HomeMy WebLinkAboutAgenda - 05-03-1982 10980 MINUTES MAY 3, 1982 The Orange County Board of Commissioners met in regular session on Monday, May 3, 1982, at 10:00 A.M., in the Commissioners' Room, Orange ` County Courthouse, Hillsborough, North Carolina. Commissioners present: Chairman Richard E. Whitted, and Commissioners Norm Gustaveson, Shirley E. Marshall, Norman Walker and Don Willhoit, A. BOARD COMMENTS Commissioner Whitted announced that the joint meeting with the Mayor and Board of Commissioners of the Town of Hillsborough would be at 4:00 P.M. rather than 3:30 P.M. Commissioner Willhoit added discussion of the Damascus Fire District referendum; Commissioner Walker added discussion of the spot- lighting of deer. B. AUDIENCE COMMENTS There were no audience comments about topics on the printed agenda or not on the printed agenda. C. MINUTES Commissioner Willhoit moved to approve as submitted the Minutes of April 26, 1982; Commissioner Gustaveson seconded the motion. Vote: Ayes, 5; noes, U. D. DR. SIMMONS' REPORT Dr. Mike Simmons, Superintendent of the Orange County Schools, pre- sented a report on capital funding for the schools. Part of the presentation was a slide show of schools state-wide, their dates of construction, per- centage still in use and cost of renovation. Dr. Simmons reviewed sources of funding for schools' capital projects, includtpg a proposed local option .01 sales tax. The Board thanked Dr. Simmons for his presentation. E. 6, SUBDIVISIONS The Board moved the discussion on Planning Department items in order to accommodate some citizens who had arrived early. a. Rustic Acres: Mr. Polatty reviewed this subdivision with the Board saying the Board had referred it back to the Planning Board with instructions that the sight distance be checked. Mr. Polatty said the sight distance was 243' with a stopping distance of 265' on SR 1710. With this additional information, Commissioner Gustaveson moved to approve the Planning Board's recom- mendation of approval for the preliminary plat of Rustic Acres Subdivision; [nm- missinner Walker seconded the motion. Vote: Ayes, 5; noes, O. b. John McCormick Property: Mr- Polatty described the subdivision to the Board adding that this request included a request for a variance from the right-of-way requirements. Both Planning Staff and Planning Board recommend denial based on the condition of the road, width of the right-of-way on the road and the total number of lots on the existing road. Mr. McCormick told the Board the develop- ment had obtained the 20' right-of-way easement from the property owner under threat of condemnation and further easement was not likely to be forthcoming from this owner, The County Attorney told the Board it lacked the authority to grant less than a 30' foot easement. Commissioner Marshall moved to deny the minor subdivision request of John McCormick on the grounds that the Board lacked "the authority to do anything else." Chaitmun Whitted said the motion died for lack of a second whereupon Commissioner Nillboit said he would second Commissioner Marshall 's motion if she would accept an amendment to state the reasons for denial include those listed by the Planning Board and Staff (see this paragraph for those reasons), Commissioner Marshall accepted amendment to her motion. Vote: Ayes, 4 (Commissioners Gustaveson, Marshall , Nillhnit and Whitted); noes, 1 (Commissioner Walker). c. Preliminary Plat Fred E. Roberts Property: Mr- Polatty described this property for the Board. Commissioner Walker moved, seconded by Commissioner Gustaveson, to approve the Preliminary Plat of the Fred E. Roberts property with the condition stipulated by the Planning Board (that is, a drainage easement on the stream and the width of the easement to be determined by the Erosion Control Officer). Vote: Ayes, 5; noes, 0. E9 ' . Zoning Alternatives in Murphy School Area Discussion of this item was moved up in order tn accommodate Mr. Art Vann who had commitments for the time it was previously scheduled. The Board allowed Staff to make its presentation and those who were present were allowed to address the Board, however, a decision was delayed until the afternoon session to permit others who wished to be present an opportunity to be heard, (For the sake of clarity and conciseness all discussion which occurred on this item ���� �~~_ today is included here.) Mr. Polatty told the Board that all five home occupations presently existing in this area could be brought into conformance with the stand- ards as outlined in the Zoning Ordinance Article 6.16'1, 6.16.2, and 6.16.3 and he recommended that they be brought into compliance with the Zoning Ordinance as it is. Mr. Polatty specifically said Dean's Truck and Coach could comply under the section of the Ordinance regulating Home Occupations on lots over 200,000 sq.feet. by doing four things: 1) agree to reduce the floor area used for the Home Occupa- tion; 2) screen the outside storage of the buses; 3) screen the building; and, 4) increase the lot size (which Mr. Dean has already done). Mr. Polatty elaborated that Mr. Dean, in order to reduce the amount of floor space, would have to divide his building; he understands that Mr. Dean is presently using about one half this building for storage. Mr. Vann, Mr. Dean's attorney, said his client wished to comply with the Zoning Ordinance; they can live with the Home Occupa- tion as outlined in the Ordinance. Ms, Nancy Laszlo, a property owner who lives in the area, said there were 4U- 6O property owners who objected to further commercial development in the neigh- borhood. Commissioner Walker moved to approve the Planning Staff's recommendation, that is, no Special Use Permit be created for home occupations and further, that the uses now there conform to the existing zoning ordinance requirements for home occupations; additonally, Dean's Truck and Coach, Phillip's Garage and Bass Welding should provide a scaled site plan that shows the lot boundaries, all existing structures, storage areas, screening (existing and proposed), set- backs, Gustaveson d bankn, signs (including size) and floor areas. May 23-29 Public Works Week Commissioner Walker moved, seconded by Commissioner Gustaveson, to proclaim May 23-29, 1982, Public Works Week in Orange County. (That Proclamation is on page of this book.) Vote: Ayes, 5; noes, O. E.3. May 16-23 Soil Stewardship Week Commissioner Marshall moved, seconded by Commissioner Gustaveson, to proclaim May 16-23, 1982, Soil Stewardship Week in Orange County, (A copy of that Proclama- O tion is on page of this book.) Appointments Energy Commission: Commissioner Gustaveson moved, seconded by Commissioner Willhoit, to appoint Mr. Robert Giddings Carrboro's representative on this Commission. Vote: Ayes, 5; noes, 0' The Board deferred action on the following/ Commission on Women, Hillsborough Planning Board, Orange County Planning Board, Southern Triangle Fire District Board of Trustees. Recreation Coundil: Commissioner Walker moved` seconded by Commissioner Gustaveson, to appoint Barry Thomas Torain the Cheeks Township representative to this Council, Vote: Ayes, 5; noes, O. Industrial Facilities and Pollution Control Financing Authority: Commissioner Gustaveson moved, seconded by Commissioner Marshall, to reappoint Dr. Ed Bergman and Mr. Sandy RcOamroch to terms on this Authority. Vote: Ayes, 5; noes, O. Carrboro Board of Adjustment: Commissioner Gustaveson moved, seconded by Commissioner Willhoit, to appoint Mr. Bruce Browning and Ms. Margaret Brown to terms on this board expiring in April Of 1988 and 1084, respectively, Vote: Ayes, 5; noes, O' Senior Citizens Board: Commissioner Willhoit mnved,seronded by Commissioner Gustaveson, to appoint Mr. Robert Sawyer to this Board to fill the unexpired term of Gloria Williams. Vote: Ayes, 5; noes, O. Capital Health Systems Agency: Commissioner Gustaveson moved, seconded by Commissioner Willhoit, to submit Mr. Richard Schramm and Ms. Erma Jones to the Capital Health System Agency Board Selection Committee for consideration. Vote: Ayes, 5; noes, U. E.4. Budget Amendments Commissioner Gustaveson moved, seconded by Commissioner Marshall to approve the budget amendments (see page of this book). Vote: Ayes, 5; noes, O. E.5. Vacant County Positions Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to approve the Manager's recommendation to unfreeze the following positions: Secretary IV (Planning Department), Truck Driver, Custodian, Maintenance Mechanic II (All in Public Works Department), and Social Worker II (Department of Social Services). Vote: Ayes, 5; noes, O. E. 7. Oak Hill Preliminary Assessment Resolution Commissioner Willhoit moved, seconded by Commissoner Gustaveson, to adopt the 361 Preliminary Assessment Resolution for the Oak Hill Road Participatory Paving Project and to schedule the public hearing on the Preliminary Assessment Resol- ution for May 18, 1082, at 7:30 P.M. Vote: Ayes, 5; noes, O. E.8. Report and Recommendations on Economic Development Dr. Ed Bergman and his class,bf graduate students in Planning at the University of North Carolina at Chapel Hill presented the final report and recommendations for economic development of Orange County to the Board of Commissioners. (That report is on file in the office of the Clerk to the Board.) One of the recom- mendations l is th mendations made by Dr. Bergman's class s e establishment of an Office of Economic Development by the County which would best serve the needs of all County residents. Such an office, as seen by the Class, would have five functions: 1) Planning; 2) Implementation; 3) Assistance; 4) Liaison; and, 5) Coordination. Another recommendation made by Dr. Bergman's class is the creation by the Board of Commissioners of an Economic Development Advisory body which would monitor the Office of Economic Development. Discussion among the Board members and the members of the Orange County Industrial Facilities and Pollution Control Financing Authority followed the presentation- Dr. Bergman, Chair of the Authority, said the Industrial Authority feels that it shouldn't be the arm of the County to pursue and seek out industry, it needs staff leadership and support which would come from a special Office of Economic Development. Mr. Grainger Barrett, a member of the Authority and an attorney, said by definition the Authority only approve� narrow financial transactions; that wider planning for economic development should come from other bodies. Chairman Whitted said this Board was on the record as wanting industry to locate in Orange County. ^ The Board thanked Dr. Bergman and his class fora fine presentation. The Board took a short break and resumed deliberations with all members present. E.13 Release of Interest Request Mn' Grace Wagoner, of the University of North Carolina Property Office, was present for this discussion as was Mr' John Horner, Tax Collector for the County. Commissioner Gustaveson moved, seconded by Commissioner Whitted, to approve the Tax Collector's recommendation to deny release of interest for the University of North Carolina on tract # 710242, Phi Sigma Kappa Fraternity. ' | ������� �' ' ^'~~�m Ms. Wagoner told the Board that the University had initiated the action to pay the taxes; however, she said, there was no account set up and no funds to pay the taxes. To establish the account and fund it took time she said, during which the interest began to accrue. Commissioner Whitted withdrew his second. Nr. Horner said the University had paid the amount it thought was due on the property, that is, the back taxes but no interest. Commissioner Gustaveson'moved, seconded by Commissioner Willhoit, to table this request until the Board could consult with the County Attorney. Vote: Ayes, 5; noes, U- /-Clerk's Note: Further discussion of this subject occurred later in the meeting, however, for conciseness and clarity, all discussion is included here'7 The County Attorney told the Board it could go into executive session over this question because of the client/attorney privilege. Commissioner Gustaveson moved, seconded by Commissioner Willhoit to go into executive session to discuss property matters. Vote: Ayes, 5; noes, O. Following the executive session, Commissioner Whitted moved, seconded by Commissioner Willhoit, to approve the release of interest request by the University of North Carolina on the property on Tax Map 66, Lot 5, Tract # 710242' Vote: Ayes, 5; noes, O. E. 10 Cane Creek Environmental Impact 3tatement. Commissioner Willhoit noted some areas in the draft of the environmental impact statement prepared by the Division of Environmental Management on the Cane Creek Reservoir which he felt should be further addressed by Staff. The Board is to discuss this subject on May 19th. E. 14 Added Item--Resolution on Spotlighting of Deer Commissioner Walker moved, seconded by Commissioner Gustaveson, to adopt the Resolution calling for the Wildlife Commission to hold a public hearing in Orange County on the spotlighting of deer. Vote: Ayes, 5; noes, O. (That Resolution is on page of this book. E. 15 Added Item--Damascus Fire District Commissioner Willhoit noted that the Statutes call for the County to set the tax rates on or before July 1st of each year and said the vote on the referendum wouldn't be certified until July 1st whereas the budget for the County was set for adoption on June 22nd. Commissioner Willhoit moved, seconded by Commissioner 01966 U(..) U Walker, to set a noon meeting on July 1, 1982, for the purpose of setting the Damascus Fire District Tax rate assuming the referendum passes. Vote: Ayes, 5; noes, U. E.12 Auction of Surplus County Property Mr. Mark Rees, Purchasing Officer for the County, reviewed the fixed asset system for the Board. Commissioner Willhoit moved, seconded by Commissioner Marshall , to declare the items surplus as listed on the printout attached, to adopt the Resolution, and to give the Purchasing Officer the authority to negotiate sales of this inventory with other agencies prior to the auction, excluding vehicles. Vote: Ayes, 5; noes, O. E.11. Meeting with Town of Hillsborough Commissinners. Hillsborough Commissioners present: Mayor Lucius Cheshire, Jr', and Com- missioners Lynwood Brown, Jr,, Allen Lloyd, Paul Martin, and Rachel Stevens. All Orange County Commissioners were present as noted at the beginning of the meeting this date. Chairman Whitted briefly reviewed the background on the Old Courthouse, saying that the Town of Hillsborough had filed suit last October contesting the County's ownership of the Old Courthouse. This meeting is to attempt resolution of those differences. Chairman Whitted added that the Town and County Commissioners had a common concern--the historical integrity of the Old Courthouse. Mayor Cheshire listed the Town's concerns: 1) future Boards of County Commissioners may not share the present Board's concerns regarding the Old Courthouse, therefore the restrictions are requested; 2) the interior of the building is worth preservation as well as the exterior; 3) if conversion of the interior occurs, architectural detailing will be destroyed for short-term utilization of the building; 4) possible structural damage may occur during any renovation' Mayor Cheshire confirmed that the major point o'f concern is over the interior of the building with the stipulation that any interior changes be of a restorative nature rather than renovation. Chairman Whitted said this Board of County Commissioners could not limit the authority of future Boards; that this building is too expensive to maintain without deriving some use from it, Mayor Cheshire said the Town does not care who owns the building as long as it is preserved. 089G7 Commissioner Willhoit said the County Board had thought that the North Carolina Department of CultUral Resources would be the proper agency to advise the County on renovations to historical buildings. The Town suggested perhaps the North Carolina Department of Archives; the County Attorney sa id he did not k now if this agency would give its "advice and consent" to plans submitted to them. Town Commissioner Stevens said the Town Board is opposed to the third floor ° of the building being used as a courtroom. Mayor Cheshire agreed, saying the desire was unanimous to see the Museum stay on the third floor; but there were really two issues: 1) Museum to remain in its present location; and, 2) the building be preserved. Chairman Whitted reiterated that the building must have some function; it cannot be maintained as a museum piece. Mayor Cheshire suggested the County list the interior restrictions it could accept and submit these to the Town of Hillsborough Commisuiunprs, Chairman Whitted said (and there was a consensus on the Board) that it would not be fair to future Boards of Commissioners to have to maintain the building under extreme restrictions. This Board prefers to have a process for review rather than a list of restrictions for future Boards to follow. Mayor Cheshire suggested a thirty day moratorium on the lawsuit to pursue resolution between the Boards. Chairman Whitted said a rewrite of Section IV of the proposed contract to address the concerns of the Town Commissioners on the appropriate review agency for building renovations would be done during the moratorium. Mr. Roscoe Strickland, President of the Hillsborough Historical Society, said he appreciated the County Commissioners' concerns regarding the Old Court- house and that one set of architectural drawings for the interior of the building were "tastefully done'" He added that he was speaking for himself and not for the Society when he suggested that perhaps the museum could occupy a ground floor . in the building. Chairman Whitted thanked the Mayor and Commissioners of Hillsborough for coming to the meeting. Commissioner Walker moved to adjourn Commissioner Ma, .hall ) seconded the motion. NEED: All positions have been advertised. Energy Commission: There are three vacancies. The resumes have been reviewed and there are no current applicants. The Town of Carrboro has recommended Mr. Robert Giddings as its representative. Commission on Women: The office has received two applications; the Commission Chair, Ms. Peggy McCarthy, is interviewing applicaL prior to recommending applicants to the Boare of Commissioners. 1 purpose of the interview is to ensure the Commission appointees al willing to work on the Commission. Hillsborough Planning Board: The Town Commissioners are inter- viewing applicants the evening of 4/29/82; I expect a recommendation for this position on 4/30/82. Orange County Planning Board: Ms. Claudine Harris, Eno Township representative, has resigned; I am attaching the resume of Dr. Lloyd Heron who lives in Eno Township. Additionally, the Cedar Grove Representative seat is still vacant. Recreation Advisory Council: The Cheeks Township and Little River Township seats are vacant. I am attaching resumes for Barry Thomas Torain and Ms. Elaine Parker, respectively. Southern Triangle Fire District Board of Trustees: The Board of Commissioners reserved on appointment to the four member Board. Industrial Facilities E Pollution Control Financing Authority: The terms of Dr. Bergman and Mr. McClamroch expired March, 1981. (See the attorney's letter to you, dated 4/15/82) Both wish to be reappointed. Carrboro Board of Adjustment: The Board of Aldermen recommends that Mr. Bruce Browning and Ms. Margaret Brown be appointed to th Board as extraterritorial members for terms effective immediately and expiring in April of 1988 and 1984 respectively. See the letter and Resolution from the Town of Carrboro. Senior Citizens Board: Position created by virtue of Ms. Williams' inability to attend the meetings on a regular basis. The surveyor of the property has provided the additional information shown on pages 3-5. The information shows a sight distance of 243' with a stopping distance of 265'. IMPACT: The additional information provided by the developers indicate that the sight distances at the intersection is longer than thought at the first Board meeting. The proposal meets the existing standards for lot size and the tract is bordered by Duke Forest and Southern Railroad. PURPOSE: The Board asked the PlanninF Staff to outline the alternatives in the Zoning Ordinance that ray be used to deal with the non-conforming or illegal uses located in the Vurnhy School area. NEED: The Zoning Ordinance has several sections that may aqply to the Commercial Uses for the area near Murphy School. The concern of the businesses is that they be allowed to continue operation. The concern of the neighbOrhood residentis is that the character of the neighborhood not be altered and that all the uses conform to the Zoning Ordinance requirements. The five co ,ercial uses in the area of Trurphy Schobl'that asked for rezoning were 0-fl Electric, Phillips General repair, Auto Catering Service, Bass Welding Shon, Dean's Truck and Coach. G-P Electric is a home occuoation and can continue to operate as it - does today. Phillips General repair could meat the standards of hone occupation for lots less than 200,000 Square feet. The arount of floor area in the garage would have to be reduced, the building will have to be screened and all parking areas will have to be screened and all siEns will need to meet zoning ordinance requirements. Auto Catering Service is a non-confOrming use and can continue to operate but not expand. Bass '.Telding Shop could reet the standards of home occupation for lots less than 2D0,000 square feet. A build- ing ray have to be constructed or the amount-of floor area may have to be reduced, no outside stora-e of materials is allowed, and the building would have to be screened, Dean's Truck aid Coach can meet the requirement of hone occunation on lots greater than 200,000 square feet. The amount of floor area would have to be reduced, the build- ing screened from the road, and any outside storage screened from the road, The Corner Grocery is currently zoned correctly for camercial use. Orange Glass Co. and Star Castle Disco are non-conforming uses and may continue to operate under the ZoninF. Ordinance. The impact of the Board's decision varies with the alternative selected. FECCUINDR1ION: Planning staff recormends that no Special Use Permit be created for hone occupations. Further, staff recommends these uses conform to the existing zoning ordinance requirements for hone occu2ations. In the March 8, 1982 Public Hearing agenda packet the Planning Staff outlined two alternatives to the requested rezonings for the non- conforming, illegal, or home occupations near Murphy School. Those alternatives are still available to the Board. During the Planning Board's discussion of these rezoning requests another alternative emerged. The home occupation section (6.16.6) of the zoning ordinance would cover all the applicants. There are basically 3 types of home occupations created in the Zoning Ordinance. First, 6.16.6.1 establishes home occupations in all residential (R-2-R--13) districts except R-1 and B. 6.16,6.2 establishes home occupations on lots less than 200,000 square feet and 6.16.6.3 is for home occupations on lots greater than 200,000 square feet. Section 6.16.6.3 (lots greater than 200,000 square feet) could cover tan's Truck and Coach with some amount of reduced floor area, screened outside storage, and screened buildings. The Board asked if requiring a special use permit for home occupations night alleviate some of the concerns expressed by residents. The Planning Staff feels that the requirements of section 6,16.6 provide as reach protection as a special use permit would, Any requirements of a new special use permit would include the requirements contained in the present home occupation. In conclusion, a special use permit could allow variance in the requirements for each applicant. Usually the! Board would want to make these requirements more restrictive in order to protect surrounding property. In the Murphy School cases, particularly Dean's Truck and Coach, Bass Welding and Phillips Repair, the requirements would need to be lessened. Violations of either the existing home occupation requirements or a new home occupation special use permit are punishable by the same sentence or fine. 00979 1 Memo - Board of Commissioners April 14, 1982 Page 2 Presently, the Zoning Ordinance is very liberal in allowing home occupations. Most zoning ordinances allow home occupations within the existing dwellingkunit. This is allowed under 6.16.6.1 in our ordinance. The other two classes of home occupations allowed in 6.16.6.2 (lots under 200,000 square feet) and 6,16.6.3 (lots over 200,000 square feet) are the two home occupations that allow detached accessory structures. If home occupations , which are permitted' uses ; now, are converted into Special Use Permits, the impacts would be that home owners would be that homeowners- would derive some greater degree of protection from the process homeowners would have to go through to develop a home occupation in an accessory building while the applicants would have to wait and follow an application process. Planning staff does not think the requirements would be any different if these home occupations were Special Use Permits instead of uses by right. Therefore, we conclude that homeowners would not derive a greater degree of protection with home occupations as Special Use Permits. The planning staff recommends that the rezoning requests be denied, and that the existing uses conform to the Zoning Ordinance. Staff further recommends that each use provide a scaled site plan that shows the lot boundaries, all existing structures, storage areas, screening (existing and proposed), setbacks, signs (including size) and floor areas. Each use in this area should,with little inconvience, be able to conform to section 6.16.6.2 or 6.16.6.3 and will be able to continue to operate. However, since most uses will be at the maximum allowed floor area they will not be able to expand. WHEREAS the Board of County Commissioners of Orange County has received a petition requesting the paving of Oak Hill Road (S.R. 1835), in Chapel Hill Township,. Orange County, North Carolina, which petition has been signed by at least seventy-five percent (75%) of the owners of property adjoining the said roads, which property represents at least seventy-five percent (75%) of the lineal feet of frontage of the lands abutting the said roads, pursuant to North Carolina General Statute Section 153A-205(c); and WHEREAS the Board of Commissioners of Orange County has elected to finance the local share of the costs of paving the said roads, as permitted by North Carolina General Statutes Section 153A-185(4) and as provided for in North Carolina General Statute Section 153A-205; IT IS HEREBY RESOLVED THAT: 1.. Within thirty (30) days after the notice of confirmation of the assessment role is published, each owner of the property may pay his or her assessment in full. b. Horner: Late in the year of 1981, it became apparent that the University was going to have to take over the mortgage payment for the Phi Sigma Kappa Fraternity house on Mason Farm Road or else risk having the bank foreclose on the mortgage ox the property may be sold for past due taxes. Inasmuch as this fraternity house sits in the middle of property bequeathed to the University by Mary Mason, the University could ill afford to have the property sold either by the bank or the county. It took some weeks for the University to do the paper work necessary to reclaim the, property from the fraternity and get the tax notices in order to pay for the past due taxes. Our requisition to cover the taxes was written on January 5, 1982, the earliest possible time we could do that after having to officially reclaim the building. Because it took some time for the requisition to go through the University processes and the University computer, we did not get the check to the county until February 10, 1982. I have been advised by a member of your office staff that the University needs to pay an additional $234.67 in interest because we did not make our payment by December 31, 1981. This letter is to request your consideration of giving the University relief from having to pay this penalty for not meeting the December 31 deadline. As you are well aware, an institution the size of the University requires a great deal of approvals and processing of forms in order to get a payment made and it was not a question of being negligent in getting the work done but a question of insufficient timing to make the payment by December 31, 1981..
