Thompson -and- Mr. Randall Waugh Mrs. Jane Allen Waugh Dear Ladies and Gentlemen, In response to your request for our Board to "prepare and forward to appropriate Federal and State authorities, a resolution . . ." regarding the recent flag-burning incident on the UNC campus, our attorney advised us that the District Attorney was the appropriate officer to which this matter should be referred. T am enclosing copies of correspondence from the District Attorney on this matter, citing a 1974 decision of the United States Supreme Court, which indicates that the flag-burning incident is protected as "symbolic speech" by the First Amendment to the Constitution, Although we agree that this act is repugnant to us, we feel secure in reaffirming our support of the First Amendment, which allows such extreme expression of free speech. I hope this clarifies our position on your request and we appreciate your bringing the matter to our attention. The Board of Adjustment may permit an individual mobile home to be located on the same lot as an existing single--family dwelling for temporary residential use for a period not to exceed one year if a custodial relationship exists between the occupants of the mobile home and the existing single-family dwelling when all of the fol--, lowing conditions are met: a) One of the following types of relationships shall exist between the occupants of the mobile home and the existing single family dwelling: 1. Blood relationship 2. Relationship by marriage 3. Legal guardian relationship designated by Court of Law b) The necessity of direct custodial care shall be certified in writing by a licensed physician (M. D)because of age or poor health. c) The applicant shall demonstrate that tyo other reasonable alternative as available based on the utilization"of habitable space in the existing single-family dwelling unit. d) The mobile home shall meet all front, side, and rear yard setback requirements for the zoning district wherein such mobile home is located. e) Water and sexier facilities to the.moible home shall be approved by the Orange County Health Department or by the appropriate agency or municipality from which water and sewer will be provided. £) All abutting property owners shall have been notified of the applica- tion for such temporary use permit by the Planning Department. g) on lots less than 40,000 sq. ft. the applicants lot shall not contain more than l (one) existing single-family dwelling. 2. A renewal shall be issued only upon application of the permittee. Any such application for renewal shall be treated as a new application hereunder. 1
