PURPOSE: To consider the legal advertisement for items to be presented at the Board of
County Commissioners/Planning Board Quarterly Public Hearing scheduled for May 21, 2007.
BACKGROUND: The Board of County Commissioners reviews proposals to be considered at
public hearing for consistency with general County policy and presentation format. The following
items are proposed for consideration at the May 21, 2007 Quarterly Public Hearing.
A. PUBLIC HEARING ITEMS
1. US 70/Cornelius Street Corridor Strategic Plan: A task force of Orange County
economic development and community leaders, Orange County and Hillsborough Town
Board Commissioners, and business owners and residents have worked for the past year
to develop a strategic plan for the section of Cornelius Street between North Churton
Street (NC 86) and Holiday Park Road/Lakeshore Drive. The Task Force was charged
with exploring ways to enhance and improve the character of the corridor focusing on
land uses, transportation, crime and code enforcement, and site plan and design issues.
The corridor is in Hillsborough's planning jurisdiction, but implementation of plan
recommendations will require the cooperation of both local governments. Additionally,
the corridor is part of the larger area being addressed in the jointly funded Hil/sborough-
Orange County Strategic Growth Plan.
Note: The Hillsborough Town Board of Commissioners will join the County
Commissioners and Planning Board for presentation of this item.
2. NC Highway 57 Speedway Area Small Area Plan: A 12-member task force of residential
and commercial property owners, at-large county residents, Durham and Person County
representatives, and two Orange County Commissioners have spent the past 10 months

addressing planning issues fora 900+ acre area in the northeast corner of Orange County.
A key issue addressed by the Task Force has been non-conforming, non-residential land
uses and the effect on existing and future land use in the area. Additional issues included
traffic and access management, water quality and quantity, noise and noxious odors, and
an appropriate level of residential and non-residential development. Traditional rezoning
and special use- permit processes were not felt to afford the community sufficient protection
and assurances of maintaining a rural life style and character. The Task Force is
suggesting that a Rural Economic Development Area (REDA) be created to facilitate a
process to bring non-conforming activities into compliance.
3. Land Use Element Text Amendments: Text Amendments to Section 3.3 entitled "Land
Use Plan Categories" to amend the definition of the "10-Year Transition" category and to
Section 4.0 entitled "Implementation and Evaluation" to amend the "Land Use Element -
Zoning District Matrix" to potentially allow non-residential uses in designated 10-Year
Transition areas in accordance with adopted small area plans and/or zoning overlay
districts as being considered in the Efland-Mebane Small Area Plan Implementation
Focus Group.
4. Sedimentation and Erosion Control Ordinance: The NC Department of Environment
and Natural Resources (DENR) Land Quality Section has completed a technical audit of
the County's Erosion Control program and suggested 15 amendments/changes designed
to strengthen the County's Ordinance and enhance compliance with the State's 2006
Model Ordinance.
5. Orange County Stormwater Ordinance for Lands within the Neuse River Basin:
Text amendments to the Orange County Stormwater Ordinance for Lands within the
Neuse River Basin to reflect changes in the Nitrogen Reduction Offset payment
calculation. The proposed amendment will replace the specific calculation method with a
statement that the offset payment will be calculated based on the current State of North
Carolina requirements.
6. Orange County Zoning Ordinance: Text amendments to Article 4.3 Permitted Use
Table and Article 6.29 Development Standards for Economic Development (ED) Districts
to add performance criteria for retail establishments including and amended review and
approval process and categorization of low-intensity non-residential use.
B. NON-PUBLIC HEARING ITEMS
1. Agricultural Support Enterprises: Planning and Economic Development staff will
provide an update on the proposal to create a new conditional district rezoning process
for agriculturally related businesses. Unlike general rezoning, property subject to the
conditional district rezoning process may be used only for a specific land use(s) based on
asite-specific development plan. The Board of Commissioners~will be asked to endorse
three key concepts: 1) amend the Land Use Element of the Comprehensive Plan and
Zoning Ordinance to allow conditional district zoning; 2) prepare clear performance
standards; and 3) create the Agricultural Support Enterprises Manual.
Note: The conditional district rezoning process could be used countywide and not
just for the Agricultural Support Enterprises proposal.
FINANCIAL IMPACT: Other than advertising costs which are included in the FY 2006-07
Budget, there are no direct financial impacts associated with the approval of this item.
RECOMMENDATION(S): The Administration recommends APPROVAL of the proposed May
21, 2007 Quarterly Public Hearing legal. advertisement.

HILLSBOROUGH TOWN BOARD OF COMMISSIONERS (Item A.1)
ORANGE COUNTY PLANNING BOARD
A joint public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Monday, May 21, 2007, at 7:30 PM for the purpose of giving all interested citizens an
opportunity to speak for or against the following items:

endorsement of three key concepts: 1) amend the Land Use Element of the

2) prepare clear performance standards; and 3) create the Agricultural Support
Enterprises Manual.
Changes may be made in the advertised proposals that reflect debate, objections
and discussion at the hearing.

request is made to the Director of Planning at least 48 hours prior to the Public
Hearing by calling the appropriate number listed below. The full text of the
changes may be obtained after May 16, 2007 from the Planning Department. Also,
the text may be obtained at the County website www.co.orange.nc.us at the
