HomeMy WebLinkAbout2016-661 BOCC - Dispute Settlement Center - MOA for assistance with Firearms Committee March 3, 2016 Memorandum of Agreement between Orange County,North Carolina and the Dispute Settlement Center (DSC) 1. DSC will provide facilitation services to the Orange County Board of Commissioners in support of the Orange County Firearms Safety Committee. 2. In particular, DSC will: (a) Review background information and consult in advance of the first Committee meeting with interested members of the Board,the eight appointed Committee members, and the six designated Committee resource persons, in order to become familiar with the relevant positions, interests, expectations, and needs of the Board and Committee participants, and to answer questions or identify and resolve concerns regarding the facilitator's role in this process. (b)Draft a set of Committee protocols to be considered by the Committee and facilitate discussions that will lead to Committee adoption of a helpful set of protocols to guide the overall Committee process. (c)Prepare for and follow-up to each meeting as needed in order to support the Committee in setting an agreed upon meeting,timeframe and location,meeting purposes, an agenda consistent with the meeting purposes specifying topics,timeframes, and methods/formats; and in having meeting notes documenting.key Committee discussion points, decisions, and recommendations. (d)Provide procedural leadership at each Committee meeting so that at each meeting the participants are focused on a shared set of purposes and topics,participants_are able to follow a clear and agreed upon process, conversation is open to and balanced among all Committee members and designated resource persons, the roles of the meeting participants are clearly defined and agreed upon by Committee members, and Committee members' feelings and ideas are taken into consideration. 3. Andrew M. Sachs, Coordinator of DSC's Public Disputes Program, will serve as lead facilitator and DSO's point of contact to the County for this project. Donna Baker, Clerk to the Board of County Commissioners, will be the County's point of contact to DSC for the contractual aspects of this project. 4. The County will provide or reimburse DSC for all materials and logistics necessary for this project, including but not limited to open meeting notifications, adequate meeting facilities, audio-visual equipment,photocopying, flip chart easels and pads, markers, tape, and meeting refreshments and meals. The County will reimburse DSC for automobile mileage for travel necessary to the project at the IRS rate in effect at the time of travel, which is currently $ .54 per mile. S. In consideration for DSC's services described herein, the County will pay DSC $125/hour for all time provided by DSC to this project, including but not limited to time in travel, preparation, planning, consultations, set up, follow-up, meetings, process evaluation, and contract management. 6. The County will pay DSO's invoices within 30 days of receipt. Checks will be made payable to the order of the Dispute Settlement Center and mailed or delivered to DSC, 302 Weaver Street, Carrboro, NC 27510. DSC federal tax identification number is F56- 1216584. 7. If one or more disputes related to this contract emerge between DSC and the County, then all relevant parties will seek resolution of the dispute by face-to-face problem-solving, facilitated by a mutually agreeable third party if necessary, before taking the grievance for resolution to any outside authority.
