An executive session to consider personnel matters. 1--,:-,ae) -57'9 AN ORDINANCE GRANTING A FRANCHISE TO VILLAGE CABLE OF ORANGE COUNTY, ',INC. TO CONSTRUCT AND MAINTAIN A CABLE TELEVISION SYSTEM WITHIN THE UNINCORPORATED AREAS OF ORANGE COUNTY, NORTH CAROLINA. THE BOARD OF COMMISSIONERS OF ORANGE COUNTY, NORTH CAROLINA ORDAINS: Section I. Grant and Term. Subject to the terms and conditions of the Orange Orange County Cable Television System Ordinance and t -le other terms and conditions of this Ordinance, Village Cable of Orange County, Inc., its successors and assigns, is hereby granted for the term of fifteen (15) years from and after the effective date hereof, the right, privilege and franchise to construct or have constructed, operate and maintain 3 cable television system and to operate a cable television service in the unincorporated areas of Orange County, North Carolina for the purpose of providing cable television service to the , . citizens of the unincorporated areas of Orange County, and for that purpose to erect, install and construct upon, across, • - beneath and along any street or road all necessary cable and other equipment and facilities as may be necessary and appurtenant to the cable television system. In addition, this . ; right, privilege and franchise shall extend to property rented or leased from other persons, including but not limited to any public utility or other grantee, franchisee or permittee, in order to do business in the unincorporated areas of Orange County. The CATV system and service herein franchised shall I be used and operated solely and exclusively for the purpose •;;, 3 expressly authorized by ordinance of Orange County and no other purpose whatsoever. •''';;; • I 'T i ;; Section II. Renewal. • The franchise herein granted may be renewed for an additional period of ten ( 10) years upon terms satisfactory to • . both Orange County, North Carolina and Village Cable of Orange County, Inc. . , Section III. Non-Exclusive. The right herein granted to construct and operate a cable television system and service shall be non-exclusive, .;! • • and Orange County reserves the right to grant similar franchises to any person or persons ayany period during the present franchise or any extension thereof. Section IV. Construction of System. Village Cable of Orange County, Inc. shall obtain • the proper permission and authority from the North Carolina . - Department of Transportation, or other agency of competent jurisdiction, and where appropriate, private land owners before any cable or other equipment necessary and appurtenant to the cable television system may be placed within any street or road. it shall be unlawful for any telephone, telegraph, or power company, or any other public utility company or , . person to lease or otherwise make available to any other person, any poles, lines, facilities, equipment or other property for use in connection with the operation of a cable television system or service, unless such other person holds a valid franchise granted pursuant to the provisions of the Orange County Cable Television System Ordinance. All highways, roads, streets, sidewalks, avenues, alleys, bridges and other public and private places that may be disturbed or damaged in the construction or maintenance of the cable television system, shall be promptly repaired or re- placed by Village Cable of Orange County, Inc. at its own ex- pense. All poles, wires, cables or other facilities to be constructed or installed within the streets or roads shall be • constructed or installed only at such locations and depths and in such a manner as to comply with all state statutes and rules and regulations of the North Carolina Department of , • Transportation, or other agency of competent jurisdiction, and said department of transportation or other agency of competent : jurisdiction must approve such construction and maintenance. All facilities constructed or installed within the streets or roads shall be so constructed and installed so as to cause minimum interference with the proper use of said streets or roads, and minimum interference with the property rights of -2- property owners adjoining said streets or roads. Said facilities shall be constructed or ir,stalled so that, after construction or installation is complete, they shall cause .7. interference with proper use of said streets or roads, and lo interference with property rights of owners of property adjoining said streets or roads. In the event Village Cable of Orange County, Inc. shall fail to replace or repair any of the said public and private facilities within ten ( 10) working • days after written notice to do so from the Orange County • Manager, the same may be replaced or repaired by the proper authorities of Orange County, North Carolina, and the said • Village Cable of Orange County, Inc., in that event, shall forthwith pay to the County the cost of such work. Section V. Relocation of faCilities. In the event (at any time during the franchise period or any extension thereof) Orange County or the North Carolina Department of Transportation, by reason of traffic conditions, public safety, street closing, or abandonment, highway or street construction, change or establish any street grade, install sewers, drains, water pipes, power lines, signal lines, or any type of structure or improvement, Village Cable of Orange County, Inc. shall, at its expense, protect, support, temporarily disconnect, relocate in the same street - - or other place any of its properties, owned or leased, upon reasonable notice by the County or The North Carolina Department of Transportation. Neither the County nor The North Carolina Department of Transportation shall be liable for any disturbance of Village Cable of Orange County, Inc. 's installation resulting therefrom. Village Cable of Orange County, Inc. shall carry out instructions and directions of The North Carolina Department of Tranportation district engineer whenever it is necessary to raise or remove any of Village Cable of Orange County, Inc. 's wires or cables temporarily for the purpose of moving or removing structures -3- on the public streetSor roads of Orange County. Village Cable of Orange County, Ind.. shall do such tee trimming or other maintenance work as shall be necessary to maintain its lines and cables and other property in good working order; where necessary with the prior approval of the appropriate public or private agency and person. As between Orange County and Village Cable of Orange County, Inc., all actions herein re- ' ! quired to be performed shall be performed at the expense of Village Cable of Orange County, Inc. and Village Cable of Orange County, Inc. shall hold Orange County free and harmless from all damages or claims for damages arising from such actions of Village Cable of Orange County, Inc., including attorney's fees necessary to defend any such claim. Section VI. Ordinances Applicable. Village Cable of Orange County, Inc. shall be sub- •,. ject to all laws and ordinances relative to the use of all public facilities, relative to cable television systems and operations, and where appropriate, relative to planning ordinances, policies and procedures. Section VII. Location Maps. Village Cable of Orange County, Inc. agrees to maintain in the office of the Orange County Manager copies oF all maps showing the location of all wires, cables and other fixtures situated within the unincorporated areas of Orange County. Section VIII. Hold Harmless Village Cable of Orange County, Inc. , its successors • i and assigns, shall indemnify and save harmless, Oranie County, , its officers and employees, from and against any and all claims, demands, actions, suits, and proceedinqs by others, and against all liability to others, arising out of any act or omission of Village Cable of Orange County, Inc., its . ' successors and assigns and the officers, employees or agents of either as applicable, in the exercise or enjoyment of its franchise, including but not -4- -• r 11 1 MEMORANDUM OF UNDERSTANDING BETWEEN THE ORANGE SOIL AND WATER CONSERVATION DISTRICT and the SOIL CONSERVATION SERVICE, USDA and the COUNTY OF ORANGE, NORTH CAROLINA This Memorandum of Understanding is between the Orange Soil and Water Conservation District, hereinafter called the District, and the Soil Conservation Service, hereinafter called the Service, and the County of Orange, North Carolina, hereinafter called the County. The District, the Service, and the County have the common objective of helping to bring about the conservation, development, and wise use of land, water, and related resources. They, therefore, enter into this Memorandum of Understanding as the foundation for an enduring cooperative working agreement. Under the terms of the Soil Conservation Act of 1935 and other Acts, the Soil Conservation Service is authorized to cooperate with and to furnish assistance to the District for conservation and resource development work. The General Statutes of North Carolina establishes the District as a governmental subdivision of the State of North Carolina for the purpose of exercising public powers in connection with the conservation and development of soil, water, and related natural resources. -2- The General Statutes of North Carolina authorize the County to possess property, and exercise all of those powers conveyed by law to the County in the interest of the health, safety, and general welfare of all the residents residing within the corporate limits and within the boundaries of the County. WHAT THE DISTRICT WILL DO: 1 . With the help of the County, Service, and others, will develop and keep current a long range program of natural resource conservation. 2. Make available to the County, and coordinate,., such technical assistance as available, to assist the County in helping to bring about the conservation, development, and wise use of land, water, and related resources. 3. Provide assistance to the County in accordance with the annual work plan prepared by the District in consultation with the County and the Service. 4. Provide assistance to the County in accordance with priorities set by the County for the kind and amounts of work to be performed, including help with an effective sedimentation and erosion control program. 5. Furnish'the County annually an estimate of the cost of providing the kinds and amounts of assistance requested by the County. 6. Provide the County progress reports annually, or as requested, showing type and amount of work done. 7. Provide the County soil survey interpretations and review and make written comments on problems of water disposal, drainage, erosion and sedimentation control, beautification, pollution control and related matters as requested by the County. ► -3- WHAT THE SERVICE WILL DO: I. Make available through the District, such personnel as available to assist the County in helping to bring about the conservation, development, and wise use of land, water and related resources. 2. Provide assistance to the District and County in accordance with priorities set by the District for the kinds and amounts of work to be performed. 3. Assist the County in accordance with an annual plan of operation prepared by the Service in consultation with the District and the County. 4. Be responsible for technical supervision of all assistance provided the District and the County.F 5. Assist the District and the County in establishing and maintaining standards and specifications for conservation use and treatment of land. 6. Assist the District and County in preparing and implementing resource conservation plans within the limits outlined above. WHAT THE COUNTY WILL DO: 1. Develop procedures for the orderly and progressive handling of request for services to be provided by the District. It shall be the responsibility of the County to inform recipients of services provided by the District of these procedures. 2. Furnish the District annually, an estimate of the number of requests for services it will submit to the District in the coming year. The County will submit its estimate to the District 30 days before a budget estimate is needed by the County. t' -4- 3. Be responsible for such enforcement as required to insure the conservation, development and wise use of land, water, and related resources within the County. Development will be done in accordance with approved conservation plans and adopted standards and specificat IT IS FURTHER UNDERSTOOD: 1 . Either party, as mutually agreed upon, will provide or arrange for such additional services, facilities, equipment, materials, and arrangements as may be required to achieve common objectives. 2. Personnel and facilities of the County, the Service, and the District shall be under the jurisdiction of their respective employers; each retaining the right to establish headquarters for its personnel at such places as it deems most appropriate. 3. Funds supplied the District by the County will be transferred to the to the treasurer of the District to be expended under direction of the District. 4. Personnel and facilities supplied with County funds shall be under the administrative jurisdiction of the County and technically • responsible to the District Conservationist of the Service. 5. Neither the County, the District, nor the Service be bound by any obligation in this Memorandum or any Supplement thereto, or other appropriate arrangements which will involve the expenditure of funds in excess of that authorized by law. 6. Any Supplemental Memorandum of Understanding or other appropriate arrangements now in effect between the District and the Service shall remain in full force and effect. 7. This Memorandum of Understanding will be effective when signed by the three parties involved. Improvements OCO 8001 This memo concerns the difficulty we have encountered in getting a DOT encroachment signed for the Town of Hillsborough for the-installation o the water and sewer services in Northern Fairview. DOT requires that a encroachment contract be entered into by three parties: DepacLilent of Transportation - as the agency responsible. for the maintenance of the roads. Orange County as the agency making the installation. Town of Hillsborough - as the agency owning and operating the sewer system. Hillsborough -has objected to signing the agreement until Orange County provides a guarantee to cover the cost of all repairs that might become .necessary to the water and sewer service lines in the first year. Hill! borough claims they had a bad experience with the pinup station recently installed in Northern Fairveiw; for the first few months there were mechanical problems and the Town expended labor getting things correctec (the contractor warranted the parts) . The water and sewer serviCes now proposed will have a one-year contractor guaranteejparts and labor) but the Town wants fuller coverage, because they say that when a leak occurs there is not always time to call the contractor back- . As I see it, the County's options are as follows: 1. The County can appeal to the Hillsborough Commissioners to drop tb guarantee requirement because: a. there is a contractor's warranty, b. there is very little likelihood of repairs being needed in wat and .sewer service lines (almost all of which will not even be - . connected to) ,, c. JFtMc:lm /Ur: AGENDA ATTACHMENT # 11 AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE COUNTY OF ORANGE, NORTH CAROLINA AND THE JOHN R. McADAMS COMPANY, INC. REGARDING: EFLAND ESTATES AND GREATER EFLAND AREA SEWER FACILITIES STUDY OCO 8002 THIS AGREEMENT, made and entered into this the day of 1 1981, by and between The County of Orange, NC, hereinafter referred to as the COUNTY, and The John R. McAdams Company, Inc. , hereinafter referred to as the ENGINEER. WITNES SETH THAT WHEREAS the Efland Estates Subdivision has been declared a health hazard by the Orange County Health Department, and WHEREAS the COUNTY therefore inten to study the feasibility of providing sewerage facilities to Efland Estates Subdivision and the surrounding area, NOW, THEREFORE, the COUNTY and the ENGINEER, for and in consideration of matters hereinafter set forth, do hereby agree as follows: I. The ENGINEER shall undertake a study and prepare a feasibility report al the following lines: A. Investigation of sewerage alternatives to handle the immediate Eflan Estates sewer problem. The alternatives would include, but not necessarily be limited to, subsurface discharge at a nearby site, package treatment plant, and pumping to some existing wastewater system in the area. B. Investigation of the desirability of making sewer facilities availab to the greater region around Efland. (Orange County Planning Depart ment would provide indication of sewerage needs from a land use planning standpoint.) Also, investigation of alternatives for such regional sewerage facilities. C. For each of the above two possible sewerage projects, 1. develop alternatives for sewerage facilities 2. estimate costs for alternatives 3. investigate sources of funding for each alternative (including but not limited to, HUD Imminent-Threat-to-Health grant progra NC Clean Water Bonds, and EPA Federal Water Pollution Control Act funding) . D. Recommendations as to facilities to be built, funding sources, and implementation. 4 e II. The ENGINEER shall present the above feasibility report to the Orange County Commissioners, and at their direction shall then prepare appli- cations for grants for funding of facilities proposed in the feasibility report. However, the ENGINEER shall not be required under this agree- ment to prepare lengthy environmental statements (in excess of about four pages) for these grants. III. The COUNTY shall pay the ENGINEER a fee based on the following unit hourly charges: Engineer $35,00/hour Jr. Draftsman $16.00/hour Planner 27.00/hour Survey Party 35,00/hour Technician 24.00/hour Inspector 18.00/hour Sr. Draftsman 20.00/hour Secretary 14.00/hour The total fee paid to the ENGINEER shall not exceed $1,500. The fee shall become due upon completion of the feasibility report and the grant appli- cations; or upon completion of the feasibility report itself if the COUNTY elects not to apply for grants. Iv. The ENGINEER shall complete the feasibility study and be prepared to pre- sent it to the Orange County Commissioners not later than one month from the date of this agreement. The ENGINEER shall prepare the grant appli- cations as expeditiously as possible after being given directions to do so by the Orange County Commissioners. Several g the ] suggestions at that time to increase participation. Most of the brought fs weri inoorporated into the program through the cooperation of suggestions were Social Services and County Commissioners. County Board of The following is a summary of services implemented to increase Food Stamp usage: 1. Provide full time applications intake worker for Carr Mill office who would u on anon-appointment basis. This was implemented August 18, 1980. Response to this effort has been light with work load averaging about 404 of normal work load with weeks when work-1 is below 25%. Change of assignment for part of work day seems priority remaining to give prompt assistance on non�-appointment basis. with 2. Begin offering appointments for Food Stamps at Joint Orange-Chatham Community Action sites in Cedar Grove and Ef1and-ChBek. This was implemented September 2, 1980. Response to this effort has been nag gable.. It is estimated 90% of appointments that have been scheduled were di- verted to these sites by our staff, Numerous visits have been canceled due ti no appointments being soheduled and many trips have been made to see only a f. clients, The rate of applicants who do not keep appointments has been very h JOA Director Was Rare was notified of these problems in October, 1980 and h assistance was solioited to make Lull use of this service. 3. Mail issuance of Food Coupons should be increased. In April 1954 209 families were mailed their monthly allotment of coupons by Dept. of Social Services staff. The County Commissioners are being requested to increase clerical staff by 20 hours per week. A portion of this time is needed for a up person in coupon issuance since mail 'emanate is increasing monthly. 6, Extra Certification hours beyond regular work week, The Food Stamp staff will make special arrangements for after hours certifici on an individual basis upon request. The Board of Social Services and staff not felt demand is high enough to justify the extra cost of a regular after k certification schedule. 7. Employment of Minorities in Food Stamp Eligibility Specialist positions. The agency was fortunate to be able to recruit two minority employees assign Food Stamp interviewing in August 1980, Many recommendations were made regard hiring minorities with persons from the Orange County Client Council stating agency was not using available "loopholes" and 'weivers of Merit System requir meats to hire minority personnel. Harold Webb, Director of the Office of Ste Personnel addressed this matter in a letter dated June 20, 1980, Mr. Webb et he was not aware of "loopholes" and commended the agency for following persor personnel policies. A copy of this letter was sent to North State Legal Sery ,031w0e. 8. Identify by Name and Address and telephone numbernlegal advise is available f, "Notice of Adverse Action" to Food Stamp applicants and recipients. North State Legal Services provided the agency with a stamp to be used, as sta. above. This was begun in July 1980, 9. Display of a graph showing partioipation figures and goals. This was done in August with monthly fluctuations being posted as soon as the3 are available. The staff is aware of the program toward the goal through use this visual aid. 10. Goal setting for participation rate increases to 5096 of eligibles by January 1 1981 and 70% by June 1, 1981. The Social Services Board set a goal of WS participation by January 1, 1981. With the above 9 actions steps having taken place there has been no significan increase in participation rates since June 1980. The growth rate on the attac bar graph is partically flat except for the yearly mummer increase (see June, July, August 1979 & 80). November and December are usually up above Sept. and October's annual figures so we will hopefully have large increases until the e of 1980. November and December's count will not be available until about the second week of the following month. -Conclusion- The Social Services Board has asked that the Food Stamp program monitor closel; the factors listed, in this memorandum in order to increase participation in tht page 3 Deoember 1, 1 Food Stamp program. The growth rate is not as dramatic as the Board and Sta had hoped.. Haweve4 should demand be greater in the future the program is et to meet such demand, and is wng every effort to increase usage. To reach Mal of 40% of the estimated population in Orange County within 12 of the poverty guidelines (Food Stamp Eligibles) may not be possible unless a large number of persons applying for Low Income Energy Assistance (LIEA) in Decembi also sign Food Stamp applications, We are encouraging all LIEA applicants o: their probable Food Stamp eligibility status. The increase for November and December combined would need to be 435 additional participants, The Board and staff wish to thank each of the individuals and agencies who have E an interest in the Food Stamp program.
