FLOOD DAMAGE PREVENTION ORDINANCE
ARTICLE 1. STATUTORY AUTHORIZATION FINDINGS OF FACT PURPOSE AND OBJECTIVES
1.1 STATUTORY AUTHORIZATION
The Legislature of the State of North Carolina has in Section 110 of the Flood
Disaster Protection Act of 1968 (Title XIII of tha Housing and Urban Development
Act of 1968 (Pub. L. 90-448) , 42 U.S.C. 4001-4128, and 44 CFR Part 67.4(a)
delegated the responsibility to local governmental units to adopt regulations
designed to promote the public health, safety, and general welfare of its
citizenry. Therefore, the Board of County Commissioners of Orange County, North
Carolina does ordain as follows:
1.2 FINDINGS OF FACT
(a) The flood hazard areas of Orange County are subject to periodiC Anundat
which results in loss of life, property, health and safety hazards,
disruption of commerce and governmental services, extraordinary public
expenditures for flood protection and relief, and impairment of the
tax base, all of which adversely affect the public health, safety and
general welfare.
(b) These flood losses are caused by the cumulative effect of obstructions
in flood plains causing increases in flood heights and velocities, and
by the occupancy in flood hazard areas by uses vulnerable to floods or
hazardous to other lands which are inadequately elevated, flood-proofed,
or otherwise protected from flood damages.
1.3 STATEMENT OF PURPOSE
It is the purpose of this ordinance to promote the public health, safety and
general welfare and to minimize public and private losses due to flood
conditions in specific areas by provisions designed to:
(a) restrict or prohibit uses which are dangerous to health. Qafal+,,
(e) prevent or regulate the construction of flood barriers whic
unnaturally divert flood waters or which may increase flood
to other lands.
1.4 OBJECTIVES
The objectives of this ordinance are:
(a) to protect human life and health;
(b) to minimize expenditure of public money for costly flood con
projects;
(c) to minimize the need for rescue and relief efforts associate
flood and generally undertaken at the expense of the general
(d) to minimize prolonged business interruptions;
(e) to minimize damage to public facilities and utilities such a6
and gas mains, electric, telephone and sewer lines, streets
bridges located in flood plains;
(f) to help maintain a stable tax base by providing for the sound
and development of flood prone areas in such a manner as to z
future flood blight areas; and,
(g) to insure that potential home buyers are notified that properi

ARTICLE 2. DEFINITIONS
Unless specifically defined below, words or phrases used in this ordinan,
shall be interpreted so as to give them the meaning they have in common 1
and to give this ordinance its most reasonable application.

"Area of s.ecial flood hazard!! is the land in the flood plain within a co

the preparation of additional sites by the construction of facilities for
servicing the lots on which the mobile homes are to be affixed (including the
installation of utilities, either final site grading or pouring of concrete
pads, or the construction of streets).
"IloodLoyfilaadine means a general and temporary condition of partial or
complete inundation of normally dry land areas from the unusual and rapid
accumulation or runoff of surface waters from any source.
"Flood Hazard Boundary Map (FHBM)" means the official maps for Orange County,
issued by the Federal Insurance Administration, where the boundaries of the areas
of special flood hazard have been designated as Zone A.
"Flood Insurance Rate Map (FIRM)" means the official maps for Orange County, on
which the Federal Insurance Administration has delineated both the areas of
special flood hazard and the risk premium zones applicable to the community.

Federal Insurance Administration. The report contains flood profiles, as well
as the Flood Hazard Boundary-Floodway Map and the water surface elevation of the
base flood.
"Floodplain" any land area not in the floodway susceptible to being inundated by
water from the base flood, and designated on the Flood Hazard Boundary Map preparE
by the U.S. Department of Housing and Urban Development, orzif not deSignated 'on t
maps, then designated in the Soil Survey of Orange County as Altavista OW., Chewa
(Ch), or Congaree (Cp) soils, or these soils are identified by a' site survey and
attendant topography, vegetation patterns, and physical flood evidence, such as ma
on trees or vegetation.
"Floodway" means the channel of a river or other watercourse and the adjacent
land areas that must be reserved in order to discharge the base flood without
cumulatively increasing the water surface elevation more than one foot. As used

Mobile .home shall also mean a doublewide mobile home whidh is two or
manufactured housing units designed for transportation on their own c
connect on site for placement on a temporary or semi-permanent founds

"New mobile home 'ark or mobile home subdivision" means a lot in singl

homes for use as dwelling units for which the construction of faciliti
servicing the lot on which the mobile hoMe is to be affixed (including
minimum, the installation of utilities, either final site grading or ti
of concrete pads;; and the construction of streets) is completed on or
effective date of this ordinance.
"Start of construction" means the first placement of permanent construe
structure (other than a mobile home) on a site, such as the pouring of
or footings or any work beyond the stage of excavation, including the r
of a structure. Permanent construction does not include the installatil
streets and/or walkways; nor does it include excavation for a basement,
piers or foundations or the erection of temporary forms; nor does it inc
installation on the property of accessory buildings, such as garages or
not occupied as dwelling units or not as part of the main structure. Fo
structure (other than a mobile home) without a basement or poured footin
the "start of construction" includes the first permanent framing or asse
the structure or any part thereof on its piling or foundation. For mobi

has been damaged and is being restored, before the damage occurred. For the
purposes of this definition "substantial improvement" is considered to occur
when the first alteration of any wall, ceiling, floor, or other structural part
of the building commences, whether or not that alteration affects the external
dimensions of the structure. The term does not, however, include either
(1) any project for improvement of a structure to complyywith existing state or
local health, sanitary, or safety code specifications which are solely necessary
to assure safe living conditions, or (2) any alteration of a structure listed
on the National Register of Historic Places or the State of North Carolina
Inventory of Historic Places.
"Variance" a relaxation of the terms of this ordinance where such variance will
not be contrary to the public interest and, where, owing tO conditions peculiar
to the property and not the result of actions or the situation of the applicant,
a literal enforcement of the ordinance would result in unnecessary and undue
hardship. A variance is authorized only for the dimensional controls of this
ordinance; establishment or expansion of a use otherwise prohibited shall hot be
permitted by a variance.
ARTICLE 3. GENERAL PROVISIONS
3.1 LANDS TO WHICH THIS ORDINANCE APPLIES
This ordinance shall apply to all areas of special flood hazard within the
jurisdiction of Orange County.
3.2 BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD
The areas of special flood hazard identified by the Federal Insurance Administratif
through a scientific and engineering report entitled "The Flood Insurance Study
for Orange County, North Carolina," dated September 16, 1980, with accompanying
Flood Insurance Rate Maps and Flood Boundary and Floodway Maps and any revision
thereto are hereby adopted by reference and declared to be a part of this
ordinance.

(b) For purposes of this section, an artificial obstruction is

4.2 PERMISSIBLE USES WITHIN FLOODWAYS
The following uses may be made of floodways as a matter of right and a

(a) general farming, pasture, outdoor plant nurseries, horticult1

(b) ground level loading areas, parking areas, aircraft runways a

(c) lawns, gardens, play areas and other similar uses;
(d) golf courses, tennis courts, driving ranges, archery ranges,
grounds, parks, hiking or horseback riding;
(e) streets, bridges, overhead utility lines, railway lines and ri
creek and storm drainage facilities, sewage or waste treatment
outlets, dams, water supply intake structures, and other simil
community or utility uses;
(f) temporary facilities (for a specified number of days) such as
circuses, carnivals, or similar transient amusement enterprise:
(g) boat docks, ramp, piers or similar structures.
4.3 CONSTRUCTION WITHIN FLOODWAYS AND FLOODPLAINS RESTRICTED
(a) No structure may be constructed and no substantial improvement
existing structure may take place within any floodway.

(d) Whenever any portion of a floodplain is filled in with fill dirt, sic)]
shall be adequately stabilized to withstand the erosive force of the
base flood.
4.4 WATER. SUPPLY AND SANITARY SEWER
Systems in Floodways and Floodplains.
(a) Whenever any portion of a proposed development is located within a fix
way or floodplain the agency or agencies responsible for certifying to
the County the adequacy of the water supply and sewage disposal system
for the development shall be informed by the developer that a specifie
area within the development lies within a floodway or floodplain.
'Thereafter approlial of the .proposed system by that agency shall-consti
tute a certification that:
(1) such water supply system is designed to minimize or eliminate
infiltration of flood waters into it.
(2) such sanitary sewer system is designed to eliminate infiltration,
of flood waters into it and discharges from it into flood waters.
(3) any on-site sewage disposal system is located to avoid impairment
to it or contamination from it during flooding.
4.5 MOBILE HOMES
(a) No mobile home shall be placed in a floodway except in an existing mobi
home park or existing mobile home subdivision.
(b) All mobile homes located in the floodway after the adoption of this
ordinance shall be anchored to resist flotation, collapse, or lateral
movement by providing over-the-top and frame ties to ground anchors.
Specific requirements shall be that:
(1) over-the-top ties be provided ateach end of the mobile home, with
one additional tie per side at an intermediate location on mobile
homes of less than fifty feet and one additional tie per side for
4.6 SPECIAL PROVISIONS FOR SUBDIVISIONS
(a) An applicant for final plat approval of a subdivision shall
by the planning department of the use and construction rest/

(b) Final plat approval for any subdivision containing land that
a floodway or floodplain may not be given unless the plat sh

ARTICLE 5, ADMINISTRATION
5.1 BUILDING PERMIT REQUIRED
Building Permits shall be required in conformance with the provisions o
ordinance.
5.2 DESIGNATION OP BUILDING INSPECTOR
The building inspector is hereby appointed to administer and implement t
sions of this ordinance.
5.3 DUTIES AND RESPONSIBILITIES OF THE BUILDING INSPECTOR
Duties of the building inspector shall include, but not be limited to:
(a) Review all building permits to assure that the requirements of
ordinance have been satisfied.
(b) Advise permittee that additional federal or state permits may 1
and if specific federal and state permits are known, require 0
of such permits be provided and maintained on file with the del
permit.
(c) Notify adjacent communities and the North Carolina Department c

(f) Verify and record the actual elevation (in relation to mean sea level)
to which the new or substantially improved structures have been flood-
proofed.
(g) When flood-proofing is utilized for a particular structure, the buildi
inspector shall obtain certification from a registered professional
engineer or architect.
(h) Where interpretation is needed as to the exact location of the boundar
of the areas of special flood hazard (for example, where there appears
be a conflict between a mapped boundary and actual field conditions) ti
building inspector shall make the necessary interpretation. The persor
contesting the location of the boundary shall be given a reasonable
opportunity to appeal the interpretation as provided in this article.
(i) When base flood elevation data has not been provided in accordance with
Article 3, Section B, then the building inspector shall use the Orange
County Soil Survey and any other data available from a federal, state
or other source, in order to administer the provisions of Article 5.
(J) All records pertaining to the provisions of this ordinance shall be
maintained in the office of the building inspector and shall be open
for public inspection.
5.4 PERMIT PROCEDURES
Application for a building permit shall be made to the building inspector.
Information requested on the application:shall include all information as:ptovided
for on a building permit. In addition the following may be required:
(a) Plot plans drawn to scale showing the nature, location, dimensions, and
elevations of the area in question.
(b) Existing or proposed structures, fill storage ok materials; drainage
facilities, and the location of the foregoing. Specifically, the ,!
following information is required.
(c) Elevation in relation to mean sea level, of the lowest floor (including

(a) The Board of Adjustment as authorized by the Orange County I
Commissioners shall hear and decide appeals and requests fox

(e) In passing upon such applications, the Board of Adjustment shz
consider all technical evaluations, all relevant factors; stall
specified in other sections of this ordinance, and:
(1) the danger that materials may be swept onto other lands t
injury of others;
(2) the danger to life and property due to flooding or erosioi
(3) the susceptibility of the proposed facility and its contex
flood damage and the effett of such damage on the individt
(4) the importance of the services provided by the proposed fa
to the community;
(5) the necessity to the facility of a waterfront location, wh
applicable;
(6) the availability of alternative locations, not subject to
. .
action, if applicable, expected at the site; and,
(11) the costs of providing governmental services during and after
flood conditions including maintenance and repair of public
utilities and facilities such as sewer, gas, electrical, and wat
systems, and streets and bridges.
(f) Upon consideration of the factors listed above and the purposes of th
ordinance, the Board of Adjustment may attabh such conditions to the
granting of variances as it deems necessary to further the purposes
of this ordinance.
(g) Variances shall not be issued within any designated floodway if any
increase in flood levels during the base flood discharge would result.
(h) Conditions for Variances
(1) Variances shall only be issued upon a determination that the
'varianceija the minimum necessary, considering the flood hazard,
afford relief.
(2) Variances shall only be issued upon (i) a showing of good and
sufficient cause; (ii) a determination that failure to grant
the variance would result in exceptional hardship to the
applicant; and, (iii) a determination that the granting Of a varia
will not result in increaded flood heights, additional threats to
public safety, extraordinary public expense, create nuisances,
cause fraud on or victimization of the public, or conflict with
existing local laws or ordinances.
(3) Any applicant to whom a variance is granted shall be given written
notice specifying the difference .between 'the base flood elevation7.
and the elevation to which the structure is to be build and stating
that the cost of flood insurance will be commensurate with the
increased risk resulting from the reduced lowest floor elevation.
(4) The building inspector shall maintain the records of all appeal

improvement of any commercial, industrial or other non-resi
structure shall either have the lowest floor, including bas
elevated to the level of the base flood elevation or, toget
attendent utility and sanitary facilities, be flood-proofed
below the base flood level the structure is water tight witl

components having the capability of resisting hydrostatic at
hydrodynamic loads and effects of buoyance. A registered pr

(3) Mobile Homes
(a) No mobile home shall be placed in a floodway, except in
mobile home park or existing mobile home subdivision.
(b) All mobile homes shall be anchored to resist flotation,
or lateral movement by providing over-the-top and frame
ground anchors. Specific requirements shall be that:
(1) over-the-top ties be provided at each end of the mo
home, with one additional tie per side at an interm
location on mobile homes of\less than fifty feet an
additional tie per side for mobile homes of fifty f(
(ii) frameties be provided at each corner of the home wit
additional ties per side at intermediate points for
homes less than fifty feet long and one additional t
Mobile homes of fifty feet or longer;
(iii) all components of the anchoring system be capable of
a force of 4,800 pounds; and,
(iv) any additions to the mobile home be similarly anchor(

(iii) in the instance of elevation on pilings: (1) lots are
large enough to permit steps; (2) piling foundations are
placed in stable soil no more than ten feet apart, and,
(3) reinforcement is provided for pilings more than six
feet above the ground level.
(4) Floodways — Located within areas of special flood hazard established
in Article 3, Section B, are areas designated as floodways. Since
the flood waters which carry debris, potential projectiles and erosion
potential, the following provisions shall apply:
(a) Prohibit encroachments, including fill, new construction,
substantial improvements and other developments unless
certification by a registered professional engineer or
architect is provided demonstrating that encroachments shall
not result in any increase in flood levels during occurence
of the base flood discharge.
(b) If Article 5, Section B(4) (a), is satisfied, all new construction
and substantial improvements shall comply with all applicable
flood hazard reduction provisions of Article 5.
(c) Prohibit the placement of any mobile homes, except in an existing
mobile home park or existing mobile home subdivision.
ARTICLE 6. COMPLIANCE
No structure or land shall hereafter be located, extended, converted, or
structurally altered without full compliance with the terms of this ordinance
and other applicable regulations.

ARTICLE 8. INTERPRETATION
In the interpretation and application of this ordinance all provisions
(1) considered as minimum requirements; (2) liberally construed in favc
protection of the public health; safety, and welfare.
ARTICLE 9, WARNING AND DISCLAIMER OF LIABILITY
The degree of flood protection required by this ordinance is considered
reasonable for regulatory purposes and is based on scientific and engin
considerations. Larger floods can and will occur on rare occasions. F
heights may be increased by man-made or natural causes, This ordinance
imply that land outside the areas of special flood hazard or uses permit
within such areas will be free from flooding or flood damages. This orc
shall not create liability on the part of Orange County or by any office
employee thereof for any flood damages that result from reliance on this
ordinance or any administrative decision lawfully made thereunder.
ARTICLE 10. PENALTIES FOR VIOLATION
Violation of the provisions of this ordinance or failure to comply with
its requirements, including violation of conditions and safeguards estab.
in connection with grants of variance or special exceptions, shall const:
a misdemeanor. Any person adjudged in violation of this ordinance shall
punished as provided in G.S. 14-4. Each day such violation continues she
considered a separate offense. Nothing herein contained shall prevent Or
County from taking such other lawful action as is necessary to prevent or
any violation.

Ordinance,
The Planning Staff :feels there are two distinct alternatives possible
for the Flood Damage Prevention Ordinance. Basically, the two alternatives
I are Alternative B, which would allow no development within the flood plain
or Alternative A, which would allow some development provided the first
floor elevation is higher the Base Flood elevation (Alternative A is contained
in Section 4.2 of the draft ordinance) Alternative B would require few changes
in the attached ordinance. The major changes would occur in Article 4, Sectior
4.3 which would read:

There are several conditions that may dramatically change some of the numbers
indicated in this memo.* If the County Commissioners should extend zoning to un-

Adjustment would also increase not only because of the greater number of zoned
townships but also because of the larger number of special uses.
The number of subdivisions varies each year depending on the fluctuations in
the economy. The Planning Staff feels that the division of land through the minor
subdivision process should not be encouraged. Overall planning for the County is
easier with major subdivision covering larger tracts of land.
The staff recommends that requests for interpretation of the new ordinance
to theoloard of Adjustment or requests for rezonings in the presently unzoned
townships not be charged a fee. After the adoption of the new ordinance the
following fees could be established.

Last year, OPC was able to provide services to Chapel Hill High School's Summer Scho
Program because the grant period Started 3 months late. The program was very successf
and the high school is interested in continuing the program this summer (1981) .
With a summer extention under this project, OPC is prepared to provide consultation
teachers (20 hours) , and two problem-oriented discussion groups twice a week (50 hours
In addition, we would like to extend our services under this grant to pilot two parent
educational-support groups for the parents of the children who have been or who are
currently in the discussion groups.
