APRIL 5, 1982 The Orange County Board of Commissioners met in regular session on Monday April 5, 1982, at 10:00 A'M, in the Commissioners' Room, Orange County Court- house, Hillsborough, North Carolina. Commissioners present: Chairman Richard E. Whitted, and Commissioners Norm Gustaveson, Shirley E. Marshall, Norman Walker and Don Willhoit. A. Board Comments: Chairman Whitted said he had an announcement to add to the agenda. B. [here were no members of the audience who wished to cnnment about items on the printed agenda or not on the printed agenda. C. Minutes: Commissioner Willhoit moved, seconded by Commissioner Whitted, to approve the Minutes of January 19, 1982, as submitted. Vote: Ayes, 5; noes, O. Commissioner Marshall moved, seconded by Commissioner Gustaveson, to approve the Minutes of January 25, 1982, as corrected. Vote: Ayes, 5; noes, O. Commissioner Willhoit moved, seconded by Commissioner Walker, to approve the Minutes of February 16, 1982, as corrected. Vote: Ayes, 5; noes, 0' Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to approve the Minutes of the meeting on March 17, 1882 (Work session) as submitted. Vote: Ayes, 5; noes, O. D. Reports: 1. Mr. Ed Holland of Triange J Council of Governments, summarized the major findings of the report entitled HAZARDOUS AND LOW-LEVEL RADIOACTIVE WASTE, REGION J, NORTH CAROLINA produced by the Subcommittee on Hazardous and Low-Level Radioactive Waste at Triangle J COG. Following the summarization of the major findings (cited above), Nr. Holland reviewed the recommendations made by the Subcommittee on Hazardous and Low-Level Radioactive Waste, / U'H5 ` | � It was a consensus of the Board of Commissioners to refer this report and its recommendations to Z0TAC, the Orange County Board of Health and the Orange County Planning Board for their study and recommendations to the Board of Commissioners. Commissioner Gustaveson moved, seconded by Commissioner Marshall, to ask the County Manager and Legal Staff to evaluate the Chatham County moratorium on hazardous wastes disposal sites in that County for its applicability in Orange County, Vote: Ayes, 5; noes, O. 2. Mr. John Gastineau represented the Chapel Hill-Carrboro Chamber of Commerce and is the Chair of the Economic Development Committee of that Chamber. Mr. Gastineau's remarks are copied on pages of this book. The thrust of his comments was that Orange County needs to develop an economic development plan. Additionally, he offered three options for getting an economic development employee into the County. The Board thanked Mr. Gastineau for his report. 3. Sheriff Knight—Jail Inspection Report: Sheriff Knight told the Board of Commissioners that the problems cited by the jail inspection report (dated March 8, 1982) would be corrected when the new facility was completed (that report is on pages of this book). The Board thanked the Sheriff for his report. E. ITEMS FOR BOARD DECISION l. Proclamation: Commissioner Gustaveson moved, seconded by Commissioner Walker, to proclaim the week of April 18'24, Volunteer Week in Orange County and to empower the Chair to sign the Proclamation. Vote: Ayes, 5; noes, 0' 2, Proclamation: Commissioner Walker moved, seconded by Commissioner Gustaveson, to proclaim April 19-24th Clean Up Litter Week in Orange County, and to empower the Chair to sign the Proclamation. Vote: Ayes, 5; noes, O. 3, Governor's Statewide Volunteer Awards: Commissioner Marshall moved, seconded by Commissioner Walker, to have the Clerk contact the service organizations within the County for nominees for these awards for Board consideration. Vote: Ayes, S;noes, O. 4, Appointments: Recreation Council -Commissioner Walker suggested Ms. Elaine Parker may be willing to serve and asked the Clerk to send her a resume, -- . Vote: Ayes, 5; noes, 0' Industrial Facilities and Pollution Control Financing Authority--Commissioner Gustaveson moved, seconded by Commissioner Willhoit, to appoint Mr. Grainger Barrett to the unexpired term of Shannon Julian. Vote: Ayes, 5; noes, O. Capital Health Systems Agency--Commissioner Marshall moved, seconded by Com- missioner Whitted, to appoint Commissioner Gustaveson to the Board Selection Com- mittee. Vote: Ayes, 5; noes, O. The Clerk was asked to advertise for the consumer and provider positions on that Board Selection Committee. 5. Proposed Efland Sewer System: Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to adopt the Project Ordinance utilizing $201,210 in Federal and State Grants for the Efland Sewer System. Vote: Ayes, 5; noes, O. R, Vacant County Positions: Commissioner Gustaveson moved, seconded by Commissioner Marshall , to approve the filling of Public Health Nurse I, Sanitation Supervisor and Custodian, as recommended by the Manager. Vote: Ayes, 5; noes, V. 10. Resolution to sell foreclosed property: Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to adopt the Resolution to sell foreclosed property to the previous owner' (That Resolution is on pages of this book.) Fire District: Commissioner Willhoit moved, seconded by Commissioner Marshall, to approve the attached petition requesting a special Fire District, called Damascus Fire District, and to call for the rgeferendmn to be held with the Primary in June. Vote: Ayes, 5; noes, V- 8. Child Support Enforcement Budget: Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to give tentative approval to the Child Support Enforcement Budget. Vote: Ayes, 5; noes, 0, McBrie, Inc.--(Please see page of this book for the Tax Supervisor's summation) This concerns property purchased in 1981, which the purchaser main- tains that part of the price was for good will Commissioner Walker moved, seconded by Commissioner Whitted, to approve the tax refund for $218.25, because of part of the original purchase price being for "good will and a premium for control ." Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to table the motion by Commissioner Walker until the Tax Supervisor gets a copy of the Bill of Sale from McBrie, Inc. Vote: Ayes, 5; noes. 12. Community Development: a. Resolution Establishing Just Compensation--Commissioner Willhoit moved seconded by Commissioner Gustaveson, to approve the Resolution establishing Just Compensation for $10,450'00' Vote: Ayes, 5; noes, O. b. Housing Rehab Awards: Commissioner Marshall moved, seconded by Commis- sioner Whitted, to award housing rehab contracts to Morrow Construction for $3,600.00 and $12,400.00 for units 138C and 104 and to McDuffie Construction for $1,904.80, $1,800'00 and $2,630.00 for units 116, 73 and 98, respectively. Vote: Ayes, 5; noes, O. The Board of Commissioners recessed for lunch and reconvened at 1:30 P.M. with all members present. Road Matter: Commissioner Whitted reviewed the process which the Town of Chapel Hill had begun several years earlier in regard to needed road improve- ments in that area of the County. Commissioner Whitted noted that with the new University of North Carolina Athletic Center planned for construction that the ' traffic problems would increase and POT had done nothing originally. The Board of .0856 Commissioners is being asked to reaffirm its support for those road improvements. Commissioner Walker moved, seconded and amended by Commissioner Willhoit, to write to DOT expressing Board concern that the projects had been left off DDT's Seven Year Transportation Plan for Orange County and to encourage DDT to attend to this request; increased need for these road improvements are to be stressed for DOT. Vote: Ayes, 5; noes, 0. 14. 911 Relocation: Commissioner Gustaveson moved, seconded by Commissioner Marshall, to approve the selection 'of an engineer, to authorize the Chair to sign the agreement to purchase property and contract for professional services and to approve the budget amendment (see pages , ~—/�� of this book for details). Vote: Ayes, 5; noes, 0' 15- Budget amendments: Commissioner Gustaveson moved, seconded by Commissioner Willhoit, to approve the budget amendments (see page of this book). Vote: Ayes, 5; noes, O. 8. Plaxnioa a) Subdivisions I, Rustic Acres--Mr. Rick Cannity made this presentation to the Board. The Board expressed concern over the sight distance from the property into the highway. Commissioner Willhoit moved, seconded by Commissioner Marshall , to refer this subdivision back to the Planning Board with instructions to check t means of access to the property than that one planned. Vote: Ayes, 4(Commis- sioners, Gustaveson, Marshall , Whitted and Willhoit); noes, 1 (Commfsinner Walker). D. Deerwood—Mr' Cannity made this presentation to the Board. Commissioner Willhoit moved, seconded by Commissioner Gustaveson, to approve the subdivision as recommended by the Planning Board. Vote: Ayes, 5; noes, O. c) Rezoning Requests 1. Cleora Sterling Corporation--This request is for rezoning from Residential-1 to Light Industrial . This site is in the South Orawge Fire District but is covered by Town of Carrboro Fire Department. Commissioner Willhoit moved, seconded by Commissioner Marshall, to approve the request for rezoning from R-1 to L'l, as recommended by the Planning Bnard, Vote: Ayes, 5; noes, O. 2. Dean's Truck and Coach, G-M Electric, Phillips General Repair, Bass Welding, and Auto Catering Service--These requests are for rezoning from Residential-1 to Community Commercial-3. The requested changes in the Land Use Plan (Agenda Item Bb) were considered concurrent with the rezoning requests. Mr. Polatty, Planning Director, made Planning Staff's presentation to the ~_l2 Board of Commissioners, Mr' Polatty said this request for rezoning is the most intensive use. Both Planning Board and Staff recommend denying the rezoning and Land Use Amendment requests because: 1) the intensity of activity allowed; 2} inappropriateness of the requests because there are no urban services; and, 3) the subsequent development would alter the characteristics of the neighborhood. Mr. Polatty added that two of the uses were legal while three of the businesses were illegal and all could be brought into compliance under the Zoning Ordinance. Those in illegal operatiod are Dean's Truck and Coach, Bass Welding and Phillips General Repair. Both Mr. Vann, an attorney, and Mr. Dean, owner/operator of one of the bus- inesses, spoke, asking that they be permitted to remain in business. Mr. Wells, Principal of the Carolina Friends School, said Mr. Dean rendered a valuable service to the school by repairing the school buses, Commissioner Walker moved to approve rezoning for this area to Existing Commercial-3. Motion died for lack of a second. Commissioner Ni1lhnit moved, seconded by Commissioner Gustaveson, to accept the Planning Board recommendation to deny the amendment to the Land Use Plan and not to rezone the entire area. Vote: Ayes, 5; noes, 0. The Board asked the Planning Staff to work with those operations now illegal or with illegal characteristics to bring them into conformance with the Zoning Ordinance. Commissioner Gustaveson said for the record that it is not the Board's intention to put anyone out of business. Commissioner Gustaveson moved, seconded by Commissioner Marshall, to refer Dean's Truck and Coach and Phillips General Repair to the Planning Staff to reach alternatives which would permit them to con- tinue operations while conforming to the Orange County Zoning Ordinance, Vote: Ayes, 5; noes, O. E-7, Dr. Pam Mayer: In her monthly report Dr. Mayer outlined the instructional programs by funding source, 1.e' local, federal or state. She noted, also, the most expensive pro- gram is the "Trainable Mentally Handicapped." The Board thanked Dr. Mayer for her report. B. Planning e) Addition of Roads (Commissioner Willhoit left the meeting at 3:15 P.M.) Commissioner Whitted moved, seconded by Commissioner Marshall , to approve � . ; u the addition of Winterberry Drive and Carmine Court to the State Secondary Road System. Vote: Ayes, 3; noes, 0 (Commissioner Gustaveson was out of the room for this vote; Commissioner Nillhuft, as noted earlier, had left the meeting). d) Water Resources Report Amendments The Board delayed the consideration of a date for a Public Hearing for the amendments to the Zoning Ordinance which would implement the recommendations of the Water Resources Task Force Report until Commissioner Willhoit could be present. Added Announcement Commissioner Whitted announced that two members of the Planning Staff, Mr. Fred Luce and Ms. Susan Smith, had received an Outstanding Planning Award from the North Carolina Chapter of the American Planning Association for their "General Aviation Airport Need and Sites Survey'" The Board congratulated Mr. Luce and Ms. Smith on the recognition by their peers. "itted, Chair Paulette Pridgen-Pond, Clerk t U 8 5 ;-, Below are the remarks that John Gastineau will be giving to the Orange Ar County Commissioners at their regular meeting on 4ave-41 2-2, 1982 at 10:00 a.m. My name is John Gastineau, and I am Chairman of the Economic Development Committee of the Greater Chapel Hill-Carrboro Chamber of Commerce. The goals for this committee during 1982 are as follows: -Develop a strategy for creating, through and with the Chamber, a leadership role and capacity for the purpose of bringing together the local governments to address and deal with: 1. Relationship with the North Carolina Industrial Division. 2. Growth policies. 3. Method of greeting prospects and showing our area. 4. Development of necessary collateral materials. During our fiscal year of 1981, the Chamber attempted to address the problem of economic development in southern Orange County and to get community leaders and government officials thinking about the benefits of controlled, qua.LiLy :vL 'JUL aw.1 uLly pis-y=L wuy i L OUIJU1U LJC handled. We first had a joint meeting of our government officials in April to discuss this important topic. At that meeting, we also had a speaker from the North Carolina Industrial Development Division giving his experience as to how we go about organizing for economic development. UU860 :-) - We reviewed the strong emphasis that the ttate of North Carolina is putting on economic development and also realize that our neighboring counties are very active in their areas and are years ahead of us, The Carrboro Economic Development Committee and the Town of Carrboro have been addressing the problem in their area on a limited basis for about two or three years. Triangle J is also interested in economic development and have started developing maps and to address it on a regional basis to compete with the big urban areas. It is the Chamber's feeling that if Orange County does not develop a program for the proper handling of economic development, that we are either going to be left out entirely, get the leftovers what other areas do not want, and/or will be left in a position of taking whatever comes to us. After this April meeting, it was decided that a planning retreat at • Quail Roost should follow where we would have the opportunity to sit down and discuss the specific type of developments that would be beneficial for our area, how to develop good promotional materials and a marketing strategy plan, and how do we go about identifying available land with possible water, aw.1 Li:otlayuLLaLival cp.011.1.1 LliaL :4= t;uula il.E41.=t. if r.Li prospect or prospects were found. It was also necessary to identify who would take the lead in our particular area. At that meeting, it was agreed that we would promote the Chamber of Commerce as the lead to the North Carolina Commerce Department for our area until a more formal program could be worked out. 00861 - - After this meeting at Quail Roost, we had a joint meeting at the Town of Carrboro in which we gave our reports concerning the above subjects that we had identified as important and also showed a film on office industrial parks which was very good. We sincerely feel that economic development can benefit Orange County as follows: 1. To provide a broader tax base. 2. To be sure that we get the type of development compatible with our area and to discourage the wrong type, 3. To improve the average income levels in our county, 4. To provide better job opportunities for the residents of Orange County. 5. To provide job opportunities for the graduates of our two high schools. 6. To work with and help the local businesses already in our area. We would like to express some different ideas for discussion to you to accomplish 6,= It ist"Chamber's feeling that the proper development for economic improvement is a county wide concern and would best be addressed on a county wide basis. We would like to see the County Commissioners study the pros and cons of the following proposals which can best achieve the above results and to select the program which can be implemented- utia_Gp N_' r t• • I. Orange County could employ a professional economic developer for all of Orange County on a county wide basis. This department would come under the County Manager for Supervision and would have available all of the county departments to them for information and cooperation. We would recommend an advisory committee also be appointed consisting of representatives from each of the local government units in the county, the public school systems in the county, the Chamber of Commerce, and other interested citizens. Through this advisory committee, it could be recommended as to the type of development that is desired in the various sections of the county and local government units and also help in the recruitment of those desirable industries/office complexes. We estimate that this would require an annual expenditure of approximately $35,000 to $40,000 which will certainly be repaid many times by the additional tax base and spendable incomes. II. An alternate to the above would be to establish the same type of division but with the various municipalities contributing financial support. Possibly a separate authority would have to be established to let each of the government units have a vote. There still should be an advisory committee working with them to get tne citizens input. III. We feel the most desirable way would be for the Chamber to set up a separate nonprofit organization under the Community Development Division to be responsible for the economic development in all of Orange County. Funding would require the joint effort from the county government and other local governments as well as selling stock or membership U 8 6 3 r t_t to various interested individuals and/or businesses. The organization would be housed in the Chamber of Commerce building and directed by the Executive Director of the Chamber of Commerce, It is our feeling that this would cost between $60,000 to $65,000 in required funds to provide office space, office equipment, transportation, promotional materials, and entertainment used for prospects as well as the employment of the paid staff which would cost the county the least amount of money of the three plans. A separate Board of Directors consisting of a representative from all of the government units, the Chamber of Commerce, and interested subscribers would be established. We know Durham County provides funds direct to the Chamber of CoMmei-ce for this purpose, IV. If none of the above proposals are feasible, the only other alternative would be for the Chamber through volunteers to attempt to do the required job. This committee probably would principally be interested in the development of southern Orange County, It would also require the cooperation of the local governments to be successful. This is an extremely important subject and whatever version of economic development strategy is decided upon, it must be implemented early in the 1982,1983 year, Thank you for your time this morning. February 25, 1982 Orange County Commissioners Hillsborough, N.C. Dear Commissioners: In November of 1980, McBri Inc. purchased the business known as "The Colonial Inn" from Mr. V.V. (Pete) Thompson for a price of $75000. The purchase price gave McBri Inc. complete control of the existing business, the right to use the name and reputation of "The Colonial Inn" and ownership' of the equipment and furnishings. Mr. Thompson retained ownership of the building and real estate which were leased to McBri Inc. under a separate agreement. We incorrectly listed the entire $75000 as the value of the business property for our 1981 taxes. That listing resulted in a tax liability of $693.53 which has been paid by McBri Inc. The equipment and furnishings while still serviceable had in fact been used by Mr. Thompson for a number of years and in our opinion the real value of that equipment itself is considerably less than $75000. We considered that at least $25000 of the purchase price was for the control of the existing business and the use of the name "The Colonial Inn" and therefore a more realistic and fair value for the equipment and furnishings would be $50,000. NEED: For several months, search has been underway to identify a suitable site and structure which could take the place of the Old Chapel Hill Police Department Building. Considerations applied to each site included: 1) degree of permanency; 2) security, 3) access to wire center offices for telephone linkage and to antennas for improved County-wide radio transmission, 4) overall cost (i .e. in terms of leased lines, moving, and rental versus renovation versus new construction), 5) location in relation to major thoroughfares and parking, 6) expansion potential. The solution had to be one in keeping with long range needs--recognizing that continued growth will mean an increasing call and dispatch frequency. Consideration as applied to structure went the additional step of com- paring the cost of implementing federal guidelines for fallout yroteotion. It is now possible to propose a course of action that would consist of purchasing a parcel of land for central location between Hillsborough and Chapel Hill and erecting a minimal structure to house equipment and personnel. Plans and specifications must yet be developed and a sale consummated on the land. A decision at this point would enable these actions to be taken and construction started. IMPACT: Cost between now and the end of the fiscal year is estimated at $35,000' There will be an offset to costs in the form of reduced leased telephone lines. The site proposed is on the boundary of the two major telephone districts (Central Telephone and Southern Bell) serving northern and southern parts of the County. With direct line to both, it will be possible to eliminate the cost of the intermediate linkage between the two which is now provided by General Telephone in Durham. Such linkage now costs $330 per month or $6,600 per year. RECOMMENDATION: 1. Authorize Chairman to sign agreement to purchase the property, 2. Select engineer/architect to develop plans and specifications (list of experienced firms is attached) and authorize Chairman to sign the professional services agreement. 3. The Planning Board reviewed-this request at their March 15, 1982 meeting and were concerned about two related items. The possible future hook up to water and sewer lines when they are extneded to this area, and the problem with fire protection since there were no fire hydrants in this area. Although these two concerns were seen as something Cleora Sterling should address in the future, the Planning Board agreed that there would be minimal impact from this rezoning. IMPACT: Approval of this request would allow Cleora Sterling to locate part of their proposed addition in Orange County's jurisdiction. Denial would require then to build in Carrboro's jurisdiction. RECOMVENDATICN: The Planning Board recommends approval ialth stated concern for fire protection. NEED: This was discussed at the Public Hearing on March 8, 1982, attachments are with that agenda. The following is a brief summary of the points brought out in the Planning Board's discussion of this request at their meeting on March 15, 1982: 1. Concern about 5 requesting rezoning since 3 could now be classified as have occupations or non-conforming uses. 2. Rezoning to CC-3 zone, if one or two existing business are moved or closed up a number of different commercial uses could move in. 3. Concern about changing criteria for EC-5 district and possibly creating small zoning lots around existing commercial buildings. 4. Concern about helping illegal uses conform to home occupation requirements in the ZdniRg Ordinance. IMPACT: This area is designated as Rural-Residential in the Land Use Plan. The applicants have requested a change in the Land Use Plan and rezoning to Camnunity Oxmlercial- 3. This is the second most intensive commercial district. Development with intensity allowed in the CC-3 zone could alter the Character of the neighborhood if the 5 rezonings are approved. PECCKENDATION: The Planning Board recommended that illegal uses cease or change to conform to the requirements of Article 11 Non-Conforming Uses or Home Occupations under Section 6.16.6 and that zoning in that area stay as presently designated. The Planning Staff recommends denial of this request. The scale and intensity of development allowed by the request would be inappropriate for this location. There are no urban services available to this area, and the existing commercial uses do not serve a large portion of County residents. Staff feels the request for Community Cormiercial-3 is inappropriate under the existing conditions. The commercial activities in the immediate area include three illegal uses, three non-conforming uses, and two home occupations. The Planning Staff recognizes alternatives to denial. ALTERNATIVE 1: Change the Land Use Plan to create a Rural Neighborhood Node at Murphy School, amend the Permitted Use Table to allow motor vehicle repair and maintenance in the Neighborhood Commercial-2 zoning district, and rezone the existing commercial uses to the NC-2 district. This district would allow much less intense development levels. ALTERNATIVE 2: Change the application criteria of the Existing Commercial-5 district, from application in unzoned townships to all townships, and rezone the properties to the EC-5 district.
