PURPOSE: To authorize execution of the Environmental Review Record
for the Whitted Forest Housing Development CDBG Program and
the Request for Release of Funds form and authorize
publication of a Combined Notice to the Public of No
Significant Impact on the Environment and Request for
Release of Funds.
BACKGROUND: The N.C. Department of Economic and Community Development
(DECD) requires that an environmental assessment be
conducted in each Housing Development project area prior to
releasing grant funds. This assessment is done to
determine whether CDBG activities will have a significant
impact in the project area.
County staff has conducted this assessment and determined
that proposed housing activities would have no. significant
environmental impact on the community. The findings of this
assessment is recorded in the attached Environmental Review
Record (ERR) . This document must be approved by the Board
and executed by the Chief Elected Official before
submission to DECD.
Additionally, the County is required to advertise at least
once in a newspaper of general circulation a Notice to the
Public of No Significant Impact on the Environment and
Request for Release of Funds. The notice .attached, in a
format prescribed by DECD will accomplish this task. Upon
approval, this notice will be published on or about
January 7, 1993 in the Durham Morning Herald. The public
will have a 15 day comment period to review the ERR.
RECOMMENDATION(S) :
The Manager recommends:
1. Approve the ERR and the Request for Release of
Funds and authorize the Chair to sign the documents on
behalf of the Board.
2. Authorize the publication of a Combined Notice to the
Public of No Significant Impact on the Environment and
Request for Release of Funds in the Durham Morning
Herald on or about January 7, 1993.

which will combine high quality apartments with extensive on-site services: to the
residents. The site for the community is a 5.9 acre tract located in the Town of
Hillsborough at the corner of NC Highway 70 West and Holiday Park Rd.
The units will be contained in five buildings with 20 three bedroom .and 15 two
bedroom apartments. The apartments will be affordable to persons earning less than
50% of the area median income.
CDBG funds will be used for construction costs.

Summary of Findings
and Conclusions:
The Whitted Forest Housing Development project will result in no long-term
adverse impact on the community. The Hillsborough area has a critical need for
affordable rental housing, thus Whitted Forest will provide a much needed in-
crease in the housing stock.

Whitted Forest Development, Hillsborough, Orange County
According to Superfund Section records, the Whitted Forest
Development is not located on or near any CERCLIS/Inactive
Hazardous Waste sites. The only CERCLIS/Inactive Hazardous Waste
site within the 4-mile search radius is White Furniture Company _
(NCD003185816) . It is located 2 miles southwest of the proposed
project location. The site has been given NFRAP status (No Further
Remedial Action Planned) by the U.S. EPA. I have attached a map
which denotes its location. Based on the distance from this site
and its NFRAP status, it is unlikely to affect or be affected by
the Whitted Forest Project.

Upon review of the Preliminary Site Plan for Whitted Forest I.
have noticed that open space with existing trees is included.
Also, there is a designated area for a playground.
I ~ecommend that the playground include a large play
apparatus (equipment > that will meet the requirements of the
Americans with Disabilities Act (ADA> as well as paved
handicap accessible walk or path leading to and from the play
area.
The Recreation & Parks Department will be happy to assist
with the specifications for this area.
I realize that this site j s located in the jurisdiction of
the Town of Hillsborough' s Planning Board. However, the
Oranpe County Erosion Control office will have jurisdiction
on grading requirements. •

RE: Whitted Forest
This is to confirm our telephone conversation today. My files indicate that a site plan was
approved for the Whined Forest Apartment Development on October 10, 1990 (there is no time
limit for this approval in the Zoning Ordinance). I have enclosed a copy of the approval sheet
with the conditions listed. The site plan in my files have not been revised to address the
approval conditions. The fourth "other requirement" refers to "general notes" which I have also
included for your information.
I have also enclosed three letters from the Town's consulting engineer, David Cain, discussing
water and sewer requirements. The letters from 1987 refer to the Concorde Place Apartments,
a similar project on the same lot as the Whiffed Forest Project.
The Whined Forest Project is currently in good standing with the Zoning Ordinance and the
Vision 2010 Comprehensive Plan. Water and sewer requirements are listed in the engineer's
letter.
A Zoning Permit from the Town of Hillsborough will be required before a Building Permit from
Orange County can be obtained. Before issuing the Zoning Permit, I need to have a copy of the
revised site plan to insure that all of the conditions will be met, including water and sewer
changes. The Zoning Permit fee is based on the cost of construction (not land). The scale is as
follows: $50 for the first $50,000 + $1.25/$1,000 above $50.000.

Whitted Forest Plan Review

We have received a proposed site plan for the Whitted Forest
development on US 70 at Holiday Park Road and have conducted a
preliminary review of its water•, sewer and stormwater aspects .
The following comments summarize our review:
1) Although proposed stormwater improvements are shown on
the plans, supporting calculations for pipe sizing,
runoff volume, etc. must be submitted before we can
evaluate their compliance with Town standards.
2) All sewers operated and maintained by the Town of
Hillsborough must be a minimum of 8-inch diameter and
have manholes at a 400 foot maximum spacing. Easements
(20 feet wide) must be dedicated for this purpose. If
the Town does not operate and maintain the sewers, the
developer can install the system of his choice with the
understanding that all sewers within public right-of-way
must conform to the standards described above.
3) All water main sizes must be shown on the plans .
4) The developer should be informed that a 12-inch water
main is planned for Holiday Park Road and, should be
considered during design.
4) Reference is made to two letters dated May 26, 1987 and
May 29, 1987 (attached) regarding utility service to
this same property. The recommendations in those
letters remain valid.

Dear Mr. Hughes:
Since my earlier letter to you dated May 26, 1987 on the availability of water
and sewer service to the proposed Concorde Place Apartments in Hillsborough, several
items have come up that I would like to bring to your attention.
A question has been raised concerning,the effect of the new complex on the
water pressure available to existing nearby residences. The problems that current
customers are having with their water pressure in the area are a direct result of their
high elevation in relation to the Town's elevated storage tanks: This situation will not
improve until a new elevated tank is constructed in the northwest section of the
Town's service area to serve these higher elevations. As noted previously, the
proposed development is located at a relatively low elevation that will enable it to
have an adequate supply pressure without affecting existing customers.
The demand generated by the apartments will not be great enough to appreciably
affect the friction losses in the surrounding water mains. This means that existing
customers will not be adversely affected by the new development as a result of
increased water demand. -
The Town Board has apparently adopted a policy mandating that no new water
lines less than 8 inches in diameter be accepted as part of the Town system. This
policy was adopted to ensure that adequate future growth needs are met, and affects
the proposed development to the extent that 8 inch water lines will be required within
the complex.

Dear Harding:
We have completed our preliminary review of the availability of water and sewer
service to the Concorde Place Apartments. The proposed location of the development
is at the northeast corner of the intersection of U.S. Highway 70 By-pass and Holiday
Park Road on the edge of Hillsborough's northwest corporate limits. The following
comments address the requirements for both water and sewer extensions.
Water Service
The proposed plans indicate that water service is to be provided from a tie-in to
the existing 6-inch water main on Holiday Park Road. Preliminary testing of hydrants
in the area show that the available static pressure at the proposed site will be a minimum
of 43 psi, above the minimum pressure of 30 psi required for non-fire demand periods.
The future construction of the elevated water tank off Faucette Mill Road will enhance
the situation by increasing the available head in the northwest part of Hillsborough.
Since the development will be constructed entirely within Hillsborough's corporate
limits, provisions must be included to provide fire protection. Lines internal to the
complex must be at least 6-inch and have hydrants spaced at minimum 400 foot intervals.
. The water mains also must be specified as either PVC C900 or ductile iron pipe (DIP)
class 50 as opposed to the copper pipe shown on the existing plans. Specific items such
as these will be addressed in greater detail when reviewing the developer's plans and
specifications for final Town approval.
Flow rates to the proposed site during fire demand conditions cannot be calculated
without further system testing. The relatively small size of the buildings, however, will
not pose a significant fire demand over that of existing facilities in the area. System
testing to determine maximum delivery rates during fire demand will be conducted in
conjunction with final plan review.
Sewer Service
The preliminary plans submitted by the developer propose that sewer service to
the apartment complex be in the form of gravity lines extending to the existing gravity
system on U.S. Highway 70. No pump station or force main would be necessary under
this arrangement.

FINDING OF NO SIGNIFICANT IMPACT
It has been determined that such request for release of funds will not constitute an
action significantly affecting the quality of the human environment and accordingly
Orange County has decided not to prepare an Environmental Impact Statement
under the National Environmental Policy Act of 1969 (PL 91-190). The reasons for
such decision not to prepare such Statements are as follows:
1. The findings of the Environmental Review indicate that the adverse impacts
to human and natural environment are not significant and can be minimized
by appropriate safeguards.
2. The proposed Housing Development project will improve the community
conditions and provide much needed additional rental housing stock.
3. No negative comments were received from the statutory and related agencies.
An Environmental Review Record respecting the within project has been made by
Orange County which documents the environmental review of the project and more
fully sets forth the reasons why such Statement is not required. This Environmental
Review Record is on file at the above address and is available for public
examination and copying upon request at Room A-25 between the hours of 8:00 am
and 5:00 pm.
No further environmental review of such project is proposed to be conducted prior
to the request for release of Federal funds.
PUBUC COMMENTS ON FINDINGS
Al! interested agencies, groups and persons disagreeing with this decision are
invited to submit written comments for consideration by Orange County to the
Orange County Housing and Community Development Department, 300 West Tryon
Street, P.C. Box 8181, Hillsborough, NC 27278. Such written comments should be
received at the address specified on or before January 25, 1993. All such comments
so received will be considered and Orange County will not request the release of
Federal funds or take any administrative action on the within project prior to the
date specified in the preceding sentence.
RELEASE OF FUNDS
Orange County will undertake the project described above with Block Grant funds
from the North Carolina Division of Community Assistance under Title I of the
Housing and Community Development Act of 1974. Orange County is certifying to
DCA that Moses Carey, Jr., in his official capacity as Chair of the Orange County
Board of Commissioners consent to accept the jurisdiction of the Federal courts if
an action is brought to enforce responsibilities in relation to environmental reviews,

decision-making and action; and that these responsibilities have been satisfied.The
legal effect of the certification is that upon its approval Orange County may use the
Block Grant funds and DCA will have satisfied its responsibilities under the National
Environmental Policy Act of 1969.
OBJECTIONS TO STATE RELEASE OF FUNDS
DCA will accept an objection to its approval only if it is on one of the following
bases: (a) that the certification was not in fact executed by the certifying official or
other officer of applicant approved by DCA; or (b) that applicant's environmental
review record for the project indicates omission of a required decision, finding or
step applicable to the project in the environmental review process. Objections must
be prepared and submitted in accordance with the required procedure (24 CFR Part
58) and may be addressed to DCA at Suite 250, 1307 Glenwood Avenue, Raleigh,
North Carolina 27605.
Objections to the release of funds on bases other than those stated above will not
be considered by DCA. No objection received after February 9, 1993 will be
considered by DCA. Comments must specify whether they concern the finding of no
significant impact or the intent to request release of funds.
