ORANGE COUNTY BOARD OF COMMISSIONERS

1. A public hearing with officials of the Department of Transportation to
consider secondary road plans in Orange County for the coming fiscal year.
2. Does any Board member desire to modify this agenda?
3. Does any member of the audience desire to speak concerning:
A. Items not on this agenda?
B. Items on this agenda?
4. Robert oates, Retion III IV-D Consultant, will discuss Orange County's
IV-D program with the Board.
5. Scan Da fa Corporation has petitioned the Board of Commissioners to
release certain tax bills assessed against them for leased property located
at Memo ial Hospital in Chapel Hill .
6, The Erosion Control Officer will report violations of the county's
erosion control ordinance at the Stoneridge Subdivision.
7. The Chapel Hill Kiwanis Club has requested the Board of Commissioners
issue a permit for them to hold a fireworks display on July 4, 1979.
8. Resolutions of Appreciation for services rendered Orange County by:

B. Col nel William H_ Breeze - Orange County Planning Board
C. Johr Scarlett Orange County Planning Board
D. Nancy Laszlo - Orange County Board of Adjustment

9. The Tow of Hillsborough has requesters the county allow Brian Benson,
a member of its planning staff, to prepare the Town's final Community
Development Application. The county would be reimbursed for Mr. Benson's
time. he Planning Board will comment.

12. The Comm pity Development Task Force recommends the Board of
Commissi hers establish as just compensation for water and sewer
easements in the Community Development Area the sums shown on the
accompan ing document.
11. Representatives of JOCGA have requested the Board of Commissioners
validate its current governing board known as the Economic Opportunity
Commission of Orange County and its current Joint Board of Directors.
12. Appoint eats:
A. The Board should name a member to the Human Services Advisory
Commission representing the Orange County Housing Authority.
B. Will the Board name a second alternate to the Board of Adjustment?
3 C. Mable Poteat has resigned from the Health and Medical Care Advisory
Committee creating one vacancy on this group.
D. Doe the Board wish to fix terms of office for members of the Health
and Medical Care Advisory Committee?
E. Tom Hawkins has resigned from the Industrial Facilities and Pollution
Con rol Financing Authority, creating one vacancy on this group.
13. The Planing Board has enacted a resolution recommending the Commissioners
create n Agricultural Task Force and has recommended fifteen persons to
serve o� this group.
14. The Reg�ster of Deeds requests the Board:
A. Approve a proposed budget of $155,068 for the Land Title Record
Gra' t.
B. Aut orize creation of a Land Records Management Advisory Council .
C. Endorse efforts she will make to allow installation of a
of Parcel Identifier Index in Orange County.
15. The Board of Equalization and Review for 1979 will hold its first meeting.
No cases will be heard at this session.

A G E N D A
1. Members of the Board of Equalization and Review will file their oath of
office ith the Clerk.
2. The Chairman will convene the Board of Equalization and Review of 1979.
3. The Board should fix a time for future meetings and have the Tax
Supervisor prepare an agenda.
ADDENDUM
16. The Board of Commissioners will discuss items relating to Interstate - 40
and perhaps enter into an executive session.

As I have mentioned several times, our Boards are technically out of
compliance since C5A regulations and JOCCA Bylaws indicate that Governing
officials of each political jurisdiction designate their "Public Official"
representatives to our Boards. In the case of Orange County this relates
to the Economic Opportunity Commission of Orange County Inc. known as our
Orange Board and the Joint Board which is the policy-making Board.
In order to validate our current Board, I'd appreciate your referring
the current members of our Public Officials sector to the County Commis-
sioners for their ratification. I-le have attempted to develop a broadly

APPLICABILITY : This CSA Notice applies to differing categories of
CSA grantees depending upon the particular amendments
to the Economic Opportunity Act. Each provision in =
Section 4 below indicates those categories of grantees
to which the amendment discussed therein applies. CSA
is now preparing detailed and comprehensive rules,
regulations and guidelines implementing various pro-
visions of the 1978 Amendments, both those appearing
in Section 4 below and others.
r� REFERENCES The Economic Opportunity Amendments of 1978.
I. PURPOSE
The purpose of this CSA Notice is to provide notice to CSA
grantees and their delegate agencies about certain provisions of
the Economic Opportunity Amendments of 1978 which are immediately
applicable to their programs.
2. IMPLEMENTATION ='
All grantees and other recipients of CSA assistance to which
the provisions of the 1978 Amendments apply must take steps
at once to comply with the new statutory requirements as soon
as possible. The detailed rules, regulations and guidelines
that CSA is now preparing will contain, when appropriate,
specific deadlines for compliance with the various amendments.
3. BACKGROUND

The Economic Opportunity Amendments of 1978 contain several
provisions which have an immediate and significant effect
on CSA grantees. Because of their immediate impact, ninerf
sections of the 1978 Amendments are quoted in this CSA Notice :;:

2, Comment:
The basic change in Section (c) expands the statutory
rule to set forth conditions or terms which prohibits
the CSA Director from imposing arbitrary population
requirements as the sole criterion for deciding the
eligibility (or ineligibility) of county or multi-
county units to be served by a new community action
agency. Whenever at least 20 percentum of the families
! and unrelated individuals residing in a county or
multicounty unit have incomes below the poverty level
or index, (such findings must be based on the most
recent census or survey conducted by the Bureau of
Census), the size of the total population of such
units may not alone be the basis for granting (or
denying) eligibi ity to such units seeking to be
served by a community action agency.
On the other hand, the amended Section 210(c) does
not prohibit the use of population size as a cri-
terion for eligibility when it is used in conjunc-
tion with other compelling conditions provided in the
law. Thus, under the amended law, a new CAA may not
be designated in county or multicounty units if the
unit 1) has a population of less than 50,000; 2) was
served by an existing CAR on June 1, 1978; and 3) the
new CAA would serve a sm. 11er geographical area than
that served by an existing CAA on June 1, 1978. It
should be noted that all three of the above conditions .�
must be evident for denial of eligibility. The effect
of the new Section 210(c) language is such that if
the applicant unit can satisfy criteria 2) and 3) de- :
nial of eligibility could not be decided solely an the
applicant's failure to satisfy the criterion related
to population size.
CSA is amending its regulation on the eligibility and
establishment of coy munity action agencies (CSA Instruc-
tion 6400-02) to reflect this change.
B. COMPOSITION OF CAA GOVERNING BOARDS. Section 211(b); OEO Instruc-,
Lion 6400•-01.
1. Text;_ Amended Section 211(b) provides:

cials may be counted in meeting such one-third requirement,
(2) at Ieast one=third of'the members are persons chosen
in accordance with democratic selection procedures adequate
to assure that they are representative of the poor in
the area served, and (3) the remainder of the members are
officials'or members of business, industry, labor. re
ligious, welfare, education, or other major groups and I
interests in the community. Each member of the board
selected to represent a specific geographic area within
a community must reside in the area he represents. No
person selected under clause (2) or (3) of this subsection
as a member of a board shall serve on such board for more '
than five consecutive years, or more than a total of ten _
years."

2. Comment:
The amended 217(b) requires that Community action boards

shall now .consist of not less than fifteen members. The
first change assures for the first time, a representative
minimum as*well ,as maximum level of participation on all
community action boards. In addition the one-third of
the board who are elected public officials must be current
7y holding office.
The second change expresses the intent of Congress that
elected public officials do not hold terms on the board
ear se but that they serve on the board in their capacity
as e'iected officials. i
Grantee boards must be in compliance with this subsection
within forty days from publication. t I
