Proposed Amendments Craig Benedict, Director, (919) 245-2575 Perdita Holtz, (919) 245-2578 Ashley Moncado, (919) 245-2589 PURPOSE: To consider amendments to the 2015 Schools Adequate Public Facilities Ordinance Technical Advisory Committee (SAPFOTAC) Report. BACKGROUND: Following the certification of the 2014 Schools Adequate Public Facilities Ordinance Technical Advisory Committee (SAPFOTAC) Report, Orange County entered into an agreement with TischlerBise to update student generation rates. The Student Generation Rates for Orange County Schools and Chapel Hill-Canrboro School District Report, completed on October 28, 2014, provided updated student generation rates based on an inventory of recently built units from January 1, 2004 to December 31, 2013. In March 2015 the formal review process for the 2015 Schools Adequate Public Facilities Ordinance Technical Advisory Committee (SAPFOTAC) Annual Report commenced. The report and executive summary were approved and certified at the May 19, 2015 BOCC meeting. This report included the updated student generation rates for both school districts based on the student generation rate analysis completed by TischlerBise in October 2014. Due to minor mis-categorizations identified with the student generation rate analysis completed for Chapel Hill-Carrboro City Schools in the report, TischlerBise provided a revised student generation rate study to Orange County on May 7, 2015. The original report included student generation rates based on housing units that were categorized incorrectly. Specifically, 155 housing units were incorrectly categorized as multifamily instead of single family attached and vice versa. The revised student generation rates are included in Attachment 1. If approved, the corrected chart would replace the chart on page 44 of the 2015 SAPFOTAC Report. Student generation rates for Orange County Schools were calculated correctly and as a result are not part of this amendment. It should be noted that no additional sections or calculations contained in the 2015 SAPFOTAC Report, including student projections, will be affected by this amendment. The amendment is necessary to correct student 2 generation rates approved in the 2015 SAPFOTAC Report for Certificate of Adequate Public Schools (CAPS) purposes. As required by the SAPFO Memoranda of Understanding (MOUs), all SAPFO parties were informed of the proposed amendments on July 13, 2015 and provided the opportunity to comment. Chapel Hill-Carrboro City Schools (CHCCS) administration presented the proposed amendments to the CHCCS Board of Education at its August 8, 2015 meeting and the Board had no comments. On August 4, 2015 the Chapel Hill Town Council received the proposed amendments via email and offered no comments. The Carrboro Board of Aldermen received the proposed amendments at its September 15, 2015 meeting and approved a resolution recommending adoption of the amended student generation rates. FINANCIAL IMPACT: Consideration and approval will not create the need for additional funding for the provision of County services. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to this agenda item: • GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY The creation and preservation of infrastructure, policies, programs and funding necessary for residents to provide shelter, food, clothing and medical care for themselves and their dependents. Efforts to approve the proposed amendments to the 2015 SAPFOTAC Report will result in positive outcomes related to the above goal.
