Line 1 reduced to reflect underspending trend and line 2 increased to reflect overspending trend in past four months . Lines 5 , 7 , 9 , 10 , 13 : These lines show variations from previous budg for various reasons : Reduction in Title XX staff shifts more overhead expense to Income Maintenance operations . IRA? Feemire, Chief Day Care Section Division L Division of Plans and Operations SUBJECT: Revised Day Care Allocations Based on Congreggional Reductions On August 13, 1981, Congress amended Public Law 97-35 in which Title XX of the Social Security Act was replaced with the Title XX - Social Services Block Grant Program. As amended, the grant authorized $2.4 billion for Fiscal Year 1982 (Federal) to be allocated to each state and the District of Columbia in the same proportion as that state's population is to the population of all states (minus allocation to entities outside the United States) based on the Bureau of Census 1980 Decennial Census. In accordance with the federal reduction of Title XX funds to this state, the Department of Human Resources and the Division of Plans and Operations must reduce the grantees of the funds accordingly. Based on the 20 percent across- the-board reduction of Title XX funds, which was approved by the North Carolina Association of County Social Services Directors, the allocation of Day Care funds to your county has been adjusted. Effective October 1, 1981, your SFY 1981-82 annual allocation will be changed as illustrated below. Formal funding authorization change notices will follow, if applicable. Bobby Baker 9 pages shopemuvb»sc: 929-8109 PURPOSE: To consider executing procedural steps necessary for Caldwell and Cedar Grove Fire Districts to apply for a revised insurance rating from the North Carolina Fire Insurance Rating Bureau. NEED: Both departments may be qualified for an improved rate. The Bureau and County requirements for making application involve three things to be in place prior to the Bureau's inspection and decision' 1. Contracts between a department and the County whereby the former agrees to provide adequate fire protection in return for the receipt of a fire district tax from the County. 2' Fire District and boundary description approved and adopted by the Board of Commissioners, 3. Inspection by the Fire Commission certifying that minimum standards (as specified in March 20, 1975 Minutes) are being met (done November 6, 1981)' In the case of Caldwell all except number two have been met. NORTH CAROLINA CONTRACT AND AGREEMENT ORANGE COUNTY THIS CONTRACT AND AGREEMENT, made and entered into this the day of __ , 19 _, by and between the COUNTY OF ORANGE , party of the first part , also referred to as County and the Cedar Grove Fire Department , Inc. party of the second part , also referred to as Fire Department ; W I T N E S S E T H : THAT WHEREAS , N. C. G.S . 69-25. 5 provides that counties may provide for fire protection in a fire district by contracting with any incor- porated nonprofit volunteer or community fire department ; and WHEREAS , the new N . C.G. S . 159-13 ( a) ( 8) , which became effective July 1 , 1973 , provides that the budget ordinance "may be in any form that the Board ( of Commissioners of Orange County) deems most efficient in enabling it to make the fiscal policy decisions em- bodied therein , but it shall be so organized that the accounting sys- tem will show appropriation and revenues by line items within at least the following funds : . . . ( 8) a fund for each special district whose taxes are collected by . . . " the county of Orange ; and WHEREAS , the party of the second part is a nonprofit corporation organized for fire protection purposes ; and WHEREAS , it serves a special tax district created by a vote of the people ; and 1 -2- WHEREAS , the County of Orange levys and collects the taxes and is responsible for appropriating said funds for the use and benefit of the citizens in the fire protection district ; and WHEREAS , the County desires to grant a long-term contract to en- able party of the second part to make long- range plans ; and WHEREAS , the County desires to standardize all its arrangements with Fire Departments in the County ; NOW , THEREFORE , in consideration of the premises and the consider ation of TEN DOLLARS to each the other in hand paid , the parties here- to contract and agree as follows : 1 . The party of the first part contracts and agrees that it wil " cause to be assessed or levied a special tax of up to but not exceedir $ . 15 per one hundred dollar valuation of all real and personal property in the Cedar Grove Fire District unless otherwise limited by law and/or a vote of the people ; and will collect said tax as a part of the ad valorem taxes of the County of Oranlie ; provided however, beginning with the fiscal yei 1981 the amount levied annually shall be based on the n( projected in the budget estimate submitted by the Fire Department to the County and approved by the County Commissioners . 2 . That a special or separate fund shall be maintained by the County for funds collected as a result of said special tax . 3. That current taxes , as they are collected by the county , shall be paid to the Trustees of the Cedar Grove Fire District , ()rang! County , as follows : periodically that delinquent taxes shall be remitted quarterly . -3- 4 . The party of the second part shall provide the necessary - equipment and personnel for furnishing adequate fire protection as determined by the North Carolina Department of Insurance , Fire and Rescue Service Division , for all property located within the Cedar Grove Fire District , and it will furnish said fire protection free of charge to all persons and individuals located in said District in an efficient and workmanlike manner. 5 . That all funds paid to the party of the second part by the party of the first part shall be used exclusively to provide fire protection within said Cedar Grove Fire District and to pay other legitimate fire protection expenses including principa and interest on the aforementioned loan made by the Farmers Home Admin- istration. 6 . It is agreed that the party of the first part may inspect all books and accounts for the party of the second part at any time that it shall desire ; it is further agreed that the Fire Department will present to the County Commissioners an annual audit by a C . P. A. which audit shall be in conformity with existing audit policies of the County 7. The party of the second part agrees to comply with County bud- geting procedures and other procedures provided for by State Law and agrees to submit budget estimates to the Board of Commissioners on the standard forms used by county departments ; the party of the sec- ond part also agrees to use standard line items for accounting de- vised or consented to by the County Accountant from time to time. 8. NEED: The Board, in discussing this at a 1980 meeting, indicated that hardship should be the primary criterion for any refund. Accordingly, the following is proposed: PERMIT FEE REFUND POLICY Fees for permits issued for construction which does not start shall not be refunded unless the applicant can show verifiable hardship. North Carolina State law states building permits expire after six months if no construction has begun. No fees shall be refunded for permits that fall within this • -- category. Application for a refund must be made within six (6) months'' of the date of issuance of the permit, and be accompanied by the permit. The application shall give reason or show cause that there is a hardship- Proofmust be given that no work has begun on the project. The service charge retained by the County shall be either twenty dollars or 20% of the original fee or the smaller of these. Hardship cases are analyzed by examining personal hardship, natural disaster, hardship caused by the government, or hardship caused by the individual . When a hardship is caused by the death of a family member, sickness of the applicant, a natural disaster, such as hurricane or flood, or for other reasons not caused by the applicant, the fee will be refunded. Other reasons not caused by the applicant may include actions taken by Orange County which render construction impossible or impractical when the applicant has made application in good faith reliance on the state of things before the precipitating action. IMPACT: Approval of a policy would permit administrative action to be taken on three cases that are pending.
