ADJOURNMENT APPROVED SEPTEMBER 2 1986 1 MINUTES ORANGE COUNTY BOARD OF COMMISSIONERS REGULAR MEETING JULY 23, 1986 The Orange County Board of Commissioner met in regular session on July 23, 1986, 7:30 p.m. in the Courtroom of the old Post Office, Chapel Hill, North Carolina. BOARD MEMBERS PRESENT: Chair Don Willhoit and Commissioners Shirley Marshall, and Moses Carey. BOARD MEMBERS ABSENT: Commissioners Ben Lloyd and Norman Walker. ATTORNEY PRESENT: Geoffrey Gledhill. STAFF PRESENT: County Manager Kenneth R. BOARD COMMENTS Chair Don Willhoit announced a meeting will be held next Tuesday, July 29 with Alamance County at 7:00 p.m. at the Technical College of Alamance for the purpose of discussing solid waste incineration and water. B. AUDIENCE COMMENTS 1. MATTERS ON THE PRINTED AGENDA Chair Willhoit announced that those persons who would like to make comments will be recognized at the time that item is discussed. 2. MATTERS NOT ON THE PRINTED AGENDA None. C. PUBLIC HEARING ,1. PUBLIC HEARING ON THE LEVY OF AN ADDITIONAL ONE-HALF PERCENT LOCAL SALES AND USE TAX IN ORANGE COUNTY Gordon Baker presented information on the additional one-half percent local sales and use tax. He stated that the General Assembly has given authorization to counties to levy an additional one half percent local sales and use tax to give counties and municipalities another source of income to meet their growing financial needs and reduce reliance on other revenue sources such as property tax and Revenue Sharing. There are restrictions which dictate how the tax must be distributed. THE PUBLIC HEARING WAS OPEN FOR CITIZEN COMMENTS. 1. IRA TROLLINGER, Assistant Superintendent and Director of Instruction for Orange County Schools, read a prepared statement from Orange County School Superintendent Dan Lunsford. Lunsford stated that the Orange County School Board adopted a resolution in support of the additional one-half sales tax with 100% of the proceeds to be used for school capital needs. If the sales tax is approved he asked that the Board meet with the two school systems in the fall of 1986 to review the project status with the purpose of accelerating the current planned projects for both school systems. He requested that with the Counties . portion of the sales tax, the County consider a small amount for current expenses for program refinements on the current mark-up list. He asked that another $10.00 be added to the per pupil amount. 2. LINDSEY ELAND. Orange County School Board Chair, spoke in support of the one- half cent tax and asked that part of the money be used for program enhancements. He asked that further consideration be given to funding the media center for the High School this year. 3 . ,LIBBA WELLS, spoke in support of the one-half cent tax increase. It is an important source of funds which the schools can use for capital improvements. 4 . TED LATTA, spoke in support of the one-half cent sales tax and asked that it be earmarked totally for schools. 5. SUE . BAKER, Chapel Hi1l-Carrboro School Board Chair, asked that the Board approve the one-half cent tax. She expressed the concern for meeting the needs with the current capital allocation as proposed. 6. TED PARRIsH. member of the Chapel Hill-Carrboro Board of Education, spoke in support of the passage of the sales tax for Orange County. 7. SHAWN WALSH spoke against the levying of the additional one- half cent sales tax. WITH NO FURTHER COMMENTS, THE PUBLIC HEARING WAS CLOSED. D. ITEMS FOR DECISION 1. CONSIDE RATION OF LEVYING THE ONE-HALF PERCENT LOCAL SALES AND USE TAX FOR ORANGE COUNTY. Motion was made by Commissioner Marshall, seconded by Commissioner Carey to approve the resolution to levy the additional one-half percent local sales and use tax for Orange County. A RESOLUTION LEVYING A ONE-HALF PER CENT (1/2%) ADDITIONAL LOCAL GOVERNMENT SALES AND USE TAX IN ORANGE COUNTY AS AUTHORIZED BY ARTICLE 42 CHAPTER 105 OF THE NORTH CAROLINA GENERAL STATUTES WHEREAS, the Board of Commissioners of Orange County is now of the 1 opinion and does hereby find and declare that the levy of a one-half per cent (1/2*) additional local government sales and use tax within Orange County is both desirable and necessary to adequately finance the operation of the county and the cities and towns herein; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Orange County as follows: Section 1. There is hereby imposed and levied within Orange County the one-half per cent (1/2%) supplemental local government sales and use tax authorized by Ratified Chapter 906 of the 1985 Session Laws (Regular Session, 1986) , and codified as Article 42 of Chapter 105 of the General Statutes of North Carolina, effective July 7, 1986. The tax hereby imposed and levied shall apply to the same extent and be subject to the same limitations as are set forth in said Chapter 906. Section 2. Collection of the tax by the North Carolina Secretary of Revenue, and liability therefore, shall begin and continue on and after the first day of September, 1986. Section 3 . The net proceeds of the tax levied herein shall be distributed by the Secretary of Revenue as provided by law. Section 4. This Resolution shall become effective upon its adoption and a certified copy hereof shall be delivered to the North Carolina Secretary of Revenue. Adopted this 23rd day of July, 1986. VOTE: UNANIMOUS. 2. WATER CONSERVATION ORDINANCE (SECOND READING) (The Drought Management Plan is on page of these minutes) Motion was made by Commissioner Carey, seconded by Commissioner Marshall to amend the existing Water Conservation Ordinance with the addition of paragraph 2 under Article 2 (as stated below) and the adoption of the drought management plan as presented by the County Manager. ARTICLE 2 PARAGRAPH 2 "With wri ten approval by the Orange County Manager transfer s limitations may be waived on a temporary basis in order to comply with physical system limitations which require the transfer of larger quantities, when an exception is granted the water transferred in any one transfer shall not exceed the sum of seven times the daily transfer limitations for the user. The water transferred weekly to the user requesting an exception shall not exceed the water usage/allocation limit for the user established in Table II. The user requesting the transfer exception shall give written substantiation of the need for the exception with its request. " VOTE: UNANIMOUS, Chair Don Willhoit stated that Mayor Sheffield expressed concern that the Ordinance does not permit the Town of Hillsborough to transfer water to OWASA when the Alert Stage is reached. Willhoit requested that the County Attorney draft an amendment to the Ordinance that would allow for the transfer of water under certain conditions. Geoffrey Gledhill explained that the amendment would permit the 1 transfer of water to OWASA up to 1/2 million gallons a day during ACTION " STAGES II-VI when the number of usable days of water remaining from all other water sources available to OWASA is less than the number of days remaining in the water supply of Lake Ben Johnston, Corporation Lake and Lake Orange and the number of usable days would be computed on the basis of the allocations that are in the table including instream flow. Commissioner Marshall expressed concern that OWASA has not provided the figures requested by NRCD last March and if the amendment is approved, the figures may be delayed. 4 AMENDMENT TO THE WATER CONSERVATION ORDINANCE - FIRST READIN Motion was made by Commissioner Carey, seconded by Chair Willhoit ' to adopt the amendment as stated below: (A) During ACTION STAGES II-VI of the Lake Orange Conservation Stages, OWASA shall be allocated up to .50 MGD, which may be withdrawn as prescribed in this ordinance and as prescribed in any contract between OWASA and other water users named in this TABLE II. Any such allocation shall only occur when the number of usable days of water remaining from all other water supply sources available to OWASA is less than the number of usable days of water remaining in the water supply reservoirs of Lake Ben Johnston, Corporation Lake and Lake Orange including augmentation from other sources. The number of usable days of water remaining in the water supply reservoirs of Lake Ben Johnston, corporation Lake and Lake Orange includin g augmentation sources shall be determined using the water usagallocation©m limit, including instream flow, established in this TABLE II. VOTE: AYES, 2; NOES, 1 (Commissioner Marshall) . Chair Willhoit noted that water would not be transferred until the figures are provided by OWASA to NRCD as requested. CABLE TELEVISION FRANCHISE TRANSFER (SECOND READING) Motion was made by commissioner Marshall, seconded by Commissioner Carey to adopt the resolution approving the transfer of Village Cable's Cable Television Franchise to Prime Venture I. RESOLUTION OF THE ORANGE COUNTY BOARD OF COMMISSIONERS APPROVING TRANSFER OF VILLAGE CABLE'S CABLE TELEVISION FRANCHISE TO PRIME VENTURE WHEREAS, the Board of Commissioners of Orange County by an ordinance effective February 24, 1981, granted to Village Cable of Orange County, Inc. ("Village Cable") a franchise to operate a cable television system in Orange County; and WHEREAS, Village Cable, on June 11, 1986, entered into an asset purchase agreement with Prime Venture I, Inc. ("Prime Venture") , a Delaware Corporation, for the sale and transfer of substantially all of Village Cable's assets, including its cable television system in orange County, to Prime Venture; and WHEREAS, Village Cable has requested permission from the Board of Commissioners to transfer its rights under the franchise to Prime Venture; and WHEREAS, Prime Venture agrees to accept the terms and obligations of the franchise as transferred; and WHEREAS, Prime Venture agrees to be bound by the memorandum of Agreement concerning handling of citizen requests for the extension of Cable TV service and to maintain a local office for the purpose of handling subscriber complaints and providing prompt maintenance service; and WHEREAS, Prime Venture agrees to provide an audited report of gross annual receipts as provided for in Section XIII of the Cable Television System Ordinance; and WHEREAS, the Board of Commissioners has determined that Prime venture is qualified to hold the cable television franchise; • NOW, THEREFORE, BE IT RESOLVED by the Orange County Board of Commissioners that: 1. Upon consummation of the asset purchase agreement between , Village Cable and Prime Venture and the successful transfer of they assets of Village Cable to Prime Venture, and the signed acceptance of this resolution by Prime Venture, all rights and obligations of Village Cable incorporated in the cable television franchise ordinance and franchise cited above are transferred to Prime Venture. 2. All other provisions of the franchise ordinance and franchise shall remain in effect. VOTE: UNANIMOUS. 4. AIR AMBULANCE CERTIFICATE AND FRANCHISs (Copy is in the permanent agenda file in the Clerk's Office) Motion was made by Commissioner Carey, seconded byt Commissioner Marshall to approve the certificate and franchise which will allow the North Carolina memorial Hospital Air Ambulance Program to provide emergency medical services and transportation of patients within Orange County. VOTE: UNANIMOUS. 5. AMBULANCE CERTIFICATE AND FRANCHISE (Copy is in the permanent agenda file in the Clerk's Office) Motion was made by Commissioner Marshall, seconded by Commissioner Carey to approve the certificate and franchise which will I allow for the regulation and administration of emergency medical services on the premises of Orange County Speedway as provided by County Ordinance. VOTE: UNANIMOUS. 6. COUNTY ANNEX RENOVATION PLUMBING BID AW, •D Motion was made by Commissioner Carey, seconded by Commissioner Marshall to award the plumbing section of the Revere Road County Annex renovation project to Process Plumbing and Piping, Raleigh, NC for a sum of $15,900 and authorize the Chair to sign on behalf of the Board contingent upon the adoption of the 1986-87 budget. VOTE: UNANIMOUS. 4. 1986-87 BUDGET ADOPTION Gordon Baker distributed a revised mark-up/mark-down list that was discussed at the July 10 Board meeting. The mark-down items totaled $56, 237• The fixed expenditures which cannot be reduced totaled $26, 890. The capital items reduced totaled $8,582 which is not reflected in the total. The revised mark-up list totals $540, 095 of which $214,725 is for long range school capital . Baker reviewed the revenues including the monies expected from the additional one-half sales tax. He presented the revisions of the affects on the fund balance of the various tax increases. In conclusion he presented the projected fund balance available for general fund revised as of July 22, 1986. Commissioner Marshall noted that the mark-up of $30,000 for the mapping project in the Land Records Office had been left off the list and should be included. Chair Willhoit asked that $12,50p be added for Agricultural Extension contingent upon resolving problems. Don Willhoit explained for the benefit of the two school systems that the only way to increase their allocation for current capital would a be to increase the property tax rate, 6 After a brief discussion on the personnel merit program, motion was ' made by Commissioner Carey, seconded by Commissioner Marshall to a pprove the option 4 merit program as presented by the Personnel Director. VOTE: UNANIMOUS. Commissioner Marshall asked that the Personnel Ordinance be reviewed by the Board in December or January. Chair Willhoit suggested that $306, 000 ($156, 000 for Orange County Schools and $150, 000 for Chapel Hill-Carrboro Schools) be allocated for roof work out of the projected revenue for schools from the additional one-half cent sales tax. Motion was made by Chair Willhoit, seconded by Commissioner Marshall to adopt the 1986-87 Budget Ordinance. (Copy of the Budget Ordinance is on pages _ of these minutes. VOTE: UNANIMOUS. F. ADJOURNMENT With no further business to come before the Board, Chair Willhoit adjourned the meeting. Adopt the drought management plan. 011 AN ORDINANCE PROVIDING FOR THE CONSERVATION OF WATER DURING A WATER SHORTAGE, RESTRICTING THE USE OF WATER AND WATER WITHDRAWALS, AND ALLOCATING AUGMENTED STREAMFLOW f 3 FROM RESERVOIRS. WHEREAS, University Lake is a significant source of raw water from which the Orange Water and Sewer Authority supplies water to Orange County; and , WHEREAS, a critical water supply condition exists on the upper Eno River with only Lake Orange to rely upon in times of drought as a significant reserve water source for (a) supplying Hillsborough, Orange Water and Sewer Authority, and Orange-Alamance, and for (b) augmenting streamflow in the Eno River to assimilate waste discharge from the Town of Hillsborough Wastewater Treatment Plant; and WHEREAS, the level of both University Lake and Lake Orange must be managed to insure that Orange County citizens have essential supplies of water in these reservoirs can extend the time and availability of suplies for all users during critical periods; and WHEREAS, some degree of demand reduction and cooperation by the users of the water in these reservoirs can extend the time and availabi- lity of supplies for all users during critical periods; and WHEREAS, no user has the right to withdraw a disproportionate share of the augmented flow nor reduce natural streamflow Such that other downstream riparian needs and instream needs cannot be satisfied; and WHEREAS, General Statutes Section 153A-121 authorizes owners of stored 014 water to set rules to govern water allocation during drought periods; and WHEREAS, Orange County has developed conservation rules and an allocation plan based upon monthly raw water withdrawal records, modeling of streamflow conditions as have existed over a 40 year period by the North Carolina Division of Water Resources, and calculation of the 7-day 10 year low flow at Lake Ben Johnson. NOW, THEREFORE, the Board of County Commissioners of Orange County, pursuant to North Carolina General Statutes Section 153A-121, ORDAINS: ARTICLE 1. Water Shorta•e and Withdrawal Conservation Restrictions. A. While water is flowing over the Lake Orange spillway normal con- ditions will be deemed to exist with no withdrawal or conserva- tion restrictions to be enforced. A water shortage shall be declared to exist with respect to Lake Orange, whenever the level of Lake Orange reaches the second of seven stages shown on Table 1, or whenever emergencies develop such that citizens cannot be supplied with water to protect their health, safety and welfare without curtailing the water demand. Conservation measures and a limit on withdrawals shall be insti- tuted upon reaching the alert stage and made more restrictive through successive stages of drought in an effort to prolong the availability of water. Each public water user must make allow- ance to pass below its intake facilities the prescribed minimum flow established for its service area plus the proportionate share of other water users' share plus instream flow need cal- culated for the Eno River below Lake Ben Johnson. Water withdrawal rates for public water users and instream flow releases shall be instituted in the amounts and per the condi- Old tions shown in Table II. B. A water shortage shall be deemed to exist, with respect to University Lake, whenever the level of University Lake reaches the second of the six stages shown on Table 1, or whenever emergencies develop such that citizens cannot be supplied with water to protect their health, safety and welfare without curtailing the water demand. C. In the event of a water shortage in either University Lake or. Lake Orange or both, the Chairman of the Board of County Commissioners is authorized, empowered, and directed to issue a public proclamation declaring to all persons the existence of such state and the severity thereof, and place in effect the restrictive provisions authorized in Article 3 of this ordinance. ARTICLE 2. Unlawful to Use Water Contrar to Provisions of this Ordinance. The streamflow requirements of the no River set forth in Table II, shall be in effect at all times from the effective date of this ordinance. From the effective date of this ordinance it shall be unlawful and a violation of this ordinance for any water user to cause the streamflow to be reduced below the levels herein set or to exceed the transfer limitations herein set. With written approval by the Orange County Manager transfer limitations may be waived on a temporary basis in order to comply with physical system limitations which require the transfer of larger quantities. When an exception is granted the water transferred in any one transfer shall not exceed the sum of seven times the daily transfer limitations for the user. The water transferred weekly to the user requesting an exception shall not exceed the water usage/allocation limit for the user established in Table II. The user requesting the transfer exception shall give written substantiation of the need for the exception with its request. In the, event the Chairman of the Board of County Commissioners issues O1 any proclamation authorized by Article 1, then it shall be unlawful for any person, firm, or corporation to use or permit the use of water from the Eno River through the facilities of the Orange-Alamance Water System, Inc. , the Town of Hillsborough, or the Orange Water and Sewer Authority (when supplied by the Town of Hillsborough) and water from any raw water supply within Orange County used by the Orange Water and Sewer Authority, in violation of any of the mandatory restrictions contained in the proclamation until the Chairman, by public proclamation, has declared a particular- stage of the water shortage to be over and the restrictions applicable to it no longer in effect. In light of the many benefits that can be derived by conserving water, all persons, firms, or corporations in Orange County using any of the , water supplies which are the subject of this ordinance should follow water conservation practices regardless of the time of year or whether or not a water shortage exists. Water conservation should be followed during all phases of construction--related activities. Water needed should be obtained from supplemental sources other than the Eno River portion lying above the Hillsborough Waste Treatment Plant. Where water for construction is needed from the Eno River written permission shall be obtained from a water providing utility. All such water shall be considered as a portion of the Utility's water allocation. A copy of the written approval shall be delivered to the Orange County Manager immediately. ARTICLE 3 . Restrictive Measures in Effect at Each Sta.e of a Water Shorta.e. The severity of the water shortage shall be determined by the emer- gency or the level of University Lake and Lake Orange as shown on Table 1. A. In the event the water level of University Lake declines to a stage II level above mean sea level, in feet, a stage II water 1 shortage ALERT shall be deemed in effect. In the event the water level of Lake Orange declines to a stage II elevation of water below Lake Orange spillway, in feet, a stage ii water shortage ALERT shall be deemed in effect. When a water shortage ALERT is in effect the following voluntary water restrictions are imposed: B. In the event the water level of University Lake declines to a stage III level above mean sea level, in feet, a stage III water shortage WARNING shall be deemed in effect. In the event the water level of Lake Orange declines to a stage III elevation of water below Lake Orange spillway, in feet, a stage III water shortage WARNING shall be deemed in effect, and in addition to 14 the restrictions heretofore imposed, the following moderate mandatory water restrictions shall be in effect. It shall be unlawful to use water from the public water system supplied by the Town of Hillsborough, Orange Alamance Water System or the Orange Water and Sewer Authority for the following purposes: C. In the event the water level of University Lake declines to a stage IV level above mean sea level, in feet, a stage Iv water shortage DANGER shall be deemed in effect. In the event the water level of Lake Orange declines to a stage IV elevation of water below Lake Orange spillway, in feet, a stage IV water shortage DANGER shall be deemed in effect, and in addition to the restrictions heretofore imposed, the following severe mandator water restrictions shall be in effect. It shall be unlawful: 1. To water or sprinkle any lawn. 2. To water any vegetable garden or ornamental shrubs except during the hours of 6:00 p.m. to 9:00 p.m. on Saturday. 3. To make any non-essential use of water for commercial or public use, and the use of single service plates and utensils is encouraged and recommended in restaurants. 016 1. D. In the event the water level of University Lake declines to a stage V level above mean sea level, in feet, a stage V water shortage EMERGENCY shall be deemed in effect. In the event the water level of Lake Orange declines to a stage V elevation ofl water below Lake Orange spillway, in feet, a stage V water shortage EMERGENCY shall be deemed in effect, and in addition to the restrictions heretofore imposed, the following stringent mandatory water restrictions shall be in effect, and in addition to the restrictions heretofore imposed, the following severe , mandatory water restrictions shall be in effect. It shall be unlawful: 1. To use water outside a structure for any use other than an emergency use involving fire. 2. To operate an evaporative air conditioning unit which recycles water except during the operating hours of the business. 3. To introduce water into any swimming pool. E. In the event the water level of University Lake declines to a stage VI level above mean sea level, in feet, a stage VI water shortage CRISIS shall be deemed in effect. In the event the water level of Lake Orange declines to a stage VI elevation of water below Lake Orange spillway, in feet, a stage VI water shortage CRISIS shall be deemed in effect, and a system of water rationing shall be put in effect in addition to all previously imposed restrictions. In the event of water rationing in which water will be supplied in the minimal quantities required for the health, welfare, and safety of the citizens in accordance - with a program determined by Orange County: • 01 rt 1. It shall be unlawful to fail to act in accordance therewith or use water in any manner or attempt to evade or avoid such water rationing restrictions. 2. Fire protection will be maintained, but where possible tank trucks shall use raw water. ARTICLE 4. Penalties. A. Any violation of the provisions of this ordiance shall constitute a misdemeanor, punishable upon conviction by a fine not to exceed- . $50.00 or imprisonment not to exceed thirty days, as provided by N. C. General Statute Section 14-4. Any such violation may be enjoined, restrained, or abated as provided by N. C. General Statute Section 153A-123 (d) and 153A-123 (e) . B. If any section, subdivision, clause or provision of this ordi- nance shall be adjudged invalid, such adjudication shall apply only to such section, subdivision, clause, or provision so adjudged, and the remainder of this ordinance shall be deemed valid and effective. C. All Ordinances and clauses of Ordinances in conflict herewith are repealed on the effective date of this Ordinance. The Ordinance entitled "AN ORDINANCE PROVIDING FOR THE CONSERVATION OF WATER DURING A WATER SHORTAGE, AND RESTRICTING THE USE OF WATER DURING MORE SEVERE SHORTAGES" and as amended, is repealed on the effec- tive date of this Ordinance. The consumation of the trans action is subject to approval of the franchise transfer. On June 13, 1986 Village Cable officially requested approval of Cable Franchise transfer in accordance with Section VII (b) of the Orange County Cable Television System Ordinance. The ordinance provides that the official request. includes "identifying particulars of the proposed transaction," County Attorney has reviewed transaction information submitted by Village Cable and Prime Venture I. Prime Venture i is owned by Prime Cable corporation which has headquarters in Austin, Texas. Prime Cable has franchises in Georgia, New York and Maryland. BUDGET CONTROL: The Board of Commissioners, in approving this budget, has utilized to the fullest extent Possible its revenue sources. , Over collections of revenue or unanticipated revenue sources cannot- be expected to materialize during the year. It is, therefore, of utmost importance, and the County Manager is hereby directed, to initiate steps to insure that the budget as fixed herein is lived within. General Statutes of the State of North Carolina provide for budgetary control measures to 'exist between a County and Public School System.
