PURPOSE: To consider approving Clancy &Theys Construction Company of Raleigh, NC as
the Construction Manager at Risk for the Animal Services Facility and authorizing a contract in
the amount of $30,000 for pre-construction services associated with the project.
BACKGROUND: The Animal Services Facility has been under design through the leadership
and guidance of aBoard-appointed planning committee for several months. The re-location of
the current facility is prompted by the University of North Carolina's desire to reclaim the
property upon which the current Shelter is situated for its Carolina North development.
As presented during the review of the facility plans in June 2007, staff solicited and interviewed
for Construction Manager at Risk Services over the summer for both the Animal Services Facilty
project and the 911 Center upfit. Three of the five responding firms were interviewed for the
work, with Clancy &Theys deemed to be the best fit for the Animal Services Facility project.
Among its long list of projects, Clancy &Theys completed a 16,000 square foot facility for the
SPCA of Wake County in March 2004. The facility is comparable both in size (Orange County's
facility is proposed at approximately 23,500 square feet) and program to that of Orange County.
Further, the firm has the resources and capacity necessary to carry out this project and is well-
versed in the CMAR project delivery method.
If appointed by the Board, Clancy &Theys would join the development and construction team
immediately and would provide pre-construction services in concert with the team during the
design development process. These services would be concentrated on interactive pricing and
budgeting exercises through the design development phase as well as the construction
document phase up to the issuance of a Guaranteed Maximum Price ("GMP"). A GMP
component of this contract will be presented to the Board for consideration upon finalization of
this work.
As the Board is aware, the deadline for vacating the current Shelter is December 2008, which is
the date established by the University. While final regulatory approvals are pending, the County
and most notably, the Town of Chapel Hill, have expedited the approval processes in an
extraordinary manner to help the County meet this aggressive construction timeline.
Construction is expected to begin in November 2007.
FINANCIAL IMPACT: In recognition of the substantial amount of work that is carried out by the
contractor prior to a final GMP being set, a contract committing the County to pre-construction
costs incurred by the contractor is forwarded for approval by the Board at the onset. This is an
amount that would be rolled into the GMP when negotiations are successfully finalized, but is
also an amount that would be paid to the Contractor in the event an acceptable GMP could not
be negotiated. The pre-construction services contract amount for this project is $30,000.
As a reminder, the project budget for the Facility currently stands at $5.8 million including land,
design and construction. Amore precise funding plan will be presented when the GMP contract
is presented for Board consideration within the next few months.
RECOMMENDATION(S): The Manager recommends that the Board authorize a contract to be
prepared by the County Attorney in an amount not to exceed $30,000 for pre-construction
services with Clancy & Theys of Raleigh, North Carolina to serve as the Construction Manager
at Risk for the Animal Services Facility; and authorize the Chair to sign on behalf of the Board.
