6. The Orange County Board of Commissioners met in special
7' joint session with the Orange County Board of Education on Friday,
8. January 22, 1982, at 12:00 P.M. (Noon) in the Board of Education
9' Meeting Room, 200 East King Street, Hillsborough, North Carolina.
10. The purpose of the meeting was to discuss the Efland Elementary
11. School property.

Commissioners present: Chairman Richard E. Whitted (who
13.
arrived at 12:15 P.M.) , and Commissioners Norman Gustaveson,
14. Shirley E. Marshall, Norman Walker and Don Willhoit.

Board of Education Members present: Chairman Oscar Compton,
16.
and members Lindsay Efland, Walter Faribault, Jr. (who arrived

at 12:15 P.M.) , James Rae Freeland, Norman Haithcock, Max
18.
Kennedy and John Thomas Walker.

Chairman Compton called the meeting to order and said there
20.
would be an executive session on other matters following this
21.
meeting for the Board of Education members.

Vice-chairman Gustaveson told the Board of Education member'•
23.
that the Board of Commissioners had some concerns about the Efl:.r.J
24.
School property. Commissioner Gustaveson asked if the Board of
25.
Education could build in assurance of accessibility for the public
26.
to the property and if there could be a reversion clause in the
27.
sales contract which said if the property was no longer used for
28.
recreation purposes the County or Board of Education would first
29.
have opportunity to buy it.

Chairman Compton said the Board oflEducation had discussed
31. stipulations on the sales contract at the October 5, 1981, meeting
32.
and had felt that would be too restrictive; now, the Board of
33. Education thought that it was too late to place restrictions on

the sale.
35. The Board of Education Attorney, Mr. Rogers, said such
36. stipulations should have been part of the notice of sale and ;
37. could not be unilaterally imposed on the sale at this time.

4. Commissioner Gustaveson noted that the stated goal of the
5• Efland Ruritan Club (the other bidder for the property) was public
6. recreation and if both parties were agreeable to restrictions
7. such restrictions would not be unilaterally imposed.
8. Commissioner Willhoit said there was some disagreement over
9. the real value of the property; that if the property sold for
10. closer to its appraised value ($45,000 for land and $45,000 for
11. buildings) then restrictions would not be proper.
12. Chairman Compton said the Board of Education had never
13. received a request for that property from the Board of Commis-
140 sioners until after the property was placed up for bid. Com-
15. missioner Gustaveson disagreed saying that further public use
16. of that property had been part of the planning sessions with the
i7. Board of Education for several years.
18. The Board of Education reiterated its opinion that it was
19. too late to place restrictions on the sale of the property.
^G• Commissioner Willhoit restated the Board of Commissioners'
�• feeling that the high bid for the property ($45,100 at this
22. time) was :Low but would be acceptable to the Board of Commis-
23. sioners if subject to certain assurances regarding public
24. - accessibility and a reversion clause as explained by Commissioner
25. Gustaveson. Commissioner Willhoit said this was a question of
26. public trust for public property and that stipulations on the
27. sale would document that trust for the public. Mr. Efland said
28. the Board of Education was an "elected body" and would "exercise"
29. its "responsibility" at the "point of sale."

30. Mr. Faribault, Jr. , said he had concerns about the use of
31. the property; he felt it should be used by all members of the
12. community and should benefit all the community.
3• Mr. Haithcock moved to adjourn the joint meeting with the
34• Board of Commissioners; Mr. John Thomas Walker seconded that
35• motion. Vote: Ayes, 12; noes, 0.
