The property in question is lot 28 of Orange County Tax Map 3 Hillsborough-Town-
, - -- ship. The present zoning classification is R-1 Residential, while the requested
designation is R-3.

The property is located within an area designated as 10 year Transition. •�`'
IMPACT: . Approval of the request Would allow a density of 10,000 sq. ft. per dwelling
unit instead of the 4O,00O sq. ft. that is presently allowed.

A 1982 traffic count on NC 86 north of where NC 57 intersects with 86 indicates
5,600 trips per day. • '
�
If this property is developed at the R-g density, an additional 706 trips per
day would be created. This traffic would be added to NC 86 either at the
intersection of Coleman Loop Road (SR 1332 ) or from an entrance along the

frontage of this property with NC 86. The Department of Transportation has
recommended that a left turn lane would be needed on NC 86.
The Town ofA\ lls6orough has indicated that due to lack of water pressure it
. could be 1 to 11 years before the Town. could serve a development in this area
with the proposed density.

The property is designated Ten Year Transition in the
Orange County Land Use Plan and meets all the criteria as set •
forth in the Land Use Plan.
The property meets the application criteria as set forth
in the zoning ordinance in that it is designated Ten Year Tran- -•
sition, water and sewer are proposed as part of the development,
and vehicular access is by NC 86 and S.R. #1332 a.k.a. Coleman
Loop Road.
The accompanying letters from the Town of Hillsborough,
Orange County Rescue Squad, Hillsborough Volunteer Fire Depart-
ment, and Orange County Sheriff' s Department, all indicate that
these agencies can and will provide the necessary services for
this development.
Hillsborough is growing and there is a shortage of moder-
ately priced residential lots in the immediate area. If this
rezoning is granted, we hope to be able to provide those needed
home sites.

Dear Sir:
The purpose of this letter is to state that Frank Pearson, developer,
will be able to tap to the Town's water-sewer system for a proposed develop-
ment found on Tax Map 5, Block A, Lot 4 and Tax Map 3, Lot 28, if all re-
quirements shown on the Town's Water-Sewer Extension Checklist are met; and
if all State agencies requirements are met; and all requirements of the Town's
engineers are complied with. However, the Town of Hillsborough assumes no
financial responsibility for the upgrading or improvements to any existing
water or sewer line or to any existing pumping station located in this area.

I have reviewed the proposed developement to be constructed on
N. C. 86 at Coleman Lp . Rd. , North of Hillsborough . If the
water lines are installed in accordance with good engineering
practices, with hydrants properly located, the Orange Rural
Fire Deptartment can provide adequate fire protection with no
additional burden or problems.

Dear Ms. Smith:
•
This is in reference to your request for an access review of property
ldcated in southwest quadrant of intersection of NC86 and SR1332
(Coleman Loop Road) in -Hillsborough Township. It is recommended that
a left turn lane be constructed on NC86 for any access onto NC86.
The speed limit on NC86 is 55MPIX at this location. The vertical
alignment is hilly. Trucks using NC86 will build up speed going
downhill and probably have a difficult time stopping for traffic
stopped on NC86 waiting to turn left into -the development. The
development also borders onto Coleman Loop Road. It is possible
that access to the development can be off Coleman Mill Road with
the left turn lane being constructed at the intersection of NC86
and Coleman Mill Road. We will be glad to discuss options with the
developer or his engineer as plans are being finalized. '
Access to development off SR1395 (Harper Street) was also investigated. .
Access to Harper Street from this proposed development is acceptable.

PURPOSE: To receive public comment on a proposed rezoning request scheduled for public
hearing on Fabrbary 25, 1985. ' ,

NEED: Robert A. and Rachel S. Scholar have requested a rezoning for 12.40 acres of land � u'
located along Harper Street (SK 1395) and Dixie Drive north of Hillsborough. The
purpose of the request is to permit higher density residential development than ~
is presently allowed. ~`
The property in question is part of Lot T7 of Orange County Tax Map 5, Hillsborough � � ^
Township. The present zoning classification is R-1 Residential , while the requested
designation is R-4.
The property is located in an area designated as 10 Year Transition in the Orange
County Land Use Plmn, •
IMPACT: Approval of th e request wou ld allow a density of 10,000 s q. ft. per dowllYmg unit
instead of the 40,000 sq. ft. that is presently allowed.
A 1982 traffic count on Harper Street at the entrance into Northern Fairview
indicated.300 trips per " If this |2�40 acre tract �s developed at an R-4

density an additional 274 trips per day would be added to the streets in Northern
Fairview, r.
If Highland Woods is completely developed, approximately 415 trips per day would .
be using Harper Street from this subdivision. |
If the remainder of Mr. Scholars' property does not get developed this would put
approximately 698 trips per day on the streets in Northern Fairview. If the remainder
, is developed at an R-4 density, this would provide approximately 1005 trips per day
concentrated on Dixie and Harper streets unless a nother entrance is considered.
The Town of Hillsborough has indicated that due to lack of water pressure it could
be 1 to 11 years before the Town could serve a development in this area with the
proposed density.
D.O.T. recommends no improvements to Harper Street.
RECOMMENDATION(S) : That the Planning Board recommends denial based on the lack of assurance of

This is in reference to your request for an access review of property ,
16cated in southwest quadrant of intersection of NC86 and SR1332
(Coleman -Loop Road) in -Hillsborough Township. It is recommended that
a left turn lane be constructed on NC86 for any access onto NC86.
• The speed limit on NC86 is 55MPH at this location. The vertical
alignment is hilly. Trucks using NC86 will build up speed going
downhill and probably have a difficult time stopping for traffic
• stopped on NC86 waiting to turn left into the development. - The
. .
development also borders onto Coleman Loop Road. It is possible
that access to the development can be off Coleman Mill Road with
the left turn lane being constructed at the intersection of NC86
and Coleman Mill Road. We will be glad to discuss Options with the
developer or his engineer as plans are being finalized. -

Access to development off SR1395 (Harper Street) was also investigated.
Access to Harper Street from this proposed development is acceptable.

LOCATION AND DESCRIPTION

The property is located. on US 70. It is referenced as Lot 36C and 37 on Tax 1
Map 28 in Cheeks. Township. The request addresses all of lot 36C and the portion 1
of Lot 37 not-. zoned EC-5' in 1984.. These lots contain- 3.83 and 17.45 acres respectively.
. The. area is designated on. the Land Use Plan as Ten Year Transition and zoned R-I .
The applicant, requests that an error in the Zoning Atlas for Cheeks Township be
corrected to show this- parcel as. commercial as opposed to Residential.-1 zoning
district.. The use has been in operation since 1972 and the property was previously
used for commercial purposes for many years. Only a portion of Lot 37 dimensioned
as. 170'x 450, feet was listed in the.list of specific lots to be zoned other than
AR' or R-I in the extension of zoning to Cheeks Township. The applicant's business is
called the WI-Com: Truck Lines, Inc. The portion of the property currently zoned
Existing Commercial-V includes the. office, shop, storage areas and structures,
parking and refueling areas. The. zoned portion does not include the pond or ,

is an overgrown, previously timbered area on which an abandoned open structure is

I do hereby request that you correct a zoning
error contained in the Zoning Ordinance in Cheeks '
Township on a portion of Cheeks Township which is
better known as Tract #37 and Tract #36C on the north
side of Highway 70, which is now known as Wil-Com Truck
Lines, Inc. property.
Wil-Com Truck Lines, Inc. opened for business in
February of 1972 as a truck leasing company. At that
time we were renting a 30-foot by 50-foot building from
Mebane Lumber Company to use as a shop, fueling point,
servicing and storage area for trucks and trailers.
In October of 1972, we purchased 17.45 acres and
3.83 acres from Mebane Lumber Company to use for the
same purpose and have used this continuously to this
time for our business. This property has been used for
businesses for the last 35 years. Originally it was
used by Bobby Roberts Lumber Company. Thereafter it
was used as Norman Hobby Wood Working Shop. The next
owner also used it for business purposes which was
Mebane Lumber Company, our immediate predecessor in
title, and we have used it continuously since
purchasing it from Mebane Lumber Company, including the
time that we leased it from Mebane Lumber Company.
This property now has a shop, office, storage
area, parking/fueling area and a small fire pond for
fire protection.

RECOMMENDATIONS
Article 8.2.2 states that where a preponderance of evidence
• indicates compliahce with the general standards, specific rules
governing the specific use, and that the use complies with all
requi red regulations and.s tandards, the application must be approved
unless it is found, in some specific manner, that:
I. The use will not promote the public health, safety and general
welfare.. . if located where proposed and developed and operated
according to the plan as submitted;

2. The use will not maintain or enhance the value of contiguous
property;
3. The use is not in compliance with the general plans for the
physical development of the county as embodied in these regu-

lations or in the Comprehensive Plan, or portion thereof,
adopted by the Orange County Board of Commissioners.

• opposing the application. The proof must also be in the form of
competent material and substantial evidence.
No information has been received which would establish grounds for

RECOMMENDED CONDITIONS OF APPROVAL:
1. The grantee of this Special Use Permit shall post with Orange County,
in a farm acceptable to the County Attorney, a bond or letter of
credit in an amount equal to the cost of all improvements plus 10%.
The amount shall be determined on the,basis of fully executed construc-
tion contracts or certification by a registered engineer employed
by the grantee of this Special Use Permit. Security for construction
of the improvements in this project may follow phasing in the. project.
• Specifically, as improvements are completed in each phase that phase
and a corresponding amount of money may be released from thessecurity
, instruments or the security instruments may be renegotiated based on
the "yet to do" portion of the improvements.
2. Security shall be provided for the grading, paving and stabilization
of all cleared areas, streets and other vehicular travelways; side-
walks and other pedestrian walkways; erection of street signs;
• utility installation and hookups and "tot lot"; landscaping and mulching
• around all mobile home units.
3. All necessary easements to permit utility (electricity, telephone and
cable television by any cable television provider franchised by Orange
County to serve this. development) , installation, servicing and
_hook-ups to the development and to each unit within the development
shall be provided at no cost to the utility provider.
4. Roads, parking areas , walkways, street signs,utilities, recreation
facilities and sites, landscaping and mulching around units shall. •
be maintained as constructed. All such improvements and facilities
shall further be maintained and operated in a safe manner.
• 5. The grantee shall promulgate rules and regulations governing tenancy
in the development which shall restrict accumulation of trash and
rubbish outside of the mobile home units, shall restrict storage
of 'goods outside of mobile homes and which shall further prohibit the.
storage of junked or unregistered motor vehicles. The grantee shall
file with the Orange County Planning Department a copy of the rules
and regulations promulgated under this condition and maintain an
up-to-date copy of the rules and regulations in the Orange County
Planning Department.

PURPOSE: To receive public comment on a proposed 'text amendment for Article B Special
Use Permits of the Orange County Zoning Ordinance.

NEED: ' The current Zoning'Ordinance establishes standards of evaluation for extractive
lases. The attached amendment proposal reflects a desike ,to tighten current
provisions of the Zoning Ordinance by specifically requiring. the' applicant
to submit materials addressing relationships with and impacts on adjacent
properties and facilities; impacts on and methods to minimize impacts on
surface and ground water; compliance with the provisions of the special
use permit during the interimof' the operation; rehabilitation reclamation • '
plans; and loCal need.

SECTION 8.8 .1 - EXTRACTION OF EARTH PRODUCTS (CLASS A SPECIAL USE)

8 .8 .1 Extraction of Earth. Pkoducts (Class A Special Use)

8.8.1.1 ' Additioral Information
In addition to the information required by Subsection 8. 2, the
following shall be submitted as part of the application.
a) Seven copies of the site plan, prepared by a North Carolina
• registered land surveyor or engineer, shall contain the
• following:
• 1) Extent of area to be excavated or mined.
•
2) Aerial photograph of site and all areas within 1,000
feet of the perimeter of the property flown within two
(2) months of the application for a Special Use Permit.
3) Existing topography at a contour interval of two - (2)
feet based on mean sea level datum.
4) Land use, road system, natural features and topographical
• (10 foot contourLintervals) details for the area within
. 1,000 feet of the perimeter. of the property.
• 5) Typical cross-sections showing extent of overburden,
• extent of sand and gravel deposits, and water pable. •
6) Proposed handling and storage areas for overburden', by-
products and excavated materials. •
• •
7). Location and results of groundwater borings showing depth
of groundwater.

8) Any areas proposed for ponding. •
•
9) Wind pattern details and 'on-site windbreaks .
'10) Soils details and statement addressing agricultural

8) Operational test wells and schedule of results and
analysis and response.
9.) Compliance with provisions of Sediment and Erosion
Control Ordinance.

10) Depth of extractive operations.
11) Any phasing of the operation and the relationship among
the various pbases.

12) Operating practices will be followed to comply with the
• performance standards applicable to the operation (.See
Subsection 8. 2) .
c) A Rehabilitation Plan which shall include:
1) A statement of planned rehabilitation of the excavated
• land, including detailed methods of accomplishment and
planned future use of the rehabilitated land.
• 2) A.map showing the final topography, after. rehabilitation,
to the same scale as the Site Plan, depiCting any water
areas' and methods of preventing stagnation and pollution
thereof., landscaping and ground cover. proposed to 'be
installed, and the amount and type of back fill to be
employed, if. any.
8). Typical cross-sections, showing planned rehabilitation. •
4) A phasing and timing plan, related to the phasing and
timing portion of the Operations Plan, showing the
progression of the rehabilitation and the date when it
will be complete.
5) The method of disposing of all equipment, structures,
.dikes and spoil piles associated with the operations. •
6) A written legal description or survey of the property,

8.8.1. 2 Standards of Evaluation
The following standards shall be used in evaluating an
application for a permit to conduct extraction of earth
products:.
a) The applicant demonstrates that the extractive use
operation fulfills primarily a local need as opposed
•
to a regional need in terms of supplying sand and/or
gravel for building and construction purposes . .
•
b) All operations associated with extraction shall conform
to the following perfoLwance standards:
1) Direct illumination resulting. from the operation
shall not fall upon any land not covered by the
application.
2) Equivalent sound levels at the boundaries of the
extraction site shall not exceed the following
• standards:
• - Between 7:00 a.m. and 7 :00 p.m. 68dBA
- Between 7: 00- p.m. and 7:00 a.m. 58dBA
• 3) Vibration levels at the boundaries of the extraction
site shall not exceed the following standards:
Maximum Peak Particle Velocity
- Steady state 1.0 inches/second
• - Impact 2.0 inches/second
Note: The maximum particle velocity shall be the
• product of two (2) times the frequency in
• cycles per second times the sum of three (3)
mutually perpendicular displacement 'components
recorded simultaneously. For purposes of this
ordinance, steady state vibrations are vibrations
which are continuous, or vibrations in discrete
impulses more frequent thati 60 per minute.
Discrete impulses which do not exceed 60 per
minute shall, be considered impact vibrations.
Maximum air blast vibration, measured at the
lot lines of the zoning lot containing the
extractive use, shall be 125 decibels on the
linear scale.
c) The Rehabilitation Plan shall be referred to the Orange
• County Soil and Water Conservation District for review

•
and recommendation, which shall not be binding upon the
Board of commissioners, in particular regarding the
landscape material specified, the planting and maintenance
proposed to insure continuous growth and development, and
the acceptability of the proposals for the handling of
lakes, ponds, etc.
d) The permanent roads, defined as those to be used in
excess of one (1) year, within the excavation site
shall be surfaced with a dust free material such as
• soil cement, bituminous concrete or Portland Cement
concrete from the nearest public road to the yard area.
Also, all permanent roads located within 300 feet of
residentially zoned land shall be ;treated the same.
e) Roads other than permanent roads shall be treated with
dust inhibitors, to be specified in the Operations Plan ,
• which will reduce to a minimum the generation of dust .
from the road surfaces as a result of wind or vehicular
action. Properly operated water wagons shall be an acceptable
method of dust inhibition.
f) Where the proposed extraction shall take place within
300 feet of a dwelling, school,, church, hospital, commercial;
• or industrial building, public building, or public land,
a security fence at least six (6) feet in height shall be
installed.
• •
g) Spoil piles and other accumulations of by-products shall --
not be created to a height more than forty (40) feet above
the original contour and shall be so graded that the
vertical slope shall not exceed the material's natural
•
angle of repose.
h) The Operations Plan and the Rehabilitation Plan shall be
coordinated so that the amount of disturbed land is kept to '
the -. ..absolute minimum consonant with good practices :
and so that rehabilitation proceeds in concert with
extraction.
i) No land disturbance shall take place within one hundred (100)
feet of the zoning lot Line or the property line where
the zoning line and the property line are one- and the
same. Within the 100-foot setback area, existing vegetation I
shall be retained for the purpose of providing a visual
screen and noise buffer. No disturbance or removal of
vegetation shall be permitted except for access roads
leading from the excavation area to public roads. Where
vegetation within the 100--foot setback does' not exist, the
applicant shall be required to provide a dense, evergreen
buffer consistent with the purpose cited above . The buffer
. shall be in place prior to the initiation of any excavation
activities .

j) The applicant shall submit operational reports, prepared
• on an annual basis, detailing the amounts Of materials
extracted, extent of extractive area, depth of extractive
area, and results of groundwater test borings .
k) Annual inspections of the operation . shall be conducted
by the Zoning Officer following submittal of the annual
operations reports to determine compliance with the
provisions of the Special Use Permit .
• 1) In cases of abandonment or termination of operations for
a period of twelve (12) consecutive months, application
for a new Special Use Permit is required.
m) The Board of Commissioners shall require for all
• extractive uses a performance guarantee to insure that
the provisions of the Rehabilitation Plan are met.
Such performance guarantee shall be in a form approved
by the County Attorney. The amount of such guarantee
shall cover the cost of rehabilitation on a per acre
basis, if the cost does not exceed the amount posted
with the State. If the rehabilitation cost exceeds
the amounts required by the State then the difference
• shall be made up in a bond to Orange County.
