Program DEPARTMENT: Economic Development Planning & Inspections ERCD PUBLIC HEARING: (Y/N) No ATTACHMENT(S): INFORMATION CONTACT: Willie Best ACM and IED Assistant County Manager 245-2300 Geoffrey Gledhill, County Attorney 732-2196 Craig Benedict AICP -Planning Director 245-2592 David Stancil AICP -Director ERCD 245-2598 PURPOSE: To provide an update to the BOCC on the ASE program, including the development of ordinance amendments and an ASE Program user manual. BACKGROUND: At the May 2007 Joint BOCC/Planning Board Work Session, and the June 12, 2007 regular BOCC meeting, staff presented the Board with an update on the ASE program and requested the Board's endorsement of three (3) underlining concepts, specifically: 1) Begin drafting proposed amendments to the Land. Use Element to establish support and/or consistency for the program within the Comprehensive Plan as well as proposed amendments to the Zoning Ordinance to: a. Establish a list of permitted uses for the program including appropriate application and review processes, b. Establish implementation guidelines, and c. Develop the conditional district zoning review process, for review and comment by the BOCC and Planning Board, 2) Begin drafting clear performance standards, and 3) Create the ASE Manual for review and comment by BOCC, Planning Board, and other County advisory bodies: The BOCC authorized staff to: Notify Joint Planning Partners of the project and solicit their input on the proposal, 2 2. Begin drafting clear performance standards for review and comment, and 3. Begin work on the proposed ASE Manual Since the June 12, 2007 meeting staff has completed the following: 1. Members of Economic Development, Planning, and ERCD have meet twice with the County Attorney to review proposed performance standards for the ASE program and to develop the conditional district rezoning process, (referenced within the June 12, .2007 abstract), 2. Presented an overview of the ASE program concept to a joint meeting of the Agricultural Preservation Board and the Soil and Water District Commission Board (referenced within the June 12, 2007 abstract), 3 Distributed a draft "ASE User Manual to various staff members for internal review and comment. A copy was also presented to Dr. Fletcher Barber, of Cooperative Extension, for his review and comment. Staff has asked Cooperative Extension to supply information for use within the manual and is in the process of soliciting similar input from NRCS/the Orange County Soil and Water District. 4. In August, a memorandum was sent from the Manager's Office to our Joint Planning Partners informing them of the scope and intent of the ASE program and soliciting their input on the project. Staff has been directed to contact the appropriate planning staff from these two (2) jurisdictions as a follow up to this memorandum and request a meeting with various planning representatives to discuss the implications of the program. It needs to be remembered that there are six (6) typical steps involved with implementing planning changes. These steps are as follows: 1. Multi-departmental ASE workgroup. Staff Comment: At the June 12, 2007 meeting, the BOCC approved the development of further implementation strategies, as listed above, for review and comment at future meetings. 2. Land Use Plan Text (pending) 3. Land Use Plan Map (pending) 4. Zoning Text (pending) 5. Zoning Atlas/Map (pending) 6. Petitioner Application (pending) FINANCIAL IMPACT: There is no direct fiscal impact associated with this discussion. RECOMMENDATION(S): The Manager recommends that the Board authorize staff to continue with their efforts to complete work on the proposed amendments to the Land Use Element and Zoning Ordinance, as well as the ASE User Manual, for presentation to the BOCC at a future meeting.
