BACKGROUND: The BOCC retained The Louis Berger Group and the University of North Carolina -Charlotte Urban Institute to complete Phase III of the TDR study. The Phase III studies are a continuation of the first two phases (background data collection and feasibility), which Berger and the Urban Institute completed in the fall of 2006. Staff has continued to work with The Louis Berger Group since its contract was amended in November 2006 to include Phase III work to define specific program and administrative design issues. The Environment and Resource Conservation Department and the County Attorney have been consulted on all aspects of these issues. The consultant has identified several issues that touch on broader policy questions that the BOCC can best give direction. The consultant is requesting that these work session discussions help to frame these policy issues within the TDR program. Part of this discussion will be the analysis of the TDR questionnaire, which was recently either faxed or emailed to BOCC members. Ms. Vicky Bott with the Urban Institute (contact number - 704 687 2314) can address any questions related to the questionnaire. Answers to general questions about the overall TDR program are available on the Orange County TDR website at www.co.orange.nc.us/Planning. Informal results and discussions of the survey will be preliminarily folded into a conceptual framework for TDR program and administrative design and ordinance text before any public outreach discussions are scheduled. FINANCIAL IMPACT: There is no financial impact associated with this item. (consultants to the County) UNC Charlotte Urban Institute (consultants to the County) Re: Transfer of Development Rights information for Feb. 12 Work Session The purpose of this memo is to let you know what we will be discussing with you at the work session on February 12. As you may recall, we have entered the third phase of the worl~ on the. Transfer of Development Rights study. The purpose of this phase is to select the program design and administrative options, write the ordinance and prepare the implementation plan. To this end, we are asking for your input and providing you with information as follows. First, we will ask you to determine the key goals of the TDR program that will guide the selection of administrative and program design options. We'll use the results of the survey sent out to you last week as the starting point for discussion and will seek to reach a consensus among the Commissioners on the topics covered in the survey: • Priorities for land preservation through TDR • Priorities for increased development through TDR • Measures of success for the TDR program Next, we will briefly review with you the administrative and program design options that will be the object of the next several months' work with County staff, County attorney, Planning Board 'and TDR Worl~ing Group as we assess the best fit for Orange County among the various options, consistent with the direction you will have given us in the TDR program goals. The last portion of our discussion will be to let you know what the rest of the planning process for the TDR program will look like. The process will include: ^ Meeting with Orange County staff and County attorney (March, May, June) ^ Meeting with the Planning Board (Preliminary) in March and May ^ Meeting with the TDR Working Group, consisting of representatives from several advisory boards (April, July) ^ Presentation at the May 24th BOCC work session to finalize the program options and evaluation measures ^ Request to set forth legal advertisement for the August QPH (June 26th) ^ A presentation and Public Hearing at the August 21St BOCC meeting to present the final proposed ordinance and program ^ Recommendation by Planning Board and review by BOCC (September, October) We will have a handout for you on Feb. 12 that contains the full schedule of meetings and activity on the project, including public involvement. 0 Questions for Orange County Board of County Commissioners on Transfer of Development Rights (TDR) (in preparation for February 12, 2007 BOCC work session) Each Commissioner is asked to fill out and return this survey to Laura Blackmon by February 1, 2007. Staff will tabulate the results, which will be used as the basis for discussion at the February 12 BOCC work session. These questions are preliminary -following the discussion at the February 12 session, BOCC members will be asked to revisit their answers to this survey in order to give final direction to Staff and consultants as they develop a TDR implementation plan for eventual BOCC adoption. 1.
