NOTICE
The Orange County Board of Commissioners and the Orange County
Planning Board will hold a Public Hearing on Tuesday, October 6, 1981
at 7;30 p.m. in the Superior Courtroom of the Orange County Courthouse,
Hillsborough.
The purpose of this meeting is tn 7-pceive citizen input on a request
for a Class A Special Use Permit for extractive use be the American
Stone Company. This Special Use Permit request is for property located
in Bingham Township and shown on Tax Map 28; Part of lots 9B and 8.
This property is located north/west of the intersecticn of highway 54
and Bethel, Church Road (S.R. 1104) . The requirements for the issuance
of the Special Use Permit are contained in Article 8 of the Orange County
— Zoning Ordinance, more specifically Sections 8.2 and 8.8.1.1.
It is the further purpose of the Hearing to receive citizen input
on the extension of the Orange County Zoning Ordinance to Cheeks Township.
It is also the purpose of the Hearing to receive citizen comments
on proposed technical changes to the Orange County Zoning Ordinance.
Specifically sections; 2.3.3.4; 4.2.8a) ; 4.2.20b) ; 4.2.21a) ; 4.3 (M-1,
S-28, S-42, S-45) ; 5.1 (R-2) , 6.2.1; 6.3.1; 6.20; 8.2.2, 8.4.4, 8.4.5,
8.8, 8.8.1.1; 9.11; and Article 22-
It is also the purpose of this hearing to hear comments on the
addition of a Special Use Permit requirement for all Planned Developments
Under Article . - - --
Copies of the Special Use Permit application; the Zoning Ordinance
and a list of the technical changes can be studied at the Orange County
Planning Department in Hillsborough.

SPECIAL USE PERMIT
This is a Class A Special Use Permit for Extraction of Earth Products.. This
permit runs with the land and applies to the approximately 118 acre property of
Philip 0. Durham and Alice Durham shown on Tax Mao 28, Lot 98"in Bingham Township,
Orange County and to an adjoining approximately 18 acre property owned by American
Stone company on Tax Map 28, part of Lot 8, also in Bingham Townshin,
The Extraction of Earth Products use carried out on these properties shall nsaz
the Standards of Evaluation set forth in section the Orange County Cee!.ee
Ordiance (proposed).
In addition the following requirements shall be net as a condition of this p.
1. Two observation water wells shall be contructed as soon as possible at :
the issuance of this permit to monitor the effect of the quarrying ope:
on-the lodal water table,. The first well shell, be located near the im ,
--- line of Phillip Durham about 750 feet west-northwest of the northwest cc:-
of the present excavation pit. The second well site shall be near the tc
of the disposal overburden pit at approximatley 900 feet east of the norte
east coiner of'the pit. The minimum depth of both observation wells shou.7.-1
be at least 25 feet below the lowest level of the pit. Mean sea level
elevation should be determined at the wells, and water levels shall ha ;:. ---
sured weekly in relation to mean sea level.
2. The site plan submitted by American Stone Company dated October, 1980, and
revised June 9, 1981 shall be part of this permit.
3. The temporary road shown on the site plan leading to State Road 1104 shall
be closed within six months of the approval of this permit.
4. The applicant agrees not to use its right-of-way easement to State Road 110:
for site access.
5. Disturbed land will be kept to a minimum.
6. No extraction will take place within 300.feet of a building or public lands.
7. Hours of operation shall be during daylight hours, Monday through Satu: y
8. No spoil piles or stockpiles shall be created to a height.greater than

9. Stockpiles and overburden piles shall be at least 200 feet from all streams
on the site.

.10. The stabilization of the overburden piles will be determined and
inspected by the Orange County Soil and Erosion Control Office. The (
overburden stabilization can be accomplished through a rotation method:r„,_
Part of the overburden area can be stabilized with sericea lespedeza
while stockpiling other places simultaneously in designated areas with-
in' the overburden area.
11. A water wagon shall be operated at the site as needed to keep dust
leaving the site to a minimum.
12. The streambed and banks of the channelized portions of Phil's Creek and
the areas around the settling ponds shall be stabilized.
13. A 50 foot separation shall xpmAi n at all times between the excavation pit
and Phil's Creek.
14. After mining operations have ended, current settling ponds will be left
as lakes with the banks being sloped and seeded.
15. After mining operations have ended, spoil piles will be sloped to prevent
erosion and, permanently seeded with vegetation as specificed by the Or(::::
County Soil and Erosion Control Office.
16. After mining operations have ended, the excavation pit will be filled
with water for use as a possible reservoir.
17. After mining operations have ended, the topography of the site will,JDe .
restored to resemble the original contours with the following exceptions:
a) the berm area will remain
b) the settling pond and excavation pit will remain
18. Surface rehabilitation will be concluded within twelve months of the
date operations cease.

EXTRACTION OF EARTH PRODUCTS
American Stone Company is a North Carolina Corporation with its
principal place of business in Orange County. The mailing address is
P. 0. Box 720, Greensboro, North Carolina 27402.
The property on which the quarry is located is a tract of
approximately one hundred eighteen acres, one hundred of which are owned
by Philip 0. Durham and wife, Alice Durham, of Route 4, Box 451, Chapel
Hill, North Carolina 27514 and eighteen of which are owned by American
Stone Company.
The quarry is located on Highway 54 west of Chapel. Hill at its
intersection with SR 1104, as is shown on the site plan.
American Stone Company mines and manufactures crushed stone and
is regulated by the North Carolina Mining Act of 1971, which regulated all
North Carolina quarries. Pursuant to that Act, the Company applied for and
obtained a mining permit (Permit Number 68-5).

Three copies of the Site Plan for American Stone Company are
attached, as are three copies of a topographical map of the property
involved.
B. OPERATIONS PLAN
1. Date Operations Commenced.
American Stone began operations during the summer of 1969 on a
site just across Bethel Church Road (SR 1104) from its present site on
property owned by David Durham and wife.
2. Hours and Days of Operation.
The Company proposes to continue to operate on its present
schedule which is during daylight hours, Monday through Saturday.
3. Type and Nature of Extraction.
The Company produces between 400,000 and 1,000,000 tons of
crushed granite per year.
4. Method of Operation, Disposition of Topsoil, Overburden and
By-Products.
The rock is drilled and blasted, then loaded by shovel into trucks
and hauled to the plant. There it is crushed, sized, washed, and then
stockpiled.
Most topsoil and overburden is given away to anyone who wants it.
What is not given away is stripped and placed around the operation to form
a berm, as is shown on the site plan. This berm will be sloped and seeded,
There is no by-product from this operation.

5. Equipment used in Extraction.
Standard equipment used in open pit quarrying and crushing operations
are used by the Company. A detailed list of such equipment can be provided if
aecessary.
6n Phasinz of the Ineration.
Generally, the operation can be divided into five phases: (1)
drilling and shooting, (2) loading, (3) transporting, (4) crushing, and
(5) stocking.
The phases are related in that they track the processing of the
stone from the point of actual extraction to the final, stockpile from which
it is sold.
7. Practices to Comply with Performance Standards.
(a) DIRECT ILLUMINATION.
The operations are confined to daylight hours and no
illumination is necessary.
(b) SOUND LEVELS.
Because of the centralized location of the plant and
pit on the property tract, and because of the earth berms and heavy natural
foliage surrounding most of the operations, we anticipate no problems in
meeting the sound limitations as set forth in the ordinance.
As shown on the site plan, the pit and plant are a minimum of
200 feet from the nearest property boundary, and substantially further than
that from the nearest residential, commercial, or industrial building not
on quarry property. We have consulted an expert in this field who has
advised us that we are currently meeting and can continue to meet this
requirement,

(c) VIBRATION LEVELS-

As is the case with sound levels, the distance from our
operation to any boundary is sufficient "insulation" from vibrations that
exceed ordinance limitations at that point. Our expert has also advised
us that vibrations from our steady state operation will not be perceptible
at property boundaries.
In order to assure that vibrations from blasting do not
exceed ordinance levels, a variety of blasting techniques are customarily
utilized. Depending on the location of the shot within the pit and depend-
ing on weather conditions, we can vary the number of holes shot, the number
of holes per delay, and the amount of powder per hole.
Frequently we solicit the help and advice of other out-
side explosive experts to guide us in loading and shooting in the safest
man:zer possible, and in a manner likely to restrict the noise and vibrations '
to the lowest levels possible. All state and federal blasting guidelines
are followed.
8. Other Miscellaneous Ordinance Requirements (7.8.1.2 C-H).
(a) Surfacing of Permanent Roads.
No roads other than those shown to be paved are present
on the operation site. These roads lead to a yard area.
(b) No extraction will take place within 300 feet of a
building or public lands.
(c) No spoils piles or stockpiles shall be created to a
height greater than 35 feet.
(d) Disturbed land will be kept to a minimum. Because of
the extremely high cost of stripping overburden and because of the high
cost of reclamation, it is in our best interest as well as in the best
interest of the county to restrict the amount of land disturbed to the
minimum necessary for operations.
(e) The Company has already posted a $25,000 reclamation
bond, as is required by the North Carolina Mining Act
The current plans are for the Mining Act to increase
the amount of the bond to $2,000 per acre of land covered by the permit.

REHABILITATION PLAN
(a) Current settling ponds will be left as lakes, with the banks
being sloped and seeded.
The plant area may be left for the plant area of another
industry, as a factory foundation, or as parking area, as needed. Barring
any of the above, the area may be plowed and seeded with some type of suit-
able vegetation.
Spoils piles will be sloped to prevent sliding, and seeded
with a suitable type of vegetation to prevent erosion.
The pit will be filled with water from underground springs
and Phial's Creek, and we anticipate that OWASA will want it as a reservoir,
as it is currently using to great advantage the pit from the old American
Stone Company Quarry.
(b) The rehabilitated topo should resemble the original topo map
of the area with the following exceptions: the berm area will be built up
to an unknown height and width; the settling pond and the pit will grow to
unknown sizes and depths, all depending on the longevity and volume of
business over the years of operation. Our plan is to leave the settling
pond as a lake and to allow the pit to fill with water and thereby be a
lake or a reservoir.
An accurate topographical map of the berm area, settling
pond, and pit is impossible to produce at this time.
(c) Because of the nature of the extraction process, it is
impossible to predict with any accuracy the date by which operation will
be concluded. However, we anticipate that the surface rehabilitation will

be concluded within 12 months of the date operations cengo. •
(d) Equipment will be removed for use at another site or sold.
Structures also will be removed if not needed by the successor. Spoil
piles, as mentioned above, will be sloped and seeded.

THE GENERAL HYDROLOGY OF THE SUBJECT SITE
1. The disturbed area which amounts to approximately 12 acres at the present
time drains into our pit which is then pumped into our large settling
pond.
2. The volume of water being handled by our "closed circuit" water system
amounts to our annual rainfall plus a small amount of underground spring
water encountered by the digging of our pit. This water is pumped into
our large settling pond at an estimated annual rate of 150,000 gallons
per day. A greater amount of water is pumped from this settling pond
into our plant both as dust control device and a stone washing device.
A portion of this water is returned to our settling system via our
small settling pond. The render is added to our stone as moisture
content or it evaporates.
3. The small settling pond has a holding capacity of approximately 1,000,000
gallons and the large pond has a capacity of approximately 8,000,000 gallons.
If in the future we need to increase our holding capacity, we can add an
additional 4,000,000 gallons by adding three (3) feet of additional embanks--
meat along the eastern bank of the large settling pond (3' x 4 acres 20,00''
cubic yards or 4,000,000 gallons).
4. 411 of the remaining undisturbed areas that drain into Phil's Creek are
either stabilized with crushed stone or vegetation.
✓ In addition to the performance standards covered by the ordinance we
propose to carry out the following policies in regard to sedimentation and
erosion control.
1. We will continue to stabilize the stream bed and banks of the
channelized portions of Phil's Creek and the areas along the outer banks
of the settling ponds.
2. We will close the temporary road, now being used, connecting
to SR 1104. We will at the same time construct a new road, to be used
for hauling away overburden, which will be paved if it is to be termed
permanent as described in the ordinance.
3. We will not use our right-of-way easement to 1103 so long as
we are operating a quarry at this site.
4. Water wagons or other acceptable dust inhibitors will be used
when needed is the yard areas and on temporary roads to keep dust leaving
the site to a minimum.
5. All future stockpiles and overburden piles will be located at
least 200 feet from stream., on the site .

6 We are bound by the regulations of the N. C. Mining Act of 1971
in regards to stabilization of the overburden piles. A copy of our plan
conforming to Regulation Number 1 of the "Act" is attached hereto.

Before discussing noise limitations, it is useful to review some of the terminology
used to describe noise as it is perceived by humans. Noises are composites of

the pressure variation and by the frequencies of its constituent sounds.

The range of response of the human ear is extremely large. The smallest

The simplest measure of a noise is a determination of the overall sound pressure
level. However, such a measurement gives no information on the human perception
of the noise,noise and it is more or less meaningless. It is possible to give to a

With the foregoing discussion in mind, our recommended limit on noise levels from
the operation of quarrying machinery and equipment is as follows.
The sound pressure level from the operation of producing
equipment or machinery at a quarry shall not exceed 68 dBA
between the hours of 7;00 A. M. and 6 P. M. as measured
outside and,adjacent to the nearest residential , commercial,
or industrial building not on quarry property. At other times,
this limitation shall be reduced by 10 dBA.
Th e airborne borne waves produced by blasting can be broken down into two categories,
the noise that is heard (that portion of the airborne waves being transmitted
at frequencies in the audible range), and the concussion which may be trans- d
doors ftte dbelow the audible range of frequencies but which can rattle windows an
:n and even produce perceptible movement inside buildings. It should be noted that airblast measurements are customarily made with equipment that has a

Extensive investigations into the effects of' these airborne waves have been con-
' by the Ballistics Research Laboratory and other military gencies, by the'

U ited States Bureau of Mines, and by numerous consultants. For many years, a
peak overpressure (variation of atmospheric pressure from the ambient or normal
level) of 0.5 pound per square inch was generally considered an acceptable
limit for "'irblast". Somewhat more definitive standards follow.

Fairly recent investigationt into the effects of airborne waves have cited or
postulated instances of damage at levels slightly above 0-02 psi or 1401/2 dB.
The writer knows of no reports of damage below this level.
The regulations recently promulgated by the Office of Surface Mining governing
surface coal mining operations specify that the airblast at buildings in the
vicinity shall not exceed 0.0092 psi or 130 dB, as measured with the monitoring
systems commercially available. This represents a restriction on atmospheric
overpressures that is less than one-third of levels below which no damage has
ever been reported. While considered too restrictive in some circles, the limit
is federally sponsored and will gain credibility in lay circles as a result.
Accordingly, we see no alternative but to offer the following recommendation:
The peak atmospheric overpressure produced by blasting
operations, as measured outside and adjacent to the nearest

This measurement shall be obtained with a measuring system
that has a flat response (±3 dB) at frequencies of 6 Hz, or
lower.
To lend perspective to the quantities ntities specffied above, we have measured over-
pressures generated by nearby electr i cal storms o f more 135 dB or 0.016 psi.

This is a level approximately seventy percent (70%) higher than is permitted by
the federal regulations.
Stes4y-state vibrations will be generated by the production equipment and machinery
at a quarry. The human body is very sensitive to steady-state motion; particle
velocities as low as 0'04 or 0.05 inch per second are perceptible. Accordingly,
the following limitation on steady-state ground motion is proposed:

Such vibrations attenuate very rapidly with increasing distances from the source
pquipment,
As far as the ground motion from blasting is concerned, it is of a short-term or
transient nature. When a blast is detonated, vibrations are produced which
radiate outwards through the ground in all directions. The situation is analogous
— to what happens when a rock is dropped into a body of water. In the latter, the
ripples radiate outwards in all directions on the surface of the water. There ".are two important differences: 1)� the water ripples can be seen whereas the ground movcment is generally limited to a few thousandths of an inch at most, and there.-
fore is not visible; 2) in the case of the water ripples, the distance between
successive waves (wave length) is measured in inches or a few feet at most,
depending upon the size of the rock hitting the water, while in the case of the
eround waves the wave length is measured in hundreds of feet.
In the case of the ground vibrations, we are concerned with wha happens when they
reach the location of a building. The vibrations cause the ground at a given point
or a building on top of the ground at that point to oscillate briefly back and
forth, up and down, and side to side. Research in blasting seismology er the
past 50 years has shown that the occurrence of damage is related not to the
amount of oscillation or mo nt to which a building is subjected (this is
called "particle displacement"), but it is related instead to the speed or rate
at which a structure is vibrated. The latter quantity is called "particle
' velocity". In short, therefore, it is how fast a structure is vibrated rather
t|:an how uch it is vibrated that determines whether or not damage will ensue,
The research mentioned above has been conducted by governmental agencies such
as the United States Bureau of Mines and the National Research Council of
Canada, by insurance cdmpanies, and by individual seismological consultants.
O:e limit on blasting vibrations, widely accepted in the past as a result of
this research, is a particle velucity Of 2.0 'inches per sedond.
The foregoing does not mean that a building moves 2'0 inches; it means that
rate of movement at any instant is limited to 2.0 inches per second. With
``'/esting vibrations, movement does not continue in the same direction and at
a constant rate for more than a few thousandths of a second. Movement of 2.0
inJ/cs could only be produced by continued displacement of'the ground in one
&iractfnn and at the rate of 2.0 inches per second over a full second of time.
This discussion can be understood by noting that a car, traveling at a rate
of 60 miles per hour, will cover a map or straight-line distance of 60 miles
only if it continues in one direction at this speed for a full hour. There-
fore, just asthere is no direct relation between car speed and the distance
traveled without taking other factors. Such as time of travel into consideration,

The vibration limit cited above applies to any single nnent of ground motion
(longitudinal, vertical, or transverse) with the vibrations being measured with
a three-component seismograph. In lay terms, the limit would apply to the

Dear Mr. Badham:
On June 10, 1981, I visited your company's quarry on Highway 54
west of Carrboro in Orange County. The purpose of my visit was to in-
spect the geological and ground-water conditions at the site and to
estimate the impact of quarry, expansion on the water table.
The present quarry pit covers an area of slightly less than 5
acres and is located on the northwest side of SR 1104. The former pit
is located on the southwest side of SR 1104 and is now owned by the
Orange County Water and Sewer Authority. Currently it is filling with
water and is used as an emergency, water supply reservoir.
In the quarry pit, the exposed rocks show the general bedding
planes to dip towards the north at approximately 80 to 85 0. The strike
is about NNE, and the rock appears to be a felsic tuff.
As I understand, during the years of quarry operations at this
site there has never been a water-related complaint from the nearby
residents. The quarry's well at about 450 feet from the present pit
and 180 feet in depth has supplied adequate quantities of water to the
offices and shops for several years with no problems. In a 200-foot
well at the former office site and approximately 500 feet from the
former pit, the static water level was measured at 36.0 feet below
ground surface on the day of my visit.
It appears to me that the ground-water conditions at this site
are similar to approximately a half-dozen other quarry sites with
which I an familiar. Basically the water table falls to the base of
a fractured zone at the quarry wall. At that level the water discharges
into the pit, and the level of maximum drawdown is established. The
water table slopes upward logarithmically from that level forming a
cone of depression around the pit, The limits of such a cone of de-
pression generally extend to between 300 feet and 500 feet from the
quarry walls. The extent of the cone is influenced by many factors,
the most prominent of which are thickness of soil cover, the size,
extent and degree of interconnection of the fracture zones, and the
amount of precipitation in the area. ,•'r
I have found no evidence that the ground-water conditions at your
company's quarry are essentially different from others in the Piedmont
Province of our State. In my opinion the extent of the come of depres- r
sion will shift as the size of the pit changes, but it probably will l
not extend beyond 500 feet from the pit walls.

In order to determine the current natural fluctuation in the
water table and to provide background data against which future water
levels can be compared, I recommend the installation of two obser-
vation wells as soon as practical. The first well should be located
near the property line of Phillip Durham about 750 feet WNW of the NW
corner of the pit. ,The second well site should be near the toe of the
disposal overburden pile at approximately 900 feet east of the NE
corner of the pit. The minimum depth of both observation wells should
be at least 25 feet below lower level of the pit. Mean sea level
elevation should be determined at the wells, and water levels measured
weekly should be related to this datum.
I trust this letter will answer the questions you had about
the quarry's effects on the ground-water conditions. However, if you
need further information, do not hestitate to call me.

1) Utility lines for local distribution of electricity, telephone, water and
sewerage disposal are allowed in all districts. Attached is a clarifica-
tion of this will be included in Article 4. A definition of utility lines
and line equipment to be included in Article 22 follows:
Utility Lines and Line Equipment - The local distribution system
of public utilities and community systems which include electricity,
telephone, water, sewage-disposal, and cable television. These
systems are for local distribution of services and are not intended
to be used for transmission or as trunk lineS for utilities.
Distribution systems for electrical systems shall not exceed 45,000
volts; the distributiOn systems for liquidsor gazes are those
operating at pressures of less than 100 pounds per square inch.
2) Staff agrees with this request, 15,000 volts should be 45,000 volts.
3) Staff does not agree; the installation of overhead and underground trans-
mission lines both have the potential for offsite impacts: The right of
way will be cleared and heavy equipment will be roving along the right
of way.
4) Staff agrees with the request for item e) and disagree with the elimina-
tion of b) in 8.8.19.2.
5) Staff does not Agree with this; if necessary the applicant may ask the
Board of Adjustrent for a variance from diuensional requirements of
Article 5.
6) Staff does not agree. The reason transmission lines are a Special Use is
than the County wants the ability to look at exactly where they go. Try

GENERAL COMENTS:
Staff feels that the Special Use Permit process protects the public interests
of the citizens of Orange County. If the applicant for a permit does their
homework then there should be little discussion about alternative possibilities.

7.2.2 Property owner Rust apply for Planned Development District:
The property owner must voluntarily apply for the Planned
Development district.
7.2.3 ALLOWED USES MUST BE SHOWN ON THE PLAN. -
If the petitioner elects to apply for a Planned Development District
the petition must specify the actual use(s) intended for the proparty
specified in the petition and the intended use(s) must be permitted -
in the corresponding general use district. In the petition for a
Planned Development District, the County Commissioners are to approve,
approve with conditions or disapprove the petition on the basis of
the proposed site plan and the specific proposed use.
Any change in the use shown on the plan will be treated as an amend-
ment to the Planned Development, as set forth in Article 7.8.
7.2.4 IMPOSED CONDITIONS
The Board of County Commissioners may impose such reasonable conditions
upon approval of a Special Use Permit for a Planned DevelopMent District
as will afford protection of the public health, safety, and general
welfare, ensure that substantial justice is done and equitable treatment
provided.
7.2.5 SPECIAL USE REWIRED FOR EACH PLANNED DEVELOPMB:TT
Within the Planned Development District only those uses authorized by
Article 4 as permitted in the zoning district with which the PD car-
BlgObnds shall be permitted,,and other requirements of the corres-
ponding district shall be met. In addition, within a PD no use shall
be permitted except pursuant to a special use permit authorized by the
-County Comnissioners lelich shall specify the use or uses authorized as
required in Article 8.8.23.

If the petition is approved, the County Cormassioners shall issue
a Special Use Permit authorizing the requested use with such reason-
able conditions as the governing body determine to be desirable in
promoting public health, safety and welfare.
The authorization of a Special Use PelMit in any Planned Development
DLstrict for any use which is permitted only as a "Class B" special
use in the zoning district which co.vzsponds to the Planned Develop-
merit district Stiall preclude any requirement for Board'of Adjustment
approval but shall be approved by the Board of County COmmissionerS.-
7.2.6 STANDARDS FOR EVALUATION
The General and Specific Standards for the issuance of a Planned
Development Permit shall include those for a Special Use Permit ,
as set forth in Article 8 and other requirements and standards as
set forth in Artible 7.
7.2.7 CHANGES IN COND.MONS OR USE FOR PLANNED DEVMONENP PERMIT
Any violation of a term or indication of a Planned Development Permit
shall be treated the same as any other such violation. In addition
the Planned Development Permit shall become null and of no effect,
and the property shall be rezoned at the next scheduled hearing to
its previous zoning district appropritate general district.
7.2.8 TIME LIMIT ON START OF CONSTRUCTION FOR USE PLANNED DEVELOPPEW.
Construction must start and proceed at a reasonable rate within six
months of the approval of the permit. If no construction has started
the permit becomes null and of no effect. The owner can request a six
month extension from the Board of County Commissioners if the request
is received before the permit expires.
ADDLPICN TO 7.4 PD DISTRICT - WHERE AND HOW PERMITTED
Planned Development Districts may hereafter be established by amend-
ment to the Official Zoning Atlas, approval of a Special, Use Permit,
and related amendatory action, . -
