Do the Baird Members wish to add additional items to this agenda? 2. Minutes of meetings held on January 17, 18, 23, 24 and 27 are sub- mitted for consideration. 3. Mr. Georg High representing W.H.B. Development and Stoneybrook • Homeowner; Association will request Commissioners' endorsement of two pe itions: a) Addition of 1.1+ miles of roadway in Stoneybrook Subdivision to the State Highway System. b) An exception to certain requirements relating to a cul-de-sac on Fox Run. 4. The Manager recommends the County accept a grant of $2,800, offered by the State Department of Human Resources, to support cost of maternity care for elected patients. (Agenda Attachment I) r 5. The Manag r recommends a budget amendment implementing new positions and fund transfers for the Health Department, previously approved by the Board of Commissioners, be adopted. (Agenda Attachment II) 6. (Agenda Attachment III) r8. The Manager recommends the Board accept a proposal for audit of the County's 1977-1978 fiscal year records, submitted by Peat, Marwick and Mitchell. (Agenda Attachment IV) 9. The County Attorney will review a legal issue entitled, "In Re: Plywood Antitrust Litigation". 10. Representatives of Orange County tobacco farmers will request the Orange County Board of Commissioners enact a resolution directed to the President of the United States, our Senators and Congressman requesting they take al possible action to prevent Secretary Cal fano of the U.S. Department of He Education and Welfare from continuing his attacks on the American tobacco industry. Dear Sir: My letter a January 23rd , #1 of series, refers. My understanding of matter is thi . As I recall, on Monday January 16th, .1978, an un- marked white panel trucks with boat on top, parked in my drive and a man cane to my door, stated that he was doing work for Army Engineers and asked permission to park in my drive while he made a survey on the creek (behind my house and on my property ). This approach did not get our meet - ing off to a ver3 good start . Possibly your PRO can improve on it . When questioned , your employee , apparently head man of a 4 man crew, stated he was MI a Addison of Southeastern Surveys , surveying creeks for the Army Engines s; that the river had already been surveyed ; that the raver survey creu did not trespass on my land but had made their survey from roads and bridges; sad that the unmarked uhi.te truck belonged to Southeastern Surveys. I then pave Mr. Addison permission to be on my private property with these words ., Go ahead - make yourselves at home. " when fir. Addison and his crew returned from creek area , I asked if he ha:i finished. -11r. Addison replied that he had not and would have to come back again; that he was to get readings left by another crew and could not locate heir darker. I informed 14r. Addison that no earlier crew had received or asked my permission to be on my private property , talked about righ s of free men in a free country ,, and told him about the Eno River Association and its efforts over a period of years to get me condemned off Fy land for a park (and that strangely enough, four of the E.R.A. Board of Directors owned river valley land khich Sias not yet included in the p rk and that our attorneys had recent written assurances from Raleigh that 85 of December 1977 none of these Pour .rssociation Directors has any orsl or written agreement with the State to put his own land into the par,•) Informed Mr. Addison that he would hive to have my prior permission o enter my .land again. After Mr. Ad: icon left 1 phoned Southeastern Surveys F-nd asked for person in charge of fir. Addison's survey crew. Spoke with a �,r. James Hudson, who stated, in effect , that he was in charge of the survey crew; that if Mr. Addis 'a could not find markings of earlier crew then probably the other crew had not been on my land; that (also in response to sty query ) SE Surveys was not a poor struggling company on the verge of bankruptcy , but to the contrary was a strong company in a prominent position; that their contract with Army Engineers was not lucrative enough to provide for locating the property owners (via Tax Maps at Courthouse - my suggest - ion. ) and getting permission to enter private property; also that this item of expense was not included in their estimate for bidding on the contract ; that he had notified the orange County Flanning Officer shat they would be doing in our county; and that be, Mr. Hudson (this was at my specific request ) would write me a setter asking my permission in writin,g to enter m private property , and that this letter would state the reason it was necessary to come back again - that is, verify that one of his crews had in fact trespassed on my private property, Encl : (2 ) to S. Barbour letter dtd Feb. 3rd , 1978 to Chairman and Board , 01 ange County Commissioners. pnge 2 f 3 pages (Trespass by Southeastern Surveys ) (although not st°aed I naturally hoped that Southeast be man enough to apologize for their act of trespaBs,er than woul doubt that the fist crew had even gotten on my land , express some contri- tion for it , and promise to mend their ways. ) I then assured Mr. Hudson that when 1 recel ed above described letter requesting permission to enter my private proper zy I would grant such permission; that 1 was not opposed to the flood c vnt rrol measures; that 1 was a reasonable man; and that I wanted rights of private property respected; that I had gone across the seas to defend my home and property rights; and that several, abuses of citizens ' rights bad occurred recently; and ended conversation under distinct impress; n that Mr. Hudson would write me, per above , and get my written permission before entering my land again. Did not receive Mr. Hudson' s promised letter Tuesday , Wednesday, or Thursday . However,, about 2 :45 Thursday afternoon I discovered a brown pickup with camper top stopped in my drive halfway from road to house (500 feet ), which hen came on to house, and another of your men, Mr. Bob Crawford, I think, asked permission to survey again on the creek; further stated that he had been here before , had knocked on door, and getting no answer to knock on door had gone on down to creek and surveyed; had left marker on utility pole, adding sand I guess you tore it down". I then gave him a few groups on the rights of private property and private citizens in a free country and the attempts of the mature Conservancy ' s Secret Committee ("or which 4.500 steward is offered weekly in local papers ) and the Eno River � ssoeiation to get me condemned off toy land , and told him of Mr. Hudson' s promise to get written permission to come on my property; that I w expecting a yard full of cars for a meeting very soon and that tae should not come back until Mr. Hudson had gotten my permission. Sir, my home i's about 500 feet from St ., Mary 's Road and the Utility Pole in question is another 500 feet behind MY house. That makes a 1,000 foot penetration i to my private property which your company has done without my permission. To my simple mind that constitutes trespass. ={ould YOU tell me , in writing , over your signature , what you consider it ? To my rustic way of thinking it 9190 constitutes an arrogant abuse of the rights of freeborn citizens living in a free country - to whose freedozz I made a very minute contribution in uniform overseas - to have peace and privacy in their own homes. The point is not , sir, whether your biwg powerful company has trespassed 1 ,000 feet or -- inch onto my property; you are breaking the law and Violating my privla when you do either, no matter how good our cause. ?3ut the real damage to me and the real damage to demos racyT done when you think i.t is okay , or when you assume It is okay, thet you being big and strong, or you , being working for the army, can teke l.ibetrties with the rights of small citizens like myself,,entering and heaving their private property at your will and discretion. fit t it odes and act iofis such as this set back the cause of freedom by centuries and reduc6 8.11 Small spuds like tae to the status of serfs , regardless of schoo , book theory or political, rhetoric. Who determines to what degree the rights of the citizens shall, be re- epeeted in a free country? The Army? A big company? Who? I intend to find out . Does your cont rset with the Army really not include enough money for you to contact the property owners and ask for permission to enter private property? 3. Did your estimate which you based your bid can for this surveying job really not include any cost provision to cover the expense of contacting the citizens to get their permission to enter private property? 4. a.Did you obtain this contract by sealed bid in competition with other Surveyors, or was it a negotiated bid? b.1f competitive ,, how many others bid on it ? c.Was it advertised openly or did you and the other bidders receive the specifications and invitation to bid direct ? 5. flow many dol.2. rs is y our contract fear? 6. In other word , how is it that you heve a contract calling for you to eater private property , and yet you say that there is no provision in either your eat mater or the contract for monies to cover the expense of getting permission to enter private property. If not , why not ? 7. Is it really necessary for you to send a four man crew around behind the first survey a ew to pick up the �eadinga of tt�,e first crew. 8. Is your contract by any chance "Cost FLUB "? 90 Is there any reason thrit your crew vehicles rare unmarked? I would think that you would have "Southes,=stern Surveys" In big letters on your trucks , with your address and telephone number, and perhaps a slogan. Z0. Admittedly , tiese are sirr-pl.e ri-inded questions frou a private citizen who Is not a surveyor, but %ho cannot understand why you operate from unmarked vehicles, and , as a texp!?yer, cennot understand why two multi-men crews have to enter the sane piece of private property to get one measure- ment . AGENDA ORANGE COUNTY BOARD OF COMMISSIONERS RESOLUTION FEBRUARY 6, 1978 WHEREAS: Tobacco has been commercially produced in what is now the United States of America since the year 1612; WHEREAS: Since the year 1619 the export of tobacco has been an important economic = factor to our Colonies, States and these United States; WHEREAS: The United States of America now grows and markets approximately two billion pounds of tobacco each year; WHEREAS: The economic welfare of Orange County, North Carolina, and the several tobacco producing States is substantially dependent upon the success of the tobacc industry for that: (a) A significant portion of our people earn their living working in the growing, processing, transporting and selling of tobacco; ' (b) The tax base which contributes substantially to our local , State and Federal welfare programs is to a great extent comprised of invest- ments in farms, farm equipment, warehouses, tobacco transportation, processing and manufacturing plants in our area; (c) The commerce in tobacco produces considerable revenue from income . taxes and sales taxes and excise taxes throughout the world, which funds are available for the economic welfare of all persons,° J WHEREAS: The recent personal and official actions of Mr. Joseph Califano, r Secretary of Health, Education and Welfare, have seriously endangered the welfare: ,., of our citizens by their adverse effect upon the tobacco industry; NOW, THEREFORE, BE IT RESOLVED that the President of the United States of America, our North Carolina senators, Robert Morgan and Jesse Helms, and our Congressman, L. H. Fountain, be called upon to take every reasonable action to restrain or prevent any further action by Mr. Califano in his official capacity as Secretary of Health, Education and Welfare, which actions may adversely affect the tobacco industry. BE IT FURTHER RECOMMENDED to them that in the event Mr. Califano con- tinues in any form his actions which are detrimental to the tobacco industry, then he should b removed from his office on the grounds that his actions adverse ^ to the economic welfare of our citizens are contrary to his oath and responsibilities as Secretary of Health, Education AND WELFARE. . To be eligible for these funds a patient's income must fall within specified guiddlines, she must not be a recipientIof public assistance such as medicaid, AFDC, etc. , and must not have third party medical coverage (hospital insurance) . AGENDA ATTACHMENT TI V AUDIT CONTRACT FOR FISCAL YEAR 1977 1978 Peat, Marwick and Mitchell has submitted a proposal to audit all Orange County Funds for the 19771978 fiscal year for the sum of $19,100. Dickson, Orange County Tax Callector SUBJECT: Tax Lien Sale for 1977 Taxes On the first Monday in February of each year , County Tax Collectors are required to report to the governing body the total amount of unpaid taxes for the current fiscal year that are .liens on real property. Unpaid taxes on real property $654 ,678.57 In the past we have held our sale in June of each year , If this is greeable , the falling date can be set. June 5 , 1978 (Total for 1976 --$629,937„29 AGENDA ATTACHMENT VI PLATS FOR CONSIDERATION MINOR SUBDIVISION: A. Carol Oldham: This plats shows a minor subdivision with a Class C private road originally approved in December of 1976. The property owner is requesting a one year extension of time to complete the road. The Planning Board recommends a six month extension be granted. FINAL PLATS: B. Rollingwood, Section 5: This plat depicts extension of an old subdivision and was reviewed in the preliminary phase by the Board of Commissioners a short while ago. The plat changes recommended by the Board of Commissioners at that time have been implemented. The Health Department has declined septic tank approval of two lots, #52 and #53. The Planning Board recommends approval of the subdi vi sior with the reservation that the subdivision plat be redrawn to show lots 052 and #53 not suitable for subsurface sewage disposal. C. Greenbriar .Estates: This subdivision of six lots in Eno Township was approved in August of 1977 subject to railroad approval for a private crossing. This approval was denied by the railroad therefore the plat is being resubmitted showing a new access. The Planning Boar has approved the revised plat. PRELIMINARY PLATS: D. Glen Parrish: This is in reality a minor subdivision of 1 .6 acres from a twenty-five acre tract. The property owner is requesting a variance from the sixty foot right of way requirement. The Planning Board recommends the plat indicate a sixty foot right of way in front of Mr. Parrh's property. E. Timberline. This subdivision was considered at the Board's January meeting and referred back to the Chapel Hill Planning Board for additional comment: Their comments are attached and will be reviewed by Mr. Minis. Authority. This ordinance is adopted pursuant to Chapter 703 , North Car ling Session Laws of 1977 , and G. S. 153A-134 . SECTION Z . License Required. On and after January 1 , 1978 , no person, firm or corporati n may for a consideration install, alter or restore, within and unincorporated mart of Orange County and within any city hick adopts this ordinance pursuant to the author- ity granX in G. S. 153A--122, any insulation or other materials or energy utilization equipment designed or intended to meet the State Building Code requirements for insulation and energy utilization standards who is not either: (a) licensed as a contractok to do the proposed work under Chapter 87 of the General 4atute:s; (b) working under the supervision of a registered architect or professional. engineer; (c) an owner working u�on his own building; or (d) licensed under this ordinanceT SECTION T :I . Applications. Every person desiring a license under this ordinance shall submit an application for such license to the County Inspe:ctio Department conforming to the following requirements : (1) Form of Application. Each application shall be a written statement upon forms provided by the County Building Inspector. (2) Contents of Application. Each application shall ann� to the following .information: (a) Name and home address of the applicant, if an individual, or home Office address , if a corporation or partnership; (b) Names and home addressess of the partners , if a partnership; (c) Names and home addressess of the officers and directors , if a corporation; (d) Place where the proposed business is to be Located; (e) Complete record of all, convictions of felonies ordinance or other activities involving construction, alteration, or modification of buildings and structures; (g) Information as to the circumstances in which any local, state, or federal, government agency has refused, suspended, or revoked a .license of the type described in paragraph (f) to applicant or any employee, partner,, officer, or director of the applicant; (h) Name and address of owner of property where insulation has been installed by the appli- cant or who purchased insulation from the applicant - within Orange County outside Orange County (i.) Bank reference - name of bank with which applicant conducts his business banking; (j) Business references . (3) License Fees . Each application shall be accom- pai en d by a License fee in the amount of $25 .00 for such license, such amount to be for the cal- endar year. Applications received on or after July 1 shall be accompanied by a License fee in the amount of $15 . 00 . (e) False Statements . False statements on any appli- catiEn for a license shall be grounds for immed- iate revocation or denial of such license. SECTION I . Procedure for Issuance. (a) Review by County Officers. Each application re- ceived by the County Inspection Department shall be promptly forwarded to the County Building Inspector for review. He shall request comments from the County Sheriff and all references listed related to the contents of the application as a part of his review. (b) Licensing Agency. The application and any comments and recommendations relating thereto shall. then be considered by the Building Inspector who shall then issue or deny the license pursuant to the following standards. (c) Standards . The County Building Inspector shall issue the license unless he shall find that the applicant or any employee, partner, officer, or director of the applicant: (1) Has been convicted within the last three years of a felony or an act involving dishonesty, (4) Has failed to post the bond or other security required by Section IX. ( ) Appeal from Denial. Any applicant whose license is denied may appeal the denial to the Orange County Board of County Commissioners. After reasonable notice to the applicant, the Board shall afford the applicant an opportunity to show why its license should not be denied. SECTION V. Termination and Renewal of Licenses. A 1 licenses issued -hereunder shall terminate on the last day of the calendar year for which issued. Renewal. of such licenses shill be pursuant to the same procedures and requirements set forth for initial issuance including payment of the license fee prescriled. SECTION VI. Suspension; Revocation; Appeal. { ) The County Building Inspector may suspend or revoke any license issued hereunder at any time upon a showing that the applicant or any employee, partner, officer, or director of the applicant has : (a) knowingly made a false statement in the application for a license; or (b) violated the State Building Code requirements as to insulation or energy utilization equipment or materials, whether in this or any other jurisdiction; or (c) been convicted of any act involving dis- honesty, fraud, or deceit with respect to any contract entered into for work requiring this license. ( ) Any licensee whose license is suspended or revoked may appeal the suspension or revocation to the Orange County Board of Commissioners. After reasonable notice to the licensee, the Board shall afford the licensee an opportunity to show why its license should not be suspended or revoked. SECTION VII. Change of Location. The location of any licensed business may be changed provided 10 days ' notice thereof is given to the County Inspection Department and operation at such new location does not violate any applicable State or local law, ordinance, or regulation. SECTION VIII . Bond Required. (a) Before a license shall be issued to any applicant , the applicant shall post a bond in the amount of $1000. 00 with Orange County which provides a prin- cipal amount of $1000 . 00 per insulation installa- tion project for the purpose set forth in subsection (b) of this section. SECTION IX. Permit Required; "Insulation and Energy Utilization" Permit fee; Persons Exempted. - a) On and after January 1 , 1978 , no person, firm, or corporation may for a consideration install, alter or restore, within any unincorporated part of Orange County and within any city which adopts this ordinance pursuant to the authority granted in G. S. 153A-122 , any insulation or other materials or energy utilization equipment designed or intended to meet the State Building Code requirements for insulation and energy utilization standards without first securing a permit for the work to be done. Such permit shall be either: (1) a general building permit, secured from the Orange County Inspection Department and evidencing full compliance with all applicable requirements of the State Building Code and other State and local laws ; or, (2) an "insulation and energy utilization" permit, secured from the County Inspection Department and evidencing full compliance with the insulation and energy utilization standards in the State Building Code. For, each such "insulation and energy utilization" permit issued, there shall be a fee of $10.00 for insulation projects up to 1500 square .feet of insulated area; $20.00 for all other insulation projects. ( ) The following are exempted from the requirements of obtaining a permit: (1) an owner working upon his own building; and, (2) any person working under the supervision of a registered architect or professional engineer. SECTION X. Contract Provisions. From and after the adoption of this ordinance, all sales contracts or other contracts executed for the installation within Oran e County of insulation or other energy utilization materials or equipment shall contain a provision that the work will meet requirements of the State Building Code. Any guarantees relating to quality of materials , expected performance, auality of work, or equipment to be installed shall be in writing and a copy thereof shall be de.I.ivered to the owner and shall become a part of tha contract. SECTION XI. Penalties.
