BACKGROUND: The property is located at the northwest corner of Coleman Loop Road (SR 1332) and NC 86 where Coleman Loop joins NC 86 at it southwest intersection. Adjacent land uses include undeveloped agricultural and residential land. There is one undeveloped PD-I1 zone at the southwest corner of the intersection. A portion of the 21-acre tract (3 .948) acres is zoned Light Industrial (I-1) and contains the existing building. The remaining property is zoned Agricultural Residential (AR) . The applicant proposes to rezone the remaining 17.052 acres from AR to I-1. The applicant plans to expand to the north of the existing building and parking area. The holding tank and drain field for the existing septic system are located outside the existing I-1 zone. This proposal would allow the septic system to be included in the I-1 zone. The property is in open field east of the existing Industrial building and small tree growth west of the building with electrical lines running along the northern boundary of the property. 2 The property has direct frontage on NC 86 and Coleman Loop Road. Access to the existing building is from Coleman Loop Road. Coleman Loop is designated as a collector in the comprehensive Plan and NC 86 is designated as an arterial. In 1993 , the estimated daily traffic count on NC 86 was 8900. A traffic count for Coleman Loop Road was not available. The Land Use Element of the Comprehensive Plan has this property designated as Agricultural Residential and Rural Industrial Activity Node. The node has a 2640 foot radius from the intersection of Coleman Loop and NC 86. Public Hearing Comments: There were no citizen comments at the public hearing. Commissioner Gordon requested information about the amount of acreage included in the Rural Industrial Activity Node at this intersection. This node includes 502 . 6 acres. On September 19, the Planning Board considered the proposed rezoning and made positive findings on the ordinance requirements from Articles 4 and 20 (See attachment) . The Planning Board unanimously recommended approval. PROPOSED ZONING ATLAS AMENDMENT GENERAL INFORMATION Applicant: Major Business Forms Inc. P. 0. A 400 x 430 foot I-1 zone covers the existing building. The intent of the Light Industrial (I-1) District is provided in Article 4 . 2 . 21 of the Zoning Ordinance. a) Intent The intent of the Light Industrial-I (I-1) District is to provide appropriately located and sized sites for limited industrial uses engaged in manufacturing, processing, creating and assembling of goods, merchandise or equipment. Performance standards will be used to insure the absence of adverse impacts beyond the immediate space occupied by the building. b) Application Criteria This district will usually be applied where the following conditions exist: 1. Site is located within areas designated in the adopted Comprehensive Plan as either an Industrial Transition Activity Node or a Rural Industrial Activity Node. 2 . Also, when the Board of Commissioners approved the Ecancmic Development 3 Districts proposals, the issue of the approval for each proposal was discussed. 4 The proposals for how to approve the Special Use Permits, Site Plans, Subdivision, 5 and Planned Development were presented. 6 7 QUESTIONS AND/OR COMMENTS FROM THE BOARD OF COMMISSIONERS AND PLANNING BOARD. 8 9 Commissioner Gordon stated that her understanding was that these proposals 10 were not intended to remove oversight of large projects from the Board of 11 Commissioners. She felt it was important for elected officials to have that 12 oversight. 13 14 OUESZTIONS AND/OR COMMENTS FROM CITIZENS 15 16 Bill Clayton, an Orange County citizen, stated that he was in favor of zing.ing. However, he request that this area remaining in residential zoning. • 18 19 R.L. Clayton, an Orange County resident, spoke in apposition to this 20 rezoning. She requested that it remain residential and all that future landowners 21 be alerted to the fact that it will remain residential. She feels that rezoning 22 this land will devalue her investment. 23 24 Frankie Baker, an Orange County resident and mobile have park owner, 25 requested that his entire property be zoned either residential or commercial. He 26 telt that it would place a financial burden on,him to have part of it zoned 27 commercial and .the remainder rder zoned residential. 28 29 Chair Waddell suggested that Mr. Baker meet with Mr. Collins to clarify his 30 concerns and to submit futther caments in writing. 31 32 R.L. Clayton requested clarification an the 100 foot buffer and the 30' 33 D.O.T. buffer. Mr. Collin-c indicated that if the property owner would suffer a 34 hardship with the 100' foot buffer they have the right to use the Planned 35 Development Process as long as the intent of this district is not abandoned. 36 37 Commissioner Willhoit indicated that the most significant effect an the land 38 occurs at the time of the zoning and during the subdivision dpprdval process and 39 in what the ordinance contains in terms of permitted uses. The individual 40 specific development proposals should be directed by the design manual and the 41 design standards. It should not make any difference if staff or the Board of 42 Commissioners are interpreting it. The autocue should be the same. When 500 43 acres is developed, either by a series of small steps or by a large step, the 44 outcome would then be as prescribed. The developers have stated that the length 45 of time necessary for the process is an important factor in the cost of the 46 process. Adjacent land uses include undeveloped agricultural 6 and residential land. There. is one undeveloped 7 PD-II zone at the southwest corner of the intersection. A portion of the 21-acre 8 tract is zoned Light Industrial (L-1). The remaining property is zoned 9 Agricultural Residential (AR). Effective January 1, 1994, the North caroIina 32 General Statutes (B.S. 153A-342) allow for certain rezoning actions to be 33 advertised through enhanced newspaper advertisement instead of notification by 34 mail to all affected property owners. He reviewed the summary of the proposals, also on the attached agenda abstract - Special Use Permit, Site Plan Approval, Subdivision Approval, and Planned Development Approval. MOTION: Walters moved acceptance of the Planning Staff's recommendation. Seconded by Burklin. Waddell stated that he felt only the properties on the east should be approved for expansion. VOTE: 7 in favor. 2 opposed (Brown - felt that the Special Use Permit process which requires a public hearing and allows for citizen input is very important. Waddell-noted again that he was in favor of only expanding the district to include the lots on the east portion and not the connection on the west. ) b. Other Zoning Atlas Amendments ( 1) Z-5-94 Major Business Forms Presentation by Eddie Kirk. The property is located at the northwest corner of Coleman Loop Road (SR 1332) and NC 86 where Coleman Loop joins NC 86 at its southwest intersection. Adjacent land uses include undeveloped agricultural and residential land. There is one undeveloped PD-Il zone at the southwest corner of the intersection. A portion of the 21-acre tract (3.948 acres) is zoned Light Industrial (I-1) . The remaining property is zoned Agricultural Residential (AR) . The applicant proposes to rezone the remaining 17.052 acres from AR to I-1. The applicant plans to expand to the north of the existing building and parking area. The holding tank and drain field for the existing septic system are located outside the existing I-1 zone. This proposal would allow the septic system to be included in the I-1 zone. The property is in open field east of the existing industrial building and small tree growth west of the building with electrical lines running along the northern boundary of the property. The property has direct frontage on NC 86 and Coleman Loop Road. Access to the existing 19 building is from Coleman Loop Road. Coleman Loop is designated as a collector in the Comprehensive Plan and NC 86 is designated as an arterial. In 1993, the estimated daily traffic count on NC 86 was 8900 . A traffic count for Coleman Loop Road was not available. The Land Use Element of the Comprehensive Plan has this property designated as Agricultural Residential and Rural Industrial Activity Node. The node has a 2640 foot radius from the intersection of Coleman Loop and NC 86 . There were no citizen comments at the public hearing. Commissioner Gordon requested information about the amount of acreage included in the Rural Industrial Activity Node at this intersection. This node includes 502. 6 acres. The Planning Staff recommends approval of the rezoning request. MOTION: Boland moved affirmative on all findings of fact and approval of the Planning Staff's recommendation. Seconded by Walters. The proposed amendment specifies situations in which notification by mail of individual property owners is not required. Rezonings which meet one or more of these criteria may be advertised in a local newspaper for four consecutive weeks. The advertisement would include a map of the proposed rezoning. The minimum size of the advertisement would be 1/2 of a newspaper page.
