BACKGROUND: On September 21, 1993, the Board applied to the Federal Communications Commission (FCC) for authorization to regulate certain cable rates. On October 19, 1993, the Board entered into an agreement with Triangle J Council of Governments (TJCOG) to perform cable TV rate regulation administration on behalf of the County. In May 1994 , Cablevision and Cablevision Industries submitted Cable TV rate information for review. TJCOG consultant, Action Audits, reviewed the rate information and submitted a finding to the County in June 1994 . The County Cable TV Citizen Advisory Committee met with TJCOG staff and representatives of the cable companies at their June meeting to discuss the review and findings. The Cable Committee concurred with the findings of the consultants for TJCOG that both cable companies ' rates are in compliance with the FCC rates. Since both cable companies are in compliance, the Board should not request rate changes from the FCC. Bob Gwyn, Chair of the Cable Committee will be present to comment on the rates. A public hearing on cable TV rates is not required; however, local governments are encouraged to offer citizens an opportunity to comment. RECOMMENDATION(S) : Authorize the County Manager to sign "Order Approving Benchmark Rates" for Cablevision and Cablevision Industries. On June 7, 1994 the County Manager received a report which indicated that Time Warner Cable's basic cable service, equipment and installation charges are in compliance with the FCC benchmark rates. IT IS, THEREFORE, ORDERED: That Time Warner Cable's- Durham Division for its Orange County franchise to provide basic cable service, equipment and installation rates be approved. ISSUED BY ORDER OF ORANGE COUNTY: This the day of , 1994. On June 6, 1994 the County Manager received a report which indicated that Cable Vision Industries's equipment and installation charges are in compliance with the FCC benchmark rates and that the Company's 15 channel basic service rate exceeds the maximum permitted rate by $0.01. IT IS, THEREFORE, ORDERED: That Cable Vision Industries'- Orange County basic service, equipment and installation rates be approved and that the Company be directed to comply fully with the new FCC rate regulation rules in subsequent "Request For Cable Rate Approval" filings.
