I ME moz DATE December 17, 1985. • Subject: Resolution of Appreciation Dep t Board of Commissioners Public Hearing: es Y no • Attach nt Cs) : inforoation Contact: Yes-Resolution Commissioner Shirley Marshall • plane Ntrober: PURPOSE: To present a Resolution of Appreciation to Chris Hogan and Robert Hogan, Jr. for their courage and concern for others. 004 RESOLUTION OF APPRECIATION FOR CHRIS HOGAN At ) ROBERT HOGAN, JR. • TOMAS Chris Hogan and Robert, Jr. were on October 1, 1985 busy about their normal workaday business of farming, and WHEREAS, their activities in the field were interrupted • by the sound, of an airplane in trouble and its subsequent crash, and WHEREAS, these two young men- without hesitation raced to the crash scene to investigate and to give whatever aid was • needed, and WHEREAS Chris Hogan and Robert Hogan, Jr. exhibited unusual courage and concern for the lives of others in pulling from the burning plane the sole survivor while disregarding their own peril, and WHEREAS, Chris Hogan and Robert Hogan, Jr. gave all - possible help prior to the arrival of the rescue squad, NOW,I THEREFORE, BE IT RESCUED that the Orange County Board of Commissioners that these two young men, Chris Hogan and Robert Hogan, Jr. (already recognized in their community for their fine character) be commended throughout Orange County for their extraordinary bravery, human compassion, and willingness to sacrifice their own safety to help their fellow man. Due to delays to correct a zoning change the lease/purchase agreement should commence October 30, 1985 rather than the July 16, 1985 starting date as originally set specified in the agreement. 2. The heating and cooling system should not be started until major construction has been completed as notified by the County. IMPACr: There is no financial impact in this change only spread out payments to the owner. The start up of the heating and cooling system would save a service call at a later date. The owner is agreeable to both changes. RECOLVENDATIONS): Approve addendum to lease/purchase agreement incorporating the two changes. NEED: Sections 7.2.8 and 7.9 of the Orange County Zoning Ordinance require that construction on property subject to planned development zoning amendments begins within six (6) months of Board action establishing a planned development district . Section 7.2.9 provides that "construction must start and proceed at a reasonable rate within six months of the approval of the permit . If no construction has started the pernit becomes null and of no effect . The owner can request a six month extension from the Board of County Commissioners if the request is received before the permit expires .". Section 7 .9 provides that "if actions required in any amendment establishing a PO district are not taken within the time Limit set ,1 the Zoning Officer shall review the circumstances and reconmend to the Planning Board and Board of County Commissioners : a) that PD zoning for the entire area be continued with revised time limits; or b) that PD zoning be continued for part of the area , with or without revised time limits, and the remainder rezoned to an appropriate category; or c) that the entire district be rezoned from PD to an appropriate category ." ALL planned development rezonings require the issuance of a Class A Special Use Permit . Prior to recordation of the Class 04C A Special Use Permit the applicant is required to satisfy certain conditions of approval, including the revision of the site plan(s) (where necessary) and the issuance of appropriate development permits and approvals, including, but not limited to landscape plans, drainage and stormwater control plans, utilities approvals and permits, etc . . Foilowing issuance of the Special Use Permit other approvals ma be necessary before actual construction may begin including construction, permits, grading permits, NCDOT street construction plan approvals and driveway permits, etc. On ,July 1 , 1985 the Board of County Commissioners approved the Planned Development Housing Special Use Permit (R-11 req est for West Ten Mobile Park. These alternatives were discussed at a meeting between myself, the County Manager, and the Orange County Schools Superintendent. • The alternatives are reflected in the two revised School Capital Reserve Fund schedules as follows: Alternative No. 1 The CounIty could request that the School Board delay the Media Center portion of the project until the 1988-89 fiscal year. • The estimated cost of this portion of the project is $243,000. In addition, the amounts for undesignated roofs for 1986-87 and 198788 ($126,000 and $250,000 respectively) would be transfered to the High School project. As can be seen on page 2 of Alternative No. 1, the fund would still incur a deficit in the 1987-88. fiscal year. •Also, under this plan, thereare no funds reserved for the roofs after the current fiscal year. Alternative No. 2 • The 3C per $100 property tax rate designated for long range school capital ould be extended an additional year. This would allow the High School Project to be completed in its entirety during the 1987-88 fiscal year while leaving the undesignated roof funds intact. I want to remind you also that the kc. sales tax revenue projected in these School Capital Reserve Fund schedules are estimates. Based on the growth the County is now experiencing in this revenue source, these estimates will be realized. However,lweare not assured.that this pattern of growth will continue. In addition, two additional local agencies (Council of Gmernments and 00CCA) have expressed a desire to administer Orange County's JTPA program. ORANGE COUNTY ®�t' INTEROFFICE MOIDRANDUR T0: County Manager FROR: Assistant County Manager SUBJECT: Jobs Training Partnership Act Redesignation DATE: December 11, 1985 Information received from State Department of Natural Resources and Comity Development indicates the Governor has decided to redesignate service delivery areas (SDA) for the Job 'Training Partnership Act Program (JTPA) . Counties have three options: (1) apply for redesignation before January 2, 1986; (2) remain in their current SDA; or (3) be in the state administrated rural service delivery area. The Job Training Partnership Act is a federally funded program with the primary goal of training youth and unskilled adults to enter the labor force. The Service Delivery Area is the primary unit for planning and program administration under JTPA. The State receives an annual allocation that is passed on to SDAs by a standard formula specified in the Act. During the transition from the Comprehensive Employment and Training) Act (CETA) system to the new Job Training Partnership Act system, twelve SDAs were established. The County is under the Central Piedmont Training and Employment Consorti%m, a SDA which includes Durham County and the City of Durham. Central Piedmont Employment and Training office is housed within the City of Durham with a Private Industry Council j (PIC), appointed by the above listed governing bodies, serving all jurisdictions. Even though the County is represented by the consortium, the designation of a new SDA is possible using the following criteria: 1) a single unit of general local government with a population of 200,000 or more; or 2) a consortium of contiguous units of local govern- ment with an aggregate population of 200,000 or more which serves a substantial part of a labor market area; or 3) a current SDA which has performed satisfactorily based on performance standards, response to moni- toring reports and response to end of year assess- ments (single County SDAs will be encouraged to consort with another• county(ies) where practical); or 4) contiguous units of general local government (county) that: INTEROBTICE MEMORANDUM: 8512-801 074 Jobs Training Partnership Act Bedesignation December 11, 1985 Page 2 a) have 100,000 or more population; and b) have at least two counties; and c) represent a substantial portion of a labor market area or an area in which related State or Federal services are provided; and d) are able to satisfactorily- demonstrate to the State the capacity and resources to administer the funds and have adequate safeguards for the protection of funds received. Alonig with redesignation correspondence from the State, the County has received three unsolicited proposals from Joint Orange-Chatham Community Action (JOCCA), Triangle J Council of Governments (TJCOG), and the City of Durham (Central, Piedmont) . Staff has met separately with all agencies l to evaluate their proposals. JOCCA currently administers Chatham County's JTPA program and proposes to establish a Chatham/Orange SDA. TJCOG provideoplanners for Lee and Chatham. Under the TJCOG, the )A would be Lee, Chatham and Orange counties. On record, the Central Piedmont Consortium has done exceptionally well in meeting most of the goals outlined by the PIC for each program activity. The Consortium has been generally effective and responsive to concerns unique to Orange County. 2. The Consortium is a partnership. Durham County, Orange County and the City of Durham essentially have a part- nerihip agreement. An agreement that required an inordinate amount of time to develop, with all parties striving for a mutual arrangement which would benefit all jurisdictions. Moreover, the partnership has produced an effective JITILprogram. 3. Timeliness of redesignation. If the County's relation- shi6 with the Central Piedmont Consortium is dissolved, thej County would have to establish an administrative entity to administer the program including the composi- tion of a new PIC. With the JTPA program year beginning July 1, 1986 the County would have six months to create an administrative unit, appoint/orient a new PIC, and conduct planning for the upcoming year. PIC members have devoted a great deal of time familiarizing theMselves with MBA federal and state requirements along with analyzing the unemployment proles s in both couities. Losing the expertise of the existing PIC woad certainly inpqm:t program activities adversely. Cony PirivateIndustryCbuncil Members Five of the six PIC members appointed by the Board support the existing consortium and have expressed a desire to remain with Central Piedmont Training and Employment. Briefly, the PIC members commented: 1. The Central Piedmont PIC has became relatively know- ledgeable regarding OTPA. Dialogue among PIC Timbers is increasing. 2. The Central Piedmont PIC has cultivated a relationship with the private sector. The private sector has become involved and demonstrated that involvement by contribu- ting equipment and funds for training. 3. Coordination with the local Employment Security Canals- sion has been productive. - I 4. Coordination and contributions from Durham Technical Institute are instrumental. 5. Durham County is the natural labor market for Orange County residents. 6. Cenral Piedmont received $92,000 as incentive funds from the State for exceeding performance standards. The County PIC members expressed the following concerns regarding Central Piedmont. 1. Lack of outreach/visibility in Orange County. 2. A need for better coordination with County Chambers of Commerce and local merchants. 3. A geater empbasis on the transportation problems of unemployed residents. Specifically, transportation to and from JTEA training sites. The unsolicited nature of the proposals resulted in an unusual assessment process. The proposals are general and do not exhibit a common format. Currently, JOCCA operates the JTPA program for Chatham County with a - budget of $116,000.00, which supports four basic employment/training concepts. 1. On The Job Training (OJT) : An incentive program for employers I , to lire and train JTPA eligible participants. The employer is reimbursed for up to 50% of the training wages and other re- lated cost. 2. Individual Referral (I/R) : Participants in the I/R program are counseled on a regular basis to determine occupational interest, . • aptiltude and general developmental ability. They are then placed' • in al career curriculum in the Community College system, to attain the necessary skills to become gainfully employed. 3. Limited Work Experience (LWE) : Through this JTPA activity, parti- cipaints enrolled in the I/R program are provided an opportunity to practice his/her classroom experiences, in an on the job sit- uatlon, for a six (6) month period, and is paid at the rate of $3.415 per hour for fifteen (15) hours per week. 4. Instiitutional On The Job Training: This program is designed to off er flexible classroom training in specialized or short labor sup ly areas. We have enjoyed our relationship with Orange County in the Central Piedmont Consortium and are certainly interested in • continuing I our existing agreement to address the needs of our disadvantaged citizens in the two counties. I 1 1 We feel strongly that our existing relationship and service delivery alea (SDA) addresses the JTPA legislative intent by creating an SDA structure ccording to rational economic criteria without splitting natural labor markets into many local programs. JTPA provisions require coordinated planning of services for JIM implemen- tation andlwe feel that the present structure provides that coordination. The Durham/Orange Consortium encompasses a substantial portion of a labor market and has little difficulty meeting JTPA's coordination requirement in the development and approval of its job training plan. It also allows easy coordination with other elements of the employment and training system. Activities which require the support of other 1 systems such as vocational education, employment service, community • colleges and social services are facilitated by our existing agreement. L The Prvate Industry Council (PIC), at_its last meeting, created a coordination committee with representatives from human service agencies of both counties to ensure that those persons most in need of JTPA services are identified and encouraged to participate in JTPA 1 . The existing consortium has been very successful in generating private sector support for its programs. This support has come in the form of grants, equipment loans and advisory personnel to ensure the relevance of our training programs in meeting the needs of local . employers. In fact, the Durham/Orange Consortium is viewed statewide as a mode/ program for generating private sector input into its programs. The PIC Training Center in Durham is jointly funded by private I sector contributions of equipment and materials, the funds of Durham Technical Institute, the Employment Security Commission and the Consortium. Bob Ferguson has had preliminary discussions with DTI and the 4ployment Security Commission regarding a similar center in Orange County. Due to policy differences of the participating agencies, the location of such a center and the types of training are extremely ■ important l Maximum participation in the classes must be ensured, the ■ 1 training must be in areas most likely to produce job placements after training and the entry level wages of the jobs must address the performance standards of the Job Training Partnership Act. As you' can - ' see, thislventure must be approached carefully to ensure maximum utilization of the facility. . . The Jost important ingredient in building a meaningful employment 1 and training program is effective planning. We believe that capability exists in our consortium like no other SDA in the State. Our employment and training staff has years of experience in planning and operating training programs for the disadvantaged. The PIC Planning Committee has among its membership the Manager of the Employment Security Commission and the Dean of Continuing Education of DTI. Both of these agencies have Durham and Orange Counties as planning and service areas and are key agencies in the planning and implementation of employment and training activities. Ken Thompson noted that the Orangelcounty Agricultural Extension Agency had been rated the highest of the seventeen agencies in this region which certainly indicates a department effort. $. JOB TRAINING ACT SW REDESIGNATION 3 Count Manager Ken Thompson explained the County received a letter from the Governor requesting the County identify and/or redesignate the Service Delivery Area (SDA) for the Job Training and Partnership Act Program (JTPA) . He outlined the three options available: (1) Apply to the State for a change in designation by January 2. 1986. (2) remain in the current SDA between Durham and Orange. or (3) become a part of the State administered Rural Service Delivery Area. The County received proposals from (1) COG. (2) 000CA. and (3) City of Durham. ',Meetings were held with with each of the three and also with the Private Industrial Council (PIC). The County Manager recommended that the JTPA Program remain in the Central Piedmont Employment and Training SDA. Commissioner Marshall expressed concern and requested further discussion on the questions brought out in the Commission for Women study. The issues were riot addressed in any of the proposals. She specifically expressed concern for those needs of the rural low-income people and those who are on AFDC. The question of transportation for the participants needs to be addressed and the utilization of the Coordinated Agency Transportation System (CATS) . JOOCA does have many vehicles in the CATS and would be able to address that concern. CommiSsioner Carey expressed concern about the recommendation to stay with the exiting SDA. He recognized that time constraits had not allowed formal proposals to be prepared which would have allowed a more composite picture from those who presented proposals. He pointed out that administrative convenience does not substitute for the long term best need of the County. Commissioner Marshall asked that consideration be given to the vast experience that George Esser, Board Chairman of JOOCA. would provide. Ken Thompson noted that JOOCA does have the transportation capabilities and also three job training facilities that could be used. They have had vast experience with CETA and other job training programs. He also pointed out the *table experience on the Private Industrial Council (PIC) . Commissioner Marshall questioned if the truly needy have been served by the present program or if the jobs were found first and then the people trained that would fit into the jobs. Assistant County Manager Albert Kittrell noted that the training site in Durham has received numerous contributions from local businesses and the training facilities are in excellent shape. A site in Orange County is a concern that needs to be addressed. Mr. George Esser made reference to a public hearing held in Hillsborough in 4hich citizens voiced concerns about access to the JTPA program. Outreach to people who don't have jobs and need the jobs was the greatest concern. He noted that while it is important to meet the need of the Research Triangle Park, other types of jobs need to be found. The JOOCA Board unanimously passed a request that the Orange County Board of Commissioners consider establishing an SDA with Chatham County. MCC& is considering a number of innovative programs to find the kind of jobs that AFDC women and other people who cannot read or write can be linked with. CommisSioner Marshall commended the present PIC Council and stated a need for more representation, on the Council. PIC neibers Dan Lunsford, Mildred Council and Phyllis Lotchin spoke in support of the present arrangement. It was the consensus of the Orange County PIC members to request the Orange County Board of Commissioners to remain with the current SDA. Mildred Council stated that many people who needed jobs badly had not developed the skill level to communicate with the present MA program administration. Gloria Williams. Director of JOOCA, indicated that JOOCA would , , 4 provide a fulltime program with a fulltime staff that would address the needs identified in the Commission for Women report. Waal Insko. Coordinator of the Commission for Women, noted no attempt was made to evaluate the administrative procedures. A fulltime staff person and local training centers were suggested in the report. Tom Wallace of the JTPA program in Chatham County described the types of training programs they offer and placed strong emphasis on serving the truly needy in rural areas. Motion was made by Commissioner Carey. seconded by Commissioner Marshall to designate JOOCA as the SDK for the Orange and Chatham area contingent upon Chatham County approval. A sdbititute motion was made by Commissioner Walker, seconded by Commissioner Lloyd to table the decision until Thursday. December 19 to allow additional time or further input. Town Manager of Carrboro. spoke on behalf of the staff and Planning Board. He reaffirmed their commitment and willingness to work in the Joint Planning process. He emphasized that Carrboro would like to have some input in developing the plan. Policies are being made that affect Carrboro's joint planning area and in particular the watershed areas. Be would like to see the plan applied through an ordinance and feels that the Carrboro ordinance is flexible enough to use in the joint planning area. He stated that Carrboro is ready to enter into a joint planning agreement as soon as the map is prepared. I There is still minor disagreement about the line to the north. That line will be the Town limits someday. If that line is not negotiable, he would like to look at other alternatives in the joint planning process. Chair Willhoit emphasized there was not a deliberate effort to exclude Carrboro from the joint planning process. He understood that Carrboro wanted to wait until a plan was worked out before signing an agreement. He stressed , f [ 5 that policies would need to be developed for the extension of sewer lines into the watershed and that the current County policy is to discourage such extensions. Willboit noted that the line separating the two planning jurisdictions generally followed the railroad track, Homestead Road, Rogers Road, Eubanks Road and the landfill boundaries. Morgan requested that Carrboro be directly involved in the process of developing subsequent meetings and expressed a desire to host every other meeting or every third meeting. With reference to the extraterritorial area, he feels that 1Carrboro, Chapel Hill and the County should meet and decide what is best for all communities. Commissioners Marshall and Carey both emphasized the importance of working together and including Carrboro in the joint planning area. Chair Willhoit requested that the Orange County Planning Board work with the Carrboro Planning Board to bring them up to date on developments that have taken place since the public information meeting. It was a consensus of the Board of Commissioners to involve Carrboro in the joint planning process. They were urged *1 attend the public information meeting scheduled for January 14, 1986 at Chapel Hill High. School. 9.
