IMPLEMENTATION
First, we must establish the Transition Zone's (Joint Planning Areas)
total area and boundaries. This can be done by staff or by some other
mechanism. Our methodology to do this should take the following into account;
future land needs, population, the future need for commercial, industrial,
recreation, public and residential land, your policy of in-fill of undeveloped
land inside the present Town limits, a land development inefficiency multiplier,
a multiplier to prevent land monopoly, etc., plus other factors. Our methodology
could be similar to that used by Triangle J Council of Governments in their Land
Classification Plan. A outer boundary line and an inner boundary line ( this could
be the Town limits or anywhere beyond that) would be the site for joint planning.
A specific, clear and concise land use plan must be developed by either the
staff or by some other mechanism for the area. One alternative already proposed
is that this area be residential with gradually decreasing density the greater
the distance from the Town limits. The land use plan needs to clearly specify all
Towns and the County's transportation plans and a water and sewer plan. Both Town
and County land development ordinances need to contain sections that would mandate
implementation of the land use plan, the transportation plan, and the water and sewer
plan. Each plan must be precise, clear, definite and as unambiguous as humanly
possible in delienation of standards, acreage, distances, etc. The primary and most
important plan for joint planning would be the land use plan. However, if the New
Hope basin is included in the Transition Zone, then the land use plan and (resultant)
:rater and sewer plan becomes critically important. Areas that might need special
attention are around the Proposed I-40 interchange(s), if that road is ever built.
Another potential concern is protection of Duke Forest land in the Transition Zone.
As critically important as it is to initially plan these areas, another equally
critical factor is the continual, periodic, update and adoption of all plans that
impact these joint areas. Without this continual update and adoption, good plans
will soon become obsolete and make implementation difficult, if not impossible. The
ALI Model Land Development Code proposes a two year update cycle, Atlanta, Georgia
updates and readopts its comprehensive plan annually and Seattle mandates a two year
cycle for their policy plan. The State Land Policy Council recommended a five year
update cycle for the "Land Classification Plans". Five years is too infrequent and
a one or two year cycle more reasonable.
The current informal review process by the Technical Review Committee is very
important. This process should be formal by amending the land development or zoning
ordinance accordingly and officially create a Technical Review Committee. In area C
the Orange County Planning Board would formally review the Technical.Review Committee's
recommendations. If any of its recommendations are ignored or overturned, then the
Planninn Rnard wotild have to formally state reasons whv_
In area C, Orange County's land development ordinance would be the enforcing
ordinance. The key is that we would be implementing the jointly agreed upon land
use plan and subdivision standards. The County's subdivision regulations would
have to be amended to implement Town standards in this area. Attachment A from
the North Carolina Model Subdivision Regulations (1977) gives us an example of
the kinds of standards that could be added to Orange County's subdivision regu-
lations. For the Planned Development Districts, Special Use Districts or Con-
ditional Uses, minimum standards can be stated for streets, curb and gutter, etc.

JOINT PLANNING
is The objective of joint planning . to implement city standards in
unincorporated areas that will eventually become part of the city; Joint
planning could occur within what has been called the Transition Zone, de-
fined as that land which will eventually be incorporated into the city,
possibly within twenty years, and require the full range of urban services
when totally developed.
Phil Green met with Gene Shipman, Michael Jennings, Sam Gattis and
Jim Polatty on Friday, April 6, 1979. Mr. Green reported there are three
types of joint planning, informal, formal and consolidated. Informal joint
planning is approximately the method presently used by Orange County, Chapel
Hill and Carrboro in the Transition Zone defined in Chapel Hill's 1975 Land
Classification Plan. (City standards can not be legally implemented, only
encouraged.) Formal joint planning requires mandatory referral by the land
development ordinances. A Technical Review Committee could be authorized,
by ordinances, to review in a formal report all proposed development in the
area. This report would have to be included if not accepted in the Planning
Board's recommendations to the Board of County Commissioners. A Consolidated
planning agency currently is operating in Winston-Salem/Forsyth County, Charlotte/
Mecklenburg, and Wilmington/New Hanover County.
If joint planning is adopted, staff recommends use of the formal joint
planning, as outlined above.
Mr. Green stated that there are three levels of coordination necessary to
involve in any joint planning proposals, staff, Planning Board, and Governing
Board. Three alternatives outlined below include setting up one government's
staff, Planning Board, and Governing Body as the final decision maker and those
with the ultimate responsibility for implementation of plans and development
standards. The other government's staff would review the project on the Tech-
nical Review Committee, give comments and input into a formal report that would
have to be formally responded to by the other government's Planning Board.
Each of the following alternatives are designed to include an area where
the County implements its ordinance without anx joint planning (Area C) and an
area where the City implements its ordinance without any joint planning (Area A).
Joint planning will occur in Area B.
