BACKGROUND: In July of this year, NCDOT installed "No Parking" signs along the shoulders of sections of Whitfield Road adjacent to the Korestan section of Duke Forest. The roadway shoulders in this area have been traditionally used for parking by visitors, hikers, etc. , accessing several trails through this section of the forest. DOT's decision to prohibit parking has inconvenienced and irritated a number of individuals who had used the parking when visiting Duke Forest. Some of these individuals became involved in an effort to convince DOT to allow the on-shoulder parking to continue. In response to their efforts, DOT has decided to allow continued on-shoulder parking on the side of Whitfield Road adjacent to the forest and to prohibit parking along the opposite shoulder. RECOMMENDATION: The Manager recommends that the Board receive the report as information. 2 MEMORANDUM TO: County Commissioners John Link, County Manager CIC------- FROM: Paul Thames, County Enginee DATE: September 1, 1994 SUBJECT: On-shoulder parking along Whitfield Road to access Duke Forest trails. As per the request of Commissioner Wilhoit, the following information concerning NCDOT' s prohibition of parking along Whitfield Road adjacent to Duke Forest is provided. Mike Vinable, the assistant district engineer for the NCDOT district which includes Orange County, reports that the subject of the Duke Forest visitor parking on Whitfield Road was first brought to the attention of NCDOT by a resident of the Whitfield Road area. This individual apparently reported safety concerns related to the proximity of relatively high speed traffic on Whitfield Road to vehicles in the process of parking just off of the pavement and to individuals getting into and out of parked vehicles. District DOT personnel from the Graham office inspected the area where the parking was occurring and concurred that the parking along the shoulder of Whitfield Road was undesirable. NCDOT staff noted that the parking represented a traffic safety hazard and was also damaging the edge of pavement and the roadway shoulder. In accordance with these findings, NCDOT crews soon erected "No Parking" signs along both sides of Whitfield Road in the areas where on-shoulder parking was occurring. Newspaper reports have indicated that a number of visitors to the section of Duke Forest accessible from Whitfield Road were upset with NCDOT' s decision to prohibit parking. Newspaper articles, quoting one individual who has apparently been a frequent and long time visitor to the area used for parking, have indicated that there have been no accidents which have resulted from the parking along Whitfield Road (see attached news article) . A number of individuals who frequent this section of Duke Forest have apparently become involved in a letter writing and telephone campaign to convince NCDOT to allow the parking. 3 NCDOT, in an attempt to devise a satisfactory replacement for the prohibited parking, met with officials of Duke University to discuss the possibility of developing a parking area in the vicinity. In a letter to NCDOT (see attachment) , Duke' s forest resource manager indicated that Duke University is already concerned about overuse of this section of Duke Forest by the general public. On behalf of Duke University, he declined to participate in any action that would provide enhanced parking or that might encourage additional public use of Duke Forest. The question of the shoulder parking along Whitfield Road may already have been resolved to the satisfaction of Duke Forest visitors. News reports from the August 26 edition of News and Observer indicate that NCDOT is already in the process of removing the "No Parking" signs along Whitfield Road (see attached article) . District Engineer Tommy Dyer has indicated that state DOT officials directed that he remove the "No Parking" signs along the Duke Forest side of Whitfield Road. The signs along the opposite side are to remain. Mr. Dyer has also indicated that DOT will continue providing the current level of maintenance along this section of Whitfield Road. DOT will not improve the on-shoulder parking areas by providing signage or by placing gravel on the shoulder. If I may provide additional information, please advise. The Duke Forest has been owned and managed by Duke University as an outdoor teaching and research laboratory since 1931, During this period the public has not been restricted from entering these lands so long as certain guidelines are closely followed and the public use does not interfere with the Forest's academic mission. Except for certain designated picnic sites, available by reservation,the University has not constructed or maintained any facilities for public recreation. Recognizing that public use of the Faie..tit has increased dramatically over the past few years, and that this trend is likely to continue,additional guidelines may become necessary in order to meet teaching and research requirements. Duke University is therefore not in favor of establishing a parking area which would undoubtedly encourage public use.
