levied by the Board against Goforth Properties be remitted and the payment

Dear Mr. Whitt �d:
Goforth Proper ies, Inc. of Chapel. Hill , North Carolina has paid
the $5 , 000. 00 plenalty imposed by your Board for alleged non-
compliance with the Change County Erasion Control Ordinance in
Stoneridge Subdivision , We do believe however that the fine was
unjustified and that all the appropriate factual, information was
not given to you at the time you reached this decision. Accordingly,
we are writing to ask you to review this decision in light of the
additional information we are hereby submitting:
1. IVe wer�: not given notice that the Orange County
Fl Commissioners were to consider this action, and,
accordingl, , were- not given an opport-unity to properly
represent ur side of the issue. It was only after
the stop w rk order was issued that we learned from
Mr. Freeman that he had written a letter on April. 1.3,
1979 to usladvising us that the Orange County Commissioners
would revr w the alleged noncompliance on April 23, 1979 .
The majority of all correspondence coming to us from
Mr. Freemap had previously been sent to us by certified
mail. Ile earned however that this important :letter,
written on April 13th-, was sent through the regular
mail . After learning of the stop work order, we sent
a representative to Hillsborough to secure a copy of
the April. � 3th letter; only then did we learn of its
contents. 1It is extremely puzzling to us that the
majority of all correspondence coming from Mr. Freeman
had previously been sent by certified mail and that
this very �.mportant letter which was to' give us notice
of the April 23, 1979 meeting was sent by ordinary mail .
It should further be noted that this letter was written.
on Friday, lbefore Easter, and it is possible that it
was lost i the holiday mail . We never received the
April 13th letter. We called the U.. S. Post Office and
had them put a tracer on the letter., but were informed
by the Post Office that they could not locate the letter.

2. L,1r _ Freeman, in his February 2 , 1979 :letter to us ,
indicatedjthat if we did not bring the site into compliance
within fouul,x working days of that date that a stop work
order Uoulld be issued and that such failure would be
referred do the County Commissioners for additional action.
No further correspondence was received by us indicating
that the efforts being made were not satisfactory with
Mr . Freeman. It was therefore our opinion that due to
both weath�r conditions and subsequent conversations
that our r presentative had with Mr. Freeman that we
were satisfactorily meeting his requirements . In March
of 1979 , M Freeman indicated to me that he was having
difficulties with my field superintendent and believed
that we would have a better working relationship and
coiild get better results if I changed superintendents .
1 , accordingly, relieved Mr . Tian Fritz of this respon-
sibility aid arranged for Mr. Vann Evans to meet with
MT. Freeman. Mr. Evans met on the site with Mr. Freeman
and with Mir. Neville , our subcontractor , and they discussed
all the points of the February 2nd letter that had not
been completed. It is Mr. Evans ' opinion that Mr. Freeman
agreed that the work was to be performed within a reasonable
time as th� weather permitted. It was neither Mr. Evans
nor Mr. Neville' s understanding that Mx . Freeman indicated
a deadline on the work. It should also be noted that a
subsequent letter from Mi. Freeman on March 9 , 1979 ,
which discussed Section One Stoneridge Subdivision, did
not in anyway indicate- that there was still dissatisfaction ,.
with Section Two and Three of St'oneridge. It should also
be noted tat l had not received any calls from Mr.
Freeman indicating dissatisfaction with Mr. Evans or with
Mr. Evans ° iperformance. It is clearly apparent that
there was a breakdown in communication between Mr. Evans
and Mr. Freeman. Mr. Freeman states in his February 2nd
letter to �s that he was terminating all informal , verbal.,
and writze* contacts regarding sedimentation control .
Tie states further that future contacts would be by certified
letter wit deadlines for achieving compliance_ We did
not receive any further communication from Mr . Freeman
by certified mail subsequent to February 2 , 1979 indicating
any furthe4 problems or any further difficulties . The
only conta4t was a verbal contact made between Mr. Evans , ,
Mr. Freeman, and Mr. Neville.
3. The we�ther from February to April 13th was rather
severe. TF e U. S. Weather Bureau report , a copy of
which is aftached, indicates that on February 6th,
we had 2 . 41inches of snow; on. February 7th; 2 . 9 inches
of snow; oii February 9th, 1. 5 inches of snow; on
February l th, 10. 3 inches of snow; and on February
19th, 1/10 h of one inch of snow. In addition, it
is indicat d that we had rain on February 21 , February 22 ,
February 2 , February 24, and February 25 . It is
certainly iiLi.cated from these weather conditions
that very, ]it tle work could have been accomplished
in Februar of 1979 due to the severe freezing

and thawing of the ground, seveze wetness of the ground,
and due to the snow cover. In March , the study indicates
that we ha rain on March 1 , March '4 , March 5 , March 6 ,
March 8 , March 11 , March 14 , March 19 , March 20 , March 23,
March 24 , March 25 , and 'March 27 . Accordingly, we believe
that Marchl, for the most part , was far too wet to do. any
grading ani corrective Work in the area. It should be
Hated for April that we had rain on April 3, April 4 ,
April 8 , April 9 , April 13 , and April 1.4 , indicating
that the first two weeks of April were basically very
unsatisfactory to do any corrective work.
In summary , we �ubmit -
1 . That wl certainly should have been given proper notice
of the County Commissioners " meeting before action was taken.
2 . That Mr. Freeman failed to properly communicate with
Goforth properties , Inc . about his dissatisfaction and
that he further failed to follow through on commitments
he made inlhis February 2nd letter that all further
communications would be by certified mail and with an
indicated 'deadline
3 . That Mr , Freeman should have indicated to Mr. Evans
when Mr : Evans took over the job that there was a deadline
and that we would be penalized if we did not meet that
deadline .
4 . That the severe weather conditions in February, March,
and April should have been taken into consideration before
this penalty was imposed.

We are certainly not indicating that we believe that Goforth Properties
Inc. had completely complied in all ways with the Soil and Erasion
Ordinance. I do believe that. my representatives were negligent
in not performing some of the work as fast as Mr. Freeman had
requested and the Erosion Control Act. required. In that we
completed all w�rk that Mr. Freeman required of us after the stop
work order was issued in essentially a one-day period, it is
certainly indicated that we were negligent in not having performed
this work more expeditiously. I wish to state further that we
have found Mr. Freeman very fair and very professional in carrying
out his duties as the Soil. and Erosion Control Officer. We do,
however, believe that he has been somewhat indefinite in his
communications with our office and somewhat .indefinite about some
of the procedures that he would like to have carried out within
the subdivisions . We , accardinly, do not feel that we should be
penalized for this lack of communication and for the misunderstanding
that existed be�ween Mr . .Freeman and our office . In view of all
the considerations stated here , we believe that the $5 ,000.00
penalty w4s ext- emely harsh and was an inappropriate procedure in
this situation. We accordingly, respectfully request that the

we have with M4. Freeman at the present time and since the date
of the stop work order has , in our opinion, greatly improved

the foll9wi,ng things need to be done in order to use the
punch ca> d voting equipment for the November 6 election:
i
1. Obtain written, approval from the State Board
of E1ect.iions for the use of this voting system together with
the rules and regulations adopted by the State Board of
Elections) pursuant to G.S. §163-160. 1 will or-esent this
information to the County Commissioners when they consider
the question of using the voting machine"'. The County
Commissioners will decide their use and can decide to use
voting machines in some or all voting places in the County.
2 . Obtain from the vendor a ca p of the
for the band issue together with the punch card for ballots
by bond counsel. I_ will need this as soon as possible.
3_ The Board of Elections, at their
meeting or at a special meeting called in time for�the e November
6 election must decide which precincts will use the voting
machines.
As to precincts where the voting machines will be
used pleas be mindful of G.S. §163-162 which requires paper
ballots for those that axe required to sign their ballots and
also those wishing to write in the names of candidates that
are not on the ballot.
