' 2. Narrative:
A. What are the housing needs in your jurisdiction?
' A review of the 1980 Census reveals that Orange County has
definite husing needs. Of the total number of occupied housing
units in the County, 5.23 percent lack complete plumbing for
- exclusive use of occupants, compared to only 4. 1 percent of the
State of North Carolina. As a measure of overcrowding , Census
data reveal that 5 percent of occupied housing units in the
' County have 1 .01 or more persons per room, compared to 4.5 for
the State.
Information derived from a recent local housing survey
' conducted by the Orange County Housing and Community Development
Department confirms the severity of housing needs in the County .
Out of a• total of 12,313 occupied dwelling units in the County ' s
' planning jurisdiction, 1 ,209 (9.82%) were determined to be
substandard . Units were considered substandard if a visual
inspection revealed non-compliance with HUD Model Property
Rehabilitation Standards.
B.
What are housing needs of low and moderate income persons
in your jurisdiction.
Census information and local housing surveys indicate that
obtaining affordable housing in Orange County is a serious
' problem. According to a recent Triangle J Council of Governments
report (Oct . 1986) , Statistically, the average sales price for a
new home in the Raleigh-Durham MSA is $98, 100 while for existing
homes the price is an average of $91 ,000. Approximately 64. 7
percent of families living in this area cannot afford to purchase
new housing and 59.8 percent cannot afford existing houses. In
Orange County the 1986 average sales price of a new,
conventionally built , single family house is $85,800. Although
during the period from 1980 to 1986 income has risen by 30
percent , housing costs have doubled during the same period . The
median family income for Orange County in 1987 is an estimated
$29,600 based on a family of four . In 1980, the median income
was $19,305. This has in essence created the "affordability gap"
the County is now experiencing .

' C. What are other community needs of low and moderate income
persons in your jurisdiction (water , sewer , streets, etc ..) ?
As in any rapidly growing area, there exists a severe need
in Orange County to provide and upgrade public facilities
particularly, water and sewer installation and/or improvements.
Additionally, there is a need for street improvements to
eliminate severe access and circulation problems as well as
installation of drainage systems to prevent flooding and insect
infestation problems. Provision of affordable housing in Orange
' County has also become a critical issue both for the potential
homebuyer as well as the renter .
D. What activities does your community plan to undertake to
address these needs?
In order to address community development needs of low and
moderate income households identified above, the County has
' initiated an on-going community development program. This
program involves the identification of housing and community
development needs for low and moderate income households , the
development of appropriate strategies to meet these needs , and
procurement of funds needed to carry out the community
development strategies. The Orange County Housing and C .D.
Department is responsible for coordinating the County ' s CD
Program. The following plan has been developed for addressing
housing and community development needs in the County:
1 . FY 87: Housing Demonstration Project in the Chestnut
Oaks subdivision to facilitate the construction of 35 units
total , four units in Phase Two , of owner-occupied housing for
low and moderate income households.
2. FY B8: Possible community revitalization project for
' the Rencher
rehabilitation, Street area. Activities include housing
sew water and sewer improvements, and street
improvements.
E. Explain the impact of the project (s)

requesting funding on your jurisdiction ' s need?
' The project as proposed in this Housing Demonstration
application will facilitate the construction of 35 single family
housing units for low and moderate income residents of the
County. CDBG funds will be used to provide much needed material
and labor subsidies for actual construction. Phase Two of this
subdivision calls for four units to be built , which will be
completed within an 18 month period . This project will promote
the self help approach as well as provide the County with an
additional four units for low and moderate income families thus
making an impact on the affordable housing problem in Orange
County.

The Orange County Housing Demonstration Project addresses
self-help approaches to low and moderate income housing through
an approved neighborhood based non-profit organization.

B. Summary of Project
The Orange County Housing Demonstration Project involves a
cooperative venture between the County of Orange, Orange County
Habitat for Humanity and InterFaith Council for Social Service
to assist in development of a 72 acre site by constructing four
single family housing units and completion of Phase I of road
construction.

C. Description of Participants
' Habitat for Humanity, Inc . , established in 1976, is an
international non-profit Christian organization dedicated to
improving housing conditions for low income families. Houses are
' sold at no profit , with a no interest mortgage repaid over 15-25
year period . House payments are "recycled" to build more houses
through a local Fund for Humanity. Habitat presently has 31
chapters, or affliates, around the world and 174 affliates in
the United States. These affliates are governed by a local ,
interdemonational committee or Board of Directors which sets up
an impartial , non-discriminatory family selection process.
Construction of housing units is a cooperative effort involving
both volunteer workers and homebuyers. Homebuyers are required
to contribute "sweat-equity" in designing and building their own
homes and additional work for the construction of other Habitat
assisted homes. As of January 1 , 1986, the U.S. Habitat
organization had built or repaired 888 housing units and 125
were under construction. Overseas, Habitat had approved projects
in 25 locations in 14 countries.

The Orange County Habitat for Humanity is one of ten North
II Carolina affliates and serves Orange County exclusively. Orange
County Habitat for Humanity was established in 1984 . It has
established a four member Board of Directors, and has five
1 officers as well as eight standing committees (Finance, Contracts
and Documents, Building , Publicity, Family Selection, Volunteers,
Fund Raising and Site Selection/Landscaping ) . Orange County
Habitat is an incorporated , non-profit organization, autonomous
1 from the International Headquarters in Americus, Georgia. The
organization is totally responsible for each Habitat project in
Orange County, including purchasing , fund raising , disbursements,
I legal matters, etc . Orange County Habitat for Humanity .•
(hereinafter referred to as "Habitat" ) completed its first home
in February 1987 at their recently acquired 72 acre subdivision
II known as Chestnut Oaks in Orange County. Addtionally,
construction has begun for two more homes in the subdivision.
I The self help construction concept used in Orange County
Habitat is similiar to all of the Habitat projects. The potential
homebuyer must be screened by a Family Screening Committee. The
II Committee reviews three major areas : 1 -- Need , 2 - Ability to
Pay; and 3 Family Character . Maximum income limits for
recipients have been set at $12,000 for a family of one. Maximum
income levels increase by $1 ,000 for each additional family
II member . Selected homebuyers are required to contribute 100 hours
of "sweat-equity" during the design and construction of another
Habitat assisted home before their house is started and 600
1 hours for their own home or others after the selected homebuyer ' s
unit is started . The balance of labor needed to complete the
home is provided by volunteers. The Construction Superintendent
Iis provided and compensated by Habitat .
The members of Orange County Habitat , after considering the
goal of successfully providing affordable and livable housing ,
I and having been fortunate to have 72 acres of rural land west of
Carrboro , have evolved both a system for building these houses
more efficiently, and also for establishing strong community
Iawareness and participation.
The key to building efficiency lies in modularization as a
technique for constructing the units. Prefabrication of modular
I units has worked in many parts of the world , particularly in the
provision of low cost housing . In addition, knowing that North
Carolina is a leader in industrialized housing , Habitat began to
I look at planning a simple 1 ,000 SF three-bedroom house as a
modular system. The proposed criteria for the module units are
that they are make from standard off the shelf building materials
I and that they be able to be fabricated and installed by persons
with a minimum of training and effort .
The system that evolved uses an eight (9) foot module and ,
1 in fact , a four (4) foot by four (4) foot grid is marked on the
poured concrete slab to facilitate erection of these wall
panels. The basic rectangular house plan is kept as simple as
I possible within this modular grid . This keeps costs down by
standardizing of building elements, in particular the
prefabricated roof trusses, and by minimizing the amount of
II exterior walling . Also , the planning of rooms within a rectangle
can often provide larger , more efficient spats than schemes with
a more convulted perimeter .

Hopefully, by simplifying the basic house core in this
manner , the cost savings can be used to individualize the
11 dwellings by specific optional additions. A futui-e homeowner can
choose amongst a porch , a patio , some variation in window
treatment or a higher ceiling in some rooms. In addition, the
11 number of bedrooms and bathrooms may differ lea
gling to a

variation to the rectangular plan, though preferably the
variation remains on the modular grid .

The wall units and other prefabricated elements such as the
roof trusses and cabinets will be made and stored in a large
roofed in space, which will serve as a Community Center for the
subdivision. (See Attachment __) This structure will become the
focus for Habitat ' s work in that persons not only will be taught
II how to build the modules but will be able to see what Habitat is
doing and actively participate in the design decisions for the
future community.
IIUpon completion of the house, the owner receives a zero ( 0)
percent loan amortized over a 15-25 year period . The term is
adjusted_ in an effort to maintain principal , tax and insurance
II payments at no more than 25 percent of the owner ' s income.
Additionally, the selected homebuyer must have on hand $600 at
the time they move into the house which serves as a down payment .
I The purchase price is determined by the cost of materials , labor
and site development . Typical Orange County Habitat homes are
1000 SF in size and are sold for $30-40,000, although . appraisal
values are considerably higher . Habitat and the homebuyer also
execute a "first right of refusal " agreement , which requires the
homeowner to first offer the house to Habitat prior to selling
the unit .
IIAs mentioned previously, Habitat has acquired an 73 acre
tract of land in Orange County and have begun development of a
II subdivision of 35 single family homes of approximately 1 ,000
square feet in size. Presently, funds are being raised to begin
Phase Two of the development which will include construction of
four houses, however , while intensive volunteer labor support
has been received , the funding commitments for materials and
supervisory labor have been dilatory. (See Attachment __)
I/ The County of Orange recognizes the critical shortage of
affordable housing for low and moderate income families and
therefore have been active in upgrading living and housing
11 conditions of low and moderate income families in Orange County .
The County has received HUD multi-year funding and FY83 funds
from the NC Small Cities Community Development (CDBG ) Programs.
II These funds have been used to upgrade public facilities and
housing deficiencies in the northern and southern portions of
the County where there are concentrations of low and moderate
income and minority families. Historically, the County has
1 relied
go on private sector housing providers to construct
government assisted housing for low and moderate income
residents. Although a large number of housing units are under
11 construction or have recently been completed in Orange County,
most rental units are in the $400--600 per month range with owner
occupied units averaging $85,000-40,000 per unit . Thus, clearly
these housing opportunities are not available to low and moderate
IIincome families.

In recognition of the issue of providing affordable housing
the Orange County Board of Commissioners appointed the Low and
Moderate Income Housing Task Force in August 1986 to formulate a
comprehensive housing policy for Orange County which would
enable all residents to live in decent , safe and affordable
housing . The report of this Task Force (released September 1987)
assesses the housing conditions in the County and presents a
program of recommended actions to address the housing needs of
low and moderate income residents. The County was recently
approached by the Orange County Habitat and the InterFaith
Council for assistance in developing the above mentioned 72 acre
subdivision. Specifically, Habitat requested assistance with
material and labor costs necessary to construct four (4) lots in
Phase Ii of its subdivision. Material and labor subsidies in the
amount of $150, 000 (4 houses a $37,500) to purchase materals,
pay the labor cost of the Construction Superintendent , prepare
the site for development and install a water/septic system on
each lot . (See Attachment , Cost Estimates) Habitat presently
has approximately 366 volunteers (See Attachment ___) , but lacks
the funding commitments necessary to complete Phase II
development . In an effort to promote Habitat ' s self help approach
' to housing and to assist in development of Chestnut Oaks, the
County is requesting $165,000 ($150,000 for material /labor
subsidies; $18,000 for administration) from the housing
demonstration component of the NC Small Cities Community
Development Block Grant Program. Should these funds be made
available to Orange County, the County proposes to provide
$22, 140.00 of Town funds for Phase I of road construction in the
subdivision. (See Attachment ___)
Since federal and state regulations pertaining to the use
of CDBG funds presently prohibit the Town of Wake Forest from
using CDBG funds to directly or indirectly construct new housing ,
Orange County has received the assistance of the InterFaith
Council for Social Service to facilitate development of the
Habitat project . Interfaith , which is an Orange County private,
non-profit organization, (See Attachment _) , expressed an
interest in the Housing Demonstration Program from the outset
and has a close working relationship with Habitat for Humanity.
InterFaith has extensive experience in a number of social
service areas including housing , nutrition, provision of shelter
and meals for the homeless population, weatherization, and
provision of services to the elderly, poor and disadvantaged .
The InterFaith Council has a support staff and numerous
volunteers and have agreed to receive funds from Orange County
to provide material/labor subsidies and street improvements.
( See Attachment Letter of Commitment - InterFaith ) As a
third party contractor/sub-recipient , InterFaith will oversee
the design, building and construction of the proposed activities.
As part of this arrangement , Orange County will assist with
compliance requirements associated with Title I of the Housing
and Community Development Act of 1974 and OMB Circular A-87,
' A-102, and A-112 including Davis-Bacon, Equal Opportunity,
Section 3, Fair Housing , etc .

II D. Location of Project
The proposed project is located in the Bingham Township of
Orange County just west of the Town of Carrboro . The site is
II adjacent to the FY 83 Community Revitalization Project in the
Chapel Hill Township . (See Location Map ) The 72 acre tract is
relatively flat with virtually no access to public facilities.
II Habitat has submitted subdivision plens to the Orange County
Planning Board . Based on a recent appraisal , conducted using
the comparable sales method , the 72 acre site is valued at
5213,000.

E. Service Area of the Project
IISince Orange County Habitat serves the entire Orange County
community, the proposed subdivision will service all Orange
II County residents. Based on information received from housing
providers in the County, there exists an extremely high demand
for low and moderate income housing . This observation is based
on knowledge of waiting lists for conventional public housing
11 (See Attachment __ ) ; FmHa assisted housing (See Attachment ___) ;
and HUD Section 8 Existing Housing Assistance Payments Program
(See -Attachment ___) . The local Board of Realtors and members of
the local Homebuilders Association all agree that housing units
in the less than $50,000 - $60,000 range sales are almost
non-existent in the Orange County housing market . This sales
range is comparable to the Fair Market Sales Price of a Habitat
home if sold in the private market . .
IIF. Intended Beneficiaries
The requested CDBG funds and all other funds associated
II with the proposed project , are intended to benefit low and
moderate income residents of Orange County. Based on Habitat ' s
Commitment to building four ( 4 ) houses during an 18 - 24 month
II period and local Habitat data ( the average size of a two (2)
bedroom household is three (3) and the average three bedroom
household size if five (5) persons) , the project is expected to
benefit 18 persons. All 18 persons will be low and moderate
I/ income as per NRCD published income limits. Additionally, Habitat
has incorporated in its program specific features which insure
that all initial and future homeowners will be low and moderate
II income persons.

11 G. Use of CDBG Funds
CDBG funds will be used to provide material and labor
subsidies to meet the funding requirement of self help
II construction of four (4 ) Habitat houses. The following is a
breakdown of proposed improvements needed to secure Phase II :

All architectural , planning , and engineering services are
II provided as a in-kind service to Habitat by a volunteer who is
an active Habitat participant . (See Attachment ___) CDBG funds
are being requested primarily for material subsidies because
although Habitat has a strong volunteer labor support group ,
I corresponding financial commitments have lagged behind , causing
many idle volunteers. Fortunately, Habitat has many experienced
and qualified persons volunteering professional services which
II has decreased the amount of funds necessary to acquire paid
professional services. Therefore, to fill the gap between the
number of volunteers and the amount of financial contributions,
11 CDBG funds are especially needed .
In addition to the $62,360 development costs, the County is
requesting $18,000 of CDBG funds to administer the proposed
II project . The County has agreed to assist InterFaith Council with
all Title I requirements including environmental , equal
opportunity, Section 3, Davis-Bacon, and Fair Housing . The
rCounty will use existing Housing and Community Development staff
to accomplish these administrative activities.

IMETHODOLOGY FOR BENEFIT CLAIMS
II As memtioned previously, Habitat ' s Family Screening Committee
will screen applicants for income eligibility. Habitat policies
indicate that the purpose of the Habitat program is to assist
families who would otherwise not be able to afford a home. (See
I Attachment ___) Therefore maximum income limits have been
established . Based on the applicant pool maintained by Habitat

II it was found that the average family
size for a two bedroom unit
was three ( 3) while for a three bedroom unit the average size
was six (6) . According to the president , Rev . Stanford Habitat
anticipates the construction of one - two bedroom unit and three
- three bedroom units in the Chestnut Oaks Subdivision. Utilizing
these estimates, a comparison of NRCD low/moderate income limits
and Habitat income guidelines,
II it can be shown that all
homeowners will qualify as low income (50% median income) . The
II following chart documents this benefit claim.

H. Innovation
The County of Orange feels that the proposed project is an
innovative self-help approach to providing affordable housing
for low and moderate income families. This project involves a
partnership between Habitat (a private non-profit organization
dedicated to upgrading housing conditions for low income
persons) , the County of Orange ( a growing community dedicated
II to the rehabilitation of existing housing creating new affordable
housing opportunities for low and moderate income persons) aidd
InterFaith Council for Social Service (a private, non-prot
community based agency providing a full range of services to
low income persons) . Although the County knows of one other
:l1 community in North Carolina who has a similiar partnership wit
Habitat , there is no knowledge of CDBG funds being used in North
Carolina for material and labor subsidies. Specifically, the
Orange County Habitat approach to housing construction using
modularization to accomplish efficient building with the minimum
II amount of training and effort is the very unique aspect of this
project . Although this concept has been used throughout the
world , local Habitat officials are not aware of any affliate
accomplishing housing construction using this method .
I . Transfer Potential
II The Orange County Housing Demonstration Project has a
number of characteristics which make it feasible for similar
I/ projects to be implemented in other localities.

I --There are presently 10 Habitat affiliates serving most of
North Carolina. Habitat officials strongly encourage the
formation of local partnerships to facilitate the
construction of self-help homes for low and moderate
IIincome families.
--The activities proposed (water , sewer , streets) and other
I activities needed to construct housing are eligible CDBG
activities. Additionally material and labor subsidies can
are eligible if implementation is provided by a non-profit
II community based organization. Most of these agencies have
goals similar to those of the Housing and Community
Development Act of 1974.
1 --The proposed project meets all requirements (eligibility,
51Y. low/mod benefit ) for local option projects.
I --Many Habitat affliates also purchase homes constructed by
local high school vocational education classes and
relocate them to a Habitat owned site for potential
home ownership . Orange County Habitat recently did this
II acquiring a home built by Chapel Hill vocational education
students and relocating the structure to a lot in the
Chestnut Oaks subdivision in Phase I of development .
II --For Community Revitalization projects involving relocation
activities, Habitat projects provide a logical and useful
relocation resource for CDBG programs.
Studies, Analysis, Reports Generated to Assess the
II Effectiveness and Enhancement of Opportunities for
Enlarging/Duplication of the Project
County of Orange - The County of Orange will provide
technical assistance to both Habitat and InterFaith Council and
prepare status reports to assess the progression and
I effectiveness of the project . The County will also assess the
posssibility of continuing an ongoing partnership with these two
agencies in a local affordable housing program. Results of all
internal studies conducted will be made available to all
IIinterested state and local agencies.
Orange County Habitat - Habitat will provide provide status
II reports to its regional and international office. Additionally,

J. Impact
IIShort-term Impact
The project will have immediate short-term inpact by
II providing self-help housing opportunities for a four low income
families ( 16 persons) . This program will be the first in which
the County addresses the affordable housing shortage through new
II construction.
Long-term Impact
11 The proposed project will ultimately provide
homeownership opportunities to 35 families with a adequate
recreation facilities as well as natural open space. Each
II homeowner will be responsible for maintaining his own yard , thus
giving him some pride in his accomplishments through sweat
equity and financial commitment ( the commitment to making
ik
II monthly house payments) . As mentioned earlier this partnership
may be the start of other locally initiated cooperatives designed
to provide decent , safe and affordable housing to low and
,moderate income families in Orange County.

The applicant hereby assures and certifies that:
(a) It will comply with all applicable federal and state laws,
regulations, rules and Executive Orders.
(b) It possesses legal authority to apply for the grant, and to
execute the proposed program.

a resolution, motion or similar action passed

identified as the official representative and to provide such
additional information as may be required.

Rule .1002 of the North Carolina Community Development Block Grant
Administration Rules.

(3) Consents to review and comment on all Environmental Impact
Statements prepared for Federal projects which may have an
impact on the applicants/recipients community development
program.
(4) Consents to perform all coordination functions required
under 24 C.F.R. part 58 and 40 C.F.R. parts 1500-1508.
(f) The Community Development Program has been developed so as to give
maximum feasible priority to activities which will benefit low and
moderate income families or aid in the prevention or elimination
of slums and blight.

The requirement for this certification will not preclude
NRCD from
approving an application where the applicant certifies, and NRCD
' determines, that all or part of the Community Development Program
activities are designed to meet other community development needs
having particular urgency as specifically explained in the appli-
cation in accordance with Section .0800 of 15 NCAC 13L of the
North Carolina Administrative Code.
(g) Its program will be conducted and administered in conformity with
' Public Law 88-352 and Public Law 90-284, and that it will
affirmatively further fair housing.
' (h) It will comply with all provisions of 15 NCAC 13L of the North
Carolina Administrative Code, entitled North Carolina Community
Development Block Grant Program.
' (i) It will give NRCD, HUD and the Comptroller General through any
authorized representatives access to and the right to examine
all records, books, papers or documents related to the grant.
1 (j) It will establish safeguards to prohibit employees from using
positions for a purpose that is or gives the appearance of being
motivated by a desire for private gain for themselves or others,
particularly those with whom they have family, business, or other
ties.
' (k) It will minimize displacement of persons as a result of activities
assisted with CDBG funds.
1 (1) It will not attempt to recover any capital costs of public
improvements assisted in whole or part under Section 106 of the
Act or with amounts resulting from a guarantee under Section 108
of the Act by assessing any amount against properties owned and
' occupied by persons of low and moderate income, including any fee
charged or assessment made as a condition of obtaining access to
such public improvements, unless (i) funds received under Section
' 106 are used to pay the proportion of such fee or assessment that
relates to the capital costs of such public improvements that are
financed from revenue sources other than under this title; or
(ii) for purposes of assessing any amount against properties owned
and occupied by persons of low and moderate income who are not
persons of very low income, the grantee certifies to the Secretary
or such State, as the case may be, that it lacks sufficient funds
II received under Section 106 to comply with the requirements of
clause (i) .
' (m) It has or will develop a plan that identifies community develop-
ment and housing needs, including the needs of low and moderate
income persons, and the activities to be undertaken to meet such
needs.

concerning lead-based paint will comply with 24 C.F.R. 570.608.

I give my enthusiastic support to Orange County's effort to secure
funding for more low-cost housing through Habitat for Humanity. By
11 utilizing the volunteers of Habitat the Demonstration Project Grant
multiplies its effectiveness.
Our congregation, United Church of Chapel Hill , has a member on the
Habitat for Humanity Board of Directors, made a gift a year ago of
$2500, and has had various people involved as contributors and workers.
I think the future will find this congregation and other local
congregations more involved.
As President of the Inter-Faith Council I can say that the IFC does
not meet without lamenting over the lack of affordable housing. The
demand on our emergency assistance funds for housing has grown to
menacing proportions. Any effort to provide more low-cost housing
should be supported.

Dear Ladies and Gentlemen:
I am writing this letter as support for the Orange County Habitat
for Humanity project and Interfaith Council. Habitat for Humanity, through
the offices of Interfaith Council, is seeking a grant in the amount of
$140,000 of Federal monies from the State of North Carolina to built four
low income houses in the Chapel Hill-Carrboro area. Several members of my
congregation are intimately involved in Habitat for Humanity, and the parish
has budgeted money through our Outreach Fund to support that organization.
In addition, we are presently in the process of raising money in a joint
effort with the Chapel of the Cross to build a low income house in Carrboro.
Further, members of my congregation have volunteered timeaidrenergy to work
for the Habitat projects in the Carrboro area, and we will be providing
physical labor to build the house for which we are currently trying to raise
the funds.
This letter is intended to show our support for the Demonstration
Project Grant for low income housing which Habitat and Interfaith Council
is trying to receive through the State of North Carolina. I pray that the
Orange County Commissioners will give your support to this grant proposal.

The estimates on the following page indicate: (1) the costs for all the
materials, including the well and septic system, building permits and
salary for the construction superintendent in the building of a typical
1000 square foot single family house by Orange County Habitat for
Humanity, utilizing a system of panelized components; and (2) the cost for
constructing 1100 linear feet of a twenty foot wide road, which will be
built to NCDOT construction standards, serving 8 individual lots in the
Chestnut Oaks Subdivision. All ancillary work, including drainage and
grading, will be carried out by qualified contractors who are volunteering
their time to Habitat.

Orange County Habitat was organized in the spring of 1984, being chartered
as a non-profit corporation on April 13, 1984. It was approved as a 501 (c) (3)
organization by the Internal Revenue Service on May 16, 1985. Its purpose is
to provide safe, decent housing to God's people in need, at no profit and with
no interest. It does this through the utilization of numerous volunteers (366
at last count), donations of money, materials and skilled labor from many
individuals, churches and organizations.
The local chapter is affiliated with the national organization, Habitat for
Humanity, Inc., through a charter, and by continuing covenantal relationship
with the national group. However, the local group is autonomous and incor-
porated with an independent board. A list of officers, board members, by-laws
and committee members is included.
In Orange County, we made a proposal to Access, Inc., title holder to a 72
acre tract of land, formerly_ used by Genesis House as a drug rehabilitation
program site, to use the land for low cost housing. On condition that we raise
$35,000, preserve the natural beauty and contour of the land, verify our tax
If status, all within an 18 month period of time, Access gave Habitat the title
in October, 1985. After some months of study and survey work, Habitat sub-
mitted plans for a minor subdivision status, and began work on the first house
in May of 1986. In October, 1986, a second house was moved onto a second lot,
as the first house was dedicated. The first family occupied the first house
in February, 1987, and the second family will be moving into the second house
in September, 1987. A third house is now on lot #3, and another family will

be into their house in November, 1987.
In Carrboro, in cooperation with the city, and through them, with a Community
IF Development Block Grant proposal, six potential .logs: have been made available
to Habitat. On September 11, an "old-fashioned" house raising will erect
walls and roof on this structure. We hope to have another family in place by

Dear Rick:
Following our previous phone conversations, this is a
letter formally requesting the assistance of IFC in
applying for a Demonstration Project Grant from the
state, but administered through the Orange County Com-
missioners.
The problem that arises from our p ers e v
the national board of Habitat forHumanityhassestablish-
' ed a policy that they (and we) do not accept any govern-
mental grants. The rationale is that part of Habitat' s
mission is to make parishes and individual Christians
aware of the plight of the poor, and encourage their per-
sonal and direct responsibility through organizations
like Habitat. Secondarily, there are concerns about
either getting enmeshed in governmental red tape and
! bureaucracy, or becoming overly dependent on govern-
mental sources of income. However, the national board
and local affiliates encourage cooperation with local
governmental agencies in providing assistance where
possible, including the acceptance of land and materials.
There is some debate about this at the national board
level, but the policy as stated ("we accept no direct
governmental dollars") is the rule.
Our own local board has its own debate. To ask IFC to
become our "middleman" in this process solves the letter
of the law, but possibly violates the spirit of the "law".
To call it that, structurally you must understand that each
affiliate is incorporated independently, but maintains a
"covenant" relationship of good faith with the national
organization.
I am advocating that we persue the grant through the county
I , with IFC' s assistance. We have asked for $140, 000 to fund
the construction of 4 houses ($35,000/house X 4 houses) ,
this fee includes material costs and labor costs, which the
project grant is authorized to reimburse. It is innovative
in approach, utilizing modular construction and volunteers.

' Tara Fikes of the Orange County Housing and Community Devel-
opment Department assures us that they are committed to the
administration of the monies, including audit responsibili-
ties with the state and national offices.
' That would mean that there would be a straightforward approach
of presenting our monthly expenditures to IFC (or to Orange
County) , their issuing a check to IFC for the project, and
then IFC issuing a check to Habitat.
' That is the process as I now understand it. We request
IFC' s assistance in this grant request as outlined above.
By copy of this to our national director, Ted Swisher, and
other correspondence to the national board, we hope to
effect some change in the national policy.

Ithe past year, as a registered architect, I have been Involved primarily in
supplying architectural and planning services, either in the means of
I designing several of the houses or in the layout of the subdivision at
Chestnut Oaks Subdivision. During this time I have been part of both the
Building and Site Selection Committees.
IAs so often occurs when a person involves themselves in
meaningful voluntary work, i feel that I have obtained as much from
Iworking with this group as I have contributed
I I have always been interested in the provision of low-cost
shelter and the development of successful residential communities. The
work with Habitat has provided me with this opportunity.
IIn particular I have been involved with designing modularized
housing units that can been fabricated in a custom-designed"storage
shed", which will be later used as a community center.

rThese units will be transported to sites either in Carrboro or
In Chestnut Oaks and then erected as single-family houses both quickly and
' efficiently. Most importantly, this erection can be carried out by
non-skilled volunteers, including by members of the future family itself.
I am in the process of ending these families to become more
Involved with the actual design of their future residences, by means of
manipulating scale models of their units, and by looking more deeply and
responding to their needs and desires, not only about their house, but also
their community.

craftsman or professional; whether those volunteering to help or those in
' need of the help - this teamwork - and the results it is achieving, which

FOR THE PURPOSE OF
MAINTAINING AND STIMULATING THE .ADVANCEMENT OF HEALTH IN NORTH CAROLINA
This Contract Shall Cover a Period From
July 01, 1987 to June 30, 1988
NOW, THEREFORE, the State and the Department agree that the provisions and
clauses herein set forth shall be incorporated in and constitute the terms and
conditions applicable for the following activities involving State funding.

. A. WORK TO BE PERFORMED
1. The Department shall perform activities in compliance with applicable
program rules contained in the North Carolina Administrative Code as
well as all applicable Federal and State laws and regulations.
2. The Department shall submit for approval the required Program Contract
Addenda for State funded budgets.
3. The Department shall submit completed reports as required by budgeted
funding criteria and as specified in Listing of Required Fiscal and
Statistical Reports (Addenda 1) .
4. The Department shall administer and enforce all rules which have been
approved by the State and adopted by the Local Board of Health.
B. FUNDING STIPULATIONS
' . 1. Funding for this contract is subject to the availability of State,
Federal, and special funds for the purpose set forth in this Contract.
2. During the period of this Contract, the Department shall not use State
• funds received under this Contract to reduce locally appropriated funds
as reflected in the Local Health Department Budgets.
3. The Department shall not use Personal Health Program funds to support
environmental health personnel.
4. The Department shall comply with Department of Human Resources Minimum
Administrative Standards for Local Human Service Agencies, 10 NCAC 1K,
Sections .0100 - .0900; Standards for Mandated Public Health Services,
10 NCAC 12, Section .0200; and Administrative Procedures Manual for
Federal Block Grant Funds, 1 NCAC 33, Sections .0100 - .1502.
5. The Department shall maintain employee time records for the contract
period documenting the portion of time that each employee attributes to
each activity when State funds are budgeted for the support of employee
salaries and fringe benefits. The percentage of time each employee
spends in each activity shall be converted to dollars based upon the
employees' salary and benefits. These records will serve to document
salary and benefit expenditures reported. on DHS 2949, DHS 2950, and
compliance with Chapter 479, Section 99 of the 1985 Session Laws.
6. The Department shall be responsible for determination of eligibility as
• delegated by the Secretary, Department of Human Resources, when
providing Social Services Block Grant funded services.
7. The Department participating in Medicaid Reimbursement shall:
a. Comply with the terms of the Memorandum of Understanding between the
Division of Medical Assistance and the Division of Health Services
and the Local Participation Agreement dated July 1, 1984.

b. Make every reasonable effort to collect its cost in providing
services, for which Medicaid reimbursement is sought, through public
or private third party payors except where prohibited by Federal
• regulations or State law. No one shall be refused services solely
because of an inability to pay. All payments from persons, public
Cr private third party payors, shall be utilized for the activity
that earned it and shall not reduce or replace locally appropriated
funds during the period of this Contract. Use of program inane
generated by the expenditure of Federal categorical funds will be
governed by applicable Federal regulations, including but not
limited to, 45 CFR 74.
8. Funds budgeted for Adolescent Health Activities shall not be expended
for dues or out-of-state travel.
9. The Department shall have an annual audit performed in accordance with
The Single Audit Act of 1984 as implemented by CMB Circular 128. A copy
of the audit report shall be forwarded to the Division for review.
10. Equipment is a type of fixed asset consisting of specific items of
property that: (1) are tangible in nature; (2) have a life longer than
one year; and (3) have a significant value.
a. For Budgeting and Reporting Purposes
(1) Equipment purchases meeting the above definition and having a
dollar value of $200 or more must be budgeted and reported in
Line Item 5000.
(2) Women, Infants and Children Program
All medical equipment regardless of cost and all other equipment
with an aquisition cost of $500.00 or mare must be budgeted and
reported in Line Item 5000.
b. For Inventory Purposes
(1) Equipment must be accounted for in accordance with Local
Government Accounting System Procedure No. 15 or Federal
regulations (CFR 45, Part 74.140) , whichever has the lower
threshold and/or more detailed information requirement.
(2) Women, Infants and Children Program
All medical equipment regardless of cost and all other equipment
with an aquisition cost of $500.00 or more must be inventoried
- with the Division of Health Services. Cameras and accessories,
calculators, projectors, tape recorders, dictating equipment,
video equipment and accessories, computers and accessories and
computer software with a cost of $100.00 or more, and all books
and films regardless of cost must be recorded on the Fixed Asset
System.

c. For Prior Approval Purposes
(1) Equipment purchased with State/Federal funds must receive
prior written approval from the appropriate Office, Section, or
Branch when the acquisition cost exceeds $200.00.
(2) Women, Infants and Children Program
All medical equipment regardless of cost and all other equipment
with an acquisition cost of $500.00 or more must receive prior
approval from the program office.
(3) Equipment purchased with program incare generated by the
expenditure of Title X Family Planning Funds with an acquisition
cost of $500.00 or more must receive prior written approval from
the program.
C. FISCAL CONTROL
1. The Department shall comply with the Local Government Budget and Fiscal
Control Act, North Carolina General Statute Chapter 159, Article 3.
a. The Department shall maintain a purchasing and procurement system in
accordance with generally accepted accounting practices and
procedures set forth by the Local Government Commission.
b. The Department shall execute written agreements with all parties who
invoice the Department for payment for the provision of services to
patients.
c. The Department shall receive prior approval from the State when
subcontracting for services in the Wcarien, Infants and Children
Program.
d. When subcontracting, the following conditions must be met:
(1) The Department is not relieved of any of the duties and
responsibilities provided in this contract, and
(2) The subcontractor agrees to abide by the standards contained
herein or to provide such information as to allow the Department
to comply with these standards.
e. The Department shall retain all budgets, budget revisions,
contracts, contract addenda, and financial records in accordance
with the current Records Disposition Schedule issued by the Division
of Archives and History, Department of Cultural Resources.
2. The Department shall prepare and maintain a budget for each activity
covered by this contract in a manner consistent with instructions
provided with DHS 2947 (Rev. 03/86) and DHS 2948 (Rev. 03/86) .
a. The Department shall prepare budget revisions for prior approval of
the State when those revisions are in the School Health Program
(Line Item 6200) or Delivery Services Program (Line Item 6869) .

b. The Department shall prepare budget revisions for prior approval of
the State when State funds will be increased or decreased. .
c. The Department shall prepare an informational copy for the State of
all other budget revisions when proposed expenditures exceed the
line amount budgeted.
d. The Department shall submit all revisions prior to the end of the
term specified in this Contract. Budget revisions received by the
State after the end of the contract period will be returned without
action.
3. The Department shall observe the following conditions when budgeting and
reporting earned income revenues: ..
a. All earned income must be budgeted in the program where earned,
except that income earned by a program which has no activity budget
can be budgeted in a program approved by the Division.
b. Line Item 6864 shall be used to budget anticipated TXIX/SSBG
earnings.
c. Line Item 9000 shall be used to budget TXIX/SSBG fees.
d. Line Item 102 shall be used to report TXIX/SSBG fees received and
which are used to support TXIX/SSBG expenditures shown in Line Item
9000.
e. A local account shall be maintained for unbudgeted/unreported TXIX/
SSBG fees transferred to the Department. Accounts shall be
maintained in sufficient detail to identify the program source
generating the fees.
f. No more than one year's earnings (or $5,000.00 whichever is
greater) for any activity can be carried forward from one year to
the following year.
4. The Department shall submit a quarterly report of actual receipts and
expenditures of the Department according to instructions provided with
Expenditure Reports, DHS 2949 (Rev. 03/84) and DHS 2950 (Rev. 03/82) .
a. The Department shall submit to the State the final Expenditure
Report within 45 days after the end of the contract period.
b. The Department shall refund to the State all State funds not
supported by expenditures within 10 days after notification of
overpayment.
c. The Department shall follow Women, Infants and Children Program and
other Federal program reporting requirements when they differ from
those stated above.
d. The Department shall submit to the State WIC expenditure reports no
later than the 8th of the month.

e. Reimbursement of WIC approved expenditures for July, August, and
September cannot exceed one-fourth of the total budget for the
contract period.
5. The Department shall submit on an annual basis Staff Time Activity
Report, DHS 3389. The report shall accarrrpany the final expenditure
report and must be received by the State within 45 days after the end of
the contract period.
. 6. For Adolescent Health Activity, the Department agrees to (1) have
responsibility for the immediate direction and supervision of the
activities supported through the contract, which will be conducted in
accordance with the amended plan/update submdtted by the Department;
(2)submit any media material in writing to the Maternal and Child Health
Branch prior to release to the public for approval from the Maternal and
Child Health Branch prior to release to the public; (3) submit progress
reports in meeting project objectives within 30 days of each payment
period; (4) submit an evaluation report demonstrating achievement of
stated goals no later than August 15, 1988.
D. PERSONNEL POLICIES
The Department shall adhere to and fully comply with State personnel
policies as found in North Carolina General Statute, Chapter 126, and 1 NCAC
8. Such policies include, but are not limited to, the following:
1. Equal employment opportunity;
2. Affirmative action;
3. Policies for local government employment subject to the State
Personnel Act;
4. "Local Classification and Salary Range";
5. "Compensation Policy for Local Competitive Services Employees"; and
6. "Recruitment and Selection Policy and Procedures"
7. Sanitarians employed by the Department shall be delegated authority
by the State to administer and enforce State sanitation rules and
laws as directed by the State pursuant to G.S. 130A-4(b) . This
delegation shall be done according to 10 NCAC 10A .2300.
a. Local health departments are responsible for sending their
newly-employed public health sanitarians (interns) to 20 days of
initial field training/orientation at one of the designated
training centers within 90 days fran date of employment.
b. The employing health department shall reimburse the training
center(s) $25 per day for providing initial field
training/orientation for the newly-employed public health
sanitarian.

c. Initial field training/orientation centers shall be paid within
90 days by the employing health department for services
rendered.
d. Arrangements for initial field training/orientation including
designation of the training center for newly-employed public
health sanitarians will be handled by the Sanitation Branch,
Environmental Health Section.
E. CONFIDENTIALITY
All information as to personal facts and circumstances obtained by
Department personnel in connection with the provision of services or other
activity under this Contract shall be privileged ca wnication, shall be
held confidential, and shall . not be divulged without the responsible
person's written consent except as may be otherwise required by applicable
law or regulation. Such information may be disclosed in summary,
statistical, or other form which does not directly or indirectly identify
particular individuals.
F. CIVIL RIGHTS
The Department shall assure that no person, on the grounds of race, color,
age, religion, sex, marital status, or national origin (unless otherwise
medically indicated) or otherwise qualified handicapped individual solely by
reason of his/her handicap be excluded from participation in, be denied the
benefits of, or be subjected to discrimination under any program or activity
covered by this Contract. The Department shall complete HEW Form 441,
Assurance of Compliance with the Department of Health and Welfare
regulations, under Title VI of the Civil Rights Act of 1964; for the WO ens,
Infants and Children Program, FNS-64, Assurance of Compliance with the
Department of Agriculture Food and Nutrition Service, under Title VI of the
Civil Rights Act of 1964; and HEW Form 641, Assurance of Compliance with
Section 504 of the Rehabilitation Act of 1973.
G. RESPONSIBILITIES OF THE STATE
1. The State shall provide to the Department upon request technical
assistance in the preparation of the Consolidated Contract/Activity
Budgets and Contract Addenda.
2. The State shall specify those administrative forms/reports and their
respective revision dates that are required by particular activities
pertaining to the Department's budget with the State in Listing of
Required Fiscal and Statistical Reports (Addendum 1) for the contract
period. New forms/reports not listed in Required Fiscal and Statistical
Reports shall be implemented during a contract period only with the
approval of the State Health Director.
3. The State shall provide to the Department within thirty (30) days after
receiving an activity budget from the Department an approved signed copy
of the budget.

4. The State Shall provide funds to the Department upon approval of the
Contract Addenda, activity budgets, and signing of this Contract.
5. The State shall assist the Department to comply with all applicable
laws, regulations, and standards relating to the activities covered in
this Contract.
6. The State reserves the right to conduct reviews to determine compliance
with the terms of this Contract.
7. The State shall be assured that the Department maintains expenditure of
locally appropriated funds for maternal health, child health, and family
planning activities equal to or greater than that reported on the Staff
Time Activity Report for the period beginning July 1, 1984, and ending
June 30, 1985. This maintenance of effort shall be measured by salary
equivalencies which are to be maintained in accordance with Section B.
5. of this contract.
H. DISBURSEMENT OF FUNDS
The State shall disburse funds to the Department as follows:
1. For departments receiving disbursements through the Governmental
Monetary Transfer System (GMTS)
a. For the first quarter. Provided that the Consolidated Contract is
properly executed, payment equal to one-twelfth (1/12) of the total
program grant funds for each approved budget shall be made on the
fifteenth (15th) of July, August, and September.
b. For the second quarter. Payment equal to 1/12 of the total program
grant func•.s shall be made on October 15th and November 15th.
Provided that the first quarter expenditure report is received by
November 1, payment equal to 1/12 of the total program grant funds
adjusted by over (under) expenditures reported for the first quarter
shall be made on December 15th.
c. For the third quarter. Provided that the first quarter expenditure
report has been received, payment equal to 1/12 of the total program
grant funds shall be made on January 15th and February 15th.
Provided that the second quarter expenditure report is received by
February 1, payment equal to 1/12 of the total program grant funds
adjusted by over (under) expenditures reported for the second
quarter shall be made on March 15th.
d. For the fourth quarter. Provided that the first and second quarter
expenditure reports have been received, payment equal to 1/12 of the
total program grant funds shall be made on April 15th and May 15th.
Provided that the third quarter expenditure report is received by
May 1, payment equal to 1/12 of the total program grant funds
adjusted by over (under) expenditures reported for the third quarter
shall be made on June 15th.

e. Final payment. Provided that the fourth quarter expenditure report
is received by August 15, 1988, payment equal to the difference
between approved reported expenditures and the sum of previous
payments shall be made cn September 15.
f. Quarterly payment for reported expenditures in Line Item 1000 shall
be limited to one-fourth of the budgeted amount in that line item.
g. Increased or decreased payments necessitated by changes in the total
budgeted amount will be reflected in the monthly payments subsequent
to approval of the budget revision.
h. Payments shall be suspended when expenditure reports are not
received by the dates specified. Payments will resume on the
specified dates in the months subsequent to receipt of the
expenditure reports.
2. For departments not participating in the Governmental Monetary Transfer
System (GMTS) and selecting monthly payment by check option
. a. For the first quarter. Provided that the Consolidated Contract is
properly executed, payment equal to one-twelfth (1/12) of the total
program grant funds for each approved budget shall be made on the
twenty-fifth (25th) of July, August, and September.
b. For the second quarter. Payment equal to 1/12 of the total program
grant funds shall be made on October 25th. Provided that the first
quarter expenditure report is received by November 1, payment equal
to 1/12 of the total program grant funds adjusted by over (under)
expenditures reported for the first quarter shall be made on
November 25th and December 25th.
c. For the third quarter. Provided that the first quarter expenditure
report has been received, payment equal to 1/12 of the total program
grant funds shall be made on January 25th. Provided that the second
quarter expenditure report is received by February 1, payment equal
to 1/12 of the total program grant funds adjusted by over (under)
expenditures reported for the second quarter shall be made on
February 25th and March 25th.
d. For the fourth quarter. Provided that the first and second quarter
expenditure reports have been received, payment equal to 1/12 of the
total program grant funds shall be made on April 25th. Provided
that the third quarter expenditure report is received by May 1,
payment equal to 1/12 of the total program grant funds adjusted by
over (under) expenditures reported for the third quarter shall be
made on May 25th and June 25th.
e. Final payment. Provided that the fourth quarter expenditure report
is received by August 15, 1988, payment equal to the difference
between approved reported expenditures and the sum of previous
payments shall be made on September 25.
f. Quarterly payment for reported expenditures in Line Item 1000 shall
be limited to one-fourth of the budgeted amount in that line item.

approved expenditures shall be made on the 25th of February.
c. For the third quarter. Provided that the third quarter expenditure
report is received by May 1, payment equal to approved reported
expenditures shall be made on the 25th of May.
d. For the fourth quarter. Provided that the fourth quarter
expenditure report is received by August 15, 1988, payment equal to
approved reported expenditures shall be made on the 25th of
Septeirber..
e. Quarterly payment for reported expenditures in Line Item 1000 shall
be limited to one-fourth of the budgeted amount in that line item.
f. Quarterly payment for approved reported expenditures not received by
the specified dates shall be made in the month subsequent to receipt
of the reports.
4. Transfer of TXIX/SSBG Fees
a. Upon receipt of Title XIX/SSBG fees, transfer of such funds will be
made to departrrients participating in GMTS on the 15th of the month
and to departments not participating in GMTS on the 25th of the
month.
b. When fees received exceed the amount shown in line item 6864 an
internal adjustment will be made to increase the amount shown.
I. AMENDMENT OF CONTRACT
Amendments, modifications, or waivers of this contract may be made at any
time by mutual agreement of all parties. Amendments shall be in writing and
signed by appropriate authorities.

J. PROVISION OF TERMINATION
This contract may be terminated for reasons other than non-compliance upon
sixty (60) days written notice by either party. If termination should
occur, the Department shall receive payment only for allowable expenditures.
The State may withhold payment to the Department until the State can
determine whether the Department is entitled to further payment or whether
the State is entitled to a refund.
K. COMPLIANCE
1. The State shall assure compliance with all terms of this Contract.
a. Upon determination of non-compliance, the State shall give the
Department sixty (60) days written notice to come into compliance.
If the deficiencey is corrected, the Department shall submit a
written report to the State which sets forth the corrective action
taken.
b. If the above deficiencies should not be corrected to the
satisfaction of the State after the sixty (60) day period,
disbursement of funds for the particular activity may be temporarily
suspended pending negotiation of a plan of corrective action.
c. If the deficiency is still not corrected within the next thirty (30)
days following temporary suspension of funding, program funds may be
permanently suspended until the Department can provide evidence that
the deficiencies have been corrected.
d. In the event of the Department's non-compliance with clauses of this
Contract, the State may cancel, terminate, or suspend this Contract
in whole or in part and the Department may be declared ineligible
for further State contracts or agreements. Such terminations for
non-compliance shall not occur until: (1) the provisions of Section
K-1 (a-c) have been followed, documented, and have failed to provide
a resolution, (2) all other reasonable administrative remedies have
been exhausted.
2. If the Department or the State should be determined out of compliance
with the provisions of this Contract, either party may file a formal
appeal with the Department of Hunan Resources. The appeal shall be
heard by the Department of Human Resources within twenty (20) days of
the written request. After hearing all the facts relative to the
appeal, the Department of Human Resources shall decide within ten (10)
days of the date of the hearing what sanctions, if any, shall be imposed
on the party found out of compliance.

AGREEMENT BETWEEN
ORANGE COUNTY HEALTH DEPARTMENT
AND
THE UNIVERSITY OF NORTH CAROLINA AT CHAPEL HILL
For Its Department of Obstetrics and Gynecology in the School of Medicine
THIS AGREEMENT, made and entered into this the 1st day of July,
1987,
by and between The University of North Carolina at Chapel Hill, hereinafter
Gynecology
referred to as "The University," for its Dep= r tries , hereinafter
Gynecology
in the School of Medicine; and the Orange County Health Dep�.
referred to as the "OCHD."
W I T N E S S E T H :
WHEREAS, OCHD desires to contract with The University for obstetrical
and gynecological professional services to improve obstetrical care; pa
understanding and satisfaction, and communication between the care providers
in the Orange County Health Department and The University's Department of
Obstetrics and Gyneoology; and
WHEREAS, The University's Department of Obstetrics and Gynecology desires
to provide these services for OCHD;
NOW, THEREFORE, in consideration of the premises an d of the following mutual
promises, covenants, and conditions, OCHD and The University agree as follows:
A. A third year resident in Obstetrics and Gynecology will be assigned
for a minimum period of ten weeks to the Hillsborough Clinic every Thursday
beginning at 1:00 p.m. to 3:30 p.m_ An exception to this time schedule is the
3rd Thursday of each month when the resident will begin at 1:30 p.m. The
assigned resident shall notify the clinic manager no later than 1:00 p.m. of
a change in the expected arrival time in clinic. The resident's function will
be:
1. To provide normal prenatal care
2. To provide high risk prenatal care to patients who may be
referred by the nurse practitioner.
3. To serve as backup obstetric and gyn ecologic consultant for the
nurse practitioner.
4. To assist in the dispensing of prenatal medications.
5. To consult with the senior attending at NCMH about patient
referrals and high-risk patients.

All care rendered will be appropriately documented in writing.
B. The Medical Director of OCHD will be in attendance every Thrusday
between the inclusive hours of 1:30 p.m. and 4:30 p.m. for the following
purposes:
1. Consultation about patient referrals from nurse practitioner.
2. To serve as primary obstetric and gynecologic supervisor for OCHD
nurse practitioner, perform chart verification and signature for
all prenatal patients who have been seen by the nurse practitioner
and the resident during the previous week as required by the Board
of Medical Examiners.
3. Individual and Group conferences with residents, nurse practitioner,
Public Health nurses, for staff development and explanation of
OCHD policies and management procedures, case conferences and
in-service education.
4. Development of standing orders procedure manual for nurses,
nurse-practitioners and residents.
5. The Medical Director shall accept responsibility for the work
done by the nurse practitioners during the morning hours of
each clinic.
C. The University's Department of Obstetrics and Gyencology proposes to
contract for 50 clinics per year (there being no clinic during Thanksgiving
week and allowance being made for one additional week relative to an agreed
upon holiday) . Each clinic will require 2 1/2 hours of resident time. For
50 clinics the total cost per year would be $7,641.00.
D. This Agreement shall run for a period of one (1) year from the 1st
day of July, 1987 to the 30th day of June, 1988 and shall be renewable from
year to year thereafter upon written notice executed by both parties.
E. This Agreement or its renewals may be terminated at any time without
penalty by either party provided that written notice of such termination is
furnished to the other party at least 30 days prior to termination. In the
event of such termination any payment due shall be prorated to the date of
termination.
F. It is the intent and purpose of this Department to send a senior
resident; however, due to circumstances beyond our control, it may be that
a resident other than 3rd year may necessarily attend the clinic.

G. The OCHD hereby agrees with The University that, in its educational
and/or employment practices, said contracting party will comply with such
non-discrimination laws as may be applicable to it in the performance of this
contract.
H. This Agreement contains the entire understanding of the parties and
shall not be altered, amended or modified, except by an agreement in writing
executed by the duly authorized officals of both parties.
I. The laws of North Carolina shall govern the validity and interpretation
of the provisions, terms and conditions of the Agreement.
IN WITNESS WHEREOF, the parties have hereunto signed this Agreement in
their official capacities on the day and year listed below.
