Proposed Modification to Beaver Valley Drive PURPOSE: To consider a modification to a recorded subdivision plat modifying the extension of Beaver Valley Drive. BACKGROUND: Beaver Valley is a phased single-family residential subdivision within the Cheeks Township. Please refer to Attachment 1 for a vicinity map of the project. The Planning Board approved a Concept Plan for Beaver Valley on June 17, 1996 for project totaling approximately 101.76 acres with 75 individual lots and 20.36 acres of open space centered in and on a stream running through the project. On June 30, 1997 the BOCC approved the first phase of the project allowing for the development of 40 lots and required local roadways constructed to applicable NC Department of Transportation public road standards east of the aforementioned stream. As approved, Beaver Valley Drive would eventually be extended, crossing the stream, allowing for the development of the additional 35 parcels. Attachment 3 contains the various subdivision plats recorded for the project over the last 19 years allowing for the development of Phase 1. In 2007 the County's Flood Insurance Rate Maps (FIRM) were amended. As a result of these amendments, the stream running through the project was identified as being encumbered by floodplain imposing additional development constraints and buffers. The developer, Mr. Bruce 2 Curtis, has determined extending Beaver Valley Drive to serve the undeveloped phase of the project, is not currently viable given the costs associated with extending the roadway in accordance with applicable NC DOT/flood regulatory guidelines and additional negative environmental impacts would be created in the area. Mr. Curtis is proposing to amend the project by terminating Beaver Valley Drive as a cul-de-sac near lots 37 through 39. As proposed the area formerly encumbered by the right-of-way would be combined with adjacent open space parcel(s). Please refer to Attachment 4 for additional detail. In reviewing the request staff has the following comment(s): 1. Staff agrees extension of Beaver Valley Drive will be complicated due to the presence of floodplain along the stream. 2. There is concern about the total elimination of all potential future connectivity to what was designated as `Beaver Valley Phase 2' with the wholesale elimination of the aforementioned right-of-way. 3. Staff recommends the applicant be allowed to amend the plat and create a cul-de-sac as proposed, but require the right-of-way to be preserved. This would preserve the ability for Beaver Valley Drive to be extended in the future if necessary to ensure connectivity. STAFF COMMENT: There is potential access to Phase 2 of the original project via Hoover Road, but connectivity is not guaranteed. FINANCIAL IMPACT: Existing staff will complete the necessary work required for this project. Adoption of the proposed revision is not expected to cause significant financial impacts (negative or positive) with respect to this project. SOCIAL JUSTICE IMPACT: The following Social Justice goal(s) are applicable to this item: • GOAL: CREATE A SAFE COMMUNITY The reduction of risks from vehicle/traffic accidents, childhood and senior injuries, gang activity, substance abuse and domestic violence. • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND ENVIRONMENTAL POLICIES The fair treatment and meaningful involvement of people of all races, cultures, incomes and educational levels with respect to the development and enforcement of environmental laws, regulations, policies, and decisions. Fair treatment means that no group of people should bear a disproportionate share of the negative environmental consequences resulting from industrial, governmental and commercial operations or policies. RECOMMENDATION(S): The Manager recommends that the Board approve the proposed revision, specifically allowing for the creation of the cul-de-sac while preserving a `paper' right- of-way for possible future connectivity, consistent with staffs recommendation. Curtis The Board of County Commissioners hereby approves Section One Beaver Valley subdivision preliminary plat, dated April 7, 1997 and containing 40 lots, subject to the fulfillment of requirements specified herein. Beaver Valley Drive, Fox Trail,Possum Walk Lane, Turkey Run West and Turkey Run East shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Beaver Valley Drive, Fox Trail, Possum Walk Lane, Turkey Run West and Turkey Run East. This acceptance by Orange County of the dedication to the general public of Beaver Valley Drive,Fox Trail, Possum Walk Lane, Turkey Run West and Turkey Run East shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant until such time as it is accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of Section One Beaver Valley Subdivision can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2. Disclosure that the septic system location may restrict the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. 3. Lots 11 and 12 shall be reconfigured to form one lot since there is only adequate area for septic disposal for one lot. 5 B. Roads and Access 1. Beaver Valley Drive, Fox Trail,Possum Walk Lane, Turkey Run West and Turkey Run East shall be constructed to standards of the North Carolina Department of Transportation, within a 50' right-of-way, and the construction shall be inspected and approved by NCDOT. OR A letter of credit or escrow agreement or other security shall be submitted to secure construction of Beaver Valley Drive, Fox Trail, Possum Walk Lane, Turkey Run West and Turkey Run East to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. Toad Hollow Lane shall be constructed to Class B private road standards within a 50 foot right-of-way. Toad Hollow Lane shall be inspected, and the construction certified in writing to the Orange County Planning Department by a North Carolina Professional Engineer, or a North Carolina Registered Land Surveyor. The location of the travelway within the platted private road right-of-way shall also be certified. OR A letter of credit, or escrow agreement, shall be submitted to secure construction and inspection of Toad Hollow Lane to Class B private road standards. An estimate of the construction and certification costs must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110%of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development retrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been certified by a North Carolina Professional Engineer or a North Carolina Registered Land Surveyor. 3. An erosion control plan for construction of the roads shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval. 6 4. A Private Road Maintenance Agreement for Toad Hollow Lane shall be submitted to the Planning and Inspections Department and approved by the County Attorney. 5. Approved street name signs shall be erected at the intersection of streets as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the sign is in place, or a copy of the receipt for purchase of the sign shall be submitted to the Planning Department. 6. Mace Road shall be dedicated and constructed to NCDOT specifications from the end of state maintenance to Beaver Valley Drive. 7. All lots shall access onto the new subdivision roads. • C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D. Drainage 1. Impervious surface data,pursuant to Article 6.23 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 2. Locate drainage easements as required following review and approval of the Erosion Control Plan. 3. Stream buffers shall be contained entirely within the open space areas as indicated on the preliminary plan. 4. Drainage culverts shall be sized and located as required by NCDOT and the Orange County Erosion Control Officer. E. Parkland 1. Cash in the amount of S 18,200.00 shall be paid to Orange County as payment in lieu of parkland dedication. 2. The entirety of the open space to be shown on the Final Plats shall be irrevocably dedicated to the homeowners association for recreation/open space use by residents of the subdivision. 7 F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The following easements shall be shown on the plat: a. drainage easements as required by D.2. above. 3. Minimum building setbacks shall be as indicated on the Preliminary Plan. The setback requirements shall be stated on the plat, and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. G. Certifications 1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that Beaver Valley Drive, Fox Trail, Possum Walk Lane, Turkey Run West and Turkey Run East has been constructed to State standards or that construction plans have been approved. 4.
