PURPOSE: To report on progress to date on consultation with the
owner of Multiflora Greenhouses on a plan of action
for cleaning up improperly dumped waste.
BACKGROUND: Multiflora Greenhouses, Inc. was issued a Notice of
Violation by the North Carolina Department of
Environment Health and Natural Resources, Division Of
Solid Waste Management, for having a non conforming
solid waste disposal site/open dump. The violation
notice gives Multiflora a deadline of October 22,
1994, to come into compliance. The County' s Public
Works Director and Economic Development Director, and
the Orange Regional Landfill' s Solid Waste
Administrator, met with the owner on site at
Multiflora Greenhouses to assess the dumping and
assist the owner in disposing of the improperly dumped
waste. The assessment revealed that the owner is
responsible for all costs and arrangement for the
clean up operation.
Gayle Wilson, Orange Regional Landfill Administrator,
has outlined the following two options for preparing
and delivering of the waste to the landfill for
disposal:
OPTION 1: Separate the material into segregated waste
piles. One would contain yard waste material,
including dirt and clean wood waste. The owner can
spread the clean dirt and avoid some cost for
transportation and disposal. The landfill fee for
this material is $5.00 per ton. The other remaining
materials consisting of plastics, paper, etc. , can be

Dear Mr. Rijdes:
Pursuant to North Carolina General Statutes 130A-22 (a) and
to 15A North Carolina Administrative Code 13B, you are hereby
informed that you have established a non-conforming solid waste
disposal site/open duwp on your property on New Sharon Church
Road in Orange County, North Carolina.
On August 16, 1994, accompanied by Chip Bristow and at
Jones of the N.C. Department of Agriculture Food and Drug
Protection Division, I investigated a non. conforming solid waste
disposal site on property owned by you in :Orange County, North
Carolina, Orange County Tax PIN No. 9886-71-3942 . The inspection
revealed that wastes generated by your greenhouse operation have
been disposed of in two trenches on this property. Wastes
observed in these pits included plastic pots, sheeting, cell-
packs, and flats; plants; soilless media; bags of garbage; wood;
corrugated cardboard; plastic motor oil containers; and plastic
and paper pesticide containers.
The open dumping of wastes on this property constitutes a
violation of the North Carolina Solid Waste Management Rules,
codified at 15A N.C. Admin. Code 13B; specifically:
15A N.C. Admin. Code 13B .0201(a) states that no
person shall establish, or allow to be established on
his land, a solid waste management facility, or
otherwise treat, store, or dispose .of solid waste
unless a permit for the facility has been obtained from
the Division."
You are in violation of 25A N.C. Admin. Code 13B .0201(a) in that
disposing of solid waste on this property constitutes
establishment of a solid waste management facility on this land

Dear Mr. Rijdes:
In following up the site visit by Mr. McAdoo and I yesterday, I
wish to confirm the procedures under which the Orange Regional
Landfill will accept the materials that provoked notice of
violation from the Division of Solid Waste Management. Mr. Mark
Fry and Mr. Robert Hearn of the Solid Waste Section were
unavailable yesterday, so I was unable to verify my instructions to
you with them. My directions on your proceeding to cleanup your
non-conforming solid waste site are contingent upon their approval.
You have essentially have two options in preparing and delivering
your waste to our landfill:
1) Separate the materials into two segregated waste piles. One
would contain yard waste materials such as plants, dirt and clean
(untreated and unpainted) wood. State regulations prohibit
commingling yard waste and garbage. Any dirt you could remove from
this waste sector would reduce you tipping fee because dirt that is
uncontaminated with plastic or other materials/chemicals is not
considered a waste. The fee for this material is $5/ton.
The other waste pile would consist of all other materials, such as
plastic, paper, etc. The fee for this material is $25/ton.
2) The second option is to simply commingle all materials and
deliver to the landfill. commingled. A penalty fee exists for those
loads that do not separate yard waste from other garbage, however,
delivering your waste this way would allow rapid, uncomplicated
resolution of your problem. The fee for this commingled material
is $50/ton.
I observed several small plastic chemical containers on my visit to
your site. It is imperative that these be triple-rinsed before
disposing. Additionally, we accept no liquids, so all containers
must be empty.
We will cooperate with you in any way we can to alleviate this
problem. The landfill hours are 7:00 - 4:00 Monday-Friday and 8:30
