Davis, Current Planning Supervisor 245-2580 PURPOSE: Consideration of the Preliminary Plan for Carramore for a Public Road entrance only. BACKGROUND: Location East side of Kerley Road (SR 1717) between Mt. Sinai (SR 1718) and Cornwallis Road (SR 1716) in Chapel Hill Township extending into Durham County Existing Conditions:. Existing: • Zoning: Rural Buffer (2 acres minimum lot size' ) • The property is not located in a designated protected watershed. Physical Features: • There are no designated streams in the Orange County portion of the tract. • The site, in Orange County, is flat and wooded with a mixture of pines and hardwoods. Applicant: Howard A. Partner (agent for owner Astrid Schmidt-Nielsen) - • Total subdivision acreage. is 20.658 of which 0.308 acres is in Orange County, including new street right-of-way. County and average 2. . 16 acres. • Eight lots are proposed, all of which are located in Durham • The subdivision will require the dedication of a new public road. A small portion of the public road comprising the entrance to the subdivision is-located in Orange County. Subdivision I Portion excluding R-O W) - 2 Courtesy Review: • Tract is partially within the Joint Planning Area. • Chapel Hill had no comment (see attached 12/29/06 agency review). • Durham County approved the subdivision at the Development Review Board meeting on January 26, 2007. Adjacent Land Use: • Property to the east is part of a recently approved subdivision. • Property to the north includes a single-family residential lot and a large residential tract. • Property to the south includes a single-family residential lot and a recently approved 86 lot subdivision. • Property to the west includes a large undeveloped tract across Kerley Road. • Subdivision pattern on the Orange County side includes lots averaging from .74 acres in Montvale to 2.26 acres in Kerlington and undeveloped land on the west side of Kerley Road. Proposed: Roads: • Access is from Kerley Road (SR 1717), an existing paved public road in Chapel Hill Township. • The proposed main road leading into the subdivision is Carramore Lane. • Approximately 30 feet of Carramore Lane is located in Orange County. The remainder of Carramore Lane, and all of the proposed subdivision lots, are located in Durham County. • Eight (8) lots are proposed in Durham County. Each lot has access to Kerley Road via Carramore Lane with a proposed stub out to the southern property line in Durham County to allow'for future connectivity. • Minimum lot size in Durham County is 1 acre when served by septic systems. • All roads are to be public. The Carramore Lane design drawings and construction plans shall be approved by NCDOT. Final construction shall be approved, or. secured by a Letter of Credit, by NCDOT prior to planning signatures on the final plat. . This condition has been added, to the Resolution of Approval. • A right-of-way stub out in Durham County will provide for future interconnectivity with an adjacent tract to the south (Quail Ridge). Transportation Issues: • Orange County asked for a traffic study and the applicant submitted a study prepared by The Prescott Company. This study along with NCDOT comments and staff review, indicate that no turn lanes are warranted on Kerley Road. • On page 16 of the agenda packet Karen Lincoln, the Orange County Transportation Planner, indicates that based on the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization's Long Range Transportation Plan, Kerley Road is considered to have sufficient capacity for anticipated traffic in the year 2030, having a volume to capacity ratio of 0.32. The Triangle Regional Model projections indicate 3,985 vehicles per day in 2030. Capacity at level of service D is 12,500 vehicles per day. - Open Space/Buffers: • 9,321 sq. ft. (100%) of common area open space proposed in Orange County. • Homeowners Association will maintain open space and buffers. Water-Sewer: • Individual wells and septic tanks. No water or sewer lines may be connected to homes within Orange County per Joint Planning Agreement. Recreation: • No recreation dedication is required in Orange County because there are no lots. 3 Development Process, Schedule, and Action • First Action: Neighborhood Information meeting held on October 18, 2006. • Second Action: Concept Plan approved by the Planning Board on November 1, 2006 with the following conditions: 1. The intersection and road alignments on the Preliminary Plan shall be approved by NCDOT office in Graham. 2. Homeowners Association documents that provide for maintenance of the Open Space shall be submitted with the preliminary plan. Provisions shall be included in the Homeowners Association documents that would prohibit tree cutting in the roadside Open Space except for maintenance purposes. 3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of existing R/W, whichever is greater, along Kerley Road on the Preliminary Plan. 4. Show easement location of subdivision sign on Preliminary Plan. 5. Any street lighting in Orange County shall be approved by Planning Department prior to installation. 6. A traffic study shall be prepared and submitted with the Preliminary Plan that indicates traffic patterns and traffic flows on Kerley Road. This study will be reviewed by the Orange County Planning Staff to determine whether turn lanes are warranted on Kerley Road. • Third Action: Planning Board considered the Preliminary Plan on February 7, 2007. The Planning Board determined that the conditions on the Concept Plan had been addressed and unanimously recommended approval. • Fourth Action: 4 1. The Board shall consider the application within a reasonable amount of time. 2. If the Preliminary Plan is approved by the County Commissioners the applicant shall have one (1) year to prepare and file a Final Plat or to request a one-year extension from the Planning Director. RECOMMENDATION(S): Administration Recommends Approval, in accordance with the attached Resolution of Approval. Planning Board Recommends Approval, in accordance with the attached Recommendation which corresponds with the Resolution of Approval. Before the Final Plat of Carramore can be recorded: A. Roads and Access 1 Carramore Lane shall be constructed to standards of the North Carolina Department of Transportation, within a 50-foot right-of-way with 5-foot utility easements on each side, and the construction shall be inspected and approved by NCDOT. OR A letter of credit or escrow- agreement shall be submitted to secure construction of Carramore Lane to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by . NCDOT. 2. An erosion control plan for construction of Carramore Lane shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval prior to any land disturbing activity on the site. 3. Approved double-bladed street name signs shall be erected at the intersection of Kerley Road and Carramore Lane prior to Planning Department signatures on the final plat or prior to issuance of any building permit if road construction is secured by letter of credit. 4. Prior to any construction or alteration of any existing access within the right-of-way of Kerley Road, the owner/applicant shall secure a driveway permit from the NCDOT District Office. The owner/applicant shall submit a copy of the NCDOT-approved permit and NCDOT approval letter to the Planning Department prior to or at the same time as the request for a grading permit is made, or before Planning Department signatures are affixed on the Final Plat, whichever is first. 5. Sight triangles (10'x 70') shall be shown on the Final Plat at the intersection with Kerley Road. 6. Dedicate, in fee simple, five (5) feet of additional right-of-way, or 35 feet from the centerline of the existing right-of-way, whichever is greater, along the frontage of Kerley Road. Said dedication shall meet major collector road right-of-way standards as identified in the Comprehensive Plan and required in Section IV-13-3-c-1 of the Subdivision Regulations. I Drainage Easements shall be located on the final plat as required following review and approval of the Erosion Control Plan by County staff. 2. Drainage culverts shall be sized and located appropriately, as required by NCDOT and Erosion Control, by a licensed North Carolina Professional Engineer. C. Miscellaneous 1 The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The open space located in Orange County shall be conveyed into the Homeowner's Association before Planning Department signatures are affixed to the final plat. Tree cutting in the roadside Open Space located in Orange County is prohibited except for necessary maintenance purposes that has been approved by County staff prior to any such tree cutting taking place. 3. If street lighting is proposed within the portion of the subdivision located within Orange County, then a lighting plan shall be submitted to the planning office for review and approval prior to purchase of lighting fixtures from the utility provider. Any lighting located within Orange County shall meet the Outdoor Lighting Standards as set forth in section 6.31 of the Orange County Zoning Ordinance. 4. A sign permit shall be obtained from Orange County for the subdivision sign located at or near the entrance of the subdivision prior to beginning construction. 5. Methods of disposal of trees, limbs, stumps and construction debris associated with construction activity shall be by some method other than open burning as required in the Orange County Zoning Ordinance. 1-V D. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that the platted portion of Carramore Lane has been entirely constructed to State standards or that construction plans have been approved prior to Planning Department signatures on final plat. 4. A Certificate of Approval signed by the Orange County Planning and In I spections Department shall appear on the face of the final plat. . The project falls within two separated NCDOT districts thus involving two District Engineers. We will work with our peers in Division 5 to help meet the Counties' and Developers needs. We are providing the following general comments regarding the plan submittal: 1. The proposed roadway connection on Kerley Road has been investigated and determined to be located to provide adequate intersection sight distance and has been determined to be acceptable. The traffic impact assessment provided by The Prescott Company, LLC lacks detail regarding the traffic impacts during the AM and PM peak hours, but does provide sufficient information to determine that the NCDOT turn lane warrants are not met for this access point. The Developer must obtain an approved driveway permit from this office prior to performing work within the NCDOT right of way. An approved driveway permit will be issued upon receipt of approved plans, $50.00 inspection fee, and any necessary performance bonds. 2. Since the internal subdivision roads lie within Durham County, the design and construction of the roads are subject to review and approval of NCDOT District Engineer Tasha Johnson. The information submitted by Philip Post to Mr. Partner satisfies that requirement. The Prescott Company, LLC has projected daily traffic from the count of existing traffic plus the projected traffic from the 8-lot subdivision and portion of Quail Ridge traffic through Carramore subdivision to be 2,736. That figure is less than the 2002 ADT of 3,271 used in the Triangle Regional Model (TRM) for developing the 2030 Durham- Chapel Hill-Carrboro Long-RangeTransportation Plan (LRTP). The 2030 LRTP population, dwelling unit and household projections were based on existing land use and that projected by local jurisdictions according to local land use plans. Kerley Road is located in traffic analysis zone (TAZ) 107063 in Durham County and TAZ 315070 in Orange County. The 2030 LRTP projects 347 dwelling units in TAZ 107063 by 2030 and 99 dwelling units in TAZ 315070 by 2030. That is an increase of 233 units (200 in Durham County and 33 in Orange County) from the number of dwelling units existing in 2002. The 2030 LRTP projects an ADT of 3,985 in 2030 for Kerley Road. Kerley Road is considered to have sufficient capacity for anticipated traffic in 2030, having a volume to capacity ratio of 0.32 (3,985/12,500) for LOS D. The proposal would create 8 lots on 20.658 acres located east of Kerley Road. All but 0.308 acre of the subject property is located in Durham County. ERCD comments on subdivisions are generally intended to a) address any concerns with respect to potential impacts on important natural or cultural resources, and b) identify any areas that might.be desirable for possible dedication to the County for public recreation/ open space pursuant to Section N -13-7 -b of the Orange County Subdivision Ordinance. The Preliminary Plat (November 15, 2006) shows that only 0.308 acres is located in Orange County. The Orange County portion is a narrow strip of land located adjacent to Kerley Road. The plat shows a 50- foot -wide public right of way that would be constructed through that narrow strip, from Kerley Road and into the subdivision ( Carramore Lane). The rest of the Orange County property would be set aside for Open Space -4,699 square feet south of the entrance road and 4,618 square feet north of the entrance road. The Orange County portion of the plan appears consistent with the County's desire to minimize adverse environmental impacts with respect to the protection of floodplains, wetlands, natural areas and wildlife habitat. By applying this rate to the proposed subdivision (8 units) and one-third of the proposed Quail Ridge Subdivision (2.$ units), 345 day trips are expected to be generated- This traffic may be added to the exiffitig, daily traffic occurring on Kerley Road Since current NCDOT Traffic Maps do not indicate ADT for Kerley Road, counts we're performed Tuesday through Thursday, 12/5-1.2/07/06 (attached Memo), with a resulting average daily ADT count of 2391_ * By adding trip generation o ' f 345 to ADT of 2391, a resulting ADT on Kerley Road of 2736 is obtained. An ADT of 2736 is less than the NCDOT threshold of an ADT of 4000 to require Kerley Road widening for a turn lane.
