Whitted, Chair Orange County Board of Commissioners U���1. �.� !) 6, ' MINUTES MAY 19` 1982 The Orange County Board of Commissioners met in a special session scheduled for this time and place and also adjourned from May 18, 1982, to this time and place, on May 19, 1982, at 7:30 P.M. in the Lincoln Center Board Meeting Room, Chapel Hill, North Carolina. Commissioners Present: Chairman Richard E. Whitted, and Commissioners Norman Gustaveson, Shirley E. Marshall, Norman Walker and Don Nillhoit, A. CHAPEL HILL-CARRBORO SCHOOLS' BUDGET PRESENTATION Ms. Phyllis Sockwell, Chair of the Chapel Hill-Carrboro Board of Education, welcomed the Board of Commissioners and made some introductory remarks about their budget. She said State and Federal funds were uncertain at this time and that support for the District School Tax was strong. Dr. Pamela Mayer, Super- intendent of the School System, reviewed the budget for the Boards. The schools goals are divided into three divisions: administration, instruction, and support services. Dr. Mayer listed specific goals for each division. She noted that the overall budget represented a 4.3% increase over last year's with capital out- lay requests representing about a 47.7% increase; she added that the current capital needs were not the total capital needs of the school system. Commissioner Whitted thanked the School Board members and Staff for the presentation and said the Public Hearing on the budget was scheduled for June 8, 1982' Following a five minute break, the Board of Commissioners resumed deliber- ations with all members present, with the items postponed from the meeting of the previous evening. 1. Minutes: Commissioner Marshall moved, seconded by Commissioner Willhoit, to approve the Minutes of March 1, 1982, as corrected. Vote: Ayes, 5; noes, 0' Commissioner Qillhoit moved, seconded by Commissioner Marshall, to approve the Minutes of March 8 , 1982, as corrected. Vote: Ayes, 5; noes, O. Commissioner billhoit moved, seconded by Commissioner Marshall, to approve the Minutes of March 16, 1982, as corrected. Vote: Ayes, 5; noes, O. 2. Draft Water and Sewer Extension Policy: The Manager told the Board this was a draft statement, that responses . ` . UtA2O J,(.; had not been received from either the County Attorney or the Institute of Govern- ment. Fred Luce, of the Planning Staff, reviewed the draft policy with the Board (the document is on pages of this book). Commissioner Walker disagreed with the revolving fund set up to pay back costs of extension suggesting instead 'b six year payback from ad valorem taxes." Commissioner Gustaveson felt that a more "flexible policy" was needed. Following much discussion, the Chairman suggested that the Board wait for the Attorney's and Institute's comments before making its own suggestions for changes_ 3. Requests for Special Public Hearings: The Board, by consensus, set July 8, 1982, at 7:30 P.M. in the Superior Courtroom in Hillsborough as the time and place for a public hearing as requested by Mr. Fred Cates and developers of Midway Airport. 4. Lease Agreement for Child Support Offices: The Manager presented the Board with a lease agreement for the Child Support Office; he said he hoped to locate the office in County facilities within about six months. Commissioner Gustaveson moved, seconded by Commissioner Walker, to approve the lease agreement as recommended by the Manager. Vote: Ayes, 4 (Commissioners Whitted, Gustaveson, Marshall and Walker); noes, 1 (Commissioner Willhoit). Having finished the agenda of the previous evening's meeting, the Board continued with the announced agenda for this meeting. l. Cane Creek Environmental Statement: Commissioner Willhoit noted several points he would like to make in the County's response to the Cane Creek Environmental Impact Statement: 1) there are no permitted point source discharges in Cane Creek while there were 132 such discharges in the Haw River; 2) 8% of the flow of the Haw River at the dam is effluent; 3) there is no urbanization in the Cane Creek watershed, consequently urban runoff is minimal while the Haw drains a large urbanized area and there is significant urban runoff into ft' Commissioner Willhoit said there would be significant difference in the water quality of Jordan Lake and the proposed Cane Creek Reservoir. He added that the EIS quoted 8urby's study regarding growth around such sites when the study cited actually showed very little impact on recreational growth if such sites were more than 300 yards from the reservoir. Commissioner Marshall thought that the 3nciu-Economic impact section of the Staff response to the EIS should address the pattern of growth and development that has followed the up-grading of Highway 54 U1U*1 3. /� . ..�. Vote: Ayes, 5; noes, O. Commissioner Walker moved, seconded by Commissioner Gustaveson, the nomination of Tom Bivins in the category of Disabled Person Volunteer, Vote: Ayes, 5; noes, O. . The Chairman instructed the Clerk to forward the names of those nominated in the various categories to the Governor as the nominees from Orange County, The Clerk was asked to solicit further nominees in the categories of Business/Industry Invnlvment, Youth Volunteer and to cull out those already nom- inated in other categories who were appropriate nominees in the School Volunteer 'W1uVV category. NEED: The Board had this item on its agenda of May 3rd; the Board asked that it be placed on the agenda of May 19th for consideration at that time. The Board also asked for information from the Town of Chapel Hill on requests it had made of the Div' of Environmental Management, Dept. of Natural Resources and Community Development, That information is included for your information but is not attached to the agenda. The comment period for this draft document ends June 1, 1982. Attached is a summary and critique of the report prepared by the Planning Department. Problems include: 1. No comparison of the cost to clean up of the Haw River to permit safe drinkable water. 2. No weighing of the problems of removing synthetic organic chemicals versus non-point source contributions. The former is a much more difficult contaminant to remove in terms of cost and technology. IMPACT: Comments will be used in preparing the final EIS. The final EIS will be part of the evidence considered when the Environmental Management Commission considers granting OWASA eminent domain power for acquiring land to build the Cane Creek reservoir. - RECOMMENDATION: As the Board decides. -777777. - w4 i -• • ' 7'4 : .• STATEMENT REGARDING CANE CREEK In consideration of the fact that, 1. The projected growth in this region indicates that it would be prudent to develop all potential high-quality water supplies to meet the:need% of this anticipated growth. 2. Cane Creek is the only significant undeveloped reservoir site remaining in the Cape Fear region (Southern) of Orange County. 3. Urban-type develbpment is encroaching on and threatening the viability of the dairy and agricultural industry in the Cane Creek area. 4. Watershed protection criteria could be used to stabilize and preserve the dairy industry and the quality of life in the Cane Creek area. 5. The trend in water quality standards is toward more stringent criteria as the more subtle effects of low level contaminants are recognized. Therefore, the Orange County Board of Commissioners endorses the develop- ment of the Cane Creek Reservoir. Futhet0Org, the Board believes that, consistent with the EPAStandardewhere there is a choice, the purest sources should he selected. This Board supports OWASA's attempts to provide the safest water source practicable, as a legacy to the residents of the county. 01033 SUANMARY OF CANE CREEK EIS Summary of Cane Creek EIS contains: The Environm=ental Impact Statement (EIS) prepared by the NC Department of Environmental Management for the proposed,Cane Creek reservoir relies heavily on previous reports prepared for OWPSA and the the EIS prepared by the US Army Corps of Engineers. The following are some of the significant conclusions of the EIS and Planning Staff comments on them. Water Quality The most viable alternative to the Cane Creek supply for southern Orange County is Jordan Lake. The expected water quality in these two reservoirs has long been a controversy and the question is discussed extensively in the EIS. The Cane Creek supply is located in a relatively small, rural water- shed. There are no permitted point source discharges upstream of the Cane Creek dam. Cane Creek water quality is therefore primarily in- fluenced by nonpoint source runoff. Since most of the watershed is either wooded or cultivated as farmland, the potential pollutants which might be found in the runoff could include nutrients, agricultural chem- icals and suspended sediments. In contrast the EIS points out that there are 132 point source dis- charges of domestic or industrial wastes to the streams in the Jordan Lake watershed. These include 94 discharges of domestic wastes and 39 industrial waste discharges in the watershed. Effulent from these dis- charges represents 8y of the average flow at the Jordan dam. Nonpoint source pollution also ought to be more significant in Jordan Lake because its drainage area includes the urbanized areas of Greensboro, Burlington, Chapel Hill and part of Durham. Based on what we know about the quality of runoff from urban areas and the large number of point sources of / pollution in the Jordan watershed, the conclusion should be that the Cane Creek supply should be far superior. The EIS, however, does not reach this conclusion. Cane Creek and Jordan Lake have been proposed as water supply sources for more than 10 years and a body of water quality data has accumulated for these potential sources in that time. The EIS states that in the past, Cane Creek reservoir was considered the better quality water supply based on existing data. Based on more recent monitoring and analysis, the EIS concludes that the differences in quality are not so readily apparent. The report suggests that the improvement may be due to better water quality in the Haw and New Hope steams brought about by increasing regulation of point source discharges. Another reason that the more recent data appears to show improved water quality in the Haw and New Hope steams could be that an insufficient number of samples were taken, that they were taken at the wrong times or the samples were of only a few selected pollutants of the many possible pollutants. In any case, the final water quality of an impoundment cannot be completely assessed until each of the lakes have formed and stabilized for several years. Until that data is available, the conclusion about the water quality of these two water supplies, based on the characteristics of their watersheds must be that Cane Creek will have water of superior quality. Critique Of Water Treatment Effectiveness The EIS states that one of the most important considerations in analyzing the desirability of various water supply sources is the adequacy of treatment to provide protection for human health. Tne EIS concludes that current treat- ment technology is adequate to make all of the alternative sources discussed suitable for human consumption. This conclusion is at odds with the thinking of some experts in the water quality field. They feel that the water treatment plant is too unreliable a barrier between potentially harmful raw water and the water consumer because the plants can malfunction and are operated by humans who are prone to mis- takes or incompetence. In recognition of the limitations of drinking water treatment technology, protected high quality sources are still considered by these experts to be an important "first line of defense" against the contamination of potable water supplies. Economic Cost Comparisons The EIS points out the difficulties of doing economic cost comparisons. Not only are there variables based on engineering judgements of equipment needed, but there are several methodologies for performing the economic analysis, and the choice of method used can significantly affect the results of the analysis. Cost analyses were done for the alternatives considered in the EIS using several methodologies and each gave some variation in the ranking of the alternatives. According to the EIS, perhaps the most revealing result of the cost analysis was the relative closeness of costs for all alternatives. No single alternative water supply stands out as clearly superior from a cost standpoint. Socio-Economic Impacts The EIS provides a more complete discussion of the socio-economic impacts of constructing the Cane Creek reservoir than was provided in the EIS pre- pared by the US Army Corps of Engineers in 1980. There is a good analysis of the components of community structure in the Cane Creek area that would be impacted by the project including population, agriculture, community social/ economic changes, transportation, recreation, energy use, historical/archae- ological resources and land use. The EIS draws no conclusions about the socio-economic costs identified , but does point out that similar costs have already been absorbed for the Jordan Lake project which is now complete. No figures are developed con- cerning the health costs of drinking water from the Haw. Attached is a summary of environmental impacts from the EIS. The numbered list below corresponds to the numbers in your April 16, 1982 letters to Mr. VanTilburg and Mr. Russell Radford. (1) Attached please find description and station locations for monitoring in the Haw and New Hope River basins. The maps attached show all current monitoring stations in the Haw and New Hope River drainages and the stations are marked in red. (2) Maps showing the location of all permitted wastewater dischargers in the Haw and New Hope Rivers are attached. The names and NPDES permit numbers are included. There are no significant wastewater dischargers to these drainage areas that are not currently under permit. The status of any discharger not listed in this material can be discussed directly with Mr. VanTilburg of the Raleigh Regional Office at 733-2314 or Mr. Russell Radford of the Winston-Salem Regional Office at 761-2351. A map of Division Regional Offices is included in the attached information. (3) The Division maintains permit files for each discharger to State waters. Permit files for those dischargers identified in #2 are available for public review and copies can be obtained; however, there is a charge for these copies. Several comments have been added to put the table in perspective. Compliance Summary: - There are 93 known/permitted dischargers in WSRO's portion of the Haw River. - 54 dischargers are in compliance with currently applicable water quality standards/permitted discharge limitations. - 39 dischargers are in noncompliance. - 18 of the 39 noncompliers are schools with pending variance proceedings. - there remain 21 facilities in noncompliance; 10 of the 21 are involved in abatement programs with definite compliance dates set. - there remain 11 facilities, four (4) of which are in marginal noncompliance with efforts underway to resolve their problems in short order. - seven (7) dischargers are receiving needed special attention by WSRO staff. Please note that this summary information is based on recent informatin.
