PURPOSE: To consider allowing temporary use of an approximately 5-10 foot strip of land at
the rear of the Skills Development Center property to facilitate construction on the adjacent
property.
BACKGROUND: Dr. David Park, owner and developer of the proposed Stonecrop Apartments
at 110 S. Roberson Street, Chapel Hill, has requested that the County allow his contractors to
use a narrow strip of land to the rear of the Skills Development Center for circulation and
workspace during construction. The area of use requested by Dr. Park is identified on the
attached site map and is depicted by diagonal lines.
Under the terms of this agreement, it is recommended that the developer be required to:
o Erect a chain link or similar material fence to delineate the County property upon
which temporary use is granted. No direct access from the Skills Development
Center to the construction site is permitted.
o Notify the County when the fence line is determined so the County can review the
proposed fence line prior to its erection.
o Advise contractors that the Skills Development Center shall not be utilized in any
manner during construction. In particular, parking in the Skills Development
Center parking lot is prohibited.
o Ensure that the County property is cleaned and restored to its previous state,
including, but not limited to, the removal of all construction debris, removal of the
temporary fence and replacement of the fence in its current location and
replanting of any vegetation that may be removed in the construction process with
plant material that is mutually acceptable to the County and the developer.
o Ensure that the County is included as an additional named insured on insurance
policies obtained by the contractors for construction of the project. A certificate of
insurance, along with the appropriate endorsement from the insurance company is
required before construction of the fence is permitted.
o Ensure that the fence be constructed in a manner that shall not adversely affect
operations at the Skills Development Center, including, but not limited to
elimination of spaces currently marked for parking or impeding access to the
existing dumpster site.
Construction of the apartment building is scheduled to begin within the next few months.
Permission to temporarily use the 10 foot strip of land will expire as of June 30, 2008, at which
time the County site will be restored as stipulated above.
FINANCIAL IMPACT: No financial impact is contemplated.
RECOMMENDATION (S): The Manager recommends that the Board grant temporary use of a
5-10 foot strip of land as described herein; and authorize the County Manager to sign a
document memorializing the agreement with the developer.
