Minutes p.41 8) Preliminary Plan p.47 PURPOSE: To receive the Administration and Planning Board's recommendations and make a decision on the Preliminary Plan for Pleasant Green Woods Phase 3 Subdivision. BACKGROUND: Request - Preliminary Plan Applicant: Summit Consulting/Engineers, (Parker Sniffen) agent for LinkBros, LLC Owner: LinkBros, LLC Subdivision follows the Conservation-Cluster Option of Flexible Development. Total acreaae is 73.47 acres including proposed right-of-way. VA • Located in a Rural Designated Area in the Growth Management System, which for less than 21 lots follows the normal subdivision process. • Approximately 1 mile north of US 70 and the Durham/1-85 EbD designated area: Existing and Proposed Conditions Existing: • Zoning: Rural Residential (R1) (min. lot size = 40,000 sq. ft.) • The property is in the Lower Eno protected watershed (max. density = 1 acre / dwelling.) • Maximum impervious surface in the Lower Eno protected watershed is 36% of the gross acreage. Physical Features: • A portion of five designated streams on the tract will be protected with stream buffers. • The site is mostly wooded with a mixture of pines and hardwoods. • The topography is gently rolling with a steeper slope along the streams. Adjacent Land Use: • Eno River State Park is located to the east • A 46 acre undeveloped tract is located to the west. • Greenwood Subdivision with an average lot size of 7.42 acres and Pleasant Green Woods Phase 2 with an average lot size of 1.48 acres are located to the north. • Residential tracts ranging from 1 to 19.06 acres are located to the south. • Surrounding lots are generally equal to or less dense than Pleasant Green Woods 3 except Pleasant Green Woods 2 which has an average density of 2.11 acres. Proposed: Roads: • Access is from Pleasant Green Road .(SR 1658), an existing paved collector public road. • The proposed cul-de, sac street (Pleasant Green Trail) provides access to 18 lots; two lots are accessed from the existing Jornali Drivb. Additional right-of-way was purchased at the .entrance to ensure construction of the road did not disturb adjoining properties. • All roads are to be constructed to NCDOT standards. • NCDOT comments indicate Pleasant Green Trail will need a minimum 50 foot right-of-way with 20 foot pavement. Site distance at the main entrance has been field verified and approved. A driveway permit will be required for the entrance. Road improvements on Pleasant Green Road are not warranted according to NCDOT guidelines. If more major subdivision development occurs along Pleasant Green Trail a right turn deceleration or full right turn lane on Pleasant Green Road shall be reviewed by Staff and NCDOT. • Emergency Management and the Eno Fire Department have reviewed and found the plans acceptable. (see agency review) • Staff considered requiring the road to be connected to Phase 2. However, after walking the property, staff is not recommending connecting the roads due to the slope and disturbance of the stream involved and because the developer, at Eno River Associate's request, is dedicating this area to the Eno River State Park. There are also a number of mature hardwood trees in the open space area that would be destroyed if the roads were connected. As indicated by ERCD the proposed plan "appears consistent with the County's desire to minimize adverse environmental impacts with respect to the protection of floodplains, wetlands, natural areas and wildlife habitat." 3 Open Space/Buffers: 0 36.75 acres (50%) of open space proposed. All of the open space is wooded except for the area along the power transmission lines through the eastern side of the property. The Eno River Association is requesting a portion of this open space area be deeded to the Eno River State Park system, which is amenable to the applicant. All lots have direct access to open space. 0 Existing Homeowners Association will own and maintain the open space not deeded to the State as well as, buffers, signage. Water-Sewer: 0 Individual wells. Individual septic systems. Public water and sewer is not available. Recreation: Chapel Hill District Park The Orange County Environment and Resource Conservation Department and the Recreation and Parks Advisory Council are recommending a portion of the open space offered by the applicant be deeded to the State for the Eno River State Park. This area of approximately 17.34 acres is delineated on the Preliminary Plan. The developer is also proposing a walking trail within the remaining Homeowners Association open space area to be owned by the Homeowners Association. Payment in lieu would require approximately 1. acre. The transferring of 17.34 acres to the State Park would satisfy the, payment-in-lieu option. In addition to the above t ' he Recreation and Parks Advisory Council is recommending the developer provide 10,000 square feet of playground area with apparatus and swings as well as a picnic shelter with a minimum capacity of 100 to be located in the open space area owned by the Homeowners Association. Planning Staff did not recommend this since with the walking trail and dedication of 17.34 acres to the State Park the developer is going well beyond the 1 acre required. Agency Review: • See attached documentation from Fire Marshall, Recreation and NCDOT. ERCD has commented on the homestead site and the dedication of Open Space to the State. ( see attached comments) Development Process, Schedule, and Action Planning Board: • First Action: Neighborhood Information Meeting: Held June 21, 2006 • Second Action: Concept Plan approved by the Planning Board July 12, 2006 with the following conditions: 1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT standards. 2. Homeowners Association documents that provide for maintenance of the Open Space shall be submitted with the preliminary plan. Provisions shall be included in the Homeowners Association documents that would prohibit tree cutting in the Open Space except for maintenance purposes. 3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of existing R/W, whichever is greater, along E! Pleasant Green Road on the Preliminary Plan. 4. Show five-foot utility easements along both sides of all rights-of-way. 5. The Eno River Association has recommended that a portion of the open space be dedicated. (deeded) to the Eno River State Park system. The dedication is part of the open space area on the east side of the property and the amount will be determined in an agreement between the owners and the Eno River Association. This will meet the requirement for recreation and reduce or eliminate the amount of the recreation payment-in-lieu. 6. Show location of subdivision sign on Preliminary Plan. 7. Any lighting shall meet Orange County Lighting Standards. 8. A minimum 50 foot wide Pedestrian Open Space Area (POSA) shall be provided between lot 29 in phase 2 and lot 19 in phase 3, and lots 14 and 15 in phase 3. 9. An integrated, interconnected walking trail system shall connect this phase with phase 2. If more major subdivision development occurs along Pleasant Green Trail a right turn deceleration or full right turn lane on Pleasant Green Road shall be reviewed by Staff and NCDOT. (See page 35a for example of right turn taper) The Planning Staff recommended approval, in accordance with the attached Resolution of Approval. • Third Action: Planning Board reviewed the Preliminary Plan on August 1, 2007 and unanimously recommended approval. Fourth Action: 1. The Board shall consider the application within a reasonable amount of time. 2. If the Preliminary Plan is approved by the County Commissioners the applicant shall have one (1) year to prepare and file a Final Plat or to request a one-year extension from the Planning Director. RECOMMENDATION: The Administration Recommends Approval, in accordance with the attached Resolution of Approval. Attachment 1 5 RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date: September 19, 2007 Name of Subdivision: Pleasant Green Woods Phase 3 Owner/Applicant: LinkBros. LLC/Parker Sniffen The Board of County Commissioners hereby approves Pleasant Green Woods Phase 3 subdivision preliminary plat, dated April 20, 2007 and containing 20 lots, subject to the fulfillment of requirements specified herein. Pleasant Green Trail shall be irrevocably dedicated to the general public and constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Pleasant Green Trail. This acceptance by Orange County of the dedication to the general public of Pleasant Green Trail shall be without maintenance responsibility. This road shall be maintained by the owner/applicant until such time as it is accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of The Pleasant Green Woods Phase 3 can be recorded: A. Sewage Disposal Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2. The septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. B. Roads and Access 1. Pleasant Green Trail shall be constructed to standards of the North Carolina Department of Transportation, within a minimum 50-foot right-of-way with 5-foot utility easements on each side, and the construction shall be inspected and approved by NCDOT. OR A letter of credit or escrow agreement shall be submitted to secure construction of Pleasant Green Trail to the standards of the North Attachment 1 6 Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. All lots shall receive access from the internal subdivision roads. No driveway shall be permitted within 50' of a street intersection. 3. An erosion control plan for construction of Pleasant Green Trail shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval prior to any land disturbing activity on the site. 4. Approved double-bladed street name signs shall be erected at the intersection of Pleasant Green Road and Pleasant Green Trail prior to Planning Department signatures on the final plat or prior to issuance of any building permit if road construction is secured by letter of credit. 5. Prior to any construction or alteration of any existing access within the right-of-way of Pleasant Green Road, the owner/applicant shall secure a driveway permit from the NCDOT District Office. The owner/applicant shall submit a copy of the NCDOT-approved permit and NCDOT approval letter to the Planning Department prior to or at the same time as the request for a grading permit is made, or before Planning Department signatures are affixed on the Final Plat, whichever is first. 6. Sight triangles (10'x 70') shall be shown on the Final Plat at the intersection with Pleasant Green Road. C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan, and shall be inspected and approved by the Planning and Inspections Department prior to signatures on final plat. No part of the landscaping shall encroach into the 10' x 70' sight triangles at intersections. OR Guaranteed financially through a letter of credit or escrow agreement submitted to secure required landscape installation and preservation. An estimate of the cost for required preservation, plantings and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. Attachment 1 7 Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. No clear Gutting on individual lots per section IV-13-8-c of the Orange County Subdivision Regulations is permitted. D. Drainage Drainage Easements shall be located on the final plat as required following review and approval of the Erosion Control Plan by County staff. 2. Drainage culverts shall be sized and located appropriately, as required by NCDOT and Erosion Control, by a licensed North Carolina Professional Engineer. E. Parkland The parkland dedication of 17.34 acres (open space C and part of B) will meet Subdivision Regulation requirement of provisions of public recreation for the subdivision and shall be labeled on the final plat. 2. The remaining portion of open space (19.41 acres) shall be owned and maintained by the Homeowner's Association. This open space shall be shown and labeled accordingly on the final plat. F. Construction Waste 1 Per Orange County Ordinance, clean wood waste, scrap metal and corrugated cardboard, all present construction waste, must be recycled. 2. Per Orange County Ordinance, all haulers of construction waste must be properly licensed. 3. Prior to any demolition or construction activity on the site the applicant will hold a pre-demolition/pre-construction conference with the County's Solid Waste staff. This may be the same meeting held with other development officials. G. Miscellaneous The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The open space shall be conveyed into the Homeowner's Association before Planning Department signatures are affixed to the final plat. Tree cutting in the roadside Open Space is prohibited except for necessary maintenance purposes that has been approved by County staff prior to any such tree cutting taking place. Attachment 1 8 3. If street lighting is proposed, then a lighting plan shall be submitted to the planning office for review and approval prior to purchase of lighting fixtures from the utility provider. Any lighting shall meet the Outdoor Lighting Standards as set forth in section 6.31 of the Orange County Zoning Ordinance. 4. A sign permit shall be obtained from Orange County for the subdivision sign located at or near the entrance of the subdivision prior to beginning construction. 5. Methods of disposal of trees, limbs, stumps and construction debris associated with construction activity shall be by some method other than open burning as required in the Orange County Zoning Ordinance. D. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that the platted portion of Pleasant Green Trail has been entirely constructed to State standards or that construction plans have been approved prior to Planning Department signatures on final plat. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department shall appear on the face of the final plat. Attachment 1 9 NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners that the Preliminary Plan for Pleasant Green Woods Phase 3 Subdivision is approved in accordance with the above mentioned conditions and attached Preliminary Plat dated April 20, 2007 and last revised July 13, 2007. M ORANGE COUNTY EN' nRONMENT AND RESOURCE CONSERvATION DEPARTMENT MEMORANDUM To: Eddie Kirk, Orange County Planner From: Rich Shaw, Land Conservation Manager .Tina Moon, Cultural Resources Specialist Date: June 15, 2007 Re: Pleasant Green Woods (Phase 3) Subdivision Proposal This is an addendum to Rich Shaw's memo of June 30, 2006 (Attachment 1) pertaining to the proposed Pleasant Green Woods Subdivision (Phase 3). Those comments pointed out that the subject property is located adjacent to Eno River State Park, and recommended that the owner /developer contact the Eno River Association or the State of North Carolina to discuss the possibility of conveying a southeastern portion of the proposed open space to the Eno River State Park. ERCD has been asked by the Planning staff to comment further on a) whether the natural heritage sites downstream of the property would be impacted by the subdivision, and b) whether the existing buildings have any historical value. A. Impacts on Natural Heritage Sites The section of Eno River State Park that is located immediately east of the subject property is within a large Natural Heritage site known as Middle Eno River Bluffs and Slopes (Site E13 in the Inventory of Natural Areas and Wildlife Habitat for Orange County, NC). This natural area is considered to be of State significance due to the presence of several rare plant and animal species. A map and a description of the natural area are provided as Attachment 2. If the southeastern portion of the proposed open space (Open Space "'C"'. 11.04 acres ) were conveyed to the Park and managed consistent with other property then would likely reduce the potential adverse impacts from the proposed development and the existing utility rights - of -way on the Natural Heritage site. The sections of Piper Creek and two feeder located Within the subdivision appear to be adequately buffered (80 -200 feet) to protect them during the future construction and use of the subdivision. If Open Space "C" were conveyed to the State and managed by the State Park then those streams would receive an even higher level of protection, which would lessen the possibility of downstream habitat degradation within the Natural Heritage site. Even better, I would recommend that the 150' Duke Power easement that is part of Open Space B (and adjacent to Open Space "C also be conveyed to the State. That easement includes streams that could benefit from the more rigorous oversight of herbicide use that the State Park employs with the utility companies. Historic Value of Existing Structures A small building cluster survives in the eastern portion of the site, along a high elevation point, near the stream, and in the vicinity of future lots 12 -16. Dating from the late nineteenth to early twentieth century period, the homestead consists of five buildings: a house; large multi -pen drive - through barn; large, frame, barn; low open shed (pole barn); privy; and one other small deteriorated structure (Attachment 3). Most of these buildings are in relatively poor repair. The house was constructed in stages. The front block is a one and one -half story log structure; the rear wing, which contains the kitchen and large screened porch, is a low one - story frame unit. This rear portion was probably added around the 1940s and is in very poor repair. The log portion of the house retains a large fireplace, enclosed corner stair and exposed ceiling joists in the living room, which provides a certain "rustic charm." The wallboard and updated flooring, however, indicate that it was updated over the years, probably to match the later kitchen wing. Other details, such as the board doors, three - over -one window sash, and the simple door and window surround, point to the early twentieth century construction date. The most interesting structure in the complex, from an architectural standpoint, is the large multi -pen log barn. This facility probably served a number of different uses. The drive - through design provided a covered area to off -load a wagon while the large (un- chinked) log pens, provided a ventilated space for animal lodging or feed storage (corn crib) and as indicated by the stack of feed sacks. The complex provides a glimpse of early twentieth century rural life in Orange County and should be documented with photos prior to destruction. ERCD staff has taken initial photographs as part of this review. A more formal documentation process should take place prior to demolition through the County's Quick Response Team (QRT). The team will be notified, automatically, as part of the demolition permit process. The proposal would create 20 lots on 73.47 acres located east of Pleasant Green Road and adjacent to Eno River State Park in Eno Township. ERCD comments on subdivisions are generally intended to a) address any concerns with respect to potential impacts on important natural or cultural resources, and b) identify any areas that might be desirable for possible dedication to the County for public recreation/ open space pursuant to Section N -13-7 -b of the Orange County Subdivision Ordinance. The Concept Plan (May 16, 2006) shows over 32 acres of open space, or 48% of the 73- acre site (far more than the required 33 %), to be dedicated to a homeowners' association. This forested open space would provide a small wildlife refuge and provide residents of the subdivision with woodlands for walking and nature study. The open space includes sections of Piper's Creek and two feeder streams, which flow through the property and into Eno River State Park located immediately east of the site. The open space also includes three power line transmission easements— cleared linear corridors that traverse the otherwise wooded open space. The power lines continue eastward into the State Park. The attached aerial photo of the site shows that residents of existing homes on Willet Road (immediately south of subject property) use trails along those power line easements to access the State Park property. Overall, the proposed site plan appears consistent with the County's desire to minimize adverse environmental impacts with respect to the protection of floodplains, wetlands, natural areas and wildlife habitat. The protection of open space adjacent to the State Park (as is proposed by the Concept Plan) would help to buffer the park from the proposed future home sites. [That open space also happens to be Eno River State Park master plan.] It may be prudent for the owner /developer of the subdivision to convey an eastern portion of the proposed open space to the State Park, enabling that section of the property with its existing trails and power line corridors to be managed in a manner consistent with the adjacent parkland. For instance, the State Park may have an agreement with the utilities that restricts the use of herbicides within the power line easements to protect the streams that flow through the easements. Catawba rhododendron (Rhododendron catawbiense), maidenhair fern (Adiantum pedatum), galax (Galax aphylla), sumo. mite (Allothrombium sp.), and pileated woodpecker (Dryocopus pileatus) are all regionally rare species occurring in this section of the state park. NATURAL CONEVIUNITIES: Mesic Mixed Hardwood Forest, Piedmont Acidic Cliff, Piedmont Heath Bluff, Pine —Oak / Heath, Piedmont .Alluvial Forest GENERAL DESCRIPTION: Originally known as "ERSP Cabelands and Rhododendron Bluff' (1988 inventory), the site was later expanded and renamed by the NC Natural Heritage Program. Several different habitats are found along the nearly two -mile stretch of the site in Orange County: At the driest extreme is a community of Virginia pine (Pinus virginiana), mountain laurel (Kalmia latifolia), sparkleberry (Vaccinium arboreum), galax (Galax aphylla), and trailing arbutus (Epigaea repens) growing on a steep, 80 -foot bluff near the reservoir near the western boundary of this natural area. On gentler, less- exposed slopes occur mixed mesic hardwoods, such as beech (Fagus grandifolia), red oak (Quercus rubra), bitternut hickory (Carya cordiformis), and tulip poplar (Lirioden, drop tulipifera). At the bottom'of these slopes, the herbaceous layer is very rich, as evidenced by the presence of maidenhair fern (Adiantum pedatum), wild ginger (Asarum canadense), and bloodroot (Sanguinaria canadensis). Ginseng (Panax quinquefolius) was reported from this area as late as 1972, but now appears to be extirpated from the Cabelands. Another mesic community, a catawba rhododendron bluff on a steep northwest - facing slope, is located about one -half mile downstream from the area traditionally recognized as the Cabelands. Beech (Fagus grandifolia) and white oak (Quercus alba) form the canopy of this community. In addition to the three relatively undisturbed communities just described, there exists a mosaic of successional forest stands as a result of historic cultivation of the Cabelands. Black et al. (1972) mapped the forest stands of this area and listed over 110 vascular plant species that are present. Along the mesic north - facing slopes are found the sumo mite (Allothrombium sp.), slimy salamander (Plethodon glutinosus), ovenbird (Seiurus aurocapillus), hooded warbler (Wilsonia citrina), and scarlet tanager (Piranga olivacea). The bottomlands, although narrow and somewhat disturbed, contain a large oxbow pool, which is the breeding site for spotted salamander (Ambystoma maculatum), marbled salamander (A. opacum), and several frog species. Birds inhabiting the bottomland and riparian strip include the barred owl (Strix varia), pileated woodpecker (Dryocopus pileatus), acadian flycatcher (Empidonax virescens), 113 Inventory of Significant Natural Areas and Wildlife Habitats Orange County, NC Eno River Watershed Louisiana waterthrush (Seiurus motacilla), northern parula (Parula americana), and yellow - throated warbler (Dendroica dominica). MANAGEMENT AND PROTECTION: Most of the site lies within Eno River State Park. Periwinkle (Vinca minor) and English ivy (Hedera helix), both escaped remnants from previous settlement, threaten to overwhelm the richest herbaceous flora on this site (as previously mentioned, ginseng has already disappeared, from the Cabelands). Hand removal of these plant pests is required for the long -term integrity of the site. The preliminary plat shows "Open Space C" and portions of "Open Space B" in the area of the transmission lines with their easterly boundaries adjacent to properties owned by the State of North Carolina, specifically for Eno River State Park. RPAC feels that it would be beneficial to the subdivision as well as the community at large to place these properties under the protection of the State as part of the Eno River State Park. RPAC recommends that the portion of land including and to the southeast of the power line easement be dedicated to the state of North Carolina for recreation and open space. In addition, RPAC recommends the developer provide a walking trail through "Open Space 13" as drawn but continuing through to current State property east of "Open Space C." Further, given the 20 lots proposed, RPAC strongly recommends the developer provide recreation amenities such as 10,000 square feet of playground area with apparatus and swings as well as a picnic shelter with a minimum capacity of 100. Existing and Proposed Conditions Existing: • Zoning: Rural Residential (R1) (min. lot size = 40,000 sq. ft.) • The property is in the Lower Eno protected watershed (max. density =1 acre / dwelling.) • Maximum impervious surface in the Lower Eno protected watershed is 36% of the gross acreage. Physical Features: • A portion of five designated streams on the tract will be protected with stream buffers. • The site is mostly wooded with a mixture of pines and hardwoods. • The topography is gently rolling with a steeper slope along the streams. Adjacent Land Use: • Eno River State Park is located to the east • A 46 acre undeveloped tract is located to the west. • Greenwood Subdivision with an average lot size of 7.42 acres and Pleasant Green Woods Phase 2 with an average lot size of 1.48 acres are located to the north. • Residential tracts.ranging from 1 to 19.06 acres are located to the south. • Surrounding lots are generally equal to or less dense than Pleasant Green Woods 3 except Pleasant Green Woods 2 which has an average density of 2.11 acres. Proposed: Roads: • Access is from Pleasant Green Road (SR 1658), an existing paved collector public road. • The proposed cul -de -sac street (Pleasant Green Trail) provides access to 18 lots; two lots are accessed from the existing Jomali Drive. Additional right -of -way was purchased at the entrance to ensure construction of the road did not disturb adjoining properties. • All roads are to be constructed to NCDOT standards. • NCDOT comments indicate Pleasant Green Trail will need a minimum 50 foot right -of -way with 20 foot pavement. Site distance at the main entrance has been field verified and approved. A driveway permit will be required for the entrance. Road improvements on Pleasant Green Road are not warranted according to NCDOT guidelines. • Emergency Management and the Eno Fire Department have reviewed and found the plans acceptable. (see agency review) • Staff considered requiring the road to be connected to Phase 2. However, after walking the property, staff is not recommending connecting the roads due to the slope and disturbance of the stream involved and because the developer, at Eno River Associate's request, is dedicating this area to the Eno River State Park. There are also a number of mature hardwood trees in the open space area that would be destroyed if the roads were connected. As indicated by ERCD the proposed plan "appears consistent with the County's desire to minimize adverse environmental impacts with respect to the protection of floodplains, wetlands, natural areas and wildlife habitat." Open Space /Buffers: • 36.75 acres (50 %) of open space proposed. All of the open space is wooded except for the area along the power transmission lines through the eastern side of the property. The Eno River Association is requesting a 2 A 07 Approved d 9/5/ -pp - 03 portion of this open space area be deeded to the Eno River State Park system, which is amenable to the applicant. All lots have direct access to open space. • Existing Homeowners Association will own and maintain the open space not deeded to the State as well as, buffers, signage. Waiter-Sewer: • Individual wells. • Individual septic systems. • Public water and sewer is not available. Recreation: • Chapel Hill District Park The Orange County Environment and Resource Conservation Department and the Recreation and Parks Advisory Council are recommending a portion of the open space be deeded to the State for the Eno River State Park. This area of approximately 17.34 acres is delineated on the Preliminary Plan. The developer is also proposing a walking trail within the open space area to be owned by the Homeowners Association. Payment in lieu would require approximately 15,246 square feet. The transferring of 17.34 acres to the State Park would satisfy the payment-in-lieu option. • In addition to the above the Recreation and Parks Advisory Council is recommending the developer provide 10,000 square feet of playground area with apparatus and swings as well as a picnic shelter with a minimum capacity of 100 to be located in the open space area owned by the Homeowners Association. Agency Review: • See attached documentation from Fire Marshall, Recreation and NCDOT. ERCID has commented on the homestead site and the dedication of Open Space to the State. (see attached comments) . Development Process, Schedule, and Action Planning Board: • First Action: Neighborhood Information Meeting: Held June 21, 2006 Second Action: Concept Plan approved by the Planning Board July 12, 2006 with the following conditions: 1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT standards. 2. Homeowners Association documents thatprovide for maintenance of the Open Space shall be submitted with the preliminary plan. Provisions shall be included in the Homeowners Association documents that would prohibit tree cuffing in the Open Space except for maintenance purposes. 3. Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of existing R/W, whichever is greater, along Pleasant Green Road on the Preliminary Plan. 4. Show five-foot utility easements along both sides of all rights-of-way. 5. The Eno River Association has recommended that a portion of the open space be dedicated (deeded) * to the Eno River State Park system. The dedication is part of the open space area on the east side of the property and the amount will be determined in an agreement between the owners and the Eno River Association. This will meet the requirement for recreation and reduce or eliminate the amount of the recreation payment-in-lieu. 6. Show location of subdivision sign on Preliminary Plan. 7. Any lighting shall meet Orange County Lighting Standards. Approved 9/5/07 P 8. A minimum 50 foot wide Pedestrian Open Space Area (POSA) shall be provided between lot 29 in phase 2 and lot 19 in phase 3, and lots 14 and 15 in phase 3. 9. An integrated, interconnected walking trail system shall connect this phase with phase 2. If more major subdivision development occurs along Pleasant Green Trail a right turn deceleration or full right turn lane on Pleasant, Green Road shall be reviewed by Staff and NCDOT. • Third Action: Planning Board to consider Preliminary Plan Options: 1. Action within two regularly scheduled Planning Board meetings, or extension thereof; 2. If the Planning Board fails to act within the specified time period, application forwarded to BOCC with Planning Board minutes and Planning Staff recommendations and conditions. Preliminary Plan: Addresses the conditions of approval of the Concept Plan. Additional conditions have been placed in the attached Recommendation of Approval. Fourth Action: Board of County Commissioners to hear Planning Board recommendation. RECOMMENDATION(S): Staff Recommendation The Planning Staff recommends Approval of the Preliminary Plan for Pleasant Green Woods Phase 3 with the attached Recommendation of Approval. Eddie Kirk: The property is surrounded by subdivision and to the East is the Eno River State Park. The handout you received is a letter from the North Carolina Department of Environmental and Natural Resources regarding land that has been proposed to be given to the Eno State Park. The letter states they will accept that property. The concept plan was approved on July 12, 2006 with 10 conditions and these conditions have been complied with. We have a recommendation from the Recreation and Parks Advisory Council recommending the developer provide 10,000 square feet of playground area with apparatus and swings as well as a picnic shelter with a minimum capacity of 100 to be located in the open space area owned by the Homeowners Association. We did not include this in our recommendations. We feel that the developer is going beyond the maximum required for recreation by providing the 17.34 acres to the Eno River State Park. He is also providing a walking trail thru the subdivision and this is going beyond what's required in our ordinance for recreation purposes. We are recommending approval with the attached recommendation in your packet. Bernadette Pelissier: The recent memo from Rick Shaw dated June 15, 2007 recommended to include open space B to convey that to the.state. Previously it was said that there might have more restrictions. I have two questions: Is it true that deeded to the state means that there is more rigorous herbicide use? And if the intention to deed the open space to the state will the herbicide be a problem for the streams and rivers? Eddie Kirk: The State will have more restrictions on herbicide use. Bernadette Pelissier: For future reference, is it true that you cannot spray herbicide? Eddie Kirk: That is a question I cannot answer. Renee Price: I worked with an organization that had requested that Duke and others not use herbicide. Craufurd Goodwin: I gather the land being dedicated to the Eno State Park is the 49.12 acres? Eddie Kirk: The Park is to the east of the subdivision. The 17.34 acres would be deeded to the park. Il Approved 9/5/07 Oq Michelle Kempinski: I am looking at lots 13-16, the property line and the setback line approaches the 80 foot buffer, the question is there is not much encroachment but in order to fully protect that stream area, why not shift the property line over a little bit? Parker Sniffen: Which lots? Michelle Kempinski: They are lots 13-16. Parker Sniffen: Lots are designed so that the 80 foot buffer is coincidental with the building setback to provide as much area as possible. The restrictions for what you can do rely on rules that are elsewhere and doesn't encroach on that buffer. Michelle Kempinski: Even though the property line crosses over into the 80 foot buffer? Eddie Kirk: It comes approximately 20 feet into the setback. The septic fields won't be in that stream buffer. Parker Sniffen: Rules governing the 80 foot stream buffer are under County Zoning Ordinance. Michelle Kempinski: Is there anything that can be put there? Eddie Kirk: It should be kept natural. Jeffrey Schmitt: On page 59, under the financial impact analysis, are those average sales prices anticipated by the developer? Eddie Kirk: From my understanding, they are. Parker Sniffen: They were provided by me on behalf of the developer. John Link: We are selling the lots to individuals. We have minimum requirements for square footage which is approximately 2,600 square foot. Sandra Quinn: I think that is a low price. Renee Price: For the future, when you are calculating open space, if a good portion of that becomes property of the state, that is not a part of the project area? Eddie Kirk: Is it part of the project now: Renee Price: But the density changes and the final result will be a different density. Eddie Kirk: You are correct. Renee Price: It is misleading. I have one other request dealing with the homestead; Rich was suggesting that the QRT would be able to take pictures before it is demolition. Would there be a problem with the Historic Preservation Commission going there prior to demolition. John Link: No. We would like to see deconstruction. Sandra Quinn: Will the proposed open trail under Open Space B be under the Homeowners Association? 5 Approved 9/5/07 46 Eddie Kirk: Yes. Michelle Kempinski: On the handout there was a recommendation in paragraph 3 at the bottom about a trail. Can you point out that section? Eddie Kirk: Under the recommendation from the Recreation and Parks Advisory Council, they had suggested that a trail be provided to'the state park property.
