NEED: That the Board may make choices and give direction with regard to these Boards/Commissions/Councils. Hillsborough Planning Board: There are presently two vacancies on this Board which the Board of Commissioners may fi.13. The Town of Hillsborough has submitted three recommendations for these two vacancies; in addition, — this office has received two other applications for that vacancy. All applications are attached. Personnel Advisory Board: This office has still received only one application for the three positions available. The Board has indicated that it would generate sore response. I await Board direction. Orange County Board of Adjustment: The Board appointed Mr. Wesley Pattishall, the former alternate, as the delegate to this Board on August 3; sequerray, the alternate position is now available. I have received no applications for this position. I await Board direction. Triangle J EMS Council: (alternate consumer delegate) : In August the Board appointed Mr. Vaughn as the consumer delegate to this Council, leaving unfilled the alternate position. I have received only one application for this position. I understand the County EMS Council is abbut to be reactivated; therefore the Board may decide to hold of on this appointment until after it has heard fLt..la County EMS Council's proposals. NEED: Funding for development of a needs assessment report was approved September 8, 19E' - The HSAC has spent the ensuing time meeting, with Commissioners and refining the scope of work that is expected. A profile of Commissioners' responses ara attached. WOULD YOU ?REFER A REPORT IN TERMS DF: 4 Needs 1 Services MGERME::::DTUM.s0FeAGREEMENTgy This MEMORANDUM OF AGREEMENT Pollitzer, Chairperson, of the Human Services Advisory Commission Committee on community needs assessment, hereinafter called the Chairperson, Lisa Berolzheimer, herein- after called the Project Coordinator and Orange County, hereinafter called the County, for the purpose of conducting a Community Needs Assessment of Orange County Human Services. This assessment shall be carried out so as to accomplish the following. 1 . It must identify the service needs or problems existing within the county. 2. It must determine the scope and magnitude of these needs as evidenced by statistically relevant data, such as rate of service requests , victimization rates, health statistics, census information , Title XX Data, etc. 3. It must identify to whom these needs exist ; i .e. , age, race and sex. 4. It must provide an inventory of service providers (with information on each of their programs) as to their: a) services b) service area c) size and type of clientele d) size of staff (full-time, part-time and volunteers) e) hours of operation f) years in existance g) legal status (public, private) (profit or non-profit) h) location of Administrative Office(s) -2- 5. It must provide a mechanism to transmit the information de- scribed above in a clear, concise and understandable format to Priority Setting Committees as nominated by the County Commissioners. 6.. These Priority Setting Committees must, based on the data given them and their experiences in the community, provide a recommended rank ordering of those needs that in their best judgment, the County should address and try to fulfill . The rationale for this determination shall be set forth. 7. These Priority Setting Committees shall also determine any gaps , duplication or overlap in a) services provided, b) clientele served, or c) area served. The rationale for this determination shall be set forth. The Chairperson and the Project Coordinator agree to assume respon- sibility for the presentation of a final report encompassing the above stated information. The Chairperson and the Project Coordinator agree to develop and present a preliminary report to the Human Services Advisory Commission • / / and County no later than " . Following review and comment by the HSAC a final report shall be provided no later than The County agrees to provide through the Human Services Advisory Commission and the County staff such assistance and*supOort as may be necessary to complete the data gathering phase of the needs assessment. This shall include free and ready access to all pertinent information in County funded agencies. -3- The County agrees to pay six thousand five hundred dollars ($6,500) for the development of the needs assessment report. This money shall be as follows: A) Project Coordinator $3,600 8) Consultnat Fees 1 ,500 C) Project Typist 900 o) Contingency 500 Total $3,600 Payment to the Project Coordinator shall be in six equal sums of six hundred dollars ($600) each, distributed evenly throughout the contract period. The County may withhold payments to the Project Coordinator for failure to carry out her responsibilities as described above. The term of this agreement shall be from October 12, 1981 to April 12, 1982. NEED: While funds were budgeted,no across the board salary adjustments were implemented pending action by the State. The State has now made its decision. Efective January 1, 1982, a 5% increase will go into effect for all State employees. In addition, a one grade reclassification will go into effect for State paid nurses effective October 1, 1981. Counties may follow this now or implenent it on a mandatory bas July 1, 1981. Also in addition, the State approved a post retirenent increase for those on the retired rolls July 1, 1980. Cost of this will be paid in the usual manner of increasing the rate of contribution. For Counties this will mean . an increase in the employer retirement contribution from 7.00% to 7,25%, effective July 1, 1982. PACT: Cost for a corresponding 5% increase for County employees would be $99,420 for the latter half of the fiscal year. Cost of the nurse reclassification, if retroactive to October 1, 1981, would be $6,312.47. RECOMMZZATION: 1. Approve following the State action on the across the board in order to maintain parity between the two pay plans. 2. The County would then follow the State guidelines. This has been the practice in the past for Orange County in determining the amount of merit and date of implementation. Last week, the State approved a 5% cost of living increase across the board increase for all teachers and state employees, "to restore the group health insurance policy coverage to the level in existence prior to legislative reductions made in June, and to provide special salary adjustments for certain classes of state employees (including state employed public health nurses). The 5% salary increase was made effective beginning January 1, 1982, and thus equates to a 21/2% increase for the entire fiscal year." ' --- An issue during budget, was that the schools and state employees are provided for 100% merit based on pe,fnrmance. The standard for Orange County is 2/3rds of the employees are eligible for merit increases each year. The Board and Director are concerned about the recent nurse wage inflation amongst other local employers and its short/long term effect on our department. The following is quoted from an October, 1981 publication of the NC Nurses' Association: "As of August 1981, the Personnel Commission set two classifi- cations for hospital nurses: 1) A newly graduated clinic hospi- tal nurse changed from grade 65 to 66 (5%). 2) A newly graduated staff hospital nurse changed from grade 65 to 67 (10%). At North Carolina Memorial Hospital this same staff nurse changed to a salary grade equivalent of- 68 (NCMH staff nurses and PHNs are in the same nursing series). 3) A PUN I proposed change would be from 65 to 66 (5%)," _ _ 0 0 0 4.5 MEMORANDUM Page 2 October 29, 1981 Thus, as of August, 1981, NCMH staff nurses base pay jumped to 3 grades above OUT PHN I's (as our nurses have not yet been upgraded). Even with the upgrading, our PHN I's would be paid 2 grades lower than their counterparts at NCMH. If we are placed on the Ctimmissioner's agenda to verbally discuss this request, we would make several additional points, among them are; 1. As Orange is only one of three counties in this part of the State that uses the hiring rate, the State will only allow us to start a public health nurse above the hiring rate if that person has achieved permanent status as a public health nurse before coming here, 2. Contrasted to the State, steps 2 to 4 of the pay scale are not automatic (only the increase from hiring to step 1 is automatic upon completion of probation). Orange applies the merit concept to the steps 2 to 8, with 2/3 of the staff eligibility, thereby depressing wage growth along the step scale. The Orange Personnel Policies reserve the decision to allow more than one merit per year to the Commissioners. This, in operational terms, has resulted in no salary, merit-based, quick growth as is often the case at the University or the hospital. 3. It is insulting and unfair to our superior trained and educated nurses to start so much lower and then have to work here 31/2 years to be at the starting wage of a hospital staff nurse. It takes more than 3½ years if one does not get one of the merits due to the 2/3 limit,or some other problem. 4. We are woefully understaffed and therefore we ask above average effort from our nurses (other comparable to Orange Health Departments have 19-24 nurses, we have 11 plus a supervisor); 5. We are having difficulty recruiting due to the wage gap; f) Our nurses are exceptionally dedicated and competent; 7. The community benefits from their efforts; 8. We have a great financial investment in these persons; 9. We have in the past voluntarily reclassified sanitarians prior to their manditory reclassification. While we hold our sanitarians in high esteem, we wish to not let our nurses think we do not also highly value them; 10. The increase is inevitable if we are to maintain our public health nursing service; 11. Kind words and appreciation are invaluable, however, more money (in today's economic climate) is important to employee morale. This raises serious problems for a public utility. If the transmission line right of way is acquired prior to obtaining a sPecjal use permit, the utility runs some risk of having findings of fact made that would prevent its use of the right acquired. Frequently, millions of dollars are spent acquiring rights of way, the amount depending upon the width of the right of way and the length of the line. These expenditures may be forfeited should the Board make findings which prevent the use. This would be an unnecessary burden for the ratepayer' On the other hand, if the special use permit is applied for before the/- rights of way are acquired, much of the information required for the application cannot be provided as the utility has no right to enter the various prope ,-` to make necessary surveys and studies. Subdivision regulation. — A county may by ordinance regulate the subdivision of land within its territorial jurisdiction. If a county, pursuant to G.S. 158A-3.#2, has adopted a zoning ordinance that applies only to one or more designated portions of its territorial jurisdiction. it may adopt suhriivisi..n regulations that apply only within the areas so zoned and need not regulate the subdivision of land in the rest of its jurisdiction. t 1959. e. Contents and requirements of ordinance. — A subdivision control ordinance may provide for the orderly growth and development of the county; for the coordination of streets and highways within proposed subdivisions with existing or planned streets and highways and with other public facilities: for the dedication or reservation of recreation areas serving residents of the immediate neighborhood within the subdivision and of rights-of-way or easements for street and utility purposes; and for the distribution of population and Traffic in a manner that will avoid congestion and overcrowding and will create conditions essential to public health, safety,and the general welfare.The ordinance may include requirements that the final plat show sufficient data to determine readily and reproduce accurately on the ground the location, bearing, and length of every street and alley line, lot line, easement boundary line, and other property boundaries, including the radius and other data for curved property lines, to an appropriate accuracy and in conformity with good surveying, oractice. A subdivision control ordinance may provide that a developer may provide funds to the county whereby the county may acquire recreational land or areas to serve the development or subdivision, including the purchase of land which may be used to serve more than one subdivision or development within the immediate area. The ordinance may provide for the more orderly development of subdivisions by requiring the construction of community service facilities in accordance with county policies and standards, and, to assure compliance with these requirements, the ordinance may provide for the posting of bond otiany other method that will offer guarantee of compliance. The ordinance may provide for the reservation of school sites in accordance with comprehensive land use plans 3b■the 1551Fdriets or the planning agency.For the authorization to reserve school sites to be effective, the board of commissioners or planning agency, before aPproving a comprehensive land use plan,shall determine jointly with the board of education with jurisdiction over the area the specific location and size of each school site to be reserved, and this information shall appear in the plan. Whenever a subdivision that includes part or all of a school site to be reserved under the plan is submitted for approval, the board of commissioners or the planning agency shail immediately notify the board of education. Penalties for transferring lots In unapproved subdivisions. — If a person who is the.owner or the agent of the owner of any land located within the territorial jurisdiction of a county that has.adopted a subdivision regulation ordinance subdivides his land in violation of the ordinance or transfers or sells land by reference to, exhibition of, or any other use of a plat showing a subdivision of the land before the plat has been properly approved under the ordinance and recorded in the office of the appropriate register of deeds, he is guilty of a misdemeanor.The description by metes and hounds in the instrument of transfer or other document used in therocessof selling or transferring land - does not exempt the transaction from this penalty. The county may bring an action for injunction of any illegal subdivision, transfer, conveyance. or sale of land, and the court shall, upon appropriate findings, issue an injunction and order requiring the offending party to comply with the subdivision ordinance. . , „ § 153A-335. The proposed division is on an existing Class 3 private road which once was a main road between Durham and Hillsborough -(Old Hillsborough Road, Old Durham Road, oric-inally Old NC 10, or Old US 70). The applicant can not obtain a right of way from Southern Railroad "other than that which presently exists". The applicant purchased a triangular Section of land and obtained a 30 foot right of way between Old NC 10 and the railroad. A 60 foot right of way exists between the subdivision and railroad. The present road exists within the right of way which is used by 4 existing dwellings. The subdivision meets the other minimum zoning and subdivision requirements. This area is designated arm]. NEED: The dental program was budgeted at a level of $92,757. Revenue support was to come as: $12,372 General Fund Transfer 40,000 Robert Wood Johnson Grant 28,000 Fee Support 12,385 Gund Balance carry forward $92.757 The problem is that the fund balance was not generated. This means there wilLbe a revenue shortfallunlessexpenditures are reduced or fees are raised. Beyond the current year grant funding will not exist after June 30, 1983. There is a need to adjust fees to avoid a deficit in the year and phase in fee support to replace the grant and the County subsidy. The Health Director and Health Board recomnends a two part fee adjustment: 1. Modification of sliding scale for dental fees to no less than 20% of full cost (versus the present slide of 15%) 2. Problem Six Background During the months of June through August, 1981, a survey of 1,073 patient visits showed the following breakdown: % paid by sliding scale or other source # of patient visits % of patient visits 15 579 54% 20 69 6% 40 50 5% 60 80 7% 80 26 2% 100 49 5% School Health Fund Paid 156 15% Insurance Paid, Prison Contract 64 6% 1,073 100% The chart, above, shows that the bulk of our patient visits are at the 15% pay level, followed by those children who qualify for free school lunches and who are therefore eligible to be paid for entirely by out School Health Fund. During July, 1981. - September, 1981, the 100% fee level would have generated $23, 184 in charges. The sliding fee scale deducted $17,714 and therefore the actual patient charges were $5 ,570. Therefore, we deducted approximately 76% of our fees by the sliding scale. Of the 24 Johnson funded programs in the U.S. , we deduct the largest amount by use of a sliding scale. Our accounts receivable total, since the beginning of program fees on July 1, 1980, through September, 1981, is $28,327.85, of this $9,714.60 in patient charges is a technical patient account crediting problem from last fiscal year. The money did flow into the program in the form of supplies. The Health Directc has requested the Finance Director to advise on procedures to clear up these charges. Another $6, 116.60 due the dental program from School Health in FY `81 '82 will be paid shortly, leaving a balance of $12,496.65 in accounts receivable Of this, $997.86 is a sliding based scale write-off mistake that will be correct soon. Of the remaining $11,498.79 accounts receivable, $8,703.79 is Medicaide due us and $1 ,988 is insurance. Therefore, our entire self pay accounts re- ceivable after 15 months of operation is $807 . We have exactly followed col- lection procedures established by John Horner and we predict most of the $807 will be collected.
