Does any Board member desire to add additional items to this agenda? 2. The Clerk submits minutes for the October 17th meeting for Board consideration. 3. Represents Ives of the County's Council for Women will present the Board copies of its publication, "Orange County Guide to Family Resources" . 4. Representatives of the Orange County Day Care Coalition will request the Orange County Board of Commissioners endorse their efforts to uphold day care standards in North Carolina_ 5. A resoluti n endorsing energy conservation through controlled thermostat +� settings. (Agenda Attachment I) . i 6. Appointments: A. Two va ancies exist on the County Council on Aging. (Agenda Attachment II) . B. The Bo rd should name three representatives to the Governor's Energy Awareness Conference. 7. The County Attorney will review a draft resolution creating a County Advisory Commission on Health and Medical Care. (Agenda Attachment III). 8, The Hyconeechee Regional Library is requesting supplemental appropriations to continu use of student help 18 hours a week. 9. The Manager recommends execution of a 18 month lease of 1,300 square feet of office space for the Orange-Durham Employment and Training Office (CETA) . 10. Announcement: The Orange County Board of Commissioners and the Chapel Hill Board of Aldermen will meet on November 15th, at 7:30 p.m., in the Aldermen's Room of the Municipal Building in Chapel Hill to discuss implementation of a transfer of land use control jurisdiction from Orange County to the Town of Chapel Hill . w 772 RESOLUTION ESTABLISHING ORANGE COUNTY ENERGY POLICY WHEREAS, it is apparent that citizens of Orange County and the United States are faced with energy shortages of considerable magnitude; and, WHEREAS, said energy shortages have been recognized by Orange County Commissioners; and, WHEREAS, Orange County has acknowledged the need to develop a policy for county offices and guidelines for the citizens with respect to conservation of energy.. NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Orange County that the following steps are to be taken by all offices and employees of Orange County to perserve energy: 1. Curtail the use of electricity and other forms of energy to a minimum consistent with health and safety requirements. 2. Set thermostats to maintain 68 degrees in winter and a minimum of 78 degrees in summer in all offices and facilities controlled by the county. Employees are encouraged to dress appropriately. 3. Car pools of employees commuting to and from work are encouraged. 4. Employees are encouraged to conserve energy in accordance with suggestions made by the Energy Office, and to submit additional conservation suggestions to said office. 5. There should be no heating and cooling between temperatures of 68 degrees and 78 degrees. BE IT FURTHER RESOLVED, that the Orange County citizens are encouraged to conserve energy as suggested above and in accordance with subsequent recommendations of the Orange County Energy Office. A need exists to establish the ORANGE COUNTY HEALTH AND MEDICAL CARE ADVISORY COUNCIL in order to compliment and strength 2n the activities and functions of the Orclhc� County Board of Health, = Capital Health Systems Agency, the Orange- Chatham comprehensive Health Services, the Durham-Orange County Medical Society, any and all medical and hospital associations active in orange County, and any other groups interested in the pro lems of health and medical care delivery in Orange County. There is further a need to tabulate and make known the various medical care facilities and services available to the people cf Orange County and their elected representatives in their efforts to meet the health and medical care needs of all County residents. There is hereby created and established the ORANr COUNTY HEALTH AND MEDICAL CARE ADVISORY COUNCIL. Section IV. The COUNCIL is charged with the continuing responsibility to: A. Study the health and medical care needs and resources of orange County and to periodically report the resul of the studies to the Board of Commissioners; B. Study and periodically recommend to the Board of Commissioners means by which the health and medical care systen cor.00nawnts can coordinate and facilitate the delivery of healtl care. The periodic reports and recommendations invisioned it A and B herein should contain sufficient detail. to permit the Board of Commissioners and the people of Orange County to undez stand the regni.rements for implementing each progranE�;presen.ted an option and insofar as possible to indicate the expected cost of and benefits from each alternative. The reports and recommE dati.ons should also indicate what effect new programs will hav( on the programs that are now in operation. Any such report or recommendation therefore should contain an inventory of all current programs including their costs to orange County: Along with the services that are currently being provided through each program C. Facilitate communication among various components of the health system; section V. The COUNCIL shall consist Of nine voting members appointed by the orange County Board of Commissioners for terms as follows: Tin case of a vacancy occUring during a term, the -vacancy shall be filled by the Board of commissioners for the unexpired portioi of the term. All members shall serve at the p1easure of the Board o' Co.-mimissiOners- In making appointments to the COUNCIL the Board of commissioners shall be guided by the following criterion. Persons appointed should bet A, riot employed, directly or indirectly, by any component, of the health and medical care system; B. selected so as to balance representati:&a by reside ce and socio-economic characteristics; C. Willing to exert the necessary effort to deal effectively with the complexity and technicality of the medical care s4stem. Sectio I VI. Recognizing that the COUNCIL will deal with problei requiring special medical and administration expertice, the Board I Commissioners will appoint consultants to the COUNCIL upon r1quest by the C01INCIL. Such a request or requests should be accDmpanied by a recommendation from the COUNCIL as to perso 1 qualified to serve as consultants. In no event will consultant r C_ V%lilling to and capable of providing or arranging for considerable hour's of consultation. Section VII. orange County will provide the COUNCIL with: A. Secretarial support to provide zua.nutes of meetings mailing, copying, correspondence, and telecommunications costs ; B. Staff time to facilitate communication, scheduling of persons to be in attendance , collection of requested infor- mation; C. Members &q consultants will not be paid for their, services, however, with the approval of the orange Cot ty Finar officer they will be reimbursed for travel expenses, meals and re =W xable ircde�tal expenses incurred in performing their duties. Section VIII. It is not comtemplated that the COUNCIL will owr any real estate or any tangible personal_ property of consequenc Orange County hereby reserves all rights to the work product of the COUNCIL. Dear Sirsl I understand that you will soon be considering a rezoning request made by Mr Clarence Gates for a change from Residential, to General. Commercial on Lawrence Road in Eno Township. I ask w Aat you consider the public statements made in Chapel Hill, at the joi t meeting of the Commissioners and the Planning Board, the recomm ndations of the Planning Board, and your action on a very simil r request made last year by Mr. Thomas Gates, and turn do,nm the r quested rezoning change. Please for ive me for communicating with you in this manner, but I realize th,t you are especially busy at this time and I wanted to respect your privacy. I believe that the requested change, if approv would damake the existing residential character of the neighborhood, and would tend to lower property values. Mrs. Rogers, Mr. Bunting and myselflhave publically spoken against this request, but most of the other roperty owners would have to suffer the most direct consequent s of such a change since they live beside the road. You may rememb r that with the exception of the above named property owners and Mr. Clark, the famlies living en this section of Lawrence Road are related. You may also remember that when Thomas Gates requested he same change on property located about 250, away last year, it c used a split between the famlies, and many of the family members do not want to go through th t for the again. I hope that I am nt placed at a disadvantage because I did not employ this tactic. �T Mr. Gates°right to make his position clear in a matter cf-= natu but pleas do not interpret the :fact that I have not approached you on a personal basis as an indication that I have nothing to say. This part of Eno Township has been zoned residential for quite some time. The fact that the business presently exists as a nonconformin, use paint out some of the basic problems with the prior zoning of Eno ` awnship. However, Orange County has restricted the types of us- to which his land may be put, and since investment in land and h❑m in the ar4a has been made with the protection of zoning in mind, orange County is obligated to maintain this protection unless this neighborhod or Orange County as a whale suffers if the change is n permittedI One property owner stands to gain, perhaps at the expense of the surrounding property owners; certainly they will have to give up a portion of their peace and quiet, and they may lose some of the investment they have made in their property. It would be difficult to make a case for neighborhood .improvement if the change were allowed. There are suitable locations for commercial development in the vicinity, and I am sure that a need for the business and Mr. Gates, ability would allow the business to prosper if it had tc relocate to a more suitable site. I see no reason why orange Ceunt� would have to Lose either the industry or the employment provided. The question arises of whether a person should be able to do what he wants on his own land without interference from government or hi neighbors. In the past, when people were few and far between, notY3 much might have been said, but -the rate of growth in Orange County and the type of growth that has occurred has taught us that the efJ of any person's actions do not magically stop at the property line, Increasing growth has brought increasing regulation. None of us is allowed to do what we want on our own land without restriction, either by zoning, or permits, or neighborhood pressure, whatever. Ali, of us suffer restrictions that may gall us as indivi.dual.s, but we recognize that as citizens such restrictions may be necessary evils. We ask only 'that such restrictions be fairly applied to all citizens in similar circumstances. As a citizen of the neighbor hood in question, I ask 'that you consider the rezoning request as it might affect the neighborhood as a whole, not as it might affec' an isolated part of that neighborhood. Your decision can not exist in a vacuum. Please reject 'this rezoning request. Sincerel , E. There is further a need to tabulate and make known the various medical care facilities and services available to the people of Orange County and their elected representatives in their efforts to meet the health and medical care needs of all .OLEMAN.BERNHOLZ &DICKERSON County residents. The function of the COUNCIL will be to work closely with the Orange County Health Department, the Capital Health Systems Agency, and all other professional and consumer organizations interested in and serving health needs in Orange County in defining as precisely as possible the health and 76 medical care needs of every citizen of Orange County and each community of Orange County and to periodically report to the Board of Commissioners and to the people of Orange County regarding the health services available. Section III. There is hereby created and established the ORANGE COUNTY -HEALTH AND MEDICAL CARE ADVISORY COUNCIL. Section IV. The COUNCIL is charged with the continuing respon- sibility to: A. Study the health and medical care needs and resources of Orange County and to periodically report the results of the studies to the Board of Commissioners; B. Study and periodically recommend to the Board of Commissioners means by which the health and medical care system components can coordinate and facilitate the delivery of health care. The periodic reports and recommendations invisioned in A and B herein should contain sufficient detail to permit the Board of Commissioners and the people of Orange County to under- stand the requirements for implementing each program presented as an option and insofar as possible to indicate the expected cost of and benefits from each alternative. The reports and recommen- dations should also indicate what effect new programs will have on the programs that are now in operation. Any such report or recommendation therefore should contain an inventory of all current programs including their costs to Orange County along with the services that are currently being provided through l each program; C. The COUNCIL shall consist of nine voting members appointed by the Orange County Board of Commissioners for terms as follows: Three of* the members first appointed by the Commissioners shall serve for three years; three of the members shall serve for two years and; three of the members shall serve for one year. Upon the expiration of the initial terms, all members shall serve for three years. In case of a vacancy occuring during a term, the vacancy shall be filled by the Board of Commissioners for the unexpired portion of the term. All members shall serve at the pleasure of the Board of Commissioners In making appointments to the COUNCIL the Board of Commissioners shall be guided by the following criterion. Persons appointed should be: A. Not employed, directly or indirectly, by any component of the health and medical care system; B. Selected so as to balance representation by residence and.socio-economic characteristics; C. Willing to exert the necessary effort to deal effectively with the complexity and technicality of the medical can system. Section VI. Recognizing that the COUNCIL will deal with problems requiring special medical and administration expertice, the Board of Commissioners will appoint consultants to the COUNCIL upon request by the COUNCIL. Such a request or requests should -3- be accompanied by a recommendation from the COUNCIL as to persons �OLEM..,BERNHOLZ &DICKERSON qualified to serve as consultants. Professionals of previously demonstrated knowledge and ability; C. willing to and capable of providing or arranging for considerable hours of consultation. Section VII. Orange County will provide the COUNCIL with: A. Secretarial support to provide minutes of meetings, mailing, copying, correspondence, and telecommunications costs; B. Staff time to facilitate communication, scheduling of persons to be in attendance, collection of requested infor- mation; C. Members or consultants will not be paid for their services. However, with the approval of the Orange County Financ Officer they will be reimbursed for travel expenses, meals and reasonable incidental expenses incurred in performing their duties. Section VIII. It is not contemplated that the COUNCIL will own any real estate or any tangible personal property of consequence Orange County hereby reserves all rights to the work product of the COUNCIL. Section IX. This resolution shall take effect upon its passage.
