Revised Location Map. The attached map has been revised to show the location of the Cates Creek drainage basin, the Rural Buffer border, and area roads. Hillsborough Annexation Option.One topic of discussion at the 1sst Work Group meeting was whether Hillsborough could annex within the EDD area. The answer is yes. Further research into Hillsborough's action on withdrawal from the Cooperative Planning Agreement indicates that the Town adopted a resolution on May 9, 1994 withdrawing from the Agreement, notified the County of its action on May 12, 1994 (date of notice receipt), and established an effective date of June 29, 1994, at least 30 days following the required written notice. All of Hillsborough's actions have been in accord with the provisions of the Cooperative Planning Agreement. The implication of Hillsborough's action is that, upon receipt of an annexation petition from one or more property owners within the EDD, it may exercise its statutory authority to annex the property. Given Hillsborough's withdrawal from the Cooperative Planning Agreement, this topic is among those to be discussed at the joint meeting of the Orange County and Hillsborough Board of Commissioners on Thursday, November 3. Water/Sewer Extension Option. One option for extension of public water and sewer is as follows: Limit public water and sewer service to the north side of I-40, delaying extensions to the area south of I-40 until as-yet unspecified thresholds are met. One model for these"thresholds" or"triggers"is found in the Joint Planning Area Land Use Plan. That Plan designates Transition I and II areas, and indicates that Transition Area I may be developed at densities (1-5 units per acre) and uses identified in the underlying land use plan categories. Within Transition Area II, however, no tract may be approved for development at a density that exceeds one (1) housing unit per gross acre until at least seventy-five (75%) of the gross land area in Transition Area I has developed. "Developed" is defined as consisting of any combination of the following: 1. Lots containing one acre or less; 2. Residential developments approved for development at a density of at least one units per acre; 3. Streets, roads, and utility easements located outside of lots containing one acre or less; 4. Lots or tracts that are used for commercial, industrial, institutional or governmental purposes; and/or 5. Tracts that are owned by the University of North Carolina or other non-profit entities and that are not available for development. These provisions are incorporated into both the Joint Planning Area Land Use Plan and Joint Planning Agreement. If the Joint Planning"model"were used in the I-40/O1d N.C. 86 EDD, the above mentioned option might be reworded to read as follows: Limit public water and sewer service to the north side of 1-40, delaying extensions to the area south of 1-40 until at least seventy-five (75%) of the gross land area on the north side of 1-40 consists of any combination of the following: 1. Residential developments in Secondary I areas developed or approved for development at a density of at one unit per acre or less; 2. Streets, roads, and utility easements located outside of lot boundaries; and/or 3. Lots or tracts used and/or approved for permitted commercial, industrial, institutional or governmental purposes. If this option were selected by the Board of Commissioners following the November 30 public hearing, the Economic Development Districts Design Manual (Article 6.20.4 of the Zoning Ordinance) can be revised to reflect this limitation in the I-40/Old N.C. 86 EDD. Terminology. The report of the I-40/Old N.C. 86 Work Group contains a recommendation concerning the designation of a "Secondary II" development area The Secondary II designation distinguishes the area north of I-40 (Primary Development Area) from that south of I-40 by limiting eliminating retail uses and providing for higher Site Volume Ratios (landscape-to-building ratios). An important point to note is that the original "Secondary" designation has been retained to provide a step-down between more intensive uses and adjoining residential areas. The terminology; e.g., Primary, Secondary I, and Secondary II, reflects the general terminology used in the Work Group discussions. If the Board of Commissioners wishes to change the terms to Primary I (area north of I-40), Primary II (area south of I-40), and Secondary (step-down to adjoining residential), that is certainly an option. , - C..) ›^.
