PURPOSE: To confirm the application submitted by the Chair on behalf of the Board for a
2007 National Recreational Trails Program Grant application to gain funds for the acquisition
of land for a public canoe access area along the Haw River.
BACKGROUND: In March of 2006, Orange County entered into a Memorandum of
Understanding (MOU) with other jurisdictions to work jointly on the Haw River Access Trail. At
the time, a portion of the Haw River was being accessed through private property along Old
Greensboro Road. The bridge crossing at Old Greensboro Rd .is along the identified Haw
River Trail corridor and also within a section of the primary route for the Mountains-to-Sea
Trail. In February of 2007, a member of the Environment and Resource Conservation,
Department (ERCD) staff met with landowners and found they may be interested in either
selling property or developing a land use agreement so that Orange County could manage
canoe access to the Haw River in Orange County.
Orange County has the opportunity to submit a National Recreational Trails Program Grant
application for the intentions of requesting money for this land purchase or land use
agreement. The grant would require that Orange County pay for land purchase or the price of
the land use agreement and be reimbursed once the transaction is complete. If the grant is
awarded, Orange County will be reimbursed 80% of the cost, not to exceed $75,000.
The State Trails Program has placed this particular project, for the Haw River Trail Access, at
the top of its list of priorities for allocation of funds. The Trails Grant Coordinator specifically
requested that the County apply for these funds. The deadline for submittal of this application
was February 28, 2007. In order to meet this deadline, the Chair signed the application in
advance of full Board consideration.
FINANCIAL IMPACT: Orange County would be responsible for initial purchase of land or the
land use agreement. This property would be eligible for available Lands Legacy funds. If the
grant application is successful, Orange County would be reimbursed 80% of the cost, not to
exceed $75,000. The appraised value, acquisition or agreement price is not yet known.
RECOMMENDATION(S): The Manager recommends that the Board confirm the Trails Grant
Application.

Developing paddle access at Old Greensboro Highway will bridge the longest existing
stretch of the Haw River Trail without amenities or official access about 12 miles
spanning three counties.

The grant money will be used for purchase of land.

The 8.19 acre parcel is not only currently being used as an unofficial access, but is a high
priority parcel for riparian protection. Current private landowners are unable to meet the
management demands that the increase of Haw River Trail paddlers are requiring.

existing trail project (trail head parking areas, restrooms, drinking water, etc.):
Improvements to the access upstream at Saxavahaw and downstream at Chicken Bridge_
road (the main access points associated with the Old Greensboro access ) are both
improving their facilities, creating a recreational system gap at Old Greensboro access.
Currently at Old Greensboro, there is a dirt access road in the DOT right -of -way.

this development, the Saxgpandw access is without a take-out location and the Chicken
Bridge access development is without a put-in ppstream, relegating each to only %2 of their
recreation potential. Finally, this location is an important acquisition as it bridges the gap
between the land acquisition in Chatham County with projects upstream. Without this
bridge access, successful preservation and recreation projects to the south dead-end at the
county line.

A. Project Description: This project's goal is to purchase the land currently being used as an
unofficial river access at the Old Greensboro Highway Bridge and improve the currently
dangerous river access methods. This development provides facilities at what is currently
the most important Haw River Trail access and maximizes the potential trail
improvements conducted by the partnering counties and municipalities of Alamance
County Chatham County Saxapahaw, Swepsonville Burlington and Graham

complete this project within two years from the date of award of a fully executed contract
with the Department of Environment and Natural Resources.

To complete your RTP application and become eligible for funding, you must submit the

Provide a copy of the 1:24,000 United States Geological Service (USGS) topographic map (or
map portions, clearly marked with USGS quad name), which shows your complete project site.
Indicate the project boundaries clearly on both maps.
2. A site map
Provide one copy of a site map of the project itself. The map must have a scale and a north
arrow, and the route of the proposed trail or location of the trail facilities must be clearly
indicated. If the project involves a combination of new trail construction and trail
maintenance /restoration, the locations of these two activities must be clearly marked along the
length of the trail on the site plan.

I. Landscape description
1. How many acres in the site will be impacted by the proposed trail construction?
Impact will be minimal as displayed in the site plan map. Land trail feet constructed in
this project will only include trails from the parking area to the river access area.
2. Describe the past land use of the land impacted by the proposed trail construction (for
example, reforested land, former agricultural fields, etc.)
There is an existing dirt road access branching off of a near by Lnvate driveway which is
mostly within the DOT ri hg t -of -way. The remainink area has been left in a natural state
for over 5 years.
3. Describe the site's general land cover as accurately as possible (for example, 40%
hardwoods, 30% Pines, 30% open field)
100% forested
4. If there is flowing water or open water on the site, please describe it.
The Haw River forms the western boundW of the parcel in question.
5. If there is a wetland on the site, please describe it, noting the acreage it includes. Show its
extent on the enclosed site map. Please refer to the National Wetlands Inventory Map
http: / /wetlandsfws. er.usgs.gov /wtlnds/launch.html.
It is unclear exactly how many acres of the parcel is wetland, although almost the entire
parcel is within the 100 year floodplain. It is possible that as much as 90% of the parcel
is wetland.
6. Describe the site's general topography as accurately as possible (for example, 40% steep
bluffs, 40% floodplain, 20% gentle ridges)

This bottomland hardwood area has 50 -80 year old Sycamore trees, Oaks, Ash, Box elder
etc.

Bald Eagles frequent the Haw River Wildlife Corridor. Ospreys, numerous fish species,
deer, fox, and other animals frequent this rich corridor and this site.

4. Agrees that construction of any recreational trail on National Park Service or National
Forest Service lands for motorized uses will be, on lands proposed for such uses and will
not be on lands in designated wilderness areas and that such construction is otherwise
consistent with the management direction is such approved land and resources
management plan.
5. Has the legal authority to apply for Federal assistance, and the institutional, managerial
and financial capability (including funds sufficient to pay the non- Federal share of project
costs) to ensure proper planning, management and completion of the project described in
this application.
6. Will give the awarding agency, the Comptroller General of the United States, and if
appropriate, the State, through any authorized representative, access to and the right to
examine all records, books, papers, or documents related to the assistance; and will
establish a proper accounting system in accordance with generally accepted accounting
standards or agency directives.
7. Will initiate and complete the work within the applicable time frame after receipt of

FEDERAL CERTIFICATION REGARDING DEBARMENT AND SUSPENSION
(Required of Governmental Agencies and Non-Profit Organizations)
The undersigned certifies, to the best of his or her knowledge and belief, that we are complying
with all provisions of TITLE 49 CFR 29 —TRANSPORTATION, Sec. 29.200 Debarment or
suspension.
(a) Primary covered transactions. Except to the extent prohibited by law, persons who are
debarred or suspended shall be excluded from primary covered transactions as either participants
or principals throughout the Executive Branch of the Federal Government for the period
of their debarment, suspension, or the period they are proposed for debarment under 48 CFR part
9, subpart 9.4. Accordingly, no agency shall enter into primary covered transactions with such
excluded persons during such period, except as permitted pursuant to Sec. 29.215.
(b) Lower tier covered transactions. Except to the extent prohibited by law, persons who have
been proposed for debarment under 48 CFR part 9, subpart 9.4, debarred or suspended shall be
excluded from participating as either participants or principals in all lower tier covered
transactions (see Sec. 29.1 10(a)(l)(ii)) for the period of their exclusion.
(c) Exceptions. Debarment or suspension does not affect a person's eligibility for—
(1) Statutory entitlements or mandatory awards (but not subtier awards thereunder which are
not themselves mandatory), including deposited funds insured by the Federal Government;
(2) Direct awards to foreign governments or public international organizations, or transactions
with foreign governments or foreign governmental entities, public international organizations,
foreign government owned (in whole or in part) or controlled entities, and entities consisting
wholly or partially .of foreign governments or foreign governmental entities;
(3) Benefits to an individual as a personal entitlement without regard to the individual's
present responsibility (but benefits received in an individual's business capacity are not
excepted);
(4) Federal employment;
(5) Transactions pursuant to national or agency-recognized emergencies or disasters;
(6) Incidental benefits derived from ordinary governmental operations; and
(7) Other transactions where the application of these regulations would be prohibited by law.

BOCC members;
This is to make you aware that I have authorized the staff to submit a application on Feb. 28th prior to our next meeting for funds
to possibly acquire land for the public Trail Access on the Haw River. It will be placed on the next board consent agenda for your
consideration and approval. This opportunity became available in the last few days and had a short time frame for submission
since the State Trails coordinator requested that we apply. this means that we have a great chance of being funded.
This project has been on our agenda for some time, but has not been a high priority until now after being requested to apply. If
you do not wish to approve this item after the fact, the application can be withdrawn or the money can be declined if funded.
However, I did not want to bypass this opportunity.
recognize that there are financial implications such as a matching requirement and possibly some type of partnership with the
other jurisdictions with whom we signed a MOU in 2006 to work together to achieve this goal in each of our jurisdictions. These
items can be discussed after approval of the application and funding.
