Minutes of the February 6, 1978 Board meeting are submitted for consideration. 3. A Public Nearing has been advertised for 7:30 to provide public comment prior to the 1978-79 budget preparation process, particularly concerning Federal Revenue Sharing Funds. 4. Mr. Bill Nupman and Mayor Glendale Stephenson form the Town of Mebane, and Mr. Pblicastro, an Industrial Developer for the Alamance County Chamber of Commerce, will discuss utility policies for future industrial developme t. 5. Mr. Burch Compton, Civil Defense Coordinator, will discuss with the Board his assessment of damage from the recent ice and wind storms and request the Board endorse a "Damage Assessment Report" to be forwarded to the Governor's office. (Agenda Attachment I) 6. A Subdivision Ordinance from the Orange County Planning Board is submitte - for consideration. 7. Consideration of extension of subdivision regulations County-wide. 8. Consideration of a resolution on open meetings. (Agenda Attachment IT) 9. The Coun �y Sheriff requests a resolution authorizing an application for Law Enforcement Assistance funding to purchase six protective vests costing 1450 including local match of five percent - $23. (Agenda Attachment 10. Appoint ants: a) The Chapel Hill Board of Adjustment recommends Mr. James Bullard to fill the County vacancy created by the resignation of Ms. Sonna Loewentha° on t at Board. The foll.o ing motion was made by Mrs. Riddle and seconded by Colonel Breeze. „This Planning Board approves the concept of subdivision regulations for the en- tire county as one form of land-use planning, and further moves to recommend to the County Co issioners the establishment of a county-wide committee composed of no more than three members from each Township Advisory Council and charge this committee with consolidating all recommended changes, additions, and deletions to the propose Subdivision Regulations. A deadline of April 15 is established `r for the committee to report their findings and recommendations to the Planning Board. I further move that the Planning Board take mediate steps to evaluate the recom enda ions and establish a firm recommended position to the County Com- missioners no later than April 20, 1978, which is the regular meeting of this board." - The following amendments which do not require public hearing were recommen- ded for immedi to action by the Planning Board: 1.) Move the d f inition of a minor subdivision from page 5 to the definition sec- tion. 2.) Add definition of tract - request that the County Attorney develop a de.fini.- tion for "tract" of land and that this be included in the definition section. 3.) p. 5 Ill-C-2: Amend to read as follows: No more than four (4) new lots may be created out of a tract of land by the Minor Subdivision process within a one year eraod. Add: Any tract of land which changes ownership may be re subdivided by the Minor Subdivision. process. 4.) p. 7-8 -- III-D-4-a: Add: 6. Each townshipts advisory council shall be in- formed by the Ilanning Board of Preliminary Flans of proposed subdivisions with- in that township. 5.) p. 8 - III-D-4-b: Amend to read as follows: The subdivider mbe required to demonstrate how potential problems have been avoided. .. 6.) Replace th word "developer" with the word "subdivider" throughout the regu- lations. (For Lample, on page 8, Section III-D-4-c.) 7.) p. 13 _ IV--B-2: Delete two sentences beginning "Each lot shall contain at least.. ." and ' Lots that are of restricted development potential..." Replace w with "Each lot which does not contain a suitable building site shall be desig- nated on the plat as being of restricted development potential and by instru- ment recorded in the Orange County registry as specifically prescribed by Sec- tion III-E-S-e of this Ordinance." 8.) p. 18 - IV B-8: Amend to read as follows: A buffer strap � be required in a subdivision adjacent to railroads.. . The following recommendations which will require a public hearing were also made: 1.) p. 4 111-A - The Planning Board recommends that the County Attorney and Planning staff be instructed to develop a mechanism to defer review of subdi- visions when the landowner has no intention of immediate or future development of the lot. A report should be made available by April 15. 2.) p. 5 - 111--C-1: Add: The decision of the Planning board may be appealed to the County Co issioners. 3.) p. 9 - III.-D-4-d: Strike last sentence and replace with: In the event that the County Comaissioners reject a recommendation of the Planning Board, the pro- posal shall be returned to the Planning Board which will review and reconsider it along with the County Commissioners' stated reasons for denial. The appro- priate Advisory Council will be notified of the deeision, al.so. After the review, the pr posal,, with new recciwendations, will be returned to the Com- missioners for reconsideration. 4.) P. 9 - III-E-1: Add: The Planning Board's decisions may be appealed by the subdivider to the County Commissioners. 5.) p. 13 »- IV--B-2: Amend to read as follows: The proposal shall be evaluated b the Planning Board for potential impairment of habitat of rare and endan- gered species r unique natural areas as listed by. .. 6.) p. 17 - IV B-5-b: Amend to read as follows: This lot may not be sold or a building permi I issued until the access road has been built as specified for this subdivisi n, or appropriate assurance provided as specified by Section 5 of this Ordi ce. 7. . 17 - I B �� p 6-b. Public purposes meaning recreation, housing, industrial siting, aesthetics and environmental protection besides general health, safety and welfare. In 1975, the Chapel Hill League of Women Voters helped plan the Orange County Growth options Conference held in Hillsborough in Septembez of '75. At the close of the Conference, as a group, the participants reviewed statements on four issues. The statements represented general agreement but no one was asked to sign the statements. The issues were: 1. property rights and public interest 2. impacts of growth in Orange County 3. location and farm of development in Orange County and 4. management of growth in Orange County The Assembly had general agreement that building codes and subdivision regulations should be adopted and made effective county-wide. The Assembly expressed the value of adequate controls. In summary, the Chapel Hill League of Women Voters has been involved in studying Land Use Planning in Orange County for about fifteen years. We support the extension of the Subdivision Ordinance to all of the County. We believe that subdivision regulations protect and enhance land values rather than .lower them as can happen if no planning 'is done. Thank you for the opportunity to address you. Mr. Chairman and,.Board Members: My name is Eve Shy. ,I am here as a representative of the Chapel Hill League of Women Voters to support adoption of county wide subdivision regulations. The Teague of Women Voters is a non-partisian organization concerned with issues. We acquire information, do extensive studies and have group discussions on these studies. In the 1960's, the League undertook a land use study of Orange County. From this study, in 1964, we announced our support for a sound planning program. through which public improvements, policies and regulations would be coordinated for orderly and attractive development of communities. in 1968, we announced out support of national policies and procedures which promote comprehensive long range planning for conservation and development of water resources and improvements of water quality. In 1973-74, the North Carolina League of Women voters announced support of Land Use Planning of Statewide and Regional. Application which would effectively guide development to meet human needs and would also effectively conserve resources and protect the natural environment. We urged the state government to require that localities, city and county governments do long range planning and implementation according to state guidelines and in cooperation with regional planning offices. We urged the state to provide technical and financial assistance to local governments in setting their own community goals and developing land use policies and controls to achieve these goals within the framework of regional and state goals. A different type and size of mats is required than had originally been requested. Inflated prices have also created some of the cost increase. The Proposed amendment also includes the budgeting of $339 revenues from a N. C. Symphony Program for direct payment to the Symphony. And finally $1 ,956 is requested for transfer from personnel 'to contracted services for a y uth piano instruction program ($956) and a creative playschool program ($1 ,000). The exception, relating to split doors, appears to to the advantage of the container. This split door prevents a problem that arises when t single lid goes into a filled container causing it to become detached from the arms of th loader. These same two containers will be purchased by the Chapel Hill-Carrboro school syste it is recommended by the Assistant County Manager,acting in place of :the Manager who currently on sick leave, that the Board of Commissioners accept the low bid by Consolidat Energy Products, Inc. of $7,364.00. The Consolidated Energy bid was low on all but the r loading containers, but, if we accept their total package, the cost is $100 less than the sum of the individual items. The savings by taking the whole package is $20.00, since th Sancd low bid on the rear loading containers was $80 less than Consolidated. $1'1 ,500.00 was budgeted for this purpose and additionally the Chapel Hill purchase k reduce the net cost to the County by $764.
