Minutes
PURPOSE: To consider a request by Kenneth D. Southard and Faye M.
Southard for a reduction in right-of-way width from 50
feet to 30 feet.
BACKGROUND: The Southards wish to create a 1. 382 acre lot out of a
13 . 08 acre tract. The property is located north of U. S.
Highway 70. An existing private road approximately 490
feet in length (200 feet with a 30 foot right-of-way and
290 with a 50 foot right-of-way) will provide access to
the property. The required road classification is Class C
because the access will serve a total of three lots.
A partial width right-of-way was approved (for this
private road) by the Board of Commissioners on November 1,
1988 . The private road provided access to Lot 2 (recorded
at PB 51 Pg 86) and the remaining acreage (Lot 1 and the
newly proposed Lot 3) . The circumstances which warranted
a partial width right-of-way for the initial proposal
continue to exist. The Doby lot (referenced as Will Book
87-E-200) is nonconforming in size for the zoning
district and the existing dwelling on the Doby lot does
not allow for the additional 20 feet required for the
right-of-way without interfering with the required
minimum building setback. In addition, the property owner
(James A. Wynn) west of Glisson Drive is unwilling to
grant or sell the needed area for the full required right-
of-way width.

The Planning Board considered the request on September 19,
1994 and recommended approval. The vote was unanimous.
RECOMMENDATION: The Administration recommends approval of a partial
width right-of-way of 30 feet (approximately 200 feet
in length) for the existing private road.

PARTIAL WIDTH RIGHT-OF-WAY CHECKLIST
(Adopted from the Orange County Subdivision Regulations Section IV-B-3-c-2)
(a) In the judgement of the Planning Board and with the approval of the
Board of County Commissioners, it is found that the nature and
location of the subdivision, including such considerations as
topography, the surrounding area, the present and future road plans,
and access by public safety vehicles, are such that a partial width
right-of-way is justified; and,
- The topography slopes southwest to northeast with a minimum slope
of 4% .
•
- The surrounding area is single family residences, Hinshaw's
Cabinet Shop and Mace Heavy Equipment.
- The private road is intended to serve three lots and is
approximately 490 feet in length.
- The right-of-way width is adequate for access by public safety
vehicles.
(b) The access serving the subdivision is classified as either a Class B
or Class C road according to the Orange County Private Road Standards;
and,
- The private road is classified as a Class C road.
(c) The right-of-way width provided is adequate to allow for the
construction of a travelway, ditches, shoulders and turn-around
required for the Class of road serving the subdivision; and,
The required improvements for a Class C road is 8 foot travelway
plus approximately 4 foot shoulders and/or ditches as needed. A
30 foot right-of-way will accommodate the requirements. The
existing road has been in use for over 5 years.
(d) The right-of-way width provided would allow access by the largest
emergency services vehicles serving the district in which the
subdivision is located; and,
- A 30 foot right-of-way would allow access by the largest
emergency service vehicles. Roads are seldom constructed the
width of the entire right-of-way. This road has been in
existence for over 5 years.

(e) If one or more of the following conditions are met:
(1) When the partial width right-of-way adjoins undeveloped property
and is not less than 25 feet in width, and when said adjoining
undeveloped property is subdivided and the remainder of the full
required right-of-way can be dedicated.
(2) When access to the subdivision is across property owned by other
than the applicant and the property owner is unwilling to grant,
sell or otherwise convey the full required right-of-way width to
the applicant.
(3) When pre-existing conditions preclude the provision of full
right-of-way due to the pattern of adjacent development,
historical common access and/or site-specific physical
constraints.
- The provision of a full right-of-way to the west is not available
due to unwillingness of the property owner to grant or sell an
easement.
- Pre-existing conditions to the east preclude the provision of
full right-of-way due to an existing structure which does not
allow for the granting of additional area without interfering
with the required minimum building setback. The lot is also
nonconforming in size for the zoning district.

Request for partial width right-of-way on Glisson Drive,
a pre-existing private right-of-way
To Whom It May Concern:
Pursuant to the Orange County Sub-Division regulations section
IV-B-3-c-2, we are requesting a partial width right-of-way for
the above mentioned Glisson Drive. -
Glisson Drive is a Class C road according to the Orange County
Private Road Standards serving 3 lots in the sub-division. The
right-of-way width provided does allow access by the largest
emergency vehicles serving the district .
The existing dwelling on the Doby lot (Will Book 87-E-200)
does not allow the additional 20 feet reqired for the right-
of-way without interfering with the existing building set backs.
As per the attached letter from James Wynn, he is not at this
time in a position to sell the additional right-of-way width
needed.
In conclusion we feel that the partial width right-of-way is
justified in this case.

The Planning Staff recommends approval of a
partial width right-of-way of 30 feet
(approximately 200 feet in length) for the
existing private road.
Waddell asked about further subdivision of the
larger lot. Garrett responded that is unknown
at this time.
Burklin asked about the size of the Doby lot.
Garrett responded . 92 acre (40,000 sq. ft. ) .
Garrett later clarified that the Doby lot is
nonconforming in size because it is approximately
30,000 sq. ft. ( .68 acre) whereas the minimum lot

size for the zoning district is .92 acre (40,000
sq. ft. ) .
MOTION: Barrows moved approval. Seconded by Boland.
VOTE: Unanimous.
