The Manager recommends the Board establish an Orange County Police Information Network (PIN) Board of Directors and approve the pur- pose, fundtion and responsibility of the Board as set out in the agenda attachment. 5. NACo Energy/Steering Committee Conference May 10-12, Minneapolis, Minnesota; This expense to send Mr. Rob Addelson, representing Commissioner Gustaveson; approval is needed for advance funding (Expenses reimbursed by NACo). 6. Department Heads appeal frozen positions: A. Health Department--Accounts Clerk (2 positions) B. Dept. of Social Services--Temporary Eligibility Specialist I. 7. The Road Naming Committee makes certain recommendations to the Board. 8. Planning staff submits a memorandum detailing cost figures on minor subdivisions as requested by the Board. Does the Board wish to consider again the proposed planning fees structure? 9. The Planning Board recommends: A. Scotswood Subdivision--approval with conditions; B. James J. Freeland minor subdivision--approva1 ; C. Fox Run Subdivision--approval . 10. Discussion of OWASA's response regarding the Joint Planning Agreement. 11. The Board should set dates for: A. Appointments: A--Hillsborough Board of Adjustment: Mr. Plambeck's term has expired; B--Commission on Women: Ms. Rebecca Veazy has resigned; C--Planning Board: Mr. John Wilson has resigned; D--Youth Services Needs Task Force--Nealth representative; E--OWASA--Mr. Paul Morris ' term expires June 30. F--Board of Social Services--Ms. Mae McLendon 's term expires June 30. 16. The Board should name Trustees for the South Orange Fire District. 17. The County Manager has submitted his resignation effective June 30, 1981. The Board will discuss a recruitment process for his replacement. 741e - �� �~ - ^*-�* ° �7 � AGENDA ATTACHMENT 4 Agenda Attachment The State requires all PIN Terminals to be under the direct control of law enforcement officers. The PIN Terminal located in our Communications Center has been licensed to the Chapel Hill Police Department and presumed to be under its control, This arrangement has not been satisfactory with the State and since the department's move is now unacceptable to them. An t in which a PIN Board composed of the Chiefs of Police of the urrangemen Towns in the County and the County Sheriff would exercise direct control of the PIN Terminal , such as outlined herein would be acceptable to the State. If the Board of Commissioners will approve this agreement the State will allow continued use of a PIN Terminal at the Center. If this agreement is not approved, or the Center's employees placed under the direct control of a law enforcement officer (in that case the County Sheriff) they will terminate the PIN Terminal at our Communications Center, If this is done the Communications Center will lose most of its usefulness to law enforcement. Currently, about 90% of the Center's activities are law enforcement oriented. | ' i — � ��' / / ]J8�� AGENDA ATTACHMENT 4 ORANGE COUNTY POLICE INFORMATION NETWORK BOARD OF DIRECTORS (THE PIN BOARD) ARTICLE I PURPOSE FUNCTION AND RESPONSIBILITIES 1. To approve and adopt operating procedures subject to PINS Rules and Regulations and PIN Operations Nanuals, 2. To regulate use of PIN Terminal as outlined in PIN Policy and Procedures Manual. 3. The hiring, firing and setting priorities will be the responsibility of the Chairman of the Board. 4. The officers of this Board will be appointed by the County Manager. ARTICLE II 1. The principal office of the PIN Board shall be located at 105 East Margaret Lane, Hillsborough, North Carolina, 27278. 2. The permanent mailing address for purpose of all notices and correspondence is 100 West Rosemary Street, Chapel Hill, North Carolina, 27614' 3. All PIN records and books shall be kept at the office of the terminal sight, and restricted to authorized personnel. ARTICLE III MEETINGS OF THE PIN BOARD 1.l Meetings of the PIN Board may be called by the chairman, or in his absence or incapacity, by the vice chairman, for such time and at such place in the County of Orange, as may be specified in the call. 2. Any business of the PIN Board may be considered and acted upon in any such meeting of the PIN Board. 3- A majority of the members of the PIN Board shall constitute a quorum. ARTICLE IV MEMBERSHIP 1. ARTICLE V OFFICERS 1. The officers of the PIN Board shall be the chairman, vice chairman, and secretary. 2. Approaching 5:00 PM, Monday, 4/27 , the Director confirmed that the _ Finance Director, Kathy Battern, had hired the Health Department Accoun _ Clerk in Carrboro, Donna Clayton. Donna is paid at grade 56 by the i ... .. :. Health Department. She will be paid at grade 61 , $2,200 more, to be the payroll clerk. The Director is pleased to see Donna get such an advancemen Donna's last day with the Health Department will be May 8. The Director was aware that to get on the Commissioner's May 4 agenda i to appeal this soon-to-be frozen position, he had to turn in an appeal the next day (4/28) . Therefore, the evening of 4/27 the Director talked to Ann Woodward , and the morning of 4/28 to Evelyn Lloyd. Acting on behalf i of the full board , Ann and Evelyn have authorized this as an official $ Board appeal. 1 . We are still attempting to fill the two vacant unfrozen clerical positions. The Director categorically states that he does not have capacity to accomplish the account clerk duties without hiring someone. ; i Donna's position involves collecting .fees (estimated) on an annualized 1 1 rate of $40,500, ;Jandies the numerous 3rd party forms and collection procedure . Therefore , we appeal the freezing of this poSition. i i i 4 i 1..; 751 Assuming the Commissioners unfreeze Donna's position , the Director will seek to hire Susan Ray in this position. Susan has been a temporary, no benefits, provided, employee with the department since August of 1980, filling in for various People on maternity leave. Since March 1 , 1981 , Susan has been the temporary accounts clerk in Hillsborough, filling in for Colleena Clark who is on maternity leave. Susan is trained and could immediately accomplish Donna's job. Assuming this hiring is approved, the problem of the accounts clerk vacancy would immediately shift to - Hillsborough. 2. The Director categorically states that he does not have the staffing capacity to accomplish the accounts clerk duties in Hillsborough without hiring someone. The Hillsborough accounts clerk position involves, thi. coming year, collecting fees (estimated) at the annualized rate of $36, :;-1 handles the numerous 3rd party forms and collection procedures. This in. a temporary opening as the incumbent is on maternity leave and is scheduled to return on August 31 , 1981 . Therefore, we appeal freezing of this position. It may be somewhat difficult to hire a temporary person. Even under the best possible timing there will be lag time before the new person takes over in Hillsborough. Secondly, this is a complex job and it will take some time to train the temporary person. It is a safe prediction that the department will lose significant revenue. Another temporary vacancy will occur in this unit in early summer when Linda Wade, Eligibility Specialist II, takes maternity leave. The Social Services Board at its last meeting unanimously approved this request to fill Na. Eilderly's position with a temporary appointment to be employed a maximum of six months. This will allow for training the temporary employee prior to Mrs. Wade's leave and provide needed coverage for the AFDC caseload in her absence. The AFDC caseload has increased steadily for a two year period. The unit contains five positions and a reduction to three positions during Mrs. Wade's absence would create an impossible workload. Gattis, County Manager FROM: Orange County Planning Department DATE: April 30, 1981 SUBJECT: Recommendations made to the Board of County Commissioners at the April 28, 1981 meeting of the Road Naming Advisory Committee. 1, RE: Road Naming Advisory Committee recommendation on Road Sign Installation Manpower The Road Naming Advisory Committee recommends the hiring freeze be reconsidered for road sign installation manpower. This entails the one tem- porary position who will serve for 2 months as the supervisor of 10 CETA positions (2 Crew Chiefs and 8 Laborers). Also the Committee recommends that consideration be given to including this program in the CETA summer youth program. If this cannot occur, then the County should reconsider the hiring freeze for the 3 County Laborer positions previously funded in the 1980-1981 budget. The Committee also recommends that interested volunteer fire depart- ments be utilized in erecting the signs or coordinating their placement. 2, RE: Road Naming Committee recommendation concerning existing subdivision road name signs which don't conform to county standards. These intersections do not have to be posted with new road name signs. The Road Naming Advisory Committee recommends that the Director of Emergency Services be responsible for determining whether these existing road signs are satisfactory (i.e. visible and legible) and will not hinder the efficiency of emergency services. These intersections will not have to be posted with the new Orange County road signs. 3, RE: Road Naming Advisory Committee recommendation on Installation of Signs on Roads which cross the County Line. The Road Naming Advisory Committee recommends the Planning Staff contact other counties to request joint action (i.e, same road name, sign 754 Mr. S.M. Cattis, County Manager April 30, 1981 Page 2 swapping at mutual points) in situations where roads cross and/or end in the adjacent jurisdictions. This could include any coordination of the program as necessary to ensure that the service area of Orange County emergency services have all intersections posted. 4, RE: Intergovernmental Mechanism to ensure no further public road name duplication occurs. The resolutions from various governments establishing this pro- gram and the computer print out of all public roads in Orange County (Code 0), Carrboro (Code 1), Chapel Hill (Code 2), Hillsborough (Code 3), and Mebane (Code 4) are included as Attachments 7-4 for the Board of Commissioners' information. 5, RE: The Board of County Commissioners have given RONAC a charge to name approximately 200 public non-state maintained roads that have people living on them. Attachments 7-5 is a list of the 200 roads that might fall into this category. The Clerk Ten asked to supply a list to the Police Department. Commissioner Smith presented to the Board a map of the new area to be opened in the Town Cemetery. He stated that 240 new grave sites would be ' able for sale. He was authorized by the Board to proceed with the new deve meat. I Commissioner Smith stated the First Baptist Church wished to have two ! handicapped parking signs erected at the church for the handicapped use. The Clerk was asked to order the signs for the Church. .`",,-11------------1 _ _ Item 7: Offical Naming of Un-named Streets and the Re-naming of Street with duplicate names. Upon motion of Commissioner Smith, seconded by Commissioner Johnson, i was moved and unanimously adopted to accept the new names and the re-naming those streets as presented on Item 7 of the agenda. (Insert street names) Item 8: Vernon Harris of Pridgen Consultants request direction regard: a study of the water needs around the Grady Brown School area. • Upon motion of Commissioner Martin, seconded by Commissioner Johnson, : was moved and adopted to inform Pridgen Consultants the Town Board has not • asked that Company to do a study of the water needs as discussed in his lett of February 4, 1981. Item 9: Request from the Town Clerk to hire temporarily part-time c1 _-- assistance. --- The suggestion was made by Commissioner Lloyd that the clerk working ir the Police Department be asked to assist the Town Hall staff on a part-time i basis. I Upon motion of Commissioner Lloyd, seconded by Commissioner Smith, the Police Commissioner was asked to talk with the Police Chief about the possib of the Police Clerk working part time for three monthQat Town Hall. Item 10: Requst for endorsement by the Orange County Day Care Coalitio for a Community Forum on the issue of Child Care. 75 (21 j AGENDA ATTACHMENT 8 ORANGE COUNTY PLANNING DEPARTMENT HILLSBOROUGH NORTH CAROLINA 27278 7‘1.14 41'7 co" MEMO TO: Sam Gattis FROM: Rick CannityW DATE: January 29, 1981 SUBJECT: Fee Schedule Analysis and Recommendation There are several conditions that may dramatically change some of the numbers indicated in this memo. If the County Commissioners should extend zoning to un- zoned townships the number of rezonings and zoning permits would increase some- ' what over those shown on the following pages. Cases going before the Board of Adjustment would also increase not only because of the greater number of zoned townships but also because of the larger number of special uses. The number of subdivisions varies each year depending on-the fluctuations in the economy. The Planning Staff feels that the division of land through the minor subdivision process should not be encouraged. Overall planning for the County is easier with major subdivision covering larger tracts of land. The staff recommends that requests for interpretation of the new ordinance to the:1Board of Adjustment or requests for rezonings in the presently unzoned townships not be charged a fee. After the adoption of the new ordinance the following fees could be established. This flooding will affect portions of lots in Block B (lots 15-20, 25, 26, 27 and 20); Block G (Lots 1, 2, 6, 7, 8 and 9); Block H (lots 1 - 4 and 14, 15, and 17 - 21). 15. Fire hydrants should be spaced so that any structure is no further than 500 feet from a hydrant and on a 6 inch line. 16. Lots 1 and 2, 3 and 4, 5 and 6 in Block B should have common driveways along St. Mary's Road. 17. Eliminate duplicate road names, as per road naming recommendations from the Planning Department dated August 20, 1979 and revised. 16. 20 extra feet of road right-of-Way must be observed on the north side of St. Mary's Road, to make the right-of-way 80 feet wide. 19. Kirk presented Sedgefield to the Board stating staff's recomendation for approval with the following conditions: 1. Proposed alignment of 1-40 be shown on the final plat and that such alignment be labeled "Proposed alignment of 1-40." 2. All lots North of the Northern Boundary of the street to be served by community water and septic tanks; any- thing that falls in the corridor or the northern border line and South of I-ro will be served by OWASA (Water and sewer) 3. Sewer drainage and utility easements be dedicated as required by the Orange County Zoning Officer in consultation with the Chapel Hill Town Engineer and OWASA. 4. Private water system shall be constructed to OWASA standards 5. All electric lines serving the development be placed underground. This condition does not affect the existing Planning Board Minutes April 27, 1981 Page 2 Duke Power transmission line crossing the property. Phone lines will be placed underground. 6. All lots connecting onto sanitary sewer systems be serviced by gravity flow. Except as approved by OWASA in consultation with the Orange County Zoning Officer and the Chapel Hill Town Manager individual pumps for each lot shall not be permitted. 7. A drainage plan with detailed topographic information be submitting to and approved by the Orange County Zoning Officer in consultation with the Chapel Hill Town Engineer prior to issuance of a building permit, grading permit and prior to the start of any construction. 8. The numbers, location and installation of fire hydrants be approved by CMASA in consultation with the Orange County Zoning Officer and Chapel Hill Town Engineer. A plan for such improvements shall be approved prior to approval of the final. 9. The detailed plans with profiles of all streets shall be approved by the North Carolina Department of Transportation and Chapel Hill Town Engineer prior to issuance of grading or building permits and prior to the start of any street construction. 10. Prior to paving streets, utility lines and laterals shall be installed and stubbed-cut to each lot. A letter from the owners representative shall be presented to the Orange County Zoning Officer prior to paving any street certifying that all utilities are in place. 11. An additional 15 feet right of way shall be dedicated along the property frontage on the North side of Weaver Dairy Road. 12. An imporved recreation area of one acre. 13. Lots cannot be sold before the North Carolina Department of Transportation settles the 1-40 issue. Kizer moved approval subject to the indicated conditions. The Board at their work sessions on December 9, 1980, January 7, 1981 and February 12, 1981 raised several questions and asked for specific revisions concerning the proposed Zoning Ordinance. The following list specifically addresses the concerns of the Board • as reflected in the third draft of the ordinance. • 1. References to the word morals have been deleted at the request of the Planning Board and on the further advise of the County Attorney that deletion would not harm the ordinance. 2. The inclusion of Cheeks township under the applicability section of the Zoning Ordinance. The Plsmming Board has requested that Cheeks • not be included in the extension of zoning to previously unzoned townships. The Planning Staff feels that development pressures and land use considerations warrant the inclusion of Cheeks Township in the Ordinance. 3. QUALIFICATIONS FOR PLANNING BOARD MEMBERSHIP 2.2.3 "Every member of the Board shall be a resident of Orange County. Each Township within the County shall be re- presented in the membership of the Board by at least one resident". Board of County Commissioners April 30, 1981 Page 2 4. PUBLIC NOTIFICATION OF ZONING ORDINANCE CHANGES 2.3.3.4 The Planning Staff, and Ordinance Consultant feel that the ordinance should not require any notification above what is required by The General Statues. The Planning Board has recommended the following wording which exceeds the require- ments of The General Statues. The Staff feels that these extra requirements should be a County Policy rather than an inclusion in Zoning Ordinance. The Board shall give notice of matters coming before it by causing public notation to be placed in a newspaper of general circulation in the County. The notice shall appear once a week for two consecutive weeks, the first insertion to be not less than fifteen days nor more than twenty five days prior to the meeting date. Written notice shall be sent by certified mail to all adjacent property days before the meeting date. Adjacent property owners are those whose names and addresses are currently listed in the Orange County tax records and whose property lies within five hundred feet of the affected property. R-1: a) No external evidence of its existence shall be visible, except a sign as permitted by Article 9. b) No more than thirty five percent of the floor area of the dwelling unit or five hundred square feet, whichever is less, can be used for the home occupation. c) No equipment or process shall be employed that will cause noise, vibration, or glare detectable to the normal senses at the lot lines in the case of detached dwelling units or outside the dwelling unit, in the case of attached dwelling units. d) The on-premises sale and, delivery of goods, which are not the product of the home occupation is prohibited. e) All Ar+i/r14-4^,. -1-11 , Board of County Commissioners April 30, 1981 Page 3 f) No more than 1 individual, not residing in the dwelling unit, may work in the home occupation. 6.16.6.2 Home Occupations In the AR and R-1 Districts The following restrictions shall be applied on home ocoupaticnE in the AR and R-1 districts on lots less than 200,000 square fE a) A maximum of 1,000 square feet of floor area may be used for the home occupation. This floor area can be a detached accessory structure. b) Signs shall be as provided in Article 9. c) The on-premise sale and delivery of goods, which are not the product of the home occupation is prohibited. d) No equipment or process shall be employed that will generate noise, vibration, or glare detectable at the lot lines of the lot on which the home occupation is located. e) No more than 2 individuals not residing in the dwelling unit may work in the home occupation. f) No outside storage of goods, or materials. 6.16.6.3 Home Occupations In The AR-R1 Districts (Win. 5 Acre Lots) The following restrictions shall be applied to home occupations in the AR and R-1 districts on lots in excess of 200,1000 square feet. a) A maximum of 2,000 square feet of floor area may be used for the home occupation. This floor area can be in a detached accessory structure. b) Signs shall be as provided in Article 9. c) The on premise sale and delivery of goods, which are not the product of the home occupation is prohibited. d) No equipment-process shall be employed that will generate noise, vibration or glare detectable at the lot lines of the lot on which the hone occupation is located. e) If an accessory structure is to be used for the home occupation the following criteria must be met: f) No more than 2 individuals not residing in the dwelling unit may work in the home occupation. I) The accessory building shall be set back at least 30 feet fartharr. Board, of County Commissioners April 30, 1981 Page 4 2) The accessory building shall not be closer than 40 feet to the side and rear lot lines. 3) The accessory building shall be adequately screened from view of the road and adjacent property by a densely planted ever- green shrubs or trees. 4) Any outside storage of materials far use in the home occupation shall be totally screened fran the road and from adjacent property in the same manner as the accessory structure. The storage area shall not exceed 1,000 square feet. The setback from the side and rear property lines shall be the same as for an accessory building for use as a home occupation. 5. BONUSES FOR LOWER-INCOME HOUSING 6.22 Bonus Intensities For Lower-Income Housing 6.22.1 Intent In order to provide for the availability of affordable housing to all segments of the population it is intended that the bonus intensities established in _Article 5.2.1 provide incentive for the development of lower-incame housing. It is further intended that such bonus intensities be used to promote economically mixed housing developments and to contribute to the provision of a range of housing type fbelower-incane households. g) The accessory building shall be adequately screened fran view of the road and adjacent property by a densely planted, ever- green shrub or trees. 6.22.2 Applicability The PD-2 intensity regulations established in Subsection 5.1.1 may be applied to any group housing development or planned development which shall ensure that at least 10% of the total residential floor area of the development is contained in dwelling units for which an agreement has been executed between the developer and the Federal Department of Housing and Urban Development (HUD) in accord with HUD's Section 8 new construction, substantial rehabilitation programs, or public housing or has been executed with the Chapel Hill Housing Authority or the Orange County Housing Authority. 6, 8.8.1.2 The Formula For Measuring Vibration Has Been Changed. 7. 8.8.4 Family Care Facilities have been made a use by right in residential districts. April 30, 1981 Page 5 8.8.4 Oro is Care Facility (Class B .-cial Use) 8.8.4.1 Additional Information In addition to the information required by Subsection 8.2 and 8.8.1.1 the following shall be supplied as part of the applical a) A description of the type of persons to be cared for and the nature of the care to be provided. b) If structural alterations to existing structures or new construction is required, a complete description of the nature and extend of these alterations or new construction. 8.8.4.2 Standards of Evaluation The following standards shall be used in deciding an applicatio for approval of this use: a) The proposed use is not within 500 feet of another existing Family Care Facility or Group Care Facility. b) Structural alterations shall be of such a nature as to preserve the residential character of the building. c) If a state license or permit is required to operate such a facility, the standards necessary to qualify for such a permit have been met. 8. 8.8.8 General Aviation Ports STOL And Heliports (Class A P-cial 8.8.8.1 Additional Information In addition for the information required in Subsection 8.2 and 8.8.1.1, the following shall be submitted as part of the application. a) A configuration diagram depicting the layout of runways, taxiways, approach zones and overrun areas. These diagrams should also be over laid an aerial photographs that show the area within 5 miles of the proposed site. b) Isosonic contours showing the effects of aircraft operations upon land within one mile of the boundary of the proposed site. c) The number and type of aircraft proposed to be stored including also the storage areas for aircraft, fuel and motor vehicles, service areas for aircraft. d) How on site fire and rescue services shall be provided and a letter from the appropriate agency stating services are available and adequate to protect the proposed facility. e) List land uses within the final approach areas of the airport. 8.8.8.2 Standards of Evaluation g) r - _ Board of Commissioners April 30, 1981 Page 6 b) Land sufficient to provide approach zones and overrun areas is owned or controlled by the applicant. c) Adequate land area is provided for all of the proposed uses, buildings and storage areas. d) Screening of buildings storage and maintenance areas is provided from adjacent residential land. e) Letters from appropriate fire and rescue agencies that protective services can be provided at an adequate level. f) Access shall be directly onto a State maintained road. g) Compatible land uses are located in the final approach areas of the airport. 9. 10.3 The Off-Street Parking Standards have been revised. Item i) was revised and item J) was included in a much revised form in the new item i) . i) New parking areas shall observe a 10 foot setback from all • road rights of way and a 5 foot setback from all side and rear property lines. Such setbacks shall be landscaped to provide a partial buffer to adjacent residentially zoned property. The definition of a bona fide farm was revised as follows: Bonafide Farm The use of land for farming, horticulture and forest land, the tract must be actively engaged in the commercial pro- duction, of growing of crops, plants, animals, and/or the commercial production of growing of trees, and/or the commercial production of growing of fruits, vegetables, nursery or floral products. All farm tracts must also have a sound management program. It is further intended that the tract meet one of the following criteria: 1) Composing ten or more acres on one or more tracts owned or leased by the bonafide farm unit with average annual sales of $1,000.00 for the preceeding three years. 2) A minimum of twenty acres of forest land under a sound management program owned or leased by the banafide farm unit. The proposed Agreement was revised to more clearly delineate the role of DUASA in the Joint Planning process. The revisions consisted pri- marily of the addition of a paragraph regarding the statutory authority of OWASA which delimits participation in land use planning and the statutory responsibilities of OWASA which restrain abridgment and delegation of author- ity and responsibilities vested in OWASA by law. It is the opinion of the OWASA Board and OWASA counsel that the clarification will promote the de- veloocent of a Joint Planning process that accomplishes the multiple purposes and objectives of the participating entities. After undertaking a thorough evaluation of County administration, in close interaction with the Manager both in and out of Executive Session, the Board and the Manager discussed various options. In a memorandum dated April 29, Mr. Gattis submitted his resignation effective June 30, 1981. All of the Commissioners have high personal regard for Mr. Gattis, and appreciate the service he has performed in 30 years with the County. Mr. Gattis became eligible for full retirement benefits in March of this year. The Board will proceed immediately with recruitment for his replacement. 1 ,
