Housing Rehabilitation Program
Location: Towns of Carrboro, Chapel Hill, Hillsborough and Orange County
Project Description: Single Family, Scattered Site Housing Rehabilitation
Program
Statement: This project has been determined to be categorically Excluded from
National Environmental Protection Act (NEPA) Requirements under 24
CFR 58.35 as follows (Check one of the following):
(1) Acquisition, construction, reconstruction, rehabilitation,
or installation of public facilities and improvements eligible under 24
CFR 570.201(c) and 571 .201(c) including these activities carried out as
part of an economic development project in conjunction with the special
economic development activities eligible under 24 CFR 570.203. Such
activities are categorically excluded from the NEPA requirements only in
the following circumstances.
(i) The facilities and improvements acquired for continued use,
are in place and will be retained in the same use
that existed at the time of acquisition, without
change in size, capacity or character.
(ii) The facilities or improvements replace or upgrade existing
facilities or improvements with only a minimal change in use,
size, capacity, or location (e.g. , replacement of railroad
spurs, water or sewer lines, reconstruction of curbs and
sidewalks, repaving streets).
(iii) The facilities and improvements are consistent with the
use of that site and the action will not change the use, size,
capacity, or character of the site (e.g. , landscaping, street
furniture, play equipment for established parks and
playgrounds).
(2) Special projects directed to the removal of material and
architectural barriers that restrict the mobility and accessibility of
elderly and handicapped persons as authorized by Section 105(a)(5)
of Title I and 24 CFR 570.201(k).

(3) Public service grants which:
(i) Are for eligible public services not exempt under
Section 58.34(a)(9); are provided for a new or increased level of
service not previously supported by Title I provided
by the recipient in accordance with Section 105(a) of
Title I and 24 CFR 570.201(e)(1) .
(ii) Affect only the social or economic environment and
will not result in the development of service
facilities or physical improvements regardless of
source of funds.
(iii) Are part of community development and housing projects
funded in part or in whole under Title I and consisting solely of
activities categorically excluded under this Section or exempt
under Section. 58.34.
xx (4) Rehabilitation of buildings and improvements under Section
17, or under Title I as set forth in 24 CFR 570.202 and 571 .202
except renovation of closed school buildings. However, these
activities are categorically excluded only when the following
conditions are met.
(i) In the case of residential buildings:
(A) Unit density is not increased more than 20 percent;
(B) The project does not involve changes in land use from
residential to nonresidential or from nonresidential to residential, or
from one class of residential to another (for example, from single
family attached dwellings to high-rise multiple dwelling units); and
(C) The estimated cost of rehabilitation is less than 75 percent
of the total estimated cost of replacement after rehabilitation.
(ii) In the case of commercial and industrial
rehabilitation activities:
(A) The facilities and improvements acquired for continued use are
in place and will be retained in the same use that existed at the time
of acquisition without change in size, capacity or character, or

(B)(1) The facilities, improvements, equipment replace, modernize
or upgrade existing facilities with only a minimal change in the use,
size, capacity or location (e.g. , replacement of access, railroad spurs,
water and sewer lines and other site improvements) ; and do not increase
capacity or density by more than 20 percent; and (2) the facilities,
improvements and equipment are consistent with the allowed use of that
site and do not involve change in land use, such as from residential to
nonresidential, commercial to industrial, or from one industrial use to
another.
