NCDOT Petition Information for Phoenix Drive, Edgar Street, Lizzie Lane, and Gracie Circle Road Additions in Phoenix Place Subdivision PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT), and the North Carolina Board of Transportation (NC BOT), concerning a petition to add Phoenix Drive, Edgar Street, Lizzie Lane, and Gracie Circle in Phoenix Place Subdivision to the State Maintained Secondary Road System. BACKGROUND: This request includes one (1) petition for four (4) road additions to the State Maintained Secondary Road System. The roads and their respective lengths and widths are as follows: Road Name Length in Miles Number of Lots Pavement/Right-of-way with Frontage Widths in Feet Phoenix Drive 0.16 22 22/50 Edgar Street 0.14 6 22/60 Lizzie Lane 0.15 12 22/50 Gracie Circle 0.04 8 22/50 Totals .49 48 N/A Phoenix Place Subdivision Phoenix Place Subdivision is located off Purefoy Drive in the southeast part of the County, east of Rogers Road and south of Eubanks Road, in Chapel Hill Township (Attachment 1). Phoenix Place is a Habitat for Humanity subdivision within the boundary of the Historic Rogers Road area. At the time of development in 2009, the subdivision was located within the Joint Planning Area (JPA), based on a 1984 planning agreement between Orange County and the towns of Carrboro and Chapel Hill. In accordance with the JPA, the subdivision was subject to the Town of Chapel Hill's Land Management Ordinance and Building Code process but with oversight by Orange 2 County. In 2014 the subdivision was added to Chapel Hill's Extraterritorial Zoning Jurisdiction (ETJ) and rezoned to the Town's Residential-1 zoning district. Subdivisions within the JPA and/or the ETJ are not required by law to be annexed by the town, and the Town has indicated that it is not pursuing annexation for this area at this time. Public sewer was extended from the southwest at the time of development to provide service to its residents. Thus the subdivision is not included in the current efforts to provide sewer to a number of properties in the Rogers Road area. Communications with Chapel Hill Planning staff indicate that there are no known subdivision violations. The final plat for the subdivision was recorded on November 20, 2009 (Attachment 2). Phoenix Drive, Edgar Street, Lizzie Lane, and Gracie Circle were designed to public road standards but have been private roads in the interim, intended to become a public roads when conditions met NCDOT maintenance responsibility and ownership criteria. A total of .49 mile of roads in the subdivision, providing access for 48 lots, is being petitioned for addition to the State Maintained Secondary Road System. Three of the roads have a right-of- way width of 50 feet, and a pavement width of 22 feet; one road (Edgar Street) has a right-of- way width of 60 feet, and a pavement width of 22 feet. These roads have been stubbed out for connectivity to undeveloped land. NCDOT has investigated this request and has submitted a petition to the Board of County Commissioners (BOCC) for its recommendation (Attachment 3). North Carolina General Statute §136-62 requires that road petitions for additions to the state system be made by the Board of County Commissioners (BOCC). Conclusion The above-referenced application meets the criteria endorsed by the BOCC for recommending acceptance of public roads into the State Maintained System for roads approved through the governing jurisdiction's subdivision process (NCDOT Subdivision Roads Minimum Construction Standards, January 2010). FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is associated with this item: GOAL: CREATE A SAFE COMMUNITY The reduction of risks from vehicle/traffic accidents, childhood and senior injuries, gang activity, substance abuse and domestic violence. The addition of private residential streets to the State Maintained Secondary Road System results in positive outcomes related to the aforementioned goal. RECOMMENDATION(S): The Manager recommends that the Board: 1. Forward the Petition for Addition to the State Maintained System to the NCDOT for Phoenix Drive, Edgar Street, Lizzie Lane, and Gracie Circle in Phoenix Place Subdivision; and 2. Recommend the Department of Transportation accept the roads for maintenance as State Secondary Roads.
