AGENDA ORANGE COUNTY BOARD OF COMMISSIONERS JUNE 4, 1979 OMMISSIONERS ROOM, ORANGE COUNTY COURTHOUSE HILLSBOROUGH, NORTH CAROLINA 10:00 AM 1. Does any Boa d member desire to modify this agenda? 2. Does any person in the audience desire to comment on items: A. Not on this agenda? B. On this agenda? 3. The Clerk submits minutes of Board meetings held August 28, 1978, May 10, 1979, Ma,y 15, 1979 (2 meetings), May 22, 1979 and May 24, 1979. 4. Ms. Cynthia Werts, Assistant Director, Office of Citizen Affairs , will review the role of the Orange County Involvement Council . 5. The Manager recommends the Board accept the low bid of Hewlett-Packard ($8,891.78) Jor a 9815A desk top computer and a 9871A character impact printer. 6. The Tax Coll ctor recommends the Board declare insolvent certain taxpayers named in the accompanying material and allow him to release tax bills of these individuals. 7. -`appointments: A. One vacancy exists on the Health and Medical Care Advisory Council . B. The Board should make initial appointments to the Land Title Records Advisory Committee. C. David Eng ish has resigned from the Recreation Advisory Committee. 8. The County Attorney will comment on a memorandum circulated by the Local Government Commission concerning Bond Counsel for the Industrial Facilities and Pollution Control Financing Authority, S. The Board of Education requests the Commissioners underwrite summer school breakfast and lunch programs. 10, The Board of Directors of O.W.A.S.A. has requested the Board of Commissioners consider certain alternatives for county involvement in the Cane Creek Reservoir Project. 11. The Manager submits a Memorandum of Agreement prepared by O.W.A.S.A., and relating to douse Bill 1436 dealing with assessment authority for that .. organization, for Board consideration. -2- 12. The sewer easement land owned byGRobertsandsConstanceaWilson Qbeafixedr and sewe , at $100. 13. The Finance Director submits a budget amendment recording four grants awarded during this fiscal year (Land Title Records , Transportation Planning, State Information and Referral and Senior Citizens Capital Improvements). 14, The health Director requests certain budget amendments reallocating funds within his department to conform with the new program emphasis set forth by the Board of Health. 1.5. Will the Board establish a unexpended funds ar e available of this facility. 16. The Board should fix times to further consider the proposed budget for the coming fiscal year. 17. The Chairman will present two highway matters: A. The Board's statement to be presented at the Department of Transportation hearing in Yanceyville on June 5th. B. The Board's statement to be presented at the I-40 design public hearing in Durham on June 5th. Foust, Secretary �~ North Carolina local Gove nment Commission SUBJECI: Bond Counsel for County Industrial Facilities and Pollution Control Financing Authority In several instances recently, counties or authorities created by counties to finance industrial projects under Chapter 159C of the General Statutes of North Carolina have been brought under pressure by private companies seeking to have such authorities finance projects in such counties, to ac,ept attorneys chosen by the private companies or bond counsel. I.t is very important that bond counsel for all industrial development bond financings should be the firm of bond counsel regularly employed by the county. G,S. 159C-8 states "No bonds may be issued by an authority unless the issuance thereof is first approved by the Local Government Commission." The Commission's interests in this matter are twofold: 1. First, and of paramount importance to t"c;- Commission, is the concern that bond counsel, which is charged with the respon- sibility for structuring the transaction, drafting the papers and delivering the necessary opinion on the bonds and in most instances preparing and reviewing opinions rendered by other attorneys in the financing, should be working with the best interests of the county and its industrial development authority at heart. Where counsel other than regular bond counsel to the county is selected by a private corporation, such selection is often made with the best interests of the corporation and not the county in mind. 2, Second, the Commission is charged by statute to approve the issuance of all bonds issued under Chapter 159C, to approve the interest rate thereon and to approve the manner of the sale. In the exercise of this responsibility, the Commission staff works very closely with the county's bond counsel. There may also be other alternatives of OWASA/ Orange County cooperation that the Board of County Commissioners is interested in suggesting. The OWASA Board requests that you consider three alternatives: 1. County jointly with OW_', :A develop Cane Creek by a financially equitable arrangement; 2. OWASA develop Cane Creek but request County to provide protection of watershed. This would include working with affected Land owners, Soil Conservation District, etc.; and, 3. County finance development of Cane Creek through general obligation bonds with takeover of debt service by OWASA. OWASA is well aware of the Water Resources Task Force and the importance of a total County plan. Wilson in the amount of $1200.00. A Formal Offer to purchase letter was mailed to the 5lzlsans on 4/24/79- Mr. Wilson telephoned on -:L. 8, 1979 and asked if a redesign could be done so a potential building lot 5 for one of his children would not be cut in half. I checked with Pridgen Consultants and they said this would not present any problems. I then called Don .4hite, our FUD Rep for easements, and he said to reappraise the new easement design, award just compensation, and write another Offer to Purchase letter. The re-appraisal was done on May 23, 1979. The recommended compensation mount is $100.00. The following is an agenda item for your considere,,on. The Community Development Task Force recommends reasonable and just compensation for a water and sewer easement be established for Robert D. and Constance R. Wilson in the amount of $100.00. This L22� .y is the last easement request unless there are additional design changes. /dw AGENDA ITEM 13 MEMO TO: Orange County Board of Commissioners FROM: Neal Evans, Finance Director DATE. dune 4,1879 SUBJECT: Proposed Budget Admendment The attached budget amendment has several purposes. 1) The major "itIms are the funding of additional monies for capital grant projects and fundin; two separate project funds - one for Orange County offices and one from the Land Records Grants. These are funded through use of unap- propriated fund balance and by a large number of reductions in numerous expen- diture accounts that will be unexpended at June 30 according to departmental estimates. 2) The second aria of changes is in the rearranging of funds from departments that need same additional funds "in particuliar accounts to complete the year. These include Caurts, Planning, Health, Social Service, Jail, Central Dispatch, and various Public WI rks. 3) The thrid area is the establishment and changes of details f'or grants and projects line item. These include Transportation, Planning, Information and Referral (Involvement Council), and, included in the capital and grant projects ordinance, the Title Y Senior Center grant, and the HUD Land Title Grant, 4) The Social Service amendments include the deletion of a revenue (75%) and an expense for adult service that was budgeted by amendment, but the staff funds were not available. 5) The health amendments would provide $7,700 for equipping the New Carr Mill space and $21,411 for transfer to capital projects for providing space for the dental clinic at Grady Brown. An additional $5,714 is required from fund balance for this project. While I have attempted to indicate where unexpended funds might be available in the budget, it would also be acceptable to fund all of the increases merely by appropriating fund balance and eliminating all the items marked by an as= terick(*). Generally, this am ndment does not affect the balance shown or available in year 1979-80 budget recommendations with the exception of the transfer to other funds. There are sufficient unappropriated fund balances available to cover these. You will also note an amount to increase the contingency fund by $2,275. This is actually to correct an error that occurred in amending the planning budget twice for the same amount on March 20 and April 17. 7 4 - 4~ ORANGE COUNTY, N. C. LAND TITLE GRANT PROJECT PROJECT ORDINANCE WHEREAS The Board of Commissioners of Orange County has agreed to enter into a project which involves a Federal/State grant as its major funding source: IUD Research Grant H-2894-R G, "Automated System for Land Title Recordation,' and, WHEREAS sufficient funds are available to Orange County from the grant and from the Orange County General Fund to provide a balanced budget wherein services availabl for the project are equal to the appropriations. The Orange County Commissioners understand the Chatham County Commissioners will request ihat improvements to Lystra Church Road (SR 1730) from n 15-501 NE to 54 be included in the seven year Highway Improvement Program. This project, if programmed and funded, appears to solve some congestion in Orange County by diverting traffic bound for Durham and the Research Triangle from 54 Bypass. The Orange County Commissioners, therefore, support and endorse the request to be made by Chatham County for this improvement. We do not see a need to build a so-called Southern Bypass and urge that such a road NOT be included in the seven year Highway Improvement. Program. Requests 1 through 4 herein stated provide for sensible and economical management of this traffic for now and for the foreseeable future. Because such a road would lie entirely outside any municipality, we respectfully submit that it should not be included unless and until endorsed by the units of government directly responsible in the areas involved, i. e, the Orange and Chatham Boards of Commissioners. 5. The Orange County Commissioners support the Town of Hillsborough Board's request that a study be made of the possibility of widening Nash Street within at least the t=ext seven years and that the intersections of Highway 70 and Highway 86 North, the intersection of Highway 70A Nest and Faucette Mill Road and the intersection of Highway 70 West and St. Marys Road be included in the seven year Highway Improvement Program. 6. We still have need for the upgrading of NC 86 from I-85 south to Chapel Hill. We are not now requesting, nor has the request been, to four lane NC 86. Our request is to improve NC 86 on the order of 54 west of Carrboro to the Orange-Alamance County line. This upgrading would redesign dangerous ir,carsections at Whitfield Road, Eubanks Road and other inter- sections, eliminate dangerous curves, build up the shoulders and widen the existing two lanes. We also request that NC 54 east of Chapel Hill to the Research Triangle be four laved. We would again make the point that these improvements are needed to solve local and regional traffic problems while interstate construction brings on more problems than will be eliminated. The requst is that I-40 be deleted from the current seven year Highway Improvement rogram and that improvements to NC 86 and four laning of 54 east of Chapel Hill be included.
