PURPOSE: To make a recommendation to the North Carolina Department of Transportation
(NCDOT) concerning a petition to add roads within the Charles' Woods Subdivision to the State
Maintained Secondary Road System.
BACKGROUND: Charles Woods Subdivision was approved by the Board of County
Commissioners through the major subdivision process. The roads within Charles' Woods
were originally platted and approved as public roads. Property owners within this subdivision,
specifically those living on Alex Drive (15 homes), Calvert Court (7 homes), Parker's Path (4 homes),
Settlers Trace (5 homes), East Thomasview Drive (4 homes), West Thomasview Drive (4 homes),
and Crabtree Creek Road (7 homes), have petitioned the North Carolina Department of
Transportation (NCDOT) to accept maintenance responsibilities for those roads. The roads are
located in Charles' Woods Subdivision off the south side of St. Mary's Road, Eno Township. The
Planning Board approved the concept plan for Charles' Woods, to be developed in four (4) phases, in
May 1995. The Board of County Commissioners (BOCC) approved Phase 1 of Charles' Woods in
September 1995, Phase 2 in March 1996 and Phases 3 and 4 in June 1998. All phases were
approved with streets dedicated to the general public and constructed to standards of the North
Carolina Department of Transportation.
NCDOT has investigated these requests (please refer to attached Secondary Road Addition
Reports), and has submitted the petitions to the Board of Commissioners for its review and
recommendation. In accordance with North Carolina General Statute §136-62*, the Board is required

to make a recommendation regarding the petitions to the North Carolina Board of Transportation
(NCBOT) before the NCBOT can consider the petitions.
FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item.
NCDOT will incur additional maintenance responsibilities and costs.
RECOMMENDATION(S): The Manager recommends that the Board forward the Charles' Woods
Subdivision Petition for Addition to the State Maintained system to NCDOT with a positive
recommendation.

INSTRUCTIONS FOR COMPLETING PETITION:
1. Complete Information Section
2. Identify Contact Person (This person serves as spokesperson for petitioner(s)).
3. Attach four (4) copies of recorded subdivision plat or property deeds, which refer to candidate road.
4. Adjoining property owners and/or the developer may submit a petition. Subdivision roads with prior
NCDOT review and. approval only require the developer's signature.
5. If submitted by the developer, encroachment agreements from all utilities located within the right of
way shall be submitted with the petition for Raad addition. However, construction plans may not be
required at this time.
6. Submit to District Engineer's Office. See http'//www doh dot.state.nc.us/operations/divisionl3/default.html for
county and district locations.

REQUIREMENTS FOR ADDITION
If this road meets the requirements necessary for addition, we agree to grant the Department
of Transportation aright-of-way of the necessary width to construct the road to the minimum
construction standards of the NCDOT. The right-of-way will extend the entire length of the
road that is requested to be added to the state maintained system and will include the
necessary areas outside of the right-or-way for cut and fill slopes and drainage. Also, we
agree to dedicate additional right-of-way at intersections for sight distance and design
purposes and execute said right-of-way agreement forms that will be submitted to us by
representatives of the NCDOT. The right-of-way shall be cleared at no expense to the
NCDOT, which includes the removal of utilities, fences, other obstructions, etc.
General Statute 136-102.6 (see page 29 for Statute) states that any subdivision recorded on or
after October 1, 1975, must be built in accordance with NCDOT standards in order to be
eligible for addition to the State Road System.
